Name of Operation: PANDA DAY CARE & CREATIVE SCHOOL III Facility ID: 26000886 Consultant: RONA DAVIS Operation Type: Center Case Number: Visit Date: 3/13/2025 Number Present: 89 Completed Date: 3/13/2025 Age: From 0 To 9 Total Minutes: 330 Time In: 09:00 AM Time Out: 02:30 PM Time In: Time Out: List to Use: Center Type Of Visit: Annual Comp Full Announced/Unannounced: Unannounced The purpose of today’s visit was to monitor compliance with applicable child care requirements pertinent to an Annual Compliance Visit, including compliance with requirements located in Child Care Rule Section .3000, which serve children participating in the NC Pre-K program. The previous Annual Compliance with Rated License Assessment visit was completed March 19, 2024, and prior to today’s visit, the eighteen-month compliance history score was 88% which is above 75% as required by North Carolina General Statute 110-90(4)(c-d). This program currently operates with a four-star license issued May 6, 2024. The License was based on the program earning seven points in education standards, two points in program standards, and one quality point for the Administrator completing a business training course of at least 30 clock hours. The information on record with DCDEE was verified as correct by Christina Green and the owner’s corporation status, LSDM Gainey Enterprises Inc. was verified on the Secretary of State’s website as current-active. Current Inspections are as follows: Sanitation Classification of Superior completed February 28, 2025. Fire Classification of Approved completed September 13, 2024. Christina Green and Tina Jacobs, Administrators, were present. C. Green accompanied me while I observed the indoor and outdoor areas. Upon my arrival, there were eighty-nine children in care. Children were observed participating in various activities. Indoors, children used developmentally aged appropriate materials like Legos, blocks, dramatic play materials, manipulatives, paper, and markers. Children used animals, counters, colored windows, and ribbons on a stick. Outdoors, children were observed running, climbing, sliding, playing in a playhouse, riding bikes, and digging. Positive communication was used between staff and children. For example, children were often told thank you and good job. I also observed diaper changing, toileting, hand washing, sanitation, lunch, rest time, and snack. Lunch consisted of hamburgers, buns, baked beans, mixed fruit, and milk. Snack consisted of cheese crackers and apple juice. The NCPK requirements were monitored. The review of children’s files was included in a random selection of seventeen (17) files. Green. The following violations were observed: Violation Number Comment Rule 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file. One staff member's (M.T.) First Aid training certification expired in February 2025. .1102(c) 1049 All staff did not successfully complete certification in CPR training appropriate to the age of the children in care. Verification of staff completion of the CPR course from an approved training organization was not in the staff file. One staff member's (M.T.) CPR training certification expired in February 2025. .1102(d) 1897 The child care administrator and all staff did not complete the Recognizing and Responding to Suspicions of Child Maltreatment training within 90 days of employment. A current Recognizing and Responding to Suspicions of Child Maltreatment training was not on file for one new staff member. The certificate on file was older than one year of the employee's date of employment. Therefore, the training was not completed by 10/26/24. .1102(g) The violation must be corrected immediately. Mail or email a written, dated, and signed statement to me by 5:00 pm on March 27, 2025, describing how and when the violations were corrected and how the facility plans to maintain compliance in the future. CPR and First Aid: CPR and First Aid certifications expired for one staff member (M.T). You contacted a certified instructor regarding the training. Refer to child care rule 10A NCAC 09 .1102(d) regarding staff requirements. There is a First Aid and CPR training scheduled at the end of the month for other employees who needs to be recertified before their expiration date. Recognizing and Responding to Child Abuse and Maltreatment A violation was cited for one staff member not completing Recognizing and Responding to Child Abuse and Maltreatment within 90 days of employment. The certificate on file was older than one year before the staff member’s date of employment. Child care staff are expected to be well informed about child abuse and neglect issues and adequately trained to prevent and recognize potential maltreatment. The “Recognizing and Responding to Child Abuse and Maltreatment” training must be completed within 90 days of hire. Responding to Suspicions of Child Maltreatment course is available at www.preventchildabusenc.org. On-going training for two employees (C.G. and T.H.) must be completed by 3/19/25. The previous Annual Compliance with Rated License Assessment visit was completed March 19, 2024, and prior to today’s visit, the eighteen-month compliance history score was 92% which is above 75% as required by North Carolina General Statute 110-90(4)(c-d). Children in space #1, were crawling, sitting on the floor. One child was sitting in jumper bouncy seat using the attached toys. Two teachers were holding a child while feeding. Other children were observed crawling, using soft materials like, books and rattles. Spaces #2 and #3, were observed outdoors on the playground. They were running, digging, climbing up and going down a slide, riding Little Tykes cars, sitting in wagons, and playing in a playhouse. Children in space #4, were observed participating in running a race with their teacher. They were digging in the sand using plates and spoons. Some were riding bikes. A teacher took the time to acknowledge a child that was crying. Children in space #5, were away on a field trip at a skating ring. In space #6, children were outdoors riding bikes, sitting and running. They all participated in cleaning-up before going indoors. Children in space #7, were observed participating in various activities. They were building with large blocks and colored windows. They used magnetic alphabets on a magnetic board and colored dittos using crayons. I also observed diaper changing, toileting, hand