Upon my arrival, I was greeted and welcomed into your program. Seven classrooms were opened today. I conducted a general walk-through of the indoor and outdoor learning environments. I observed the children exploring their indoor environment, eating lunch, and preparing for nap time. MONITORING A partial assessment of the child care requirements was conducted during today’s visit. There were 57 children present during this visit. The children were observed exploring their indoor environment, eating lunch, and preparing for nap time. During today’s visit, when interviewing the director, she stated that she was not aware of a child being hit with a ruler. She stated that no one has brought that to her attention, nor has she seen a teacher commit an action of that sort of behavior. The teacher that the reporter states is aware of the incident is no longer employed at the facility. When interviewing an employee, I asked if she ever witness or aware of a particular teacher “hitting a child and yelling at them to shut up and stop crying”? She stated that the teacher did a lot of excessively yelling at the children when they did something or if they were not doing what was asked of them. The employee stated that one incident that happened in the classroom was a child that fell and bit her lip. The teacher in question stated that the child fell over a shoe. The employee stated that it appeared to her that the teacher was talking to the child up close in the child’s face and pushed the child hence making the child fall and bit her lip. The employee also stated that the teacher would grab the children by the under arm tight by pinching them when they do something wrong or out of order according to the teacher in question. When interviewing the director, I asked if she was aware of an employee shaking a child or handling a child roughly in the infant classroom. She stated that she was not aware of a child being mishandled inappropriately. She stated that no one has brought that to her attention, nor has she seen a teacher commit an action of that sort of behavior. The teacher in question has moved to another age group. The teacher that informed the reporter is no longer employed at the facility. When inspecting the bathroom between the 3’s and the 4’s classroom, there was mold around both toilets and the back wall baseboards. When speaking with the director she would check with a cleaning company to see what she could use to clean around those areas when the children are not in the building. The following violations were observed and recorded during today's visit. Violation Number Comment Rule 807 A safe indoor and outdoor environment was not provided for the children. There were mold in the bathroom shared by space #3 and space #4 around the toilet's and bottom baseboards. 10A NCAC 09 .0601(a) 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. A staff member failed to intervene during an inappropriate action between another staff member and a child. G.S. 110-91(10) 1876 A child was yelled at, shamed, humiliated, frightened, threatened or bullied. A caregiver yelled in a child's face telling the child to "shut up" and "stop crying". .1803(a)(9) In order to comply with the NC Laws & Rules, any violations cited today must be corrected immediately. A compliance letter should be sent to me by June 24, 2025. The letter should address each violation, and explain how and when it has been corrected. Please send the letter to shannel.hall@dhhs.nc.gov and include the following: -Facility name -Facility ID number -Each item number COMPLIANCE HISTORY Prior to today’s visit, your compliance history was 89%. It will be updated after today's visit, and you will be informed of the new score. ALLEGATION RESOLUTION Based on the interview with the Director, Staff Members, and my observation, I was able to determine that there were violations of child care rules related to nurturing care, discipline, and unsafe environment therefore, the allegations were SUBSTANTIATED. Based on the interview with the Director, my observation, and the video footage that was still available, I was not able to determine that there were violations of child care rules regarding discipline (popping with ruler), and rough handling (shaking of a child) therefore, the allegations were UNSUBSTANTIATED. Please be advised, due to the above Allegations being Substantiated this can result in an Administrative Action being taken. TECHNICAL ASSISTANCE You may want to review these rules with anyone that works with children in your facility: 10A NCAC 09 .1803 (a) (9) PROHIBITED DISCIPLINE IN CHILD CARE CENTERS Early care and education program staff should support children’s safety and development through a positive environment that provides nurturing, responsive, and sensitive caregiving. Programs should not tolerate any inappropriate, neglectful, or abusive behaviors toward children. Program staff should avoid acting this way with one another, and they should model positive behaviors for children. Center staff should not allow any other staff member to mistreat or hurt a child without intervening to ensure the safety of the child. The center staff is there to serve and protect the children no matter what situations other adults may be facing because it is all about the children when walking into the workplace. One of the biggest challenges