The purpose of today’s visit was to monitor applicable child care requirements during a Routine Unannounced visit. This center operates with a five-star license, which was issued on 2/5/24. The last Annual Compliance visit was conducted on 1/9/25. COMPLIANCE HISTORY: The compliance history for this center for the previous eighteen-month timeframe was 92%. During today’s visit all indoor and outdoor licensed space was monitored. OBSERVATIONS: I observed the children’s having music time with a music instructor in classroom space #4. I observed a teacher reading a book to the children while they waited during bathroom time. I observed the children enjoying the outdoor environment. CHILDREN’S RECORDS: Children’s records were not reviewed today. STAFF RECORDS: I reviewed the file today for the teacher, who had transferred to this KIN site in February 2025. TRANSPORTATION: This program does not offer transportation services. INSPECTIONS: The last documented annual fire inspection was completed on 1/14/25. The last documented sanitation inspection was conducted on 6/23/25. The last documented fire drill was conducted on 6/27/25. The last documented lockdown drill was conducted on 6/10/25. The last documented playground inspection was completed on 7/17/25. The last documented water testing for Clean Water for NC Kids was completed on 2/19/24. The center completed the lead/asbestos testing through Clean Classrooms for Carolina Kids on 2/5/24. The following violations were cited today: Violation Number Comment Rule 716 All stationary equipment, more than 18 inches high, was not installed over protective surfacing. Additional surfacing was needed in the fall zone for the stationary climber to meet the requirements. .0605(j) 1757 A valid qualification letter was not on file and available to review at the facility. During today's visit I verified in the Criminal Record Check database that the music instructor had CRC clearance, but his clearance letter could not be located. G.S. 110-90.2(b) & (d) & .2703(e) All violations must be corrected immediately. The director stated that a Parent Workday was scheduled for 8/9/25. She will have the surfacing delivered and spread on that day to correct violation #0716. I stated that I needed to receive the Corrective Action letter addressing the correction of both violations by 8/11/25. TECHNICAL ASSISTANCE was provided today in the following areas: RATED LICENSE: Please know that the “hold harmless” status for Rated License reassessment has been extended until the new QRIS guidelines are ready for implementation. The three pathways were reviewed briefly during today’s visit. The director had a copy of the ECERS-3 assessment book. The purpose of today’s unannounced visit was to monitor applicable child care requirements during the center’s Annual Compliance visit. This center operates with a five-star license, which was re-issued on 2/5/24. According to the North Carolina Secretary of State website, the status of Ninth Street KIN, Inc. is “current-active”. The last Annual Compliance visit was conducted on 1/23/24. COMPLIANCE HISTORY: The compliance history for this center for the previous eighteen-month timeframe was 94%. During today’s visit all indoor and outdoor licensed space was monitored. I observed the children engaged in free play activities and having circle time. Both classrooms had current activity plans posted. Morning snack consisted of biscuits, diced pineapple, and water. All the children bring their lunches from home, and the center provides morning and afternoon snack. All the children have an opted-out nutrition form on file. CHILDREN’S RECORDS: Eight children’s records were reviewed during today’s visit. STAFF RECORDS: The staff files were reviewed during today’s visit. Annual in-service training hour requirements were tallied for training completed since the 1/23/24 Annual Compliance visit. CURRICULUM: This center implements Explorations with Young Children through Bank Street. TRANSPORTATION: This center does not offer transportation services. INSPECTIONS: The last documented annual fire inspection was completed on 1/8/24. The last documented sanitation inspection was conducted on 12/16/24. The last documented fire drill was conducted on 12/11/24. The last documented lockdown drill was conducted on 12/12/24. The last documented playground inspection was completed on 1/6/25. The last documented water testing for Clean Water for NC Kids was completed on 2/19/24. The center completed the requirements for the Clean Classrooms for Carolina Kids program on 2/5/24. The following violations were cited today: Violation Number Comment Rule 106 Operator has not scheduled and obtained a fire inspection within 12 months of the previous inspection. Operator did not submit the original approved report to DCDEE within one week of the inspection visit on a form provided by the Division. The last fire inspection at this center was conducted on 1/8/24. 