Upon arrival, I was greeted by the director, Karyn Stith-Wilkerson, who walked me through the center. LICENSE STATUS The center currently operates with a Five Star License issued on December 5, 2022. The program received six points for Program Standards, seven points for Staff Education, and one quality point. Prior to today’s visit, I reviewed the NC Secretary of State’s website and noted that the owner of this facility, Davlor Enterprise, LLC, is listed as current/active. INSPECTIONS/DRILLS STATUS -The last sanitation inspection was completed on 11/12/24, and the center received a superior rating with two demerits. -The last fire inspection was completed on 9/10/24. -The last documented outdoor play area inspection was completed on 2/17/25. -The last documented fire drill was conducted on 2/18/25. -The last documented lockdown/shelter-in-place drill was conducted on 12/20/24. -The last annual compliance visit was conducted on 9/19/24. MONITORING I completed a walk-through of the center, visiting two classrooms as well as the outdoor play area, kitchen, and bathrooms. The Pre-K students were in circle time listening to their teacher read a Dr. Seuss book. The class for two year old, three year old children and four year old children was playing on the fenced playground in the rear of the building. Both classes were celebrating Dr. Seuss week with Wacky Tacky dress up day. A partial assessment of child care requirements was conducted. I monitored all applicable requirements, including but not limited to supervision, staff-child ratios, health and safety requirements, equipment and furnishings, and program records. A file for a newly hired staff member also was reviewed. VIOLATIONS The following violations were observed and documented during today’s visit: Violation Number Comment Rule 318 Children between 12 and 24 months of age were grouped with children 3 years of age or older. A child 18 months of age was enrolled in a classroom of children ages two years through four years of age. 10A NCAC 09 .0713(a)(6) 843 A drug or medicine was administered after its expiration date. A child's epi-pen expired in November 2024. 10A NCAC 09 .0803(1)(d) 1044 Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of five years for the date of issuance). One staff member's qualification letter expired on 1/14/25. G.S. 110-90.2(b) & .2703(n)&(o) In order to comply with the NC Laws and Rules, any violations documented today must be corrected immediately. I need to receive your compliance letter by April 2, 2024. The letter must address each violation and explain how it has been corrected. According to NC General Statute 110-90(4)(d), all facilities must maintain a compliance history of at least 75% for the past 18 months. Failure to maintain compliance may result in an administrative action. The center was not in compliance with all applicable minimum licensing requirements during today’s visit and violations were documented that could impact the center’s overall compliance history score. An updated compliance history score will be generated after today’s visit, and you will be informed of the results during the next visit to your center. TECHNICAL ASSISTANCE -Criminal Backgrounds Checks for all staff members should be completed every five years. One staff member’s qualifying letter expired 1/14/25 and must be renewed immediately. They have 15 days to obtain a new qualifying letter; after that, they will not be able to work in your center until they have received their new qualifying letter. Today, a child in the Pre-K class had an epi-pen that expired in November 2024. You stated that you had informed the parent about the expired medication and that the parent had scheduled a doctor’s appointment for tomorrow to obtain a prescription for a replacement epi-pen. Child care rules state that all expired medication should be returned to the parent (or discarded after 72 hours if the parent fails to retrieve it). I suggest conducting a periodic review of children’s medications to ensure that required paperwork and medications are up-to-date. -Child Care Rules state that children between the ages of 12 and 24 months may not be grouped with children three years of age or older. Today I observed a child, aged 18 months, enrolled in a class containing children who were two, three, and four years of age. You stated that you were not aware of this rule when you allowed the child to join the class. The child must be disenrolled from the class immediately and may be allowed to rejoin after she turns two years old. CONSULTATION -The Clean Classrooms for Carolina Kids Program provides free facility-wide testing for lead in water and inspections for asbestos and lead-based paint hazards without any out-of-pocket costs. Upon arrival at the facility, I was greeted by the cook, Betulia Argueta. The Director, Karyn Wilkerson, arrived shortly after my arrival to the center. LICENSE STATUS The facility is in Hold-Harmless status for a 3-year Rated License. The program is operating with a 5-star license issued on 12/5/22. The program received 6 points in Program Standards, 7 points in Staff Education and 1 Quality point for having a Staff Benefit Package and an Infrastructure of Parent Involvement. INSPECTIONS The last sanitation inspection was conducted on 5/8/24. The last fire inspection was conducted on 9/10/24. The last fire drill was conducted on 8/27/24. The last emergency drill was conducted on 6/27/24. The last playground inspection was conducted on 8/27/24. MONITORING A full assessment was conducted, which included the following: program requirements, equipment and furnishings, staff/child ratios and supervision, medication, outdoor area and equipment, staff and children’s records. During today’s visit, we completed a walk-through of 4 spaces, including children’s classrooms, kitchen and outdoor learning environment. There was a total of 19 children present. I observed the children engaged in building structures in block center, dramatic play center, math learning activities, and Group 1 class eating lunch. Today’s lunch consisted of meatballs, lima beans, corn, a slice of bread and milk. The program does not care for children under 12 months of age; therefore, those requirements were not monitored during today’s visit. The program does not provide transportation; therefore, those requirements were not monitored during today’s visit. The NC Secretary of State website was reviewed on 9/18/24 and Davlor Enterprise, LLC was listed as active and current. The following violations were observed and documented during today’s visit: Violation Number Comment Rule 1824 The trained staff did not review the EPR Plan annually or when information in the plan changed to ensure all information was current. The director did not update the EPR Plan annually. The last update to the plan was on 4/5/23. .0607(e) 1899 Health and safety training topics were not included as part of on-going training within five years of completing the previous health and safety training topics. Three (3) staff (K.W., B.A., and S.C) did not renew their health and safety training topics within the five (5) years. .1103(b) The above violations must be corrected immediately. Child care programs are expected to