that early childhood educators and administrators face is children’s behavior. Often these behaviors are developmentally appropriate, however, some behaviors can be difficult for a teacher to manage. Providing technical assistance, coaching and professional development for staff to prevent and address these challenging behaviors, as well as promoting children’s social competence can be beneficial. If you would like assistance with dealing with the challenging behaviors of children in your care, you can contact a Healthy Social Behavior Specialist at Early Years (formally Child Care Services Association); they can be reached at (919) 403-6950. Floors, walls, and ceilings should be in good repair, and easy to clean when soiled. All bathrooms should be constructed of materials that are impervious to moisture, bacteria, mold, or fungus growth. The floor-to-wall joints should be constructed to provide a sanitary cove with a minimum radius of three-eighths inch. The office administrator, Melanie Velec, assisted me with today's visit. Upon my arrival, I was greeted and welcomed into your program. Seven classrooms were open. I conducted a general walk-through of the children indoor and outdoor learning environment. I observed the children exploring their indoor, outdoor learning environment, eating lunch, and napping. RATED LICENSE STATUS The program holds a 5-star-rated license issued on 8/16/16. The program is in the "held harmless" status and points from the previous assessment are carried forward. The program received 6 points in Program Standards, 7 points in Staff Education, and 1 quality point through the educational option of the center having a combined turnover rate of 20% or less over the last 12 months. INSPECTIONS The last sanitation inspection was conducted on 9/28/24. The last fire inspection was conducted on 3/26/24. The last fire drill was conducted on 11/25/24. The last emergency drill was conducted on 9/11/24. The last playground inspection was conducted on 11/25/24. During this visit, a partial assessment of the child care requirements was conducted. The following items were monitored and found in compliance during this visit: nurturing interactions, daily attendance, license posted & permit restrictions followed, safe indoor environment, fire drills & inspections, CRC qualifications, CPR/First Aid certification, and storage of medications & hazardous materials. The following violations were observed and recorded during today's visit. Violation Number Comment Rule 541 The written feeding plan did not include the child's name, parent signature, and/or was not dated when received by the center. In space #2 a child's feeding schedule did not include the parents signature when received by the staff and available for review during today's visit. .0902(a) 843 A drug or medicine was administered after its expiration date. A child in space #1 had butt paste diaper cream that expired on 10/24. A child in space #6 epi-pen expired on 11/2/24. 10A NCAC 09 .0803(1)(d) 847 Parent's medication authorization did not include required information. A child in space #2 did not have the name of the diaper cream ointment on the permission slip to review during today's visit. 10A NCAC 09 .0803(4)(6-9) 1835 The medical action plan was not updated on an annual basis or when changes to the plan were made by the child's parent or health care professional. A child in space #6 emergency medical plan expired on 8/18/23. .0801(b) In order to comply with the NC Laws & Rules, any violations cited today must be corrected immediately. A compliance letter should be sent to me by December 18, 2024. The letter should address each violation, and explain how and when it has been corrected. It will be updated after today's visit, and you will be informed of the new score. TECHNICAL ASSISTANCE The following items were discussed to help you prevent a reoccurrence of the violations observed during today's visit. I would suggest adding medication/ointment check to your monthly check list. I would suggest reviewing all paperwork received by parents to make sure all pertinent information is completed on application, feeding schedules, medications forms, etc. CONSULTATION Criminal background checks must be renewed every five (5) years. Criminal background checks can be completed up to six months prior to the expiration date. We are encouraging all staff to begin their renewal process early to avoid lapses in their qualification. HEALTH AND SAFETY TRAININGS Health and Safety trainings are now available through Moodle on the DCDEE website. These trainings are provided free of charge. You should use your NCID username and password to access the Moodle portal. As per Child Care Rule .1103(b) the Health and Safety trainings must be renewed at least every 5 years. Some of your staff completed the trainings in 2017, they should begin to retake the training. LICENSING FEES Your facility’s annual licensing fee Invoices should have been emailed to the facility email addresses on file by the end of November. Online payments will be due by December 31, 2024 by going to www.ncchildcare.nc.gov. In accordance with North Carolina General Statute § 110-90(1a), licensed child care facilities are assessed an annual license fee. The amount of your annual license fee is based on the licensed capacity printed on your license as of October 