Upon arrival, I was greeted by the director, Dalphia Murphy, who had to leave for an appointment shortly afterward. I walked unaccompanied through the center. LICENSE STATUS The center currently operates with a Five Star License issued on April 9, 2026. The center achieved its license through Pathway #3 (Early Head Start). Prior to today’s visit, I reviewed the NC Secretary of State’s website and noted that the owner of this facility, Randy’s Five Star Academy, is listed as current/active. INSPECTIONS/DRILLS STATUS -The last sanitation inspection was completed on 1/6/26, and the center scored a superior rating with four demerits. -The last documented outdoor play area inspection was completed on 4/10/26. -The last documented fire drill was conducted on 4/22/26. -The last documented lockdown/shelter-in-place drill was conducted on 4/8/26. -The last annual compliance visit was conducted on 10/14/25. MONITORING I completed a walk-through of the center, visiting eight classrooms as well as the outdoor learning environment and restrooms. The center serves children in Early Head Start, Durham Pre-K, and NC Pre-K programs. Toddlers were observed playing in the outdoor learning environment and eating lunch. Preschoolers were observed painting, playing in centers with teachers, playing on the playground, washing their hands, and eating lunch. The outdoor space consists of a natural play area and a preschool playground, both of which are fenced. The natural play area contains a bike path with riding toys, areas for sand and water play, garden beds, and a covered area set up for dramatic play with a play kitchen and outdoor furniture. The preschool playground contains stationary climbing equipment. A partial assessment of child care requirements was conducted. I monitored all applicable requirements, including but not limited to supervision, staff-child ratios, health and safety requirements, equipment and furnishings, and program records. Staff records for three newly hired staff members also were reviewed. This program does not provide transportation; therefore, this requirement was not monitored. I reviewed the storage of medication as well as medication permission forms, and a violation was cited. No children under one year of age are enrolled; therefore, safe sleep requirements were not monitored. VIOLATIONS The following violations were observed and documented during today’s visit: Violation Number Comment Rule 847 Parent's medication authorization did not include required information. One medication was missing an authorization form and two other medications did have all the required information on the permission formss. 10A NCAC 09 .0803(4)(6-9) In order to comply with the NC Laws and Rules, any violations documented today must be corrected immediately. I need to receive your compliance letter by May 7, 2026. The letter must address each violation and explain how it has been corrected. Please send this to mandy.annunziata@dhhs.nc.gov and include the following information: -Facility name -Facility ID number -Each item number COMPLIANCE HISTORY Prior to today’s visit, the center’s compliance history score was 90%. According to NC General Statute 110-90(4)(d), all facilities must maintain a compliance history of at least 75% for the past 18 months. Failure to maintain compliance may result in an administrative action. The center was not in compliance with all applicable minimum licensing requirements during today’s visit and violations were documented that could impact the center’s overall compliance history score. An updated compliance history score will be generated after today’s visit, and you will be informed of the results during the next visit to your center. TECHNICAL ASSISTANCE -Medication administration forms should be current for all medications, including diaper cream. Today, three children in a toddler classroom had diaper creams that were either missing medication forms or all required information was not included on the permission forms. Please be sure there is a medication permission form on file for each medication, and be sure that the form contains all required information, including the name of the cream, the cream’s expiration date, the authorization dates for administration, the specific amount of cream to apply (for example, “dime-sized,”), the date the authorization was signed, and the parent signature. I suggest that parents submit all medications and authorization forms to the director for verification; then, the director can give them to the classroom teachers. CONSULTATION -You can access and update your EPR plan by using your NCID to log into the North Carolina Risk Management Portal at https://rmp.nc.gov/portal/portal.aspx. Please review and update your EPR plan yearly. -Criminal Backgrounds Checks for all staff members should be completed every five years. Also, child care providers must obtain access to the ABCMS Provider Portal in order to meet the requirement to report new employees within five days of hire. The Division no longer recognizes or accepts Change of Information forms. You said that you agree to follow this requirement, and you submitted a ratio form indication that you follow 1:4 for infants, 1:4 for toddlers, 1:4 for two-year-olds, 