The previous Annual Compliance Visit was completed December 10, 2025, and prior to today’s visit, the eighteen-month compliance history score was 93%, which is at or above 75%, as required by North Carolina General Statute 110-90(4)(c-d). This program currently operates with a Three Star License issued August 26, 2022. The License was based on the program earning five points in education standards, two points in program standards, and one quality point by choosing to meet a programmatic option: The child care administrator has at least 10 years of documented child care administrative work experience in a licensed program that can be verified by the Division. The information on record with DCDEE was verified as correct by Brianna Bowers, Administrator, and the owner’s corporation status was verified on the Secretary of State’s website as current-active. Current Inspections are as follows: Sanitation Classification of Approved completed January 20, 2026. Fire Classification of Approved for daytime care only completed July 01, 2025. Ms. Bowers was present and assisted me while observing the indoor areas. In Space #2, there were six infants sleeping, one infant was awake on a mat, and one infant was being held during bottle feeding. In Space #8, the children were observed stacking geometric shapes, drawing on the chalk board, building with Legos, pushing the cars, pretend play in the dramatic play, and holding the ball. In Space #10, some of the children were reading books, and some of the children were cleaning up. After the children cleaning up their toys, the children transitioned to the carpet, and the teacher counted with the children. Lunch served was waffles, eggs, carrots, watermelon, and milk. A violation was observed for storage of hazardous substances. The most recent fire drill was completed on May 29, 2026, and the most recent shelter in place drill was completed April 15, 2026. The most current monthly outdoor inspection was completed on May 26, 2026. (5) new staff files were reviewed. In addition, the Criminal Background Checks were reviewed for all staff. At the completion of the visit, the Visit Summary was reviewed with Ms. Bowers. The following violation was observed: Violation Number Comment Rule 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. In Space #8 and #9, there were bottles of disinfectant spray stored on a counter less than five feet from the floor. In Space #10, there was one aerosol can of shaving cream stored in an unlocked cabinet greater than five feet from the floor. This was corrected with the teachers removed the items and placed above 5 feet, and when the administrator removed the aerosol dispenser out of the classroom to a locked area. .2820(b) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. The violations observed and documented today were corrected during today’s visit. A compliance letter is not required. Facility Specific TA/Consultation/Reminders: QRIS Conversation: Today we discussed the QRIS process for Pathway 3. At this time, you will not be submitting your application for reassessment. We talked about the enhanced ratio requirements, if you selected pathway 2 or pathway 3. In addition we reviewed the requirements for the 4 star education. In Child Care Rule .3212, begins the sections for evaluating the staff member’s education. Classroom Observations/TA Consultation: You can visit http://csefel.vanderbilt.edu/ for resources to help manage behaviors and provide strategies to help your non-verbal children. This website is the Center on the Social and Emotional Foundations for Early Learning (CSEFEL) that focuses on promoting the social emotional development and school readiness of young children birth to age 5. There are books that can be printed out and utilized in your facility to help manage children’s behaviors. For example, Tucker Turtle Takes Time to Tuck and Think. There are some resources and training that are free of charge. The steps to access the resources are located on the main page, select For Teachers and Caregivers, and then you will see the option for the book to print. Once you print the book, the staff can utilize sheet protectors and use a binder. It may be best to print a cover page and add on the front of the binder. For additional accessories, provide a soft turtle to use as a prop. The staff members can place these items in the cozy area as a way for the children to transition when he or she is having a difficult moment. The book promotes strategies for helping young children manage behaviors when they are upset. In Space #3, we talked about some suggestions during transitions. It is important to ensure that children are not waiting for long periods of time. If one staff member is prepping the area for rest time, then one staff member would need to be interacting with the children. This can include a game, a book, a song, a dance, or any approved activity. Challenging Behaviors Hotline Do you have children who bite? Do children struggle to focus during circle time? The most recent fire drill was completed on November 26, 2025, and the most recent lockdown drill was completed