1, 2024, not the number of children enrolled at your facility. Please note that annual license fees do not apply to state or public school-operated child care facilities, or to religious-sponsored facilities operating under a Notice of Compliance. Failure to pay your license fee is a violation of childcare law (N.C.G.S. 110-90(1a)). Unpaid accounts will be assessed a 10% penalty, accrued interest as established by N.C.G.S. 147-86.23, and issuance of an Administrative Action, up to and including revocation of the childcare license. Facility ID: 3255003 Consultant: SHANNEL HALL Operation Type: Center Case Number: 0224-328L Visit Date: 3/13/2024 Number Present: 66 Completed Date: 3/13/2024 Age: From 0 To 5 Total Minutes: 105 Time In: 11:45 AM Time Out: 01:30 PM Time In: Time Out: List to Use: Center Type Of Visit: Complaint Visit Announced/Unannounced: Unannounced The purpose of today’s unannounced visit was to investigate an allegation of non-compliance with the NC Child Care Licensing Requirements received by The Division of Child Development and Early Education on 2/23/24. Upon arrival, Holli Hemby, Licensing Supervisor and I were greeted by the director, Ms. Marian. I explained the reason for today’s visit. We were informed that staff from Durham Environmental Health were also present, conducting an inspection to remove the center from Disapproved Status. MONITORING A partial assessment of the child care requirements was conducted during today’s visit. Six classrooms were open during today’s visit. We did a general walk-through monitoring for staff/child ratio. During this time, we observed the children napping. While monitoring staff/child ratios in all classrooms, we observed that Space #6 had 9 children present, aged 1 - 2, with only one caregiver. Upon notifying the director of this, another staff member was moved in to the classroom ALLEGATION: There are concerns regarding supervision During today’s visit, the director was asked if she had any recent incidents to occur? The director begins to speak of different items that happened in 2023. The director mentioned a past incident that happened to a child in the Early HeadStart classroom. The director was asked if she recalled any incidents that had occurred recently with other injuries reported to her by parents. She then mentions that there was an incident in February where a child was outside walking up the steps and fell. One of the staff members that is a floater, comforted him. The employee did not notice a knot or any injury on the child and he was picked up by his parent shortly thereafter. No incident report was written and given to the parent. The director stated the child’s mother later called the center to inquire on what happened to the child’s head. The staff member was not aware of what had happened nor was the director. The director then viewed the video footage to see what had occurred. The director stated that she did not see anything that happened inside, however, when looking at video of the playground outside, she stated that she observed the child slip while going up the stairs to the covered patio on the playground and bump his head on the railing. The parent and staff from Early HeadStart came in to watch the footage to see what happened to the child as well. The director stated that HeadStart staff wrote an incident report. The director stated that no one at the center had written an incident report. RESOLUTION Based on statements made by the director, we were not able to determine that any lapse in supervision had occurred that would have caused an injury to the child, therefore the allegation was UNSUBSTANTIATED. However, an incident report was not written for an injury to a child observed on video. The following violations were observed and recorded during today 's visit. TECHNICAL ASSISTANCE *Although no safety or supervision concerns were observed during today’s visit, we did recommend treating the steps and the entire wood structure on the playground with anti-slip materials to prevent any hazards if the wood became wet or dampened. *The director stated that she was not aware that an incident report should be written and the injury recorded on the Incident Log if the staff had not witnessed the incident. We explained that although staff had not observed the incident when it occurred, as soon as it was observed on video, an incident report should have been written and provided to the parent. Incident reports written by other partner agencies would not take the place of the center’s responsibility to write one. We also discussed that new child care rules that went in to effect in 2/2021 now require all injuries observed, or staff made aware of, to have an incident report written/given to parents and it recorded on the Incident Log, regardless of whether the child received medical attention or not. Refer to rules .0802(e) and (g) for more details. *The director asked about procedures that could be implemented in a lock-down situation and safe places for children to hide and inquired if a closet in a classroom could be used. We did, however, recommend Cleaning the closet out in space #1 so if and when a emergency happens you would have sufficient space prepared to hide. *The director mentioned that there are many children enrolled that have special behavior needs. You may want to consider providing