The purpose of today’s visit was to monitor applicable child care requirements during a Routine Unannounced visit. This Family Child Care Home operates with a five-star license, which was issued on July 11, 2025. The last Annual Compliance visit was conducted on 6/24/25. The compliance history for the previous eighteen-month timeframe was 95%. Indoor designated child care space and the outdoor environment were monitored today. OBSERVATIONS: There were five children present today, ages 0 to 2. This is a Spanish emersion program. I observed the children engaged in free play activities while the operator interacted with them in Spanish. I observed the infant having tummy time. CHILDREN’S RECORDS: Children’s files were reviewed today for the three children, who began attending after the 6/24/25 visit. CURRICULUM: This program implements the Creative Curriculum, which was on the premises today. OPERATOR’S FILE: Upon reviewing information documented during the 6/24/25, I verified that the operator had current CPR/First Aid training, IT’S SIDS training, and Criminal Record Check clearance. At the current time the operator is the only resident in the home. SMOKE DETECTORS: During today’s visit I tested the battery-operated smoke detector. TRANSPORTATION: This Family Child Care Home does not offer transportation services. INSPECTIONS: The last documented fire drill was conducted on 5/10/25. The last documented lockdown drill was conducted on 4/8/25, The last outdoor inspection was conducted on 5/18/25. The operator completed the Clean Water for NC Kids on 6/23/25. The operator stated that she had not begun the process to complete the Clean Classrooms for Carolina Kids program, as discussed during the 6/24/25 visit. I explained that the operator needed to complete the program immediately. The following violations were cited today: Violation Number Comment Rule 305 Home was not equipped with either an electrically operated smoke detector with a battery back-up; or both an electrically operated detector and a battery operated detector located next to each other. At the current time the home is equipped with a battery-operated smoke detector only. NCAC 513.1; .1707(3) 601 Nutritious meals and snacks served did not meet Meal Patterns for Children in Child Care Programs. Menus were not available today for review. 10A NCAC 09. 1706(a) 714 Monthly check for hazards on the outdoor play area was not completed using a form supplied by the Division. The last documented outdoor inspection was completed on 5/18/25. 10A NCAC .1721(e)(5)(A-F) 912 Written feeding schedule was not on file for each child under 15 months of age and/or was not updated regularly to reflect changes in the child's needs. Of the three children's files reviewed today, all three were missing required paperwork. Upon installation, it would not work. The operator stated she planned to purchase and install another unit immediately. The operator stated that she had fallen behind in maintaining child care requirements, due to the death of a household member. INFANT/TODDLER REQUIREMENTS: I stated that with an infant enrolled, the Safe Sleep chart should be posted, and the infant needed to be monitored for safe breathing while sleeping. This Family Child Care Home operates with a five-star license, which was issued on 8/31/20. The last Annual Compliance visit was conducted on 7/11/24. The compliance history for the previous eighteen-month timeframe was 86%. OBSERVATIONS: There were three children present today, ages 1 to 2. I observed the children engaged in indoor free play activities, enjoying the outdoor environment, and eating lunch. Lunch today consisted of beans/rice with tomatoes, cucumbers, sliced apples, and milk. Also present during today’s visit was the operator’s sister, operator’s adult daughter, and the daughter nephew (age 1). The daughter stated that she resided in Chapel Hill, NC. The daughter stated that her nephew was visiting with her for a while this morning. The child’s dad would pick him up soon. The daughter stated that the child was not enrolled in the FCCH. The child stayed with the operator’s daughter in another section of the home during the visit. The operator’s sister stated that she was currently a part-time resident in the home, residing part of the time at this location and part of the time in her home in another section of Durham. The sister operated a licensed Family Child Care Home in her home until 4/30/25. CHILDREN’S RECORDS: Children’s records were reviewed today. OPERATOR’S FILE: During today’s visit the information on the operator’s verification form was reviewed. Yearly in-service training was tallied during today’s visit. TRANSPORTATION: This Family Child Care Home does not offer transportation services. SMOKE DETECTOR: During today’s visit the smoke detector was tested. INSPECTIONS: The last documented fire drill was conducted on 5/13/25. The last documented lockdown drill was conducted on 4/8/25. The last outdoor inspection was conducted on 5/18/25. The operator stated she completed the Clean Water for Carolina Kids on 6/23/25. Technical Assistance was provided today in the following areas: SMOKE DETECTOR REQUIREMENTS: Since a light was not visual on the smoke detector, the operator was asked to have someone to check and verify that the smoke detector is both electrically operated and battery-operated in accordance with NC Child Care Rule 10NCAC 09 .1728 © (3). CURRICULUM: The operator stated that she implemented the Creative Curriculum. The curriculum was not on site today. Current activity plans were posted. The operator stated that she had loaned her copy of Creative Curriculum (Spanish) to another FCCH provider. The operator stated that she would ask that the curriculum be returned to her. SUBSTITUTE CAREGIVERS: The operator stated that her sister and daughter had agreed to fill the role of substitute