The owner/director arrived shortly after the visit began. The purpose of today’s unannounced visit was to monitor applicable child care requirements for your Annual Compliance visit. The last Annual Compliance visit was conducted on 2/5/25. This center operates with a five-star license, which was issued on 5/16/22. CORPORATION STATUS: According to the NC Secretary of State web site, the current status of Growing Legacy Early Learning Center LLC is “current-active”. COMPLIANCE HISTORY: The compliance history for this center for the previous eighteen-month timeframe was 97%. During today’s visit all indoor licensed space was monitored. Monitoring of the outdoor environment was limited today, due to icy conditions. OBSERVATIONS: I observed the children engaged in a variety of free play activities and completing table activities. I observed a therapist working with a child in classroom space #2. Each classroom had current attendance. Current activity plans were posted in each classroom and with current menus. CHILDREN’S RECORDS: Six children’s records were reviewed today. STAFF RECORDS: Staff files were reviewed today. Yearly in-service training hour requirements were tallied during the visit for the timeframe of 2/5/25 to today. I verified that the therapist present today had current Criminal Record Check clearance. INCIDENT LOG: The director stated there had been no injuries to record in the incident log. CURRICULUM: This center implements Creative Curriculum and Funshine Express. TRANSPORTATION: This program does not offer transportation services. INSPECTIONS: The last documented annual fire inspection was completed on 2/4/25. The director stated that Durham Fire Inspections had been contacted regarding an annual inspection. The last documented sanitation inspection was conducted on 12/17/25. The last documented fire drill was conducted on 1/9/26. The last documented lockdown drill was conducted on 11/10/25. The last documented playground inspection was completed on 1/5/26. The last documented water testing for Clean Water for NC Kids was completed on 3/30/24. The center completed Clean Classrooms for Carolina Kids on 5/28/25. The following violation was cited today: Violation Number Comment Rule 114 A summary of the NC Child Care Law was not given to a parent of every child enrolled in the center. It could not be verified today that the parent of two children had received the summary of NC Child Care Laws. GS 110-102 All violations must be corrected immediately. Please send me a signed Corrective Action letter by 2/13/26, stating how the violation cited today was corrected. TECHNICAL ASSISTANCE was provided today in the following areas: CHLDREN’S MEDICAL REPORT: Please have the parent of one child complete the top portion of the medical assessment form. HEALTH AND SAFETY TRAININGS: I reminded the director that one staff needed to complete the required Health and Safety trainings again in 2026, in accordance with NC Child Care Rule 10NCAC 09. 1103 (b). EMERGENCY MEDICAL CARE PLAN: During today’s visit I talked with the director about posting the Emergency Medical Care Plan for easy reference by staff. I asked the director to list specific names on the plan, instead of just lead teacher. ADMINISTRATOR FILE: I asked the owner/director to keep a current file at both center locations. I explained how the information needed to be quickly accessible when needed. ABCMS PROVIDER PORTAL: North Carolina child care administrators can now view and edit their facility staff roster in ABCMS, the DCDEE’s criminal background check system. The provider will have access to see background check status for all employees and add/delete applicants on their roster. NC child care providers must obtain access to the ABCMS Provider Portal to meet the requirement to record new employees within five days of hire, in accordance with NC Child Care Rules. The Division no longer recognizes or accepts the Change of Information form. Access to the ABCMS Provider Portal is granted by the DCDEE Criminal Record Check Unit after completing the required Moodle training and submitting the signed form available at the conclusion of the training. RATED LICENSE: On 12/11/25 I received a signed conversion form from the owner/director, indicating that this center would complete the star-rated license assessment using Pathway I. The director indicated on the conversion form that she planned to submit the application in March 2026. During today’s visit the owner/director stated that she may submit her application in February 2026. Self study: I stated that after I verified completion of the three-month self study, I will submit a request for the ECERS-R to be conducted at this center to include the NC Pre-K classroom. The owner/director stated that the center began their self-study in November 2025. The owner/director stated that the center was working with a Technical Assistance from Early Years, preparing for ECERS-3 and ITERS-3 assessments. This center operates with a five-star license, which was issued on 5/16/22. The last Annual Compliance visit was conducted on 2/5/25. COMPLIANCE HISTORY: The compliance history for this center for the previous eighteen-month timeframe was 98%. During today’s visit all indoor and outdoor licensed space was monitored. OBSERVATIONS: During today’s visit I observed the children in classroom space #2 and #3 engaged in a variety of indoor activities. Activity plans were posted in classroom space #2 and #3. This center implements the Fun Shine curriculum in both classrooms. Classroom space #1 is a Early Head Start classroom and will open on 8/25/25. I observed the teachers in classroom space #1 setting up their classroom for tonight’s Open House. The Creative Curriculum is implemented in classroom space #1. The owner/director stated that none of the children currently enrolled had medication or a food allergy. The owner/director stated that the memorial service for one of the teachers in classroom space #3 was held on Saturday, 8/16/25. The owner/director stated that she was reached out