1:9 for three-year-olds, and 1:10 for four-year-olds. TRAINING REMINDERS -Health and safety training must be renewed every five years and can be accessed through Moodle. This includes “Recognizing and Responding to Suspicions of Child Maltreatment,” which can be found on the Positive Childhood Alliance NC website: https://preventchildabusenc.org/online-trainings/ New teachers must complete this training within one year of hire. -CPR and First Aid certification is valid for two years. New staff must complete this training within 90 days of hire. ITS-SIDS training is valid for three years and is required for all administrators and all staff working in infant classrooms. New staff should complete this training within two months of hire. RATED LICENSE STATUS The center was reassessed on April 9, 2026, using Pathway #3 (Accreditation and Head Start), and you are awaiting your new Five Star License. Upon arrival, I was greeted by the director, Dalphia Murphy, who assisted me during today’s visit. LICENSE STATUS The center currently operates with a Five Star License issued on October 1, 2024. The program received six points for Staff Education, six points for Program Standards, and one Quality Point. The center is licensed to serve 100 children on first shift. Prior to today’s visit, I reviewed the NC Secretary of State’s website and noted that the owner of this facility, Randy’s Five Star Academy, Inc., is listed as current/active. INSPECTIONS/DRILLS STATUS -The last sanitation inspection was completed on 7/15/25, and the center scored a superior rating with four demerits. -The last fire inspection was completed on 3/19/25. -The last documented outdoor play area inspection was completed on 10/10/25. -The last documented fire drill was conducted on 10/13/25. -The last documented lockdown/shelter-in-place drill was conducted on 9/10/25. -The last annual compliance visit was conducted on 10/22/24. MONITORING I completed a walk-through of the center, visiting eight classrooms as well as the outdoor learning environment. The toddlers were observed playing on the playground and transitioning inside. Preschoolers were observed playing with duplo blocks, engaging in pretend play in the home living center, playing on the playground, and eating lunch. Lunch today was spaghetti, green beans, strawberries, and milk. A full assessment of child care requirements was conducted. I used a checklist to monitor all applicable requirements, including but not limited to supervision, staff-child ratios, health and safety requirements, equipment and furnishings, and program records. Six staff and five children’s files were reviewed. This program does not provide transportation; therefore, this requirement was not monitored. No children require medications or have medical care plans; therefore, this requirement was not monitored. No children under one year of age are enrolled, thus, safe sleep requirements were not monitored. VIOLATIONS The following violations were observed and documented during today’s visit: Violation Number Comment Rule 1032 Child care providers and uncompensated providers who are not substitute providers or volunteers, including the director did not have a medical report on file prior to employment that was signed by a health care professional and/ or the medical report was older than 12 months. One staff member had a medical statement on file which was more than 12 months old, and six staff members submitted medical reports after their first day of employment. 10A NCAC 09 .0701(a) 1033 On or before the first day of work, all staff, including the director and individuals who volunteer more than once per week did not provide results indicating that they were free of active TB and/or TB test or screening was older than 12 months. Five staff members submitted TB tests after their first day of employment. .0701(a) 1874 The Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy was not reviewed with new staff prior to providing care with children and/or a signed acknowledgement with all the required information was not maintained in the staff person's file. Three staff members did not review and sign the shaken baby policy until after their first day of employment. .0608(d)(1-4) In order to comply with the NC Laws and Rules, any violations documented today must be corrected immediately. I need to receive your compliance letter by October 28, 2025. The letter must address each violation and explain specifically when and how it was corrected, as well as how you will prevent the same violations from happening in the future. According to NC General Statute 110-90(4)(d), all facilities must maintain a compliance history of at least 75% for the past 18 months. The center was not in compliance with all applicable minimum licensing requirements during today’s visit and violations were documented that could impact the center’s overall compliance history score. An updated compliance history score will be generated after today’s visit, and you will be informed of the results during the next visit to your center. TECHNICAL ASSISTANCE -When new staff are hired, they are required to submit a medical report and Tb test that were completed no more than 12 months prior to the first day of employment, and