Lillie Whetzel the Director, was present and assisted me during the visit. There were twelve (24) staff, and one hundred forty-one (141) children present on the visit today. Children throughout the facility were participating in circle time, center activities, outside play, soccer shots and personal routines. Limited monitoring of child care requirements was conducted during the visit. Supervision of children, staff/child ratios, nurture/care of children, use of adequate/approved space and permit restrictions were monitored. The License and emergency care plan were posted. During today’s visit, I discussed the self-report with Ms. Whetzel, the Director. FINDINGS The Director discussed the incident with me. It was shared that the three-year-old child was dropped off in the PS2 classroom on 6/16/26. The child upon drop off went to the bathroom while the teachers in the classroom transitioned to the playground. The child was left in the bathroom unsupervised for an undetermined amount of time. The teachers did not complete and follow the policy and procedures for transitions and supervision. The Director discussed with me that the teachers were terminated that day. All staff were retrained on 6/17/2026 regarding name-to-face policy and procedures. The administrators ensure that the name to face is completed throughout the day by checking the Procare app in the office. I observed the roster and agenda for the staff meeting conducted on 6/17/2026. The following violation was documented during today’s visit. Violation Number Comment Rule 303 Children were not adequately supervised at all times. A three-year-old child was left unsupervised in PS2 on 6/16/26 for an undetermined amount of time. .1801(a)(1-5) To comply with the NC Laws and Rules any violations cited today MUST be corrected immediately. A compliance letter must be received on or before July 21, 2026, letter must address each violation, explain how it has been corrected and how the violation will maintain compliance in the future. Child care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. INVESTIGATION STATUS The investigation was completed during today’s visit. Based on my interview and documentation received it was determined that a lapse in supervision occurred. TECHNICAL ASSISTANCE Children in child care centers must be adequately supervised at all times, indoors and outdoors. Definition of Adequate Supervision Adequate supervision means staff must: 1. Be positioned to see and hear children at all times and respond immediately. 2. Actively interact with children while moving throughout the environment. 3. Know each child’s location and activity at all times. 4. Provide supervision appropriate to each child’s age, needs, abilities, and risk level. 5. See and hear children birth–5 years old while eating. Transition Supervision (Indoor ↔ Outdoor) Transitions are high-risk and require Active Supervision, including: • Name-to-face headcounts before leaving and upon arrival. • Staff stationed at doors and gates to prevent unsupervised movement. • Use of advance warnings (songs, bells, cues). • Assigning transition roles to children who need additional support. I also discussed with the Director to continue to check ProCare name to face in the office but also check periodically throughout the day in the classroom physically. You, Lillian Whetzel, Administrator assisted me with the visit. Currently, this Child Care Center operates with a five (5) star license issued January 6, 2022, earning seven (7) points in education, five (5) points in program standards and one (1) point. The NC Secretary of State website was reviewed on 2/6/26 and Cognitive Niche Inc. was listed as current- active. The license was posted, and the restrictions were in compliance. A walk-through of the facility was completed today; all indoor and outdoor areas were monitored. Children throughout the facility were participating in group time, free play in activity areas, transitions and personal care routines. Infants were engaged in tummy time, napping, and diapering routines. Sleep checks were completed, recorded, and maintained as required. The caregivers were interacting and meeting the developmental needs for each of the children. Files for new staff were reviewed as well as CPR/First Aid training, Criminal Background Checks and SIDS training for existing staff. Fire and sanitation inspections have not occurred since the last visit and remain current. Six violations were observed today. One was corrected during the visit, and the others must be corrected immediately. A checklist was used to note the requirements monitored today. Upon arrival I was greeted by Lillian Whetzel, the Director. You assisted us with today’s visit. There was a total of 145 children present, aging in range from infant to five years old. The children were observed playing in centers and with materials, participating in circle time, playing outside, eating lunch, and completing routine tasks. LICENSE STATUS Currently, this Child Care Center operates with a five (5) star license issued January 6, 2022, earning seven (7) points in education, five (5) points in program standards and one (1) quality point. I reviewed the NC Secretary of State’s website and observed the owner of