washing, sanitation, and lunch. Lunch consisted of pasta, ground beef, green beans, mixed fruit, and milk. At the completion of the visit, the visit summary was reviewed with C. Green. The following violations were observed: Violation Number Comment Rule 721 All equipment and furnishings were not in good repair. There was peeling paint and a hole behind a blue shelf in the dramatic play area in space #5. A trash can near the exit door in space #7 was soiled on the outside and top of the can. Needs cleaning. G.S. 110-91(6); .0601(b) 808 The child care center premises, including the outdoor learning environment, was not clean, drained to minimize standing water, free of litter and hazards, and/or maintained in a manner which does not create conditions that attract or harbor pests. The grass was not cut on the outdoor areas used by spaces #5 and #6. There was water draining from the air conditioning unit on to the playground on the outdoor areas used by spaces #5 and #6. 15A NCAC 18A .2832(a) 1874 The Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy was not reviewed with new staff prior to providing care with children and/or a signed acknowledgement with all the required information was not maintained in the staff person's file. One staff member (S.B.) did not have a signed acknowledgement form on file regarding The Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy. .0608(d)(1-4) The violation must be corrected immediately. Continue to show awareness, reacting quickly, and solving problems in a comforting way. Continue to facilitate positive peer interaction, modeling positive social interaction, and explaining children’s actions, intentions, and feelings to other children. Continue to smile and laugh with children showing enthusiasm and affection. You pay attention to children and notice their cues and when they may have difficulties and need assistance. The children appear comfortable and seeks support and interacts with you. Continue to resolve any issues that they cannot resolve on their own. There were frequent episodes of smiling and laughter by the teacher and child. On multiple occasions, the teacher and children showed enthusiasm and affection with one another. The children appeared comfortable seeking support from the teacher, interacting with the teacher, and participating in activities. Have the children assist you with cleaning up before moving to another activity. This contributes to the child’s guided decisions based on teacher’s clearly identified expectations (example, cleaning up before moving to another activity). Technical Assistant/Discussions/Reminders: Shaken Baby Syndrome and Head Trauma Policy: A violation was cited for not having an acknowledgement form on file for one staff member. Remember to review and have new employees sign an acknowledgement form and place in their file before caring for children under five years of age. Refer to child care rule NCAC 09 .0608(d)(1-4). We discussed water draining from the air conditioning unit on to the playground. You stated that the air conditioning had just been repaired and will figure out what to do about the draining water. In space #7, children played in the block area, dramatic play area, and used various manipulatives. I also observed toileting, hand washing, sanitation, lunch, rest time, and snack. Lunch consisted of hamburgers, corn, pineapples and milk. Snack consisted of cheese crackers and grape juice. The NCPK requirements were monitored. The previous Annual Compliance visit was completed September 19, 2023, and prior to today’s visit, the eighteen-month compliance history score was 93% which is above 75% as required by North Carolina General Statute 110-90(4)(c-d). This program currently operates with a four-star license issued April 13, 2018. The License was based on the program earning seven points in education standards, two points in program standards, and one quality point for the Administrator completing a business training course of at least 30 clock hours. The information on record with DCDEE was verified as correct by Imran Ali and the owner’s corporation status, LSDM Gainey Enterprises Inc. was verified on the Secretary of State’s website as current-active. Current Inspections are as follows: Sanitation Classification of Provisional completed March 15, 2024. Fire Classification of Approved completed October 18, 2023. Tina Jacobs, Administrator, was present while I observed the indoor and outdoor areas. Imran Ali, Administrator for Panda Day Care & Creative School #1 and #2, arrived during the visit due to T. Jacobs needing to leave. Lewis Gainey, owner, was present during parts of the visit. I. Ali assisted me during the remaining of the visit. Upon my arrival, there were ninety children in care. Children in space #1, were crawling, sitting on the floor, in a jumper and bouncy seat using soft toys. One child was asleep in a crib. Children sat on the teacher’s lap and played with assorted age appropriate materials like soft dolls and rattles. In spaces #2 and #3, children were observed outdoors running, climbing, sliding, riding bikes, playing in a playhouse, and using a rocker. In space #4, children were using playdough and cookie cutters, blocks, dramatic play materials, books, and dolls. In space #5, children participated in a group activity on the carpet as they prepared for outdoors. In space #6, children sat at tables completing an art activity using crayons and a ditto sheet. In space #7, children played in the block area, dramatic play area, and used various manipulatives. I also observed toileting, hand washing, sanitation, lunch, rest time, and snack. Lunch consisted of hamburgers, corn, pineapples and milk. Snack consisted of cheese crackers and grape juice. The NCPK requirements were monitored. The review of children’s files was included in a random selection of seventeen (17) files. A staff member accompanied me during a walk-through of the facility. During the visit, I discussed the allegations with Tina Jacobs, Administrator, and two additional staff members. Limited monitoring of child care requirements occurred during today’s visit. The following violations were observed and/or confirmed during today’s visit. Violation Number Comment Rule 125 Daily records of arrival and departure times for children enrolled at the center were not maintained as children arrive and depart and/or were not made available for review.