September 29, 2025. The most current monthly outdoor inspection was completed on December 01, 2025. During today’s visit, the Administrative Action (AA) Written Warning was reviewed. The facility was issued the action dated October 29, 2025. The action was received on November 3, 2025. The action was placed near the entrance of the facility. At the completion of the visit, the Visit Summary was reviewed with Ms. Bowers. The following violations were observed: Violation Number Comment Rule 526 Menus for all meals and snacks were not current or posted where easily seen by parents and cook. The menu posted was not current to reflect the current week. The menu posted was dated for October 1-31, 2025. This was corrected when a staff member posted the current menu to reflect the current date/s. 10A NCAC 09 .0901(b) 540 An individual written feeding plan was not provided by child's parent or health care provider or was not followed and posted. (omit posting for centers located in a residence) The written feeding plans were not posted in Space #1 and Space #2. This was corrected when the teachers posted each child's individual written feeding plan in Space #1 and Space #2. 10A NCAC 09 .0902(a) 601 Refrigerator(s) did not maintain a temperature of 45 degrees F. or below. In Space #2, the refrigerator did not maintain a temperature of 45 degrees F. The temperature was showing 46 degrees F. This was corrected when the caregiver adjusted the temperature and when the temperature was showing a degrees less than 45 degrees F. 15A NCAC 18A .2806(j)(2) 871 Center staff did not comply with the safe sleep policy. The safe sleep policy was not posted in Space #1 and Space #2. In addition, In Space #1, there was one infant sleeping in his crib, and the mattress was positioned upward at the bottom. There were three other empty cribs with infant sheets attached, that did not have the mattress positioned flat. This was corrected when the caregiver pushed the child's mattress down and the other mattresses down. 10A NCAC 09 .0606(a) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. This is important that the Feeding Plan is posted for easy reference for any substitute staff that may assist in the classroom. If there are any changes, it is important that this is updated. Refer to Child Care Rules 10A NCAC 09 .1706 (i). Refrigerator Thermometer: A violation was observed today because the temperature on the thermometer was reading 46 degrees. It also felt warm to touch in the refrigerator. The temperature needs to maintain at least 45 degrees F. or lower. It is important to maintain the appropriate temperature to make sure that the milk used for children is not being served with potential contamination or spoiled. Safe Sleep Policy: A violation was observed today for safe sleep policy and infant sleep. The safe sleep policy was not posted in the classroom both classrooms. The safe sleep policy is required to be posted in each classroom with children under 1 year of age. A copy of the safe sleep child care rules was posted in the classroom but did not contain the policy for safe sleep. This was corrected during today’s visit. Refer to Child Care Rules 10A NCAC 09 .0606.I reviewed the safe sleep policy. The safe sleep policy was posted in the classroom. It is important to make sure to review the safe sleep policy to ensure that the policy is followed daily. Refer to Child Care Rules: 10A NCAC 09 .1724. Menu Posted: A violation was observed today because the menu posted was dated for October 2025. The menu should be dated and updated so that the families are able to see what meals are served. It is best practice to post an updated menu in each classroom. The teacher can use the menu to talk about what items are being served at each mealtime. Refer to Child Care Rule: 10A NCAC 09 .0901(B), for more information regarding this rule requirement. Administrative Action: The administrative action and cover letter dated October 29, 2025, was mailed. The facility received a copy on November 03, 2025. The action was posted by the main entrance. The previous Annual Compliance Visit was completed December 12, 2024, and prior to today’s visit, the eighteen-month compliance history score was 93%, which is at or above 75%, as required by North Carolina General Statute 110-90(4)(c-d). This program currently operates with a Three Star License issued August 26, 2022. The License was based on the program earning five points in education standards, two points in program standards, and one quality point by choosing to meet a programmatic option: The child care administrator has at least 10 years of documented child care administrative work experience in a licensed program that can be verified by the Division. At the completion of the visit, the Visit Summary was reviewed with Ms. Bowers. In Space #2, the refrigerator did not maintain a temperature of 45 degrees F. The temperature was showing 46 degrees F. This was corrected when the caregiver adjusted the temperature and when the temperature was showing a degrees less than 45 degrees F. 15A NCAC 18A .2806(j)(2) 871 Center staff did not comply with the safe