Name of Operation: BURNS CHILD CARE & PRESCHOOL CENTER Facility ID: 26000591 Consultant: NANCY STRATFORD Operation Type: Center Case Number: 0426-426L Visit Date: 5/13/2026 Number Present: 43 Completed Date: 5/13/2026 Age: From 0 To 5 Total Minutes: 270 Time In: 09:15 AM Time Out: 01:45 PM Time In: Time Out: List to Use: Center Type Of Visit: Complaint Visit Announced/Unannounced: Unannounced The purpose of today's visit was to monitor compliance with applicable child care requirements pertinent to a complaint visit. The last annual compliance visit was completed July 17, 2025, and prior to today’s visit, the eighteen-month compliance history score was at 95, which is above 75%, as required by North Carolina General Statute 110-90(4)(c-d). %. This program currently operates with a Four-Star License issued March 27, 2020. The License was based on the program earning seven points in education standards, two points in program standards, and one quality point by choosing to meet educational option: The administrator has completed a business training course of at least 30 clock hours. The information on record with DCDEE was verified as correct by Ms. Regina Robinson, Administrator, and the owner’s corporation status was verified on the Secretary of State’s website as current-active. Current Inspections are as follows: The Sanitation Classification completed April 13, 2026. Fire Classification of Satisfactory completed September 04, 2025. Ms. Robinson was present and accompanied me while observing the indoor areas. In Space #1, the children were sitting at the table eating. The teacher talked to the children and assisted with meals. In Space #4, the children were outdoors holding the parachute and following the teacher’s guide on moving the parachute. In Space #5, the children were outdoors playing in the sand box. The children were using sand toys and creative structures. Lunch served was chicken nuggets, potatoes, pears, bread, and milk. There is a concern that children are not being adequately supervised. Regarding the concern that children are not adequately supervised child, observations and interviews were conducted. In addition, the employee’s file was reviewed, and one child’s file was reviewed. The concerns were discussed with Ms. Robinson, administrator. Interviews were conducted with the administrator, the owner Ms. King, and two staff members providing care at the approximate time the incident occurred. During observations, the staff members used the face to name sheet to monitor the children. All children were supervised. On the day of the incident, there was one teacher with a group of twenty-four (24) school age children. The incident occurred between 4:27 pm -4:35 pm. The camera footage was reviewed. The staff member was located approximately 44 feet vertical from where the children were playing, and then again at a closer distance during the duration of the incident. At 4:27 pm, the children were playing near the bins and begin to approach the location where the storage bin was located. Between 4:29 pm-4:30 pm, the children start taking turns going inside of the storage bin. The children are observed taking the lid and covering the storage bins themselves. Between 4:31-4:32, one child is observed sitting on the bin, getting off the bin, and running away. The child inside of the bin is opening and closing their own lid, and the child only shows being closed in the storage bin no more than two (2) to (4) seconds. Around 4:34 pm, the camera footage shows the child getting inside of the storage bin, and closing their own lid, the other child sits on the storage bin for approximately seven (7) seconds, with the child inside. Once the child that was positioned inside of the storage bin exits the storage bin, the child is observed walking to the teacher and talking to the teacher. During the interview, the staff member stated that the child approached her crying, and at first the child would not tell her what happened. After asking the child to explain what happened, the teacher stated the child told her that “the other child put her inside the bin”. The teacher stated that she was trying to comfort the child. After she calmed down, the teacher stated that the child resumed to playing. While the teacher is talking to the child, it is observed on the camera footage that the children continue to sit inside of the storage bin and close the lid. At 4:35 pm, there was a child sitting on the storage bin with a different child inside, and the teacher walks over to talk to the children and. the children transition to a different location outdoors. The staff member stated that when a member of the management team arrived on the playground at 4:38 pm, the staff member informed the staff member of the incident that occurred with the child sitting inside of a storage bin, and unable to get out. Based on the observations and interview information, the allegation that children are not adequately supervised is substantiated. At the completion of the visit, the Visit Summary was reviewed with Ms. Robinson. The following violation was observed: Violation Number Comment Rule 303 Children were not adequately supervised at all times. The incident occurred between 4:27 pm - 4:35 pm It was confirmed during interviews, that a child was restrained inside of a storage bin, with another child sitting on top for approximately seven (7) seconds. In addition, when the teacher was made aware of the incident, the teacher did not intervene promptly, leaving another child be be restrained inside of the storage bin, with the same child sitting on top of the storage bin. This was corrected because all children were adequately supervised. .1801(a)(1-5) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. The violation observed and documented today may impact the