that information must be on file prior to working with children. Several staff members submitted medical documentation after their first day of work (D.B., P.F., G.M.,E.A.,S.H., Y. N. and P.G.). You stated that you are aware of the rule, but you needed to hire several staff quickly when teachers quit, so you had to have them start working in classrooms immediately. Moving forward, please be sure staff members do not begin work in classrooms until the medical report and Tb test are on file and are no more than 12 months old. You may have to temporarily close a classroom or find a qualified sub while you wait for teachers to submit required paperwork. -Staff members must review and sign the “Shaken Baby Head Trauma Policy” before beginning work with young children. It is important for program staff to have training and understand the vulnerabilities of children to help prevent injuries and properly handle infants. Three staff members (G.S., S.H., and Y.N) did not complete this document until after beginning work. Moving forward, please have new staff review and sign this document prior to beginning their work with children. CONSULTATION -We reviewed QRIS information and completed a form stating that you will pursue Pathway #2, Curriculum and Instructional Quality, with a targeted license transition date of April 2026. -Per sanitation inspectors, centers must discontinue the use of baby gates to make kitchens inaccessible to children. If found at an inspection, the center will be placed into provisional status (which will be longer than 7 days since it will be a construction issue), and it will remain in that status until they have addressed the issue. -The Clean Classrooms for Carolina Kids Program provides free facility-wide testing for lead in water and inspections for asbestos and lead-based paint hazards without any out-of-pocket costs. You are required to test for lead in your water every three years. -You can access and update your EPR plan by using your NCID to log into the North Carolina Risk Management Portal at https://rmp.nc.gov/portal/portal.aspx. Please review and update your EPR plan yearly. -Criminal Backgrounds Checks for all staff members should be completed every five years. One staff member’s (P.G.) qualification letter will expire on 12/30/25, and another (Y.M) on 1/27/26. I recommend that they both start the renewal process now. TRAINING REMINDERS -Training from 10/22/24 to 10/13/25 was reviewed today and results can be found on the attached Staff/Training Worksheet. All required staff ongoing training hours for the current year should be completed by 10/22/25. -CPR and First Aid must be renewed every two years. Several staff members are due for CPR and First Aid renewal by 12/9/25. New staff members must complete training within 90 days of hire. -Health and Safety Training must be renewed every five years. You can find this training in Moodle on the DCDEE website. New staff members must complete training within one year of hire. -“Recognizing and Responding to Suspicions of Child Maltreatment” (part of the Health and Safety Training) should be completed within 90 days of hire and renewed every five years. This training can be found on the Positive Child Alliance NC website: https://preventchildabusenc.org/online-trainings/. Two staff members (D.T. and P.G.) are due to renew now. -ITS-SIDS training must be renewed every three years. New staff members working with infants must complete training within two months of hire, and must not be left alone with infants during that time period. RATED LICENSE STATUS The NC State Legislature has extended “hold harmless” status until new rated licensing guidelines are in place, and you may opt to keep your current license and delay your rated license assessment until the new guidelines are adopted. Please use this time to update your WORKS account with your staff members’ education information. You can visit the North Carolina Rated License Project website (https://www.ncrlap.org) for resources regarding the rated license assessment process. AGENCY UPDATES Please check the Division of Child Development and Early Education’s website frequently for any new policies or rules. Upon arrival, I was greeted by Dalphia Murphy, director, who assisted me during today’s visit. We discussed the nature of the visit, and I conducted a general walk-through of the center. The center has 51 children enrolled, and 40 were present today, ranging in age from one to five years old. The center currently operates with a Five Star license issued on October 1, 2024. The program received six points for Program Standards, six points for Staff Education, and one Quality Point. It is licensed to serve 100 children on first shift. MONITORING Today I conducted a partial assessment of child care requirements including supervision, staff-child ratios, health and safety requirements, equipment and furnishings, and program records. Toddlers were observed working on an art activity with their teacher and playing outside. Preschoolers were observed participating in circle time and playing on the playground. During my last visit on 5/22/25, I observed both Pre-K classrooms during rest time and interviewed all four Pre-K teachers regarding rest time