Any violation(s) documented may impact the compliance history score. The violation(s) documented must be corrected immediately. On or before June 4, 2026, I must receive a written, dated, and signed compliance letter that describes accurately and in detail how and when the violations were corrected. Please be aware any information submitted by you is legal documentation. If it is determined the information provided in the letter is not true, this may be considered falsification of information. If sufficient information is not received by the due date, a follow-up visit will be conducted. Mail or email the information to: Michelle O’Kelley, Child Care Consultant PO Box 56 Jackson, NC 27846 Michelle.OKelley@dhhs.nc.gov If you email the compliance letter, it must be sent from the email address registered with the DCDEE (this serves as your signature) and the following information must be included: name, position, facility name, and facility ID number. An example is: Jane Doe, Administrator AAA Child Care ID # 12345678 Technical Assistance Criminal Background Check (CBC) – Criminal Background Checks ensure that operator’s and their household members have not committed any crimes which could potentially make them unsafe to be around children. Because Abuse and Neglect registries are also checked, it helps to ensure that children are protected from physical, mental, and sexual abuse. John Ferrell’s five-year qualification letter expired on March 3, 2026, and they were not requalified until May 7, 2026. You said it has been corrected. Scheduling due date reminders on apps like Google or Outlook calendar for criminal background checks, CPR and First Aid training, ITS-SIDS training, and other requirements will help you stay in compliance. For your compliance letter, state how you plan to ensure that Criminal Background Checks are complete and on file before the current one expires. ITS-SIDS Training – Completing ITS-SIDS training every three years provides you with the most current information and required practices to protect infants from sudden infant death syndrome and other accidents that may occur while sleeping. Since you are licensed for children under twelve months of age, whether or not have infants enrolled you are required to complete ITS-SIDS training every three (3) years. The operator’s ITS-SIDS training expired on September 7, 2025. You said you did not think you had to take it since you had no infants enrolled. For your compliance letter, state the date you completed the ITS/SIDS training and attach a copy of your certificate. Also, state how you plan to ensure that your ITS-SIDS is taken before the current training expires. Recognizing & Responding to Suspicions of Child Maltreatment: Operators are mandatory reporters of child abuse and neglect. Education is important in identifying manifestations of child maltreatment that can increase the likelihood of appropriate reports to child protection and law enforcement agencies. Your Responding to Suspicions of Child Maltreatment training certificate was dated March 4, 2021. You said you did not realize it had expired. You must complete the training at https://preventchildabusenc.org/. In your compliance letter, include the date the training was completed and state how you plan to ensure that your Recognizing & Responding to Suspicions of Child Maltreatment is completed and on file before the current one expires. Safe Outdoor Environment: Equipment, materials, furnishings, and play areas should be sturdy, safe, and in good repair. The easel in the outdoor space had rust on it. You said "I need to paint it". You must remove the easel until it is painted, as children can get a skin infection from or tetanus if they have a small break in the skin and touch rust. Electrical Outlets: Approximately 2,400 children are injured annually by inserting objects into the slots of electrical outlets. For this reason, all electrical outlets, including those on power strips, not in use that are in areas accessible to children must be protected with a safety plug or a tamper-resistant electrical outlet. There was an outlet in the indoor play space that was not covered. You said you did not realize it was not covered. This was corrected during the visit. Make it part of your daily routine to check that outlet covers are in place before children arrive. Reminders Your annual training hours requirement must be met by June 5, 2026. Your EPR plan is due to be updated on May 26. 2026. Sex Offender Registry: North Carolina General Statute 14-208 requires sex offenders to register with the North Carolina Department of Justice. The law states that a sex offender shall not knowingly reside within 1,000 feet of the property on which any public or nonpublic school or child care center is located. This does not apply to child care centers that are located on or within 1,000 feet of property of an institution of higher education where the registrant is a student or is employed. All licensed child care centers must register to receive e-mail notification when a registered sex offender moves within a one-mile radius of the center. On the back porch, they stopped to put on sun hats that were stored in a plastic tub. The children then played in the fenced back yard. They had access to sand play, push toys, swings, trucks, and portable slides. The pool is separated from the play space by a locked 4 foot fence. Drinking water was provided to the children while they played. When they returned inside, they washed their hands and toileted. The