sleep policy. The safe sleep policy was not posted in Space #1 and Space #2. In addition, In Space #1, there was one infant sleeping in his crib, and the mattress was positioned upward at the bottom. There were three other empty cribs with infant sheets attached, that did not have the mattress positioned flat. This was corrected when the caregiver pushed the child's mattress down and the other mattresses down. 10A NCAC 09 .0606(a) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. A Written Feeding Schedule is required for all children under fifteen months (15) of age and this is required to be posted. An Infant Feeding Plan will need to be followed. The Written Feeding Schedule gives instructions to follow for each child. This is important that the Feeding Plan is posted for easy reference for any substitute staff that may assist in the classroom. If there are any changes, it is important that this is updated. Refer to Child Care Rules 10A NCAC 09 .1706 (i). Refrigerator Thermometer: A violation was observed today because the temperature on the thermometer was reading 46 degrees. It also felt warm to touch in the refrigerator. The temperature needs to maintain at least 45 degrees F. or lower. It is important to maintain the appropriate temperature to make sure that the milk used for children is not being served with potential contamination or spoiled. Safe Sleep Policy: A violation was observed today for safe sleep policy and infant sleep. The safe sleep policy was not posted in the classroom both classrooms. The safe sleep policy is required to be posted in each classroom with children under 1 year of age. A copy of the safe sleep child care rules was posted in the classroom but did not contain the policy for safe sleep. This was corrected during today’s visit. The concerns were discussed with Ms. Bowers, and to inform her of the purpose of my visit. Interviews were conducted with the Administrator, Ms. Bowers and six staff members. There are allegations of violations of child care requirements, including: • Staff to child ratio Regarding the concerns for staff to child ratios, observations and interviews were conducted. Observations of the teacher and child interactions were observed in all classrooms. During today’s visit, all classrooms were maintaining the required staff to child ratio. All staff members stated their procedures for contacting administration when they are over ratio. The administrator and staff both stated that sometimes the children may have to go to another classroom to maintain ratios. One staff member stated that when their classroom is over ratio, the school age children are sometimes placed in other rooms to help out. The staff member was not certain which classrooms the school age children are placed in. The administrator stated that the school age children no longer go to other rooms to help the teachers. Six staff members confirmed that the amount of time that the classrooms were not maintaining minimum staff to child ratios were between three to ten minutes. There was one staff member that stated that their classrooms were not maintaining minimum staff to child ratios were greater than ten minutes. During today’s visit, the attendance records and name-to-face documents were reviewed for Space #5 and Space #6 for the following dates: September 16, 2025, September 24, 2025, and September 26, 2025. On all three of these dates, it was confirmed that the minimum staff to child ratios were not maintained. In Space #6, on September 16, 2024, the time was 8:00 am, there were eleven children present with one teacher. There were four two-year-old children, and seven three-year- old children. In Space #5, on September 24, 2025, the time was between 6:30 am to 7:06 am, there were eighteen children with one teacher. There was one three-year-old, four four-year-old, one five-year-old, and twelve, school age children. In Space #6, on September 26, 2025, the time was 9:20 am – 9:23 am, there were sixteen children present with one teacher. There were fifteen three-year-old children, and one four-year-old children. The administrator stated that she has adjusted some of the staff members’ schedules to make sure the facility is maintaining ratios, in addition, the administrator confirmed schedules of arrival/departure with some of the families. Based on the observations and interview information, the allegation for staff to child ratio is substantiated. At the completion of the visit, the Visit Summary was reviewed with Ms. Bowers. The following violation was observed: Violation Number Comment Rule 301 Minimum staff/child ratios and group sizes for the number and ages of children in care were not met. During interviews, a review of the attendance roster, and name to face documents, on September 16th ,24th, 26th , 2025, the minimum staff/child ratios were not met. During interviews, it was confirmed that there are times in the morning, throughout the day, afternoons, that the facility is not maintaining minimum staff to child ratios. It is important to maintain ratios in compliance with Child Care Laws. Today, I suggest informing the staff