practices. The lead teacher in the first classroom stated that she does not believe in taking things away (including playground time) as punishment for misbehavior during rest time. A teacher in the second classroom stated that if the whole class is disruptive during nap time, they may lose afternoon outside recess. Individual children who continue to be disruptive may lose five minutes of afternoon playground time. Children who misbehaved during rest time also were made to stand with their arms raised above their heads for a period of approximately five minutes. I asked all Pre-K teachers if they had concerns about staff not following the discipline policy or not speaking to children in a caring or nurturing manner. None of them expressed any concerns. At that time, the director was on vacation and unavailable for an interview. One violation for using inappropriate discipline practices was cited. Today, I discussed rest time procedures with the director and reviewed the nap and discipline policies in the center’s handbook. I also reviewed the playground schedule for both Pre-K classes and noted that each class has a designated 45-minute playground time before lunch. No outdoor time is scheduled after lunch, although the teachers and director stated that they sometimes take children outside for a short period after lunch if they have time. I reminded the director that child care rules require all children 2-12 years old in care five or more hours per day to have at least 60 minutes of outdoor playtime per day, weather permitting. In addition, I asked about the director’s observations of staff interactions with children. I discussed the discipline violation cited during my last visit and asked the director how she planned to address this issue moving forward. The director said she had not witnessed inappropriate discipline or interactions herself, but she had spoken to the Pre-K teachers who were involved in the complaint and had given one teacher a written warning for not following the school’s discipline policy. She is requiring that teacher to take classes on behavior management through Moodle, and she had a meeting with all staff to review the discipline policy. After our conversation today, she is planning to have both Pre-K teachers sign up for Conscious Discipline training. VIOLATIONS The following violation was observed and documented during today’s visit: Violation Number Comment Rule 410 Each child did not have an opportunity to be outdoors daily, if weather conditions permitted. Teachers in one Pre-K class reported that they sometimes withheld afternoon outdoor playtime as punishment for misbehavior during rest time, which would not allow the class to meet the required 60 minutes of daily outdoor playtime. GS 110-91(2);.0508(c) In order to comply with the NC Laws and Rules, any violations documented today must be corrected immediately. I need to receive your compliance letter by June 19, 2025. The letter must address each violation and explain specifically when and how it was corrected, as well as how you will prevent the same violations from happening in the future. According to NC General Statute 110-90(4)(d), all facilities must maintain a compliance history of at least 75% for the past 18 months. The center was not in compliance with all applicable minimum licensing requirements during today’s visit and violations were documented that could impact the center’s overall compliance history score. An updated compliance history score will be generated after today’s visit, and you will be informed of the results during the next visit to your center. RESOLUTION Based on staff members admitting that children were asked to stand with their hands raised above their heads during nap time in response to misbehavior, a review of the nap and discipline policies, and classroom observations, I determined that violations related to discipline had occurred; therefore, those allegations are substantiated. Based on interviews with the staff and director, as well as observations made during the investigation, I was unable to determine whether violations related to staff interactions had occurred; therefore, those allegations are unsubstantiated. Because one allegation has been substantiated, you are at risk of an administrative action. TECHNICAL ASSISTANCE -Outdoor play is important for children’s overall development. Exposure to nature boosts children’s mood and emotional health, children develop important gross motor skills as they run and climb, and there are opportunities to practice social skills when engaging with other children during child-directed free play. In addition, outdoor play provides an appropriate outlet for children to burn off excess energy, which may lead to improved behavior indoors. The Pre-K teachers in one classroom confirmed that afternoon outdoor time is sometimes withheld as a consequence for misbehavior during rest time. Child care rules require that preschool-aged children in full-day childcare participate in at least one hour of outdoor play per day, weather permitting. Your schedule indicates that morning playtime is 45 minutes; therefore, they must be given a minimum of 15 additional minutes of outdoor play during the day to meet the required 60 