provider asked if they wanted to play playdough. All the children sat at the table and were allowed to select colors of playdough and tools. The youngest sat on the provider’s lap and stacked the playdough containers. Lunch was observed and consisted of chicken nuggets, tater tots, applesauce, whale cheese crackers, and milk. The following violation(s) were documented: Violation Number Comment Rule 702 Potentially hazardous items, including but not limited to, power tools, nails, chemicals, propane stoves, lawn mowers, and gasoline or kerosene, whether or not intended for use by children were not stored in locked areas, removed from the premises, or otherwise inaccessible to children. The unlocked shed, located at the back of the yard, contained two chain saws, a container of gasoline, and a push mower. .1719 (a) (1) 1927 Openings in equipment, steps, decks, and handrails were not smaller than 3 1/2 inches or greater than 9 inches to prevent entrapment. The railing on the back porch had one section that measured 4 inches between the slats and not the required 3 and a half inches. .1719(a)(23) Be knowledgeable of the child care laws and rules and environmental health rules; review them with your staff and assist them with understanding and implementing them to maintain compliance and keep children safe and healthy. The most recent versions of child care laws and rules and environmental health rules in North Carolina, the Items Number Listing (can be used as a detailed checklist of required items) and What’s New information are available on the DCDEE website, www.ncchildcare.ncdhhs.gov. Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4)(d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. The violation(s) documented must be corrected immediately. On or before 7/11/24, I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. Please be aware, any information submitted by you is considered legal documentation. If it is determined the information provided in the letter is not true, this may be considered falsification of information. If sufficient information is not received by the due date, a follow-up visit will be conducted. Mail or email the information to: Anne Buck, Child Care Consultant PO Box 2363 Elizabeth City, NC 27906 Anne.Buck@dhhs.nc.gov If you email the compliance letter, it must be sent from the email address registered with the DCDEE (this serves as your signature) and the following information must be included: name, position, facility name, and facility ID number. An example is: Jane Doe, Administrator AAA Child Care ID # 12345678 Technical Assistance: Playground Safety – Daily inspections of the playground, ensures the space is safe and ready for use by the children. All hazardous materials must be stored in locked storage. The unlocked shed, located at the back of the yard, contained two chain saws, a container of gasoline, and a push mower. This was corrected during the visit. The railing on the back porch had one section that measured 4 inches between the slats and not the required 3 and a half inches. The wider space could allow a child to become trapped between the slats. An extra slat must be added to reduce the space between the slats to less than 3 and a half inches. You stated that you would add the additional slat to ensure the safety of the children. Additional Information: The Healthy Social Behaviors (HSB) Project supports teachers to promote healthy social-emotional development and reduce the expulsion rate among young children in licensed child care centers across North Carolina. The team is made up of specialists with early childhood education backgrounds who are passionate about empowering teachers to develop learning environments and teaching practices that promote prosocial skills in young children. To speak to a Behavior Support Advisor, contact 1-888-600-1685 option 1. Provider Access to ABCMS - Beginning February 1, child care administrators can access the Automated Background Check Management System (ABCMS) This access will allow providers to: •See the real-time background check status of staff members. •Run a printable report of the staff roster to assist with compliance visits. •See new background check applicants and add them to staff roster. Access to the ABCMS requires the successful completion of a Moodle course consisting of a short video followed by a test. All staff must connect their CBC with your license number and the date this was completed listed on your Staff and Training Worksheet. Required Water, Lead Paint, and Asbestos Testing - New child care rules require child care facilities to test for lead in drinking water, lead paint, and asbestos. Testing is required by 1/1/2025. Check out the FAQ in the updated Clean Classrooms for Carolina Kids. Currently there is funding to pay for the testing and to mitigate lead paint or asbestos hazards. Depending on the age of your home and the information you provide in the enrollment process, testing for lead paint and asbestos may not be required. For more information go to https://www.cleanwaterforuskids.org/en/carolina/ or contact your Environmental Health Specialist. You must email the results to me once these are completed. A walk-through of the facility was completed today, all indoor and outdoor areas were monitored. The provider’s daughter was present and assisted with the children. I observed children in both the indoor and outdoor learning environments and found supervision and staff/child ratios to be in compliance. Children were eating a