10A NCAC 09 .0304(a) 716 All stationary equipment, more than 18 inches high, was not installed over protective surfacing. Additional surfacing was needed at the exit point of the slide and at the base of the metal steps for the stationary climbing structure to meet licensing requirements. .0605(j) 1901 All administrators and staff did not complete a professional development plan within one year of employment, that included all the required information. The director did not have a current staff development plan. .1104(1-5) All violations must be corrected immediately. Please send me a signed Corrective Action letter by 1/23/25, stating how each violation has been corrected. TECHNICAL ASSISTANCE was provided today in the following areas: ANNUAL FIRE INSPECTION: The director stated that she did not realize that the annual fire inspection needed to be conducted within 365 days of the previous inspection. The director stated that Durham Fire Inspections was scheduled to come to this facility to conduct the yearly fire inspection on 1/14/25. SUBSIDY: The director stated that a subsidized would be enrolling in February. I encouraged the director to reach out to the DCDEE Subsidy Unit and NC Fast if she had questions about meeting their requirements. The purpose of today’s visit was to monitor applicable child care requirements during a Routine Unannounced visit. The last Annual Compliance visit was conducted on 9/5/23. This center operates with a five-star license, which was re-issued on 2/5/24 with 6 points in education, 7 points in programming, and 1 quality point. COMPLIANCE HISTORY: The compliance history for this center for the previous eighteen-month timeframe was 96%. All indoor and outdoor licensed space was monitored today. OBSERVATIONS: I observed the children engaged in a variety of indoor activities and having circle time. The children at this center bring their lunches from home each day. CHILDREN’S FILES: Children’s records were not reviewed today. STAFF FILES: The file was reviewed today for the staff, who began employment after the 1/23/24 Annual Compliance visit. I verified that all the staff had current Criminal Record Check clearance and CPR/First Aid training. TRANSPORTATION: This center does not offer transportation services. CURRICULUM: This center implements Explorations with Young Children through Bank Street. INSPECTIONS: The last documented annual fire inspection was completed on 1/8/24. The last documented sanitation inspection was conducted on 3/28/24. The last documented fire drill was conducted on 7/29/24. The last documented lockdown drill was conducted on 6/24/24. The last documented playground inspection was completed on 8/27/24. The requirements for CLEAN WATER FOR CAROLINA KIDS and CLEAN CLASSROOMS FOR CAROLINA KIDS had been completed at this center. The following violations were cited today: Violation Number Comment Rule 849 Leftover medicines were not returned to the parent after the course of treatment was completed, after authorization was withdrawn or after authorization had expired and/or medication was not discarded within 72 hours of completion of treatment or withdrawal of authorization. There were three containers of medication in the medicine box for children that were no longer attending the center. .0803(12) 1756 Enhanced staff/child ratios and group sizes were not met. When visiting classroom space #3/4, there were 12 children (ages 3 and 4) with one teacher. The second teacher entered the classroom a couple of minutes later. Upon returning from outside, I observed the second teacher in classroom space #3/4 in the kitchen, removing dishes from the dishwasher. This center follows the reduced staff/child ratios in conjunction with having achieved seven points in programming as reflected on their license. 10A NCAC 09 .2818 1890 Each staff member did not have the required medical report, proof of tuberculosis test or screening and/or completed health questionnaire in a medical file, maintained separately from the staff member's individual personnel file. The medical assessment and negative TB test for the staff person, who began employment on 8/12/24, were dated 5/9/23 and 5/12/23. .0701(d) All violations must be corrected immediately. Please send me a signed Corrective Action letter by 9/12/24, stating how each violation has been corrected. Since a violation of staff/child ratios was cited today, a return visit will be conducted to monitor staff/child ratios. TECHNICAL ASSISTANCE was provided today in the following areas: STAFF/CHILD RATIOS: I asked the director to talk with the new staff person, who began enrollment on 8/24/24, in greater depth during her new staff orientation time, explaining staff/child ratios. OUTDOOR ENVIRONMENT: I discussed the importance of raking the surfacing in the fall zone for the climber often to maintain an adequate depth of surface at the exit point of the slide on the structure. IN-SERVICE TRAINING: Since in-service training requirements were not tallied during the 1/23/24 Annual