minutes. It is never appropriate to withhold outdoor play time as a punishment for classroom misbehavior or a refusal to nap. CONSULTATION -As noted in my previous visit summary, it is permissible for children to move about the classroom and play with quiet toys during the scheduled nap time with only one teacher monitoring the room. -I gave you two handouts today from “Caring for Our Children” regarding discipline practices. One referenced methods of positive behavior support and the other outlined prohibited staff behaviors. Please share these with your staff. AGENCY UPDATES Please check the Division of Child Development and Early Education’s website frequently for any new policies or rules. MONITORING I completed a walk-through of the center, visiting five classrooms as well as the outdoor play areas The infant classroom was closed today because the teacher was out sick and there was no one available to sub. The toddlers were observed getting their diapers changed and transitioning to the playground. Preschoolers were observed playing on the playground. A full assessment of child care requirements was conducted. I used a checklist to monitor all applicable requirements, including but not limited to supervision, staff-child ratios, health and safety requirements, equipment and furnishings, and program records. Five staff and ten children’s files were reviewed. This program does not provide transportation; therefore, this requirement was not monitored. Several children require emergency medications; these were monitored and found in compliance. The center serves children under one year of age, thus, safe sleep requirements were monitored and found in compliance. VIOLATIONS The following violations were observed and documented during today’s visit: Violation Number Comment Rule 721 All equipment and furnishings were not in good repair. A piece of lattice had become detached from a storage structure on the toddler playground, exposing the sharp ends of the nails. Upon arrival, I was greeted by the director, Dalphia Murphy, who assisted me during today’s visit. LICENSE STATUS The center currently operates with a five star license issued on October 1, 2024. The program received six points for staff education, six points for program standards, and one quality point for having a staff benefits package and infrastructure for parental involvement. It is licensed to serve 100 children on first shift. Prior to today’s visit, I reviewed the NC Secretary of State’s website and noted that the owner of this facility, Randy’s Five Star Academy, Inc., is listed as current/active. INSPECTIONS/DRILLS STATUS -The last sanitation inspection was completed on 8/27/24, and the center scored a superior rating with six demerits. -The last fire inspection was completed on 2/10/23. -The last documented outdoor play area inspection was completed on 9/30/24. -The last documented fire drill was conducted on 9/30/24. -The last documented lockdown/shelter-in-place drill was conducted on 9/30/24. -The last annual compliance visit was conducted on 11/8/23. MONITORING I completed a walk-through of the center, visiting five classrooms as well as the outdoor play areas The infant classroom was closed today because the teacher was out sick and there was no one available to sub. The toddlers were observed getting their diapers changed and transitioning to the playground. Preschoolers were observed playing on the playground. A full assessment of child care requirements was conducted. I used a checklist to monitor all applicable requirements, including but not limited to supervision, staff-child ratios, health and safety requirements, equipment and furnishings, and program records. Five staff and ten children’s files were reviewed. This program does not provide transportation; therefore, this requirement was not monitored. Several children require emergency medications; these were monitored and found in compliance. The center serves children under one year of age, thus, safe sleep requirements were monitored and found in compliance. A checklist was used to note the requirements monitored today. Upon arrival I was greeted by the cook, G. Stanton. The director, Dalphia Murphy, was not present for today’s visit. Mrs. Midgette assisted me with today’s visit. There was a total of 40 children present, aging in range from infant to five years old. The children were observed playing in centers and with materials, participating in circle time, playing outside, completing routine tasks, and transitioning into lunch time. LICENSE STATUS The center currently operates with a Five-star license issued on January 1, 2021, earning six (6) points in Staff Education, seven (7) points in Program Standards and one (1) Quality point. MONITORING During today’s visit, a full assessment was conducted monitoring all spaces occupied by the children, including the outdoor play environment. All staff and a selection of children’s files were reviewed. All spaces were monitored for supervision, staff/child ratios, materials, equipment and required postings. The program records were reviewed for current inspections. INSERVICE TRAINING I reviewed staff training for the period of November 16, 2022, through November 7, 2023. Details can be found on