breakfast of cheerios, milk, and grapes. The grapes were cut small for the younger children. The provider had conversations with each child as they ate. After eating, the children toileted, washed hands, and prepared to go outside. Diapers were changed on the changing table in the dinning room and diapers disposed of in a covered container. There continues to be a fenced play area for the children in the back yard. The pool was fenced and locked as required. There were swings, push toys, and dramatic play materials available for the children. Shade was provided by two large umbrellas and trees. When the children returned inside, they washed hands and were offered a variety of art materials or magnetic blocks to play with. While the older children engaged in their activities, the infant was given supervised tummy time. The Albemarle Alliance for Children and Families / Child Care Resource & Referral is able to provide you with resources and information, training opportunities, and technical assistance on child care issues and the Environment Rating Scales. Their phone number is (252) 333-1233 or check out their website at www.albemarleafc.org. The following violation(s) were documented: Violation Number Comment Rule 701 All indoor and outdoor areas used by the children were not kept clean, orderly, and free of items which are potentially hazardous to children including removal of items a child can swallow; the removal of loose nails or screws and splinters on inside; and use of outdoor equipment that is too hot to touch. There was a crack in the plastic play house doorway with sharp edges that could injure a child as they go in or out. A black inner tube bouncy toy was hot to the touch. The new swings, on the swing set, were attached to the chain with “S” hooks which can catch children’s clothing causing a hazard. .1719(a)(1)&(17) As a licensed child care operator, it is your responsibility to be knowledgeable of the child care laws and rules and to maintain compliance with them. The NC General Statutes (Updated September 2020), Child Care Rules (Updated February 2021), and the “What’s New” section of The Division of Child Development and Early Education (DCDEE) website, ncchildcare.ncdhhs.gov, are excellent resources to help you stay current with the child care requirements. The most current forms and documents needed for your licensed facility are available under the Provider tab. Many of them are now interactive so that you can type right into the form. Many of the forms needed for families are now offered in Spanish too. And of course, I am also available to assist you, should you have questions about the child care requirements. An example is: Jane Doe, Administrator AAA Child Care ID # 12345678 Technical Assistance: Playground Equipment – Intentional planning of the environment ensures a safe environment to prevent and reduce injuries and promotes all areas of a child's development. There was a crack in the plastic play house doorway with sharp edges that could injure a child as they go in or out. A black inner tube bouncy toy was hot to the touch. The new swings, on the swing set, were attached to the chain with “S” hooks which can catch children’s clothing causing a hazard. Per our discussion, the “S” hooks must be replaced with carabiner type clips to ensure that children’s clothing does not become entangled in the hook and get dragged by the swing. You stated that you would switch them out with the correct attachments. During the visit, you moved the black inter tube to the shaded area and cooled it with water. You also stated that you will cover the sharp place on the play house or use a heating tool to smooth the edge. As you complete your daily checks on the playground, make sure you are closely inspecting and placing your hands on the materials to look for cracks, breaks, and to ensure they are not too hot for the children to use. Additional Information: Health and Safety Trainings – You have completed your 5 year cycle of trainings. These trainings must be logged on a Heath and Safety Training Log and the certificates attached as verification. Per our discussion, begin a new log for your next 5 year cycle which will be due on 8/8/28. This will help you document any trainings, that you take over the next 5 years, that meet one of the 11 topic areas. Moodle Support - The Division offers early childhood professionals a wide range of professional development opportunities through the online learning platform Moodle. DCDEE has established a new support email address and phone number to help providers navigate Moodle. To get help with Moodle, email DCDEE_Moodle_Support@dhhs.nc.gov or call (919) 814-6326. The NC Early Childhood Credential Equivalency Exam is another pathway option comparable to a NC Early Childhood Credential. This equivalency exam assesses the foundations of culturally responsive, equitable and inclusive early childhood education, planning intentional developmentally appropriate experiences, learning activities, and teaching strategies for indoor and outdoor environments for all young children, guidance techniques, and professionalism. This option is now available on Moodle at no cost. Before staff take the test, they should review the NC Child Care Rules, the NC Foundations of Early Education and Development, and the most current version of Caring for Our Children. Each of these will help them prepare to score well on the test. At the completion of the visit, this visit summary was printed, reviewed, and a copy was left with you.
