Upon arrival, I was greeted by the provider, Myi-Shanka McMillian, who assisted me during today’s visit. LICENSE STATUS The family child care home currently operates with a Four Star license issued on January 29, 2018. The program received seven points for Staff Education, two points for Program Standards, and one Quality Point. INSPECTIONS/DRILLS STATUS -The last annual compliance visit was conducted on 7/11/24. -The last documented monthly outdoor play area inspection was completed on 6/17/25. -The last documented monthly fire drill was conducted on 6/17/25. -The last documented quarterly lockdown/shelter-in-place drill was conducted on 6/17/25. MONITORING I completed a walk-through of the home, including the children’s space, kitchen, bathroom, and outdoor play area. At the time of the visit, there one child present aged eight years old. There are four children enrolled. The child was observed painting, interacting with the caregiver, and engaging in free play. The provider stated that because all the children enrolled are school-aged, she schedules weekly field trips to parks, sports activities, the movies, and the pool. A full assessment of child care requirements was conducted. I used a checklist to monitor all applicable requirements, including but not limited to supervision, capacity, health and safety requirements, equipment and furnishings, and program records. The provider does transport children; therefore, this requirement was monitored and found in compliance. No enrolled children have medications or medical care plans, so these requirements were not monitored. Children 12 months or younger are not enrolled; therefore, safe sleep requirements were not monitored. The provider verified that all the information on the FCCH Verification of Required Information for Operator and Additional Caregivers form was correct. INDOOR/OUTDOOR ENVIRONMENT Inside the home, children are cared for in a converted garage. A variety of items for learning through play are available, including manipulatives, blocks, books, art materials, and home living props and materials for school-aged children. The bathroom is located within sight of the children’s play area. The outdoor play area is a fenced side yard with a variety of gross motor equipment. VIOLATIONS The following violations were observed and documented during today’s visit: Violation Number Comment Rule 925 Signed and dated statement which attests that a copy of the discipline policy was given to and discussed with a parent/guardian of each child prior to enrollment was not on file in the home. Three children's files were missing a signed discipline policy. G.S.110-91(10); .1727(a)&(b) 1900 Children who participate in aquatic activities did not have a permission slip on file. Three children's files were missing the aquatic activities permission form. .1730 (f) In order to comply with the NC Laws and Rules, any violations documented today must be corrected immediately. I need to receive your compliance letter by July 15, 2025. The letter must address each violation and explain specifically when and how it was corrected, as well as how you will prevent the same violations from happening in the future. Please send this to mandy.annunziata@dhhs.nc.gov and include the following information: -Facility name -Facility ID number -Each item number COMPLIANCE HISTORY Prior to today’s visit, the facility’s compliance history score was 100%. According to NC General Statute 110-90(4)(d), all facilities must maintain a compliance history of at least 75% for the past 18 months. Failure to maintain compliance may result in an administrative action. The facility was not in compliance with all applicable minimum licensing requirements during today’s visit and violations were documented that could impact the center’s overall compliance history score. An updated compliance history score will be generated after today’s visit, and you will be informed of the results during the next visit to your program. TECHNICAL ASSISTANCE -An important part of running a child care business is record-keeping. Today, the children’s files were missing two important forms: permission for aquatic activities and the discipline policy. You stated that you would create a form today to give to parents to sign. To ensure each child’s file is complete going forward, you should use the children’s file checklist available on the DCDEE website in “Provider Documents and Forms” under the “Provider” tab. CONSULTATION -You can access and update your EPR plan by using your NCID to log into the North Carolina Risk Management Portal at https://rmp.nc.gov/portal/portal.aspx. Please review and update your EPR plan yearly. -Criminal Backgrounds Checks for the provider and all household members 16 years of age and older should be completed every five years. TRAINING REMINDERS -Training from 7/11/24 to 6/30/25 was reviewed today and documented on the Verification of Required Information for Operator and Additional Caregivers form. All required on-going training hours have been completed for this year. -CPR and First Aid must be renewed every two years. Your CPR and First Aid certification is valid until 6/20/25. -ITS-SIDS training must be renewed every three years. Your training expires on 6/22/28. -Health and safety training must be renewed every five years. our training expires on 7/19/28. RATED LICENSE STATUS The NC State Legislature has extended “hold harmless” status until new rated licensing guidelines are in place, and you may opt to keep your current license and delay your rated license assessment until the new guidelines are adopted. A checklist was used to note the requirements monitored today. The Family Child Care Home Provider, Myi-Shanka McMillian, was present and assisted me during today’s visit. I completed a general walk-through of the children’s space, outside play area, kitchen area and bathroom. At the time of the visit, there were eight (8) children present aging in range from one (1) to ten (10) years old. The children were observed playing in centers, water the garden, playing outside, interacting with the provider and completing routine tasks. LICENSE STATUS Currently this program operates with a Four-Star License issued January 29, 2018. The program earned seven (7) points in education standards, two (2) points in program standards, and one (1) quality point. The last annual compliance visit was completed on August 2, 2022. MONITORING During today’s visit, a full assessment was conducted monitoring all spaces occupied by the children, including the outdoor play environment. The provider’s and children files were reviewed. All spaces were monitored for supervision, child capacity, materials and equipment. The provider does not have a child under 12 months enrolled, therefore safe sleep requirements were not monitored. No children enrolled have medications or medical care plans, so these requirements were not monitored. Transportation is provided; the van was unavailable to be monitored. All other requirements were monitored. The FCCH provider verified the information on the Verification of required information for operator and additional caregiver’s form to be accurate. --PROGRAM RECORDS *The last documented fire drill was conducted 7/1/23. *The last documented shelter-in-place or lockdown drill was conducted 7/1/23. *The last documented playground inspection was conducted 7/1/23. The following violation was observed and documented: Violation Number Comment Rule 1846 An individual living in the household who had their 16th birthday after the initial licensing of a family child care home, did not complete and submit required forms within five business days. A resident in the FCCH turned 16 and did not obtain a criminal background check. RATED LICENSE STATUS On Monday June 12, 2023, the hold harmless legislation was extended and signed into law. All facilities are allowed to remain at their current star level without reassessment until June 30, 2024. Your facility has been determined to be in Cohort 1. Your reassessment year will be between July 1, 2024, and June 30, 2025. I will reach out to you prior to the beginning of your preparation year. Please use this time to make sure all your staff have a WORKS account with all education information updated. Also review updated resources on the North Carolina Rated License Project (NCRLAP) website (www.ncrlap.org). You may also want to consider the FCCERS-R self-study process and timeline for completion since it must occur over a 3-month time period prior to your rated license reassessment. HEALTH AND SAFETY TRAINING Health and Safety trainings are now available through Moodle on the DCDEE website. These trainings are provided free of charge. You should use your NCID username and password to access the Moodle portal. The Health and Safety trainings must be renewed at least every five (5) years. If you completed the trainings in 2017, you should begin to retake the training now. CRIMINAL BACKGROUND As of July 11, 2022, criminal record checks are now to be renewed every five (5) years instead of three (3) years.