members that once they reach their max, they will need to call the administrator and not accept more children in the room. The administrator can also keep track of the attendance at arrival of the children. The administrator can keep a note of classrooms ratios. We talked about strategies for maintaining compliance with Child Care Rules. Refer to Child Care Rules 10A NCAC 09 .0713. The previous Annual Compliance Visit was completed December 12, 2024, and prior to today’s visit, the eighteen-month compliance history score was 93%, which is at or above 75%, as required by North Carolina General Statute 110-90(4)(c-d). This program currently operates with a Three Star License issued August 26, 2022. The License was based on the program earning five points in education standards, two points in program standards, and one quality point by choosing to meet a programmatic option: The child care administrator has at least 10 years of documented child care administrative work experience in a licensed program that can be verified by the Division. The information on record with DCDEE was verified as correct by Brianna Bowers, Administrator, and the owner’s corporation status was verified on the Secretary of State’s website as current-active. Current Inspections are as follows: Sanitation Classification of Approved completed June 10, 2025. Fire Classification of Approved for daytime care only completed July 01, 2025. Ms. Bowers was present and assisted me while observing the indoor and outdoor areas. In Space #1, the caregiver was feeding one infant, one infant was sleeping, one infant was walking around exploring their space, and the other children were on the floor crawling and playing with toys. In Space #3, the children were playing outdoors. The children were running, catching bubbles, and sliding on the slide. In Space #6, the teacher was reading a book with the children. A violation was observed for minimum staff to child ratio. Lunch served was diced chicken green beans, peaches, milk. The concerns were discussed with Ms. Bowers, and to inform her of the purpose of my visit. Interviews were conducted with the Administrator, Ms. Bowers and six staff members. There are allegations of violations of child care requirements, including: • Staff to child ratio Regarding the concerns for staff to child ratios, observations and interviews were conducted. Observations of the teacher and child interactions were observed in all classrooms. During today’s visit, all classrooms were maintaining the required staff to child ratio. All staff members stated their procedures for contacting administration when they are over ratio. The administrator and staff both stated that sometimes the children may have to go to another classroom to maintain ratios. One staff member stated that when their classroom is over ratio, the school age children are sometimes placed in other rooms to help out. The staff member was not certain which classrooms the school age children are placed in. The administrator stated that the school age children no longer go to other rooms to help the teachers. Six staff members confirmed that the amount of time that the classrooms were not maintaining minimum staff to child ratios were between three to ten minutes. There was one staff member that stated that their classrooms were not maintaining minimum staff to child ratios were greater than ten minutes. During today’s visit, the attendance records and name-to-face documents were reviewed for Space #5 and Space #6 for the following dates: September 16, 2025, September 24, 2025, and September 26, 2025. On all three of these dates, it was confirmed that the minimum staff to child ratios were not maintained. In Space #6, on September 16, 2024, the time was 8:00 am, there were eleven children present with one teacher. There were four two-year-old children, and seven three-year- old children. In Space #5, on September 24, 2025, the time was between 6:30 am to 7:06 am, there were eighteen children with one teacher. There was one three-year-old, four four-year-old, one five-year-old, and twelve, school age children. In Space #6, on September 26, 2025, the time was 9:20 am – 9:23 am, there were sixteen children present with one teacher. There were fifteen three-year-old children, and one four-year-old children. The administrator stated that she has adjusted some of the staff members’ schedules to make sure the facility is maintaining ratios, in addition, the administrator confirmed schedules of arrival/departure with some of the families. Based on the observations and interview information, the allegation for staff to child ratio is substantiated. At the completion of the visit, the Visit Summary was reviewed with Ms. Bowers. The following violation was observed: Violation Number Comment Rule 301 Minimum staff/child ratios and group sizes for the number and ages of children in care were not met. During interviews, a review of the attendance roster, and name to face documents, on September 16th ,24th, 26th , 2025, the minimum staff/child ratios were not met. On September 16, 2025, there were four two-year-old children, and