the facility as Cognitive Niche, Inc., listed as current/active. INSPECTIONS *The last fire drill was conducted on 8/29/25. *The last emergency drill was conducted 6/9/25. *The last playground inspection was completed 8/22/25. *The last sanitation was completed on February 11,2025 with an ‘Approved’ classification. *The last fire inspection was conducted on 5/7/24. MONITORING During today’s visit, a full assessment was conducted, monitoring all space occupied by the children, including the outdoor play environment. New staff CPR/FA, qualification letters and newly enrolled children files were reviewed. All spaces were monitored for supervision, staff/child ratios, materials, equipment and required postings. The program records were reviewed for current inspections. Transportation is provided; therefore, these requirements were monitored and found in compliance. The following violations were observed and documented during today’s visit. Violation Number Comment Rule 106 Operator has not scheduled and obtained a fire inspection within 12 months of the previous inspection. Operator did not submit the original approved report to DCDEE within one week of the inspection visit on a form provided by the Division. The last documented fire inspection was conducted on 5/7/24. 10A NCAC 09 .0304(a) 533 Human milk, formula and other bottled beverages including sippy cups, sent from child's home were not fully prepared, dated, and labeled for the appropriate child. In space #1 two sets of bottles and two sippy cups was observed not have a current date. 15A NCAC 18A .2804(d) 609 Staff did not wash their hands thoroughly before beginning work, before/after handling food, before bottle feeding or serving to other children, after toileting or handling body fluids, after diaper changing and after handling soiled items. One staff member was observed completing feeding an infant and did not wash her hands after feeding. Another staff member was observed entering into the room to work and did not wash her hands upon entering. 15A NCAC 18A .2803(a) 841 Medications including prescription and non-prescription items were not stored in a locked cabinet or other locked container. In space #2, #3, and #4 diaper cream and sunscreen was observed stored in multiple children cubbies. The medications stored in the cubbies did not belong to the named children. 15A NCAC 18A .2820(d) 844 Prescribed medicine was not in original labeled container or accompanied by signed and dated written instructions from prescribing physician or health care professional. In space #1 a prescription cream was observed not in its original labeled container with a signed written instructions from a health care professional. .0803(2)(a) 849 Leftover medicines were not returned to the parent after the course of treatment was completed, after authorization was withdrawn or after authorization had expired and/or medication was not discarded within 72 hours of completion of treatment or withdrawal of authorization. In space #2 expired medication with a date of 7/2025 was observed. .0803(12) 1032 Child care providers and uncompensated providers who are not substitute providers or volunteers, including the director did not have a medical report on file prior to employment that was signed by a health care professional and/ or the medical report was older than 12 months. A staff member hired on 8/4/25 and 8/20/25 did not have a medical assessment on file. 10A NCAC 09 .0701(a) 1033 On or before the first day of work, all staff, including the director and individuals who volunteer more than once per week did not provide results indicating that they were free of active TB and/or TB test or screening was older than 12 months. A staff member hired on 8/20/25 did not have a TB test or screening on file. .0701(a) 1034 All staff, including the director, did not have an annual health questionnaire on file following the initial medical statement. The last documented annual health questionnaire for one staff member was on 7/19/24. .0701(a) 1902 The professional development plan was not reviewed annually. NON-PRESCRIPTION/PRESCRIPTION MEDICATION During today’s visit I observed non-prescription diaper cream and sunscreen with expired forms, expired diaper cream. The children were observed playing in centers and with materials, participating in circle time, playing outside, eating lunch, and completing routine tasks. LICENSE STATUS Currently, this Child Care Center operates with a five (5) star license issued January 6, 2022, earning seven (7) points in education, five (5) points in program standards and one (1) quality point. I reviewed the NC Secretary of State’s website and observed the owner of the facility as Cognitive Niche, Inc., listed as current/active. MONITORING During today’s visit, a full assessment was conducted, monitoring all space occupied by the children, including the outdoor play environment. New staff CPR/FA, qualification letters and newly enrolled children files were reviewed. All spaces were monitored for supervision, staff/child ratios, materials, equipment and required postings. The program records were reviewed for current inspections. Transportation is provided; therefore, these requirements were monitored and found in compliance.
