The purpose of today’s unannounced visit was to monitor applicable child care requirements during an Annual Compliance visit. The last Annual Compliance visit was conducted on 11/3/23. This center operates with a five-star license, which was issued on 9/8/23. COMPLIANCE HISTORY: The compliance history for this center for the previous eighteen-month timeframe was 99%. All indoor and outdoor licensed space was monitored today. In April 2024 the director had been seeking approval from Durham Building Inspections to add additional licensed space. The director stated today that project was not being perused at this time. The director stated that the additional space at her office was not being used by the children. OBSERVATIONS: Today there were 7 children present. Four of the 7 children present today were NC Pre-K children. The lead teacher/owner stated that 12 children were enrolled at this center, and 7 of the 12 children were NC Pre-K children. I observed the children engaged in a variety of free play activities, having circle time, going outside, and eating lunch. Lunch today consisted of pasta w/chicken, green peas, bread, pears, and milk. The lead teacher/owner stated that the day ended for the NC Pre-K children at 3:30 pm. The non-Pre-K children remained and operated as an after-school program for the remainder of the afternoon. TRANSPORTATION: This center does not offer transportation services. CHILDREN’S FILES: Four children’s files were randomly selected and reviewed today. STAFF FILES: Staff files were reviewed during the visit and yearly in-service training was tallied for training completed since the 11/3/23 Annual Compliance visit. INSPECTIONS: The last documented annual fire inspection was completed on 9/9/24.___ The last documented sanitation inspection was conducted on 4/17/24. The last documented fire drill was conducted on 10/5/24. The last documented shelter-in-place drill was conducted on 8/3/24. The last documented playground inspection was completed on 10/3/24. CLEAN WATER FOR NC KIDS: I observed that the director completed the webinar on Clean Classrooms for Kids on 8/9/24. The following violations were cited today: Violation Number Comment Rule 428 A current activity plan was not posted for each group of children for reference. Activity plans were needed to reflect the activities planned for the children, who attended from 3:30 pm to the end of the day. GS 110-91(12); .0508(a) 1044 Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of five years for the date of issuance). The new administrator began employment at this location on 7/18/24. Her Criminal Record Check clearance expired on 10/17/24. G.S. 110-90.2(b) & .2703(n)&(o) All violations must be corrected immediately. Please send me a signed Corrective Action letter by 11/4/24, stating how each violation has been corrected. TECHNICAL ASSISTANCE was provided today in the following areas: ADDITIONAL SPACE: During today’s visit it could not be confirmed that the space calculation sheet did not match the diagram drawing of child care space. I stated that I would discuss the matter with the lead consultant, who completed the documents. I stated that would contact the lead teacher/owner after the discussion. STAFF REQUIREMENTS: Administrator: The new administrator was not present during today’s visit. The lead teacher/owner stated that the new administrator was navigating her hours to be administrator at this location and another NC-Pre-K facility in Durham. I reviewed NC Child Care Rule 10NCAC 09 .0714 (a) and stated that the new administrator needed to be present at this location for at least 20 hours per week. I stated that the new administrator needed to submit to the licensing supervisor, Holli Hemby, and schedule for the hours she would be present at each location each week for approval. The schedules can be submitted electronically to holli.hemby@dhhs.nc.gov. Assistant Teacher: When this center became an NC Pre-K site for the 2024/2025 school year, the employee, who was the center cook, assumed the position of assistant teacher. (1) I stated that the assistant teacher needed to sign a new job description. (2) Now that the employee is working with children, he must complete the required Health and Safety trainings during his first year as assistant teacher, and complete yearly in-service training hours. I stated that for the 2025 Annual Compliance visit, I could count the Health and Safety training hours toward meeting his yearly in-service training requirement. RATED LICENSE: Please know that the “hold harmless” status for Rated License reassessment has been extended until the new QRIS guidelines are ready for implementation. I recommended that the new-assigned assistant teacher complete additional coursework in Early Childhood/Child Development during this “hold harmless” period, striving to maintain their seven