the teacher(s) trainings on how to deal with children with challenging behaviors. You can reach out to Child Care Services Association and ask to speak with a Behavior Specialist or contact the EcHo Program at Exchange Family Center as they offer training for staff on dealing with children with Challenging Behaviors. The director, Marian, assisted me with today's visit. Upon my arrival, I was greeted and welcomed into your program. Five classrooms were opened today. I conducted a general walk-through of the indoor and outdoor learning environments. I observed the children eating lunch and preparing for a nap. RATED LICENSE STATUS The program holds a 5-star-rated license issued on 8/16/16. The program is in the "held harmless" status and points from the previous assessment are carried forward. The program received 6 points in Program Standards, 7 points in Staff Education, and 1 quality point through the educational option of the center having a combined turnover rate of 20% or less over the last 12 months. INSPECTIONS The last sanitation inspection was conducted on 8/14/23. The last fire inspection was conducted on 4/12/23. The last fire drill was conducted on 12/12/23. The last emergency drill was conducted on 12/12/23. The last playground inspection was conducted on 10/26/23. During this visit, a partial assessment of the child care requirements was conducted. The following items were monitored and found in compliance during this visit: nurturing interactions, daily attendance, license posted & permit restrictions followed, safe indoor environment, fire drills & inspections, CRC qualifications, CPR/First Aid certification, and storage of medications & hazardous materials. The following violations were observed and recorded during today's visit. Violation Number Comment Rule 536 Formula and other beverages which require refrigeration were not identified for each child or properly refrigerated. A child in space #2 bottles were not labeled with the child's name before putting them in the refrigerator. 15A NCAC 18A .2804(d) 541 The written feeding plan did not include the child's name, parent signature, and/or was not dated when received by the center. In space #2 a child's feeding schedule did not include the parents signature when received by the staff and available for review during today's visit. .0902(a) 847 Parent's medication authorization did not include required information. A child in space #4 did not have a permission slip with a parent signature to administer the emergency medication during today's visit. 10A NCAC 09 .0803(4)(6-9) 848 Questionable medication instructions from parents were followed without signed written dosage instructions received from physician or authorized health professional. In space #1 and space #2 children with topical medication did not have the proper instructions on the time and amount that it should be administered. 10A NCAC 09 .0803(5) 859 Monthly playground inspections were not completed and/or they were not completed by an individual trained in playground safety requirements. A current playground inspection was not available for review during today's visit. The mulch around the climbing structure fall zones on the playground was less than one inch in depth. .0605(k)(1-4) In order to comply with the NC Laws & Rules, any violations cited today must be corrected immediately. A compliance letter should be sent to me by January 3, 2024. The letter should address each violation, and explain how and when it has been corrected. I would suggest documenting the depth of the mulch when completing your playground inspection to keep track of the amount needed to order. I would suggest adding medication/ointment check to your monthly check list. I would suggest reviewing sanitation rules with all staff. I would suggest reviewing all paperwork received by parents to make sure all pertinent information is completed on application, feeding schedules, medications forms, etc. CONSULTATION Criminal background checks must be renewed every five (5) years. Criminal background checks can be completed up to six months prior to the expiration date. We are encouraging all staff to begin their renewal process early to avoid lapses in their qualification. RATED LICENSE REASSESSMENT This facility prep year is from July 1, 2023-June 30, 2024. The facility reassessment year will not begin until July 1, 2024. During this time, the provider will decide whether they wish to have the Environment Rating Scale Assessment conducted. We discussed making sure the provider WORKS account reflects her current degree. We discussed reviewing the NCRLAP website ERS resources (www.NCRLAP.org) for updated information. Ms. Marian is aware that she can request an ERS assessment free of charge during the preparation, and depending on the scores, they can be used as guidance to enhance program quality. Technical assistance can be requested anytime during this process. HEALTH AND SAFETY TRAININGS Health and Safety trainings are now available through Moodle on the DCDEE website. These trainings are provided free of charge. You should use your NCID username and password to access the Moodle portal. As per Child Care Rule .1103(b) the Health and Safety trainings must be renewed at least every 5 years. Some of your staff completed the trainings in 2017, they should begin to retake the training.