maintain compliance with all child care requirements at all times. On or before October 3, 2024, I must receive a written, dated, and signed compliance letter that describes accurately and in detail how and when the violations were corrected. TECHNICAL ASSISTANCE Technical assistance was provided to you today in order to assist in regaining compliance and avoiding violations in the future on the following: -It is a requirement of NC Child Care regulations that the EPR Plan be reviewed and updated annually on the template provided by the Division. The last updated EPR plan on record was 4/5/23. It is important that the EPR Plan be maintained for instances of emergencies. I suggested you go into the system and update your EPR plan immediately. After updating the EPR Plan, you will need to review any changes with all staff. For future compliance, I recommend that you set an Outlook calendar update as a reminder to review and update the EPR plan annually before it expires. -It is a requirement of NC Child Care regulations that Health and Safety Training be completed by all staff within their 1st year of hire and every five (5) years thereafter. Three (3) staff members’ Health and Safety Trainings was not renewed with in the five (5) year requirement. Each staff must complete the Health and Safety Trainings immediately for your center to in compliance with this requirement. CONSULTATION AND COMPLIANCE REMINDERS To assist you in maintaining compliance with childcare requirements, the following reminders were discussed during today’s visit -Although your required safety drills are up to date as of today’s visit, you will need to complete a Fire Drill, Shelter in Place or Lockdown Drill, Playground inspection before 9/27/24 to remain in compliance with this requirement. -All new children are required to have a medical exam or health assessment and immunization record on file before or within 30 days from enrollment. The Durham Pre-K students started on 8/26/24. As a reminder you will need to have all the children’s health assessments and immunization records on file no later than 9/26/24. -One child (K.B.) has an epi-pen on site that will expire on 11/2024. I suggest that you notify the parents of the impeding expiration so that they can contact the child’s pediatrician for a new prescription. -As We reviewed staff files today, you inquired about how long you have to keep older records on file. I discussed with you that the information can be found on the DCDEE website at https://ncchildcare.ncdhhs.gov/. I also printed out the information located under rule 10A NCAC 09.2318 Child Care Center Record Retention. RATED LICENSE REASSESSMENT At this time, your license remains in Hold Harmless Status, and you will continue to operate on the license previously issued. Once Rated License Assessments have resumed, your consultant will be in touch to discuss your next steps. AGENCY UPDATES Please remember to check the Division of Child Development and Early Education website: ncchildcare.ncdhhs.gov on a weekly basis to stay updated on all current and new policies and rules. The director, Karyn Stith-Wilkerson, assisted me with today's visit. Upon arrival, you greeted me and welcomed me into your program. I observed two (2) classrooms of children during today's visit. The younger children were transitioning to the playground. The Pre-k children were observed interacting with the teacher in centers, and completing routine tasks. RATED LICENSE STATUS The program holds a 5 star-rated license issued on 12/5/22. The program received 6 points in Program Standards, 7 points in Staff Education, and 1 Quality point. INSPECTIONS The last fire drill was conducted on 9/25/23. The last emergency drill was conducted on 9/26/23. The last playground inspection was conducted on 9/25/23. The last sanitation inspection was conducted on 3/30/23. The fire inspection was conducted on 9/8/23. According to the NC Secretary of State website, the owner status of Davlor Enterprise, LCC, is current and active. During this visit, a full assessment of Child Care Requirements was conducted. The following violations were observed and recorded during today’s visit. Violation Number Comment Rule 844 Prescribed medicine was not in original labeled container or accompanied by signed and dated written instructions from prescribing physician or health care professional. A prescribed medicine in the preschool space was not kept in the original pharmacy labeled container. .0803(2)(a) 846 Over-the-counter medicines were not in their original containers or administered as authorized in writing by parent, physician or authorized health professional. An over the counter medicine was not kept in their original container. 10A NCAC 09 .0803(4) 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file. An employee who started 2/23 did not complete training in First Aid. .1102(c) 1049 All staff did not successfully complete certification in CPR training appropriate to the age of the children in care. Verification of staff completion of the CPR course from an approved training organization was not in the staff file. An employee who was employed 2/23 did not complete training in CPR. .1102(d) 1052 Staff required to receive on-going training had not completed the required number of hours according to their education and experience. One staff member did not complete their annual ongoing training hours .1103(a) In order to comply with the NC Laws & Rules, any violations cited today must be corrected immediately. A compliance letter should be sent to me by October 19, 2023. The letter should address each violation, and explain how and when it has been corrected. It will be updated after today's visit and you will be informed of the new score. TECHNICAL ASSISTANCE The following items were discussed to help you prevent a reoccurrence of the violations observed during today's visit. ONGOING TRAINING I would suggest that you utilize an outlook calendar to remind you of staff that will need to complete ongoing training hours. You can also save the staff and training worksheet and update the worksheet as items are completed. MEDICATION Over the counter medications must be kept in their original container. Prescribed medicine must be in its original pharmacy labeled container. I would suggest sending out a reminder to parents that they must keep the medication in its original container. ANNUAL IN-SERVICE TRAINING The in-service hours were monitored for the annual year October 5, 2022-October 4, 2023. CONSULTATION Some providers are experiencing delays in scheduling their fingerprinting appointments. Criminal record checks can be completed up to six months prior to the expiration date. We are encouraging all staff to begin their renewal process early to avoid lapses in their qualification. HEALTH AND SAFETY TRAINING Health and Safety trainings are now available through Moodle on the DCDEE website. These trainings are provided free of charge. You should use your NCID username and password to access the Moodle portal. As per Child Care Rule .1103(b) the Health and Safety trainings must be renewed at least every 5 years. Some of your staff completed the trainings in 2017, so they should begin to retake the training now.