points in education during the next Rated License reassessment. The program is free, and the first step is to watch the pre-enrollment webinar, which are available at www.cleanwaterforUSkids.org/carolina. The lead teacher/owner stated that inspectors had visited the center to assess in person for asbestos. She stated that she was waiting for the report. Angela Alger-Walker, Lead Consultant, accompanied me on the visit. Upon arrival, we were greeted by Monika Bunch, and she accompanied us throughout the visit. CURRENT LICENSE STATUS Your program currently operates with a five-star license issued March 24, 2023, earning seven (7) points in Staff Education, six (6) points in Program Standards and One (1) Quality Point. INSPECTION/SAFTEY DRILL STATUS: The last sanitation inspection was completed on 4/17/24. The last fire inspection was completed on 9/6/23. The last outdoor play area inspection was completed on 4/4/24. The last fire drill was conducted on 4/5/24. The last documented shelter-in-place or lockdown drill was conducted on 3/6/24. The last annual compliance visit was completed on 11/3/24. Prior to today's visit I reviewed the NC Secretary of State's website and observed that the owner of this facility, The Playhouse Early Academy LLC, is listed as current/active. The license was posted, and the restrictions were in compliance. A partial monitoring of applicable child care requirements was conducted, monitoring Supervision, Staff Child Ratio, CPR/First Aid, Special Training, Storage of Hazardous Substances, Storage of Medication, Adequate Approved/Space, Staff Records, Program Records, License Posted, and Permit Restrictions. Violations were observed and recorded during today's visit. Violation Number Comment Rule 807 A safe indoor and outdoor environment was not provided for the children. The entrance/exit door to the playground would not latch. 10A NCAC 09 .0601(a) 823 Toxic plants were accessible to children. Ivy was growing on the inside of the fence. .0604(l) The above violations must be corrected immediately. Please email me a signed letter of compliance by 5/7/24. Before the letter is sent, all violations should be corrected; please contact me if additional time is needed to correct a specific violation. Include the following in your letter: facility ID number, list the item number describing how and when the violations were corrected and tell me how you plan to maintain compliance in the future with each item. COMPLIANCE HISTORY Prior to today’s visit, the program’s compliance history score was 100%. The center was in compliance with all applicable minimum licensing requirements during today's visit and no violations were cited that could impact the center’s overall Compliance History Score. An updated Compliance History Score will be generated after today’s visit, and you will be informed of the results on the next visit to your center. TECHNICAL ASSISTANCE We reviewed the following rules to assist you in gaining and maintaining compliance with applicable child care requirements: PLAYGROUND The playground currently has potential harmful vegetation (ivy) growing along the fence. Please make plans to have these plants removed. Toxic plants shall be inaccessible to children. A list of toxic plants may be found on the Division's website at http://ncchildcare.nc.gov/pdf_forms/form16b_bb.pdf. RATIO Just remember when you open classroom “B” you will need additional staff. The space will be able to accommodate 8 children. Remember that your license capacity is 15 children. INDOOR SPACE OBSERVATIONS The indoor spaces were calculated at 35 square feet per child, according to Durham County zoning ordinance. Office space (Space #2) was measured as a potential children’s play area. Space #2 can accommodate 8 children at 35 square feet per child. The building inspection was completed on 11/5/21. The inspector approved 6 rooms including bathrooms for use by children but did not provide an initialed floorplan to identify those 6 spaces. According to the building inspection the plumbing code would allow for a maximum of 30 children. A new door has been installed but still needs to be approved by the Durham County fire inspector and building inspector as an exit. The door leads directly into the church fellowship hall which you must pass through to get to the exterior exit. Space #2 also needs to be approved by the Durham County Sanitation inspector before it can be used as an approved classroom. Please submit the approved inspection reports/documentation to me as soon as you receive it. The outdoor learning environment has a total square footage that accommodates 15 children at 100 square foot per child in compliance with a Durham County zoning requirement. Based on the outdoor square footage, the center total compacity will not change. The total license capacity for up to a maximum of 15 children.