seven three-year-old children present with one teacher. On September 24, 2025, there was one three-year old, four four-year-olds, one five-year- old, and twelve, school age children present with one teacher. On September 26, 2025, there were fifteen three-year-old children, and one four-year-old child with one teacher. GS 110-91(7);.0713(a-d) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Violations observed and documented today may impact the compliance history score. The violations observed and documented today must be corrected immediately. Additionally, by 5:00pm on October 15, 2025, you must submit a written, dated, and signed statement to me. The statement must describe accurately and in detail, how and when the violations were corrected. If the letter states that corrections have been made when they have not, this may be considered falsification of information. I stated that there is not a grace period to allow staff to be over in staff to child ratio. The staff to child ratio must be always maintained. The administrators stated that she is in the process of hiring more staff. She has also adjusted the staff members’ schedules to ensure that there are enough staff members. In addition, she confirmed with some families of their schedules, to ensure that there is enough staff to cover. Staff/Child Ratios A violation was cited today for staff/child ratios. It is important to maintain staff/child ratios as outlines in Child Care Rules. During interviews, it was confirmed that there are times in the morning, throughout the day, afternoons, that the facility is not maintaining minimum staff to child ratios. It is important to maintain ratios in compliance with Child Care Laws. Today, I suggest informing the staff members that once they reach their max, they will need to call the administrator and not accept more children in the room. The administrator can also keep track of the attendance at arrival of the children. The administrator can keep a note of classrooms ratios. We talked about strategies for maintaining compliance with Child Care Rules. Refer to Child Care Rules 10A NCAC 09 .0713. Challenging Behaviors Hotline During interviews, it was discussed that there are some concerns with challenging behaviors. I have provided resources below: Do you have children who bite? Do children struggle to focus during circle time? Do challenging behaviors cause difficult transitions? Do you spend all day managing behavior? Are you at your wits' end? I also recommended some strategies for addressing behaviors from the website: feeling chart/feeling faces, training for staff on the website, printable books on regulating behaviors, and implementing a cozy area in the classroom for the child to use when reading the printable books. I observed a copy of the administrative action, cover letter, and CAP posted as required located on a bulletin board near the front entrance of the facility. Ms. Bowers informed that Julie Whittock, Administrator, was not at the facility during today’s visit. I reminded Ms. Bowers that the information must remain posted for three months or until receipt of a closure letter from the Division. Limited monitoring of child care requirements occurred during today’s visit. I reviewed a copy of the staff training worksheet and verified that Criminal background check qualification letters, First Aid/CPR and ITS-SIDS. Criminal background check/qualification and First Aid/CPR were current for all staff members. However, one staff member’s First Aid/CPR expired in August 2024. Ms. Bowers stated the staff member completed the training recently and a current copy of the certificate will be placed in the staff file. Six staff members ITS-SIDS was either not in the staff file or had expired. Brianna Bowers, Assistant Director, accompanied me during a walk-through of the facility. I spoke with Ms. Bowers and discussed the purpose of the visit. I observed a copy of the administrative action, cover letter, and CAP posted as required located on a bulletin board near the front entrance of the facility. Ms. Bowers informed that Julie Whittock, Administrator, was not at the facility during today’s visit. I reminded Ms. Bowers that the information must remain posted for three months or until receipt of a closure letter from the Division. Limited monitoring of child care requirements occurred during today’s visit. I reviewed a copy of the staff training worksheet and verified that Criminal background check qualification letters, First Aid/CPR and ITS-SIDS. Criminal background check/qualification and First Aid/CPR were current for all staff members. However, one staff member’s First Aid/CPR expired in August 2024. Ms. Bowers stated the staff member completed the training recently and a current copy of the certificate will be placed in the staff file. Six staff members ITS-SIDS was either not in the staff file or had expired. Violation Number Comment Rule 1065 Child care providers scheduled to work in the infant room, did not complete ITS-SIDS training within two months of employment or did not complete the training every three years. Child care administrators did not complete the ITS-SIDS training within 90 days of employment and every three years thereafter. Seven staff members listed on the staff training worksheet did not have a current copy of ITS-SIDS training in the file. .1102(f) Violations must be corrected immediately. The training should include procedures for ensuring developmentally appropriate supervision and planning a safe environment. All staff members, including administrative, full-time, part-time, auxiliary, substitute, and volunteer staff, shall participate in the mandatory training. Documentation of the training shall be maintained in facility files for review by representatives of the Division of Child Development and Early Education upon request. 