compliance history score. The violation observed and documented today was corrected during today’s visit. A compliance letter is not required. Facility Specific TA/Consultation/Reminders: Administrative Action: Due to a substantiated complaint, an administrative action may be warranted. Corrective Action: The administrator stated that once she was informed about the situation, she provided a written statement to the staff member involved on April 29, 2026. The written statement included a counseling session addressing the concerns of a lack of supervision. It was communicated by a written statement, that the employee did not take accountability and refused to accept the counseling statement. However, on May 6, 2026, the employee returned to sign the counseling statements. The employee received the supervision and safety training on May 12, 2026. In addition, the employees work position was adjusted and the employees’ hours were reduced. In addition, in the child’s file, there was a signed notice, that stated the corrective action measures, and detailed information surrounding the incident. The following measures will be conducted: children are no longer permitted to playing or around storage containers, staff will receive supervision and safety training, staff meeting with supervision expectations reviewed in detail, playground procedures are being reviewed, and staff have been directed that safety related incidents must be reported to administration and parents immediately. In addition, the storage bins were removed off of the playground. Supervision: A violation was cited today for supervision. It was confirmed during staff interviews that a child had stepped in a storage bin and another child sat on the lid, leaving the child restrained inside of the bin. The teacher was not aware that the incident was occurring. Once the child left the bin, the child went to the teacher to talked to the teacher about what was happening. The teacher did not intervene, leaving another child to go in the bin, and the same child sitting on the lid, leaving the child restrained inside of the bin. It is important to make sure that all areas are safe for children. If there are any bins that are positioned in the outdoor area, it is important to make sure that the children are supervised. Children need to be supervised at all times. Teachers to make sure to use the face to name sheet to help use as a tool to ensure that all children are accounted for. Based on the video footage, the teacher was standing across from the child but could not see what was happing near the bins. The group leader wrote math problems on the dry eraser board, and the children practiced the math problems on their papers, and the children talked to the group leader about how to solve the math problems. Toileting and handwashing routines were observed. Lunch served was kidney beans, brown rice, peas, peaches, and milk. In addition, a violation was observed for medical statement. At the completion of the visit, the Visit Summary was reviewed with Ms. Robinson. On July 14, 2025, the Center received a Provisional sanitation inspection. 10A NCAC 09 .0304(b) 1032 Child care providers and uncompensated providers who are not substitute providers or volunteers, including the director did not have a medical report on file prior to employment that was signed by a health care professional and/ or the medical report was older than 12 months. There was one employee hired February 3, 2025, and did not complete the medical report prior to employment. This was corrected when the administrator had a copy of the medical report dated for July 9, 2025. 10A NCAC 09 .0701(a) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Today we talked about maintaining compliance. You stated that the medical statement on file was greater than one year, and once your identified noncompliance, the employee completed the requirements for the staff medical statement and the statement is on file. Refer to 10A NCAC 09 .0701 Health Standards for Child Care Providers, Substitute Providers, Volunteers, and Uncompensated for information regarding medical statements. Medical Statements are required before the staff member’s date of hire. Medical reports are accepted no more than one year from the employee’s hire date. When a child safety seat is required, it is important to ensure that the restraint seat is used according to the manufacturing requirements. Be reminded, car seats and booster seats both have expiration dates. This is important in maintaining compliance for the safety of children. In each transportation vehicle, it is required to include a photograph of each child using transportation. On the emergency contact form including a photograph helps identify each child being transported. I have provided some information, but not limited to the items reviewed during today’s visit. The last annual compliance visit was completed July 23, 2024, and prior to today’s visit, the eighteen-month compliance history score was at 90, which is above 75%, as required by North Carolina General Statute 110-90(4)(c-d). %. This program currently operates with a Four-Star License issued March 27, 2020. The License was based on the program earning seven points in education standards, two points in program standards, and one quality point by choosing to meet educational option: The administrator has completed a business training course of at least 30 clock hours. The information on record with DCDEE was verified as correct by Ms. Regina Robinson, Administrator, and the owner’s corporation status was verified on the Secretary of State’s website as current-active. Current Inspections are as follows: The Sanitation Classification of Provisional completed July 14, 2025. A violation was cited for the sanitation inspection. Fire Classification