Compliance visit, Technical Assistance was provided upon request on tallying in-service training hours in preparation for the 2025 Annual Compliance visit. FIVE-STAR LICENSE: During today’s visit the center had the staff/child ratio charts posted in each classroom. The forms were correctly marked, reflecting that the center was following the highest voluntary enhanced (reduced) staff/child ratios. I stated that this should be reflected on the child care license. I stated that I would have the license re-issued to include the statement. The director stated that she had observed that the statement regarding reduced staff/child ratios was not listed on the new license. Upon arrival I was greeted by Emily Smith, the Director. I completed a general walk-through of the center. At the time of the visit, there were a total of fourteen (14) children present, ranging in age from two (2) to four (4) years old. The children were observed completing routine tasks, playing in centers, and interacting with the teachers. LICENSE STATUS The center currently operates with a Provisional license issued on August 17, 2023. INSPECTIONS *The last fire drill was conducted 12/13/23. *The last emergency drill was conducted 12/14/23. *The last playground inspection was completed 1/4/24. *The last sanitation was completed on 4/14/23 with a ‘Superior’ classification. *The last fire inspection was conducted 1/8/24. MONITORING During today’s visit, a full assessment was conducted monitoring all spaces occupied by the children, including the outdoor play environment. All staff and a selection of children’s files were reviewed. All spaces were monitored for supervision, staff/child ratios, materials, equipment and required postings. The program records were reviewed for current inspections. The following violations were observed and documented during today’s visit. Violation Number Comment Rule 812 Electrical outlets and power strips, not in use, which were located in space used by children did not have safety outlets or were not covered with safety plugs unless located behind furniture or equipment that cannot be moved by a child. Two electrical outlets in the Garden class did not have safety plugs. 10A NCAC 09 .0604(c) 1867 The depth of the loose surfacing was not based on critical height of the equipment. The depth of the loose surfacing did not meet the surfacing requirements of six (6) inches around the slide equipment. .0605(k)(1-4) To comply with the NC Laws and Rules any violations cited today MUST be corrected immediately. A compliance letter must be received on or before February 6, 2024, letter must address each violation, explain how it has been corrected and how the violation will maintain compliance in the future. According to NC General Statue 110-90(4)(d) requires all child care facilities to maintain a compliance history score of at least 75% for the past eighteen months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action. TECHNICAL ASSISTANCE During today’s visit, the information below was shared with you to maintain quality within your program and to prevent further violations. PLAYGROUND SURFACING The depth of the loose surfacing did not meet the surfacing requirements of six (6) inches. The administrator stated that mulch is typically delivered every three to four months. She also stated that the next delivery is scheduled for February 3, 2024. CONSULTATION AND REMINDERS The following items were discussed during today’s visit to improve the quality of your program. CPR/FA Please keep in mind that K. Blalock CPR/FA will expire 2/2024. EMERGENCY PREPAREDNESS RESPONSE PLAN Please remember to update your EPR plan by 1/24/24 with your current Child Care Consultant and Health Consultant. RATED LICENSE STATUS On Monday June 12, 2023, the hold harmless legislation was extended and signed into law. All facilities are allowed to remain at their current star level without reassessment until June 30, 2024. Your facility has been determined to be in Cohort 3. Your reassessment year will be between July 1, 2026, and June 30, 2027. Please use this time to make sure all your staff have a WORKS account with all education information updated. Also review updated resources on the North Carolina Rated License Project (NCRLAP) website (www.ncrlap.org). HEALTH CONSULTANT Ellie Morrise is the new Child Care Health Consultant. HEALTH AND SAFETY TRAINING Health and Safety trainings are now available through Moodle on the DCDEE website. These trainings are provided free of charge. You should use your NCID username and password to access the Moodle portal. The Health and Safety trainings must be renewed at least every five (5) years. If you completed the trainings in 2018, you should begin to retake the training now. CRIMINAL BACKGROUND As of July 11, 2022, criminal record checks are now to be renewed every five (5) years instead of three (3) years. Please make arrangements to complete your 5-year re-qualification before the expiration date.