8/22/24-Ms. Whittock contacted the Cumberland County Partnership For Children on July 18 2024 and scheduled the mandatory training for August 3, 2024. Ms. Whittock submitted documentation of the completed training on August 5, 2024 to include the training information, staff attendance roster, and agenda to the Division. This Stipulation is complete as required. 3.Within one (1) week after the training in Item #2 is completed, Ms. Whittock shall contact Cumberland County Partnership for Children to schedule a technical assistance appointment related to the arrangement of classroom(s) for toddler-age children to maximize adequate supervision in the classroom(s) and to provide a safe environment for children. Upon review of all technical assistance recommendations, Ms. Whittock shall develop a written plan that describes, in detail, the steps the facility will take to ensure adequate supervision and safe indoor environment for children. The written plan shall include, but not be limited to, the following: •Child Care Rule 10A NCAC 09 .1801(a)(1-5) regarding supervision of children •When there is only one staff member in the classroom, and they are assisting children with routine caregiving duties such as diapering/toileting and dining •When staff members are completing non-caregiving activities such as cleaning and paper work •When toddler-age children are in all areas designated for routine activities •Incorporation of technical assistance recommendations related to indoor safety, including room arrangement for adequate supervision of children and the removal of hazards •Procedures for staff members to request additional support during periods of transition, meal preparation, dining, and diapering •Procedures for supervisory staff members to observe and monitor staff members’ implementation of the supervision plan while caring for children within designated areas •Procedures for periodic review of the supervision/safe environment plan with all staff members, including the review of the plan in orientation of new staff members before they assume child care responsibilities •Consequences of staff members’ non-compliance with policies/procedures/plans Documentation of the observations included in the written plan shall include the date, time, and location of each observation, the name and signature of the person(s) observed, the signature of the observer, a summary of each observation, the observer’s feedback/guidance to the staff members, and the staff member’s response. A copy of the approved written plan shall be maintained in facility files for review by representatives of the Division of Child Development and early Education upon request. 8/22/24-Ms. Whittock informed that she contacted the CCPFC on August 7, 2024 to schedule Technical Assistance visit, and was informed that the CCPFC was closed until August 12, 2024. Technical Assistance visit was completed by the CCPFC on August 13, 2024 at the facility. Ms. Whittock submitted first draft of the revised supervision policy and procedures to the Division on August 18, 2024. This Stipulation is not complete. 4.Within one (1) week after this Notice is received, Ms. Whittock shall develop supplementary written policies and procedures to the facility’s existing Emergency Medical Care (EMC) plan that provide clear instructions to staff members regarding implementation of the EMC plan. The written implementation policies and procedures regarding the EMC plan shall include, but not be limited to, the following: •Information about the types of illnesses and injuries that require immediate implementation of the EMC plan •Detailed instructions describing what steps the staff members will take to thoroughly assess a child when an incident occurs •A requirement and procedures for staff members to immediately notify the facility director, or a designated person in the director’s absence, including the method of contact and what steps to take if the director cannot be reached, when a child is suspected of having an injury or illness •A requirement and procedures for notifying parents, guardians, or documented emergency contacts of any incidents during which children may be injured or become ill; including the timeframe for notification and documentation of what information was provided, and to whom, during the notification process The written policies and procedures shall be submitted Ms. Eaton for approval.