caregiver for doctor appointments. During today’s visit I reviewed the information that the operator had on file for the sister and daughter. I stated that the following information needed to be on file: Sister: • The sister needed to complete the training Recognizing and Responding to Child Maltreatment, since the training was last completed on 7/27/18. • According to the information on file the sister’s IT’S SIDS training expired on 10/26/24. I stated that the sister needed to complete an updated IT’S SIDS training before she could substitute when children under the age of one were present. Daughter: • According to the Criminal Record Check database, the daughter had current Criminal Record Check clearance. I explained that the daughter needed to have her Criminal Record Check clearance letter on file. • The daughter’s file showed the completion of 5 hours of health and safety training and the completion of Recognizing and Responding to Child Maltreatment on 7/27/18. The daughter will seek verification that all the health and safety training were completed in 2022. • The daughter was aware that her IT’S SIDS training expired on 10/26/24. I stated that the sister needed to complete an updated IT’S SIDS training before she could substitute when children under the age of one were present. NC CLEAN WATER AND CLEAN CLASSROOMS FOR KIDS: The operator stated that she was confused and did not realize that there were two different projects that shared the same web site. I explained the process for completing Clean Classroom for Carolina Kids again today. www.cleanwaterforcarolinakids.org. RATED LICENSE: This Family Child Care Home had completed the FCCERS prep year assessment on 4/29/24 with a score of 5.5. The operator wanted to use the scores. SUBSTITUTE CAREGIVERS: The operator stated that her sister and daughter had agreed to fill the role of substitute caregiver for doctor appointments. During today’s visit I reviewed the information that the operator had on file for the sister and daughter. I stated that the following information needed to be on file: Sister: • The sister needed to complete the training Recognizing and Responding to Child Maltreatment, since the training was last completed on 7/27/18. • According to the information on file the sister’s IT’S SIDS training expired on 10/26/24. I stated that the sister needed to complete an updated IT’S SIDS training before she could substitute when children under the age of one were present. Daughter: • According to the Criminal Record Check database, the daughter had current Criminal Record Check clearance. I explained that the daughter needed to have her Criminal Record Check clearance letter on file. • The daughter’s file showed the completion of 5 hours of health and safety training and the completion of Recognizing and Responding to Child Maltreatment on 7/27/18. The daughter will seek verification that all the health and safety training were completed in 2022. • The daughter was aware that her IT’S SIDS training expired on 10/26/24. I stated that the sister needed to complete an updated IT’S SIDS training before she could substitute when children under the age of one were present. NC CLEAN WATER AND CLEAN CLASSROOMS FOR KIDS: The operator stated that she was confused and did not realize that there were two different projects that shared the same web site. A checklist was used to note the requirements I monitored today. Upon arrival, I was greeted by Mrs. Lucy Rodriguez, family childcare home provider. Upon arrival the children were playing on the playground; several children were filling water pumps with water and spraying it onto the grass. There were several riding toys and sand box. Plenty of shade was provided by the trees in the back yard. The program currently operates with a 5 Star License, issued on August 31, 2020, earning 7 points in program standard, 5 points in staff education component, and 1 quality point through business training. The program offers daytime for 1st and 2nd shift. INSPECTION/SAFTEY DRILL STATUS: The last documented shelter-in-place or lockdown was conducted on 3/22/23. The last outdoor play area inspection was completed on 6/17/23. The last fire drill was conducted on 7/14/23. The last annual compliance visit was conducted on 8/3/22. The program is privately owned so I did not conduct a search of the NC Secretary of State website. All applicable child care requirements were assessed during today’s visit. The program does not provide transportation, no infants are enrolled at this time, so these requirements were not assessed. INDOOR ENVIRONMENT: The provider cares for children on the main floor. In the children space’s there are a variety of materials for the children to explore throughout the day. The bathroom is accessible to the children that are potty trained, a changing pad is available to those in diapers. The children eat their meals in the childcare space. Lunch consisted of Broccoli and cheese soup, saltine crackers, potatoes, cantaloupe, and milk. Violations were observed and documented during today's visit. Violation Number Comment Rule 811 Baby food, snack items, and meal items sent from home, for each individual child, were not dated and labeled with the child's name. A child's food from home was not labeled with name and date. .1706(o) 1405 Authorization for up to 12 months to apply over-the-counter medications, topical ointment, topical teething ointment or gel, insect repellents, fluoridated toothpaste, lotions, creams, and powders; such as sunscreen, diapering creams, baby lotion, and baby powder, to a child, when needed, was not in writing and did not contain information required by rule .1720(b)(7). Toys need to be clean and safe to play on; have your maintenance person to pressure wash them. RATED LICENSE TIMELINE The provider stated that she has watch several videos from the NCRLAP website.