to Early Years for guidance. CHILDREN’S RECORDS: Children’s records were not reviewed today. STAFF RECORDS: No new staff had been employed since the 2/5/25 Annual Compliance visit. I verified that staff had current Criminal Record Check clearance, CPR training, and First Aid training. I verified that the therapist, who was present today, had current Criminal Record Check clearance. TRANSPORTATION: This program does not offer transportation services. INSPECTIONS: The last documented annual fire inspection was completed on 2/4/25. The last documented sanitation inspection was conducted on 6/4/25. The last documented fire drill was conducted on 8/18/25. The last documented shelter-in-place drill was conducted on 8/20/25. The last documented playground inspection was completed on 8/4/25. The last documented water testing for Clean Water for NC Kids was completed on 3/20/24. The center completed the lead/asbestos testing for clearance for Clean Classrooms for Carolina Kids on 5/28/25. The following violation was cited today: Violation Number Comment Rule 526 Menus for all meals and snacks were not current or posted where easily seen by parents and cook. The posted menus were for the month of June. 10A NCAC 09 .0901(b) Since the violation cited today was corrected during the visit, a Corrective Action letter was not requested for today’s visit. TECHNICAL ASSISTANCE was provided today in the following areas: RATED LICENSE: The Pathways to the Stars transition will begin soon. There will be a “rules roll out” module in Moodle soon. The owner/director stated that this facility would likely choose Pathway I, since the ECERS-3 had to be conducted anyway as part of the Early Head Start requirements. I stated that free webinars were offered on the ECERS-3 and ITERS-3 through the NC Rated License Assessment Project. www.ncrlap.org. I stated that the webinars could be used to meet yearly in-service training hour requirements. NC FIRE CODE: Please make sure that direct fire exits are not blocked, even partially. During today’s visit a moveable cart was partially in front of the direct exit in classroom space #3, and some of the pillows for the cozy area in classroom space #2 were partially in front of the direct exit. OUTDOOR ENVIRONMENT: In preparation for Monday’s opening, please make sure that surfacing has been raked around the stationary climber, and the wooden debris had been moved outside the fenced-in space. The director/owner, Dionne Blackwell, assisted me in today’s visit. Upon my arrival, I was greeted and welcomed into your program. Three (3) classrooms were opened today. I conducted a general walk-through of the indoor and outdoor learning environments. I observed the children having free play, eating lunch, and napping in their indoor learning environment. RATED LICENSE STATUS The program holds a 5-star-rated license issued on 5/16/22. The program received 7 points in Program Standards, 7 points in Staff Education, and 1 quality point through the programmatic options of having a staff benefits package and an infrastructure of parent involvement. INSPECTIONS The last sanitation inspection was conducted on 8/23/23. The last fire inspection was conducted on 11/8/22. (10/30/23-center did not pass due to the alarm panel needing to be updated). The last fire drill was conducted on 2/2/24. The last emergency drill was conducted on 2/5/24. The last playground inspection was conducted on 2/2/24. During this visit, a full assessment of the child care requirements was conducted. The following violations were observed and recorded during today's visit. Violation Number Comment Rule 106 Operator has not scheduled and obtained a fire inspection within 12 months of the previous inspection. Operator did not submit the original approved report to DCDEE within one week of the inspection visit on a form provided by the Division. The center did not have a current fire inspection on file for review during today's visit. The last documented fire inspection was on 11/8/22. On 10/30/23 the fire inspector visited the facility however the alarm panel needed updating therefore the center did not pass inspection. 10A NCAC 09 .0304(a) In order to comply with the NC Laws & Rules, any violations cited today must be corrected immediately. A compliance letter should be sent to me by February 29, 2024. The letter should address each violation, and explain how and when it has been corrected. Please send the letter to shannel.hall@dhhs.nc.gov and include the following: -Facility name -Facility ID number -Each item number COMPLIANCE HISTORY Prior to today’s visit, the program’s compliance history was 100%. It will be updated after today's visit, and you will be informed of the new score. TECHNICAL ASSISTANCE The following items were discussed to help you prevent a reoccurrence of the violations observed during today's visit. I would suggest calling the fire inspector two -three months before your inspection is due to schedule them to come out before the current inspection expires in case anything needs to be corrected. ANNUAL IN-SERVICE TRAINING The in-service hours were monitored for the annual year from February 17, 2023 - February 15, 2024. CONSULTATION Criminal background checks must be renewed every five (5) years. Criminal background checks can be completed up to six months prior to the expiration date. We are encouraging all staff to begin their renewal process early to avoid lapses in their qualification. AGENCY UPDATES Please remember to check the Division of Child Development and Early Education website: nchildcare.ncdhhs.gov frequently to stay updated on rule requirements. HEALTH AND SAFETY TRAININGS Health and Safety trainings are now available through Moodle on the DCDEE website. These trainings are provided free of charge. You should use your NCID username and password to access the Moodle portal. As per Child Care Rule .1103(b) the Health and Safety trainings must be renewed at least every 5 years. Some of your staff completed the trainings in 2017, they should begin to retake the training now.