of Satisfactory completed October 11, 2024. Ms. Robinson was present and accompanied me while observing the indoor and outdoor areas. In Space #1, the children were playing outdoors. Outside, the children were making castles in the sand, playing in the sand table with toys, pushing the wagon, and walking on the child sized steps. In Space #2, the children were playing outdoors. Outdoor toys and tricycles were open and available for the children. The children were lined up on the gate to play a game, and the caregiver gave prompts for the children to follow, by saying “hop” and “run”. In Space #7, the school-age children were sitting at the table with paper and pencils. The group leader wrote math problems on the dry eraser board, and the children practiced the math problems on their papers, and the children talked to the group leader about how to solve the math problems. Toileting and handwashing routines were observed. Lunch served was kidney beans, brown rice, peas, peaches, and milk. In addition, a violation was observed for medical statement. At the completion of the visit, the Visit Summary was reviewed with Ms. Robinson. Limited monitoring of child care requirements occurred during today’s visit. The following violations were observed and/or confirmed during today's visit: Violation Number Comment Rule 453 The schedule of off premise activities was not current and/or did not include required information. The off premise activities schedule/calendar did not list all information to include the purpose of the activity, time the activity will take place, and the contact person(s) in the event of an emergency for school age children. .1005(b)(5)(A-E) 476 Staff did not use the list of participating children to check attendance when leaving the center, periodically when the children were involved in the activity, before leaving the activity to return to the center, and/or upon return to the center. On June 27, 2025, the facility's list of children participating in off premise activities was not checked when the children were involved in the activity as required. On June 27, 2025, staff members failed to ensure a safe environment for a six-year-old child when they did not check the temperature of playground equipment during an off premise activity prior to allowing children to access the equipment. Regina Robinson, Administrator, accompanied me during a walk-through the facility. During the visit, I discussed the allegations with Ms. Robinson and four additional staff members. Limited monitoring of child care requirements occurred during today’s visit. The following violations were observed and/or confirmed during today's visit: Violation Number Comment Rule 453 The schedule of off premise activities was not current and/or did not include required information. The off premise activities schedule/calendar did not list all information to include the purpose of the activity, time the activity will take place, and the contact person(s) in the event of an emergency for school age children. .1005(b)(5)(A-E) 476 Staff did not use the list of participating children to check attendance when leaving the center, periodically when the children were involved in the activity, before leaving the activity to return to the center, and/or upon return to the center. On June 27, 2025, the facility's list of children participating in off premise activities was not checked when the children were involved in the activity as required. At least one of the children present was not included on the list. .1005(b)(6) 481 A list of all children participating in the off premise activity was not available at the center. On June 27, 2025, the list of children participating in an off premise activity did not include the name of all children in attendance, including a six-year-old who was injured. .1005(b)(6) 807 A safe indoor and outdoor environment was not provided for the children. On June 27, 2025, staff members failed to ensure a safe environment for a six-year-old child when they did not check the temperature of playground equipment during an off premise activity prior to allowing children to access the equipment. The staff members can place these items in the cozy area as a way for the children to transition, when he or she is having a difficult moment. In Space #2, the children were sitting on the carpet reading a book. The teacher talked to the children about objects that were displayed in the book. In Space #4, the children were lining up to go outdoors to play. The teacher counted the children and the children transitioned outdoors. Lunch served was fish sticks, green beans, mixed fruit, and milk. At the completion of the visit, the Visit Summary was reviewed with Ms. Robinson. The following violation was observed: Violation Number Comment Rule 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. In Space #1, there was an aerosol can of disinfectant stored in an unlocked cabinet, greater than, 5 feet from the floor. The administrator removed the aerosol can and placed in a locked cabinet outside of the classroom. .2820(b) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. The violation observed and documented today may impact the compliance history score. The violation observed and documented today was corrected during today’s visit. A compliance letter is not required. Facility Specific TA/Consultation/Reminders: Storage of Hazardous Items: A violation was cited today for Storage of Hazardous Items. Store items that are labeled “keep out of reach of children” and have no other warning can be stored on a shelf or in an unlocked cabinet. The shelf or cabinet must be mounted at least five feet above the floor. There was one aerosol cans of disinfectant, stored in an unlocked cabinet, five feet above the floor. Aerosol cans must be stored in locked storage.