the attached Staff-Training Worksheets. --PROGRAM RECORDS * The last annual compliance visit was completed on 11/15/22. * The last sanitation was conducted on 8/17/23. This facility received 7 demerits and a “Superior” classification. *The last documented fire drill was conducted 10/31/23. *The last fire inspection was conducted 2/10/23. *The last documented shelter-in-place or lockdown drill was conducted 6/28/23. *The last documented playground inspection was conducted 11/3/23. Prior to today’s visit I reviewed the NC Secretary of State’s website and observed that the current status of Randy’s Five Star Academy, Inc. is listed as current/active. The following violations were observed and documented during today’s visit: Violation Number Comment Rule 544 Screen time was offered to children under three years of age. Children two years and younger were having screen time during today's visit. .0510(f) 844 Prescribed medicine was not in original labeled container or accompanied by signed and dated written instructions from prescribing physician or health care professional. Albuterol was not in it's original container. .0803(2)(a) 1043 All staff records, except financial records, were not made available for review. The new staff members medical reports and TB were not made available. G.S. 110-91( 9) 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file. A staff member First Aid expired on 2/22/23, and another staff member First Aid had an expiration date of 6/17/23. .1102(c) 1049 All staff did not successfully complete certification in CPR training appropriate to the age of the children in care. Verification of staff completion of the CPR course from an approved training organization was not in the staff file. A staff member CPR expired on 2/22/23, and another staff member CPR had an expiration date of 6/17/23. .1102(d) 1811 Shelter-in-place or lockdown drills were not practiced every three months and/or drill record was incomplete. The last shelter-in-place/lockdown was conducted on 6/28/23. .0604(u);.0302(d)(8) To comply with the NC Laws and Rules any violations cited today MUST be corrected immediately. A compliance letter must be received on or before November 22, 2023, letter must address each violation, explain how it has been corrected and how the violation will maintain compliance in the future. According to NC General Statue 110-90(4)(d) requires all child care facilities to maintain a compliance history score of at least 75% for the past eighteen months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action. TECHNICAL ASSISTANCE The following items were discussed during today’s visit to help you maintain quality within your program and to prevent further violations. QUARTERLY EMERGENCY DRILL I would recommend using a reminder in your outlook calendar or desktop to ensure that you complete the emergency drill every three (3) months. SCREEN TIME I would suggest discussing with the staff during your next staff meeting the appropriate age that children are able to have screen time. I would also recommend reviewing the screen time log form with all staff. STAFF FILE Medical reports, proof of tuberculosis test and other health information must be kept separate from the individual personnel file. I would suggest coming up with a filing system to separate the medical from the personnel file. The medical and personnel file must be available for review. MEDICATION I would recommend medication be checked using a check off system to make sure that it is in its original container before sending to the classrooms. CPR/FA I would recommend using a reminder in your outlook calendar to remind you of staff members CPR/FA expiration dates. CONSULTATION AND REMINDERS The following items were discussed during today’s visit to improve the quality of your program. RATED LICENSE STATUS On Monday June 12, 2023, the hold harmless legislation was extended and signed into law. All facilities are allowed to remain at their current star level without reassessment until June 30, 2024. Your facility has been determined to be in Cohort 2. Your reassessment year will be between July 1, 2025, and June 30, 2026. I will reach out to you prior to the beginning of your preparation year. Please use this time to make sure all your staff have a WORKS account with all education information updated. Also review updated resources on the North Carolina Rated License Project (NCRLAP) website (www.ncrlap.org). HEALTH AND SAFETY TRAINING Health and Safety trainings are now available through Moodle on the DCDEE website. These trainings are provided free of charge. You should use your NCID username and password to access the Moodle portal. The Health and Safety trainings must be renewed at least every five (5) years. If you completed the trainings in 2017, you should begin to retake the training now. CRIMINAL BACKGROUND As of July 11, 2022, criminal record checks are now to be renewed every five (5) years instead of three (3) years. Please make arrangements to complete your 5-year re-qualification before the expiration date. AGENCY UPDATES Please remember to check the Division of Child Development and Early Education website (ncchildcare.gov) on a weekly basis to stay up to date on all new policies and rules.
