The purpose of today’s unannounced visit was to monitor applicable child care requirements during a Routine Unannounced visit. The last Annual Compliance visit was conducted on 9/11/25. This center operates with a five-star license, which was issued 7/10/17. COMPLIANCE HISTORY: The compliance history for this center for the previous eighteen-month timeframe was 94%. During today’s visit all indoor and outdoor licensed space was monitored. OBSERVATIONS: I observed that eight children were present in classroom space #1. Classroom space #1 is a Durham Pre-K classroom. The children in classroom space #1 were engaged in a variety of free play activities. I later observed the children eating lunch. Lunch today consisted of hot dogs, crackers, corn, string beans, and milk. Substitutions were made to today's menu before lunch. I observed that one of the two children enrolled in classroom space #3 was present today. The lead teacher in classroom space #3 was engaged in activities with the toddler. I observed that classroom space #2 was closed. The director prepared and served lunch during today’s visit. CHILDREN’S RECORDS: Children’s records were not reviewed today. STAFF RECORDS: The center had not hired any new staff since the 2025 Annual Compliance visit. By reviewing documentation from the 9/11/25 Annual Compliance visit, I verified that staff had current CPR/First Aid training and Criminal Record Check clearance. TRANSPORTATION: The vehicle with license #RHR-8881 was monitored for transportation requirements during the 9/11/25 visit. INSPECTIONS: The last documented annual fire inspection was completed on 5/22/25. The last documented sanitation inspection was conducted on 8/14/25. The last documented fire drill was conducted on 1/11/26. The last documented shelter-in-place drill was conducted on 1/13/26. The last documented playground inspection was completed on 1/14/26. The last documented water testing for Clean Water for NC Kids was completed on 9/26/24. The date that the center completed the Clean Classrooms for Carolina Kids could not be located today. The director will send me the date with the Corrective Action letter for today’s visit. The following violations were cited today: Violation Number Comment Rule 428 A current activity plan was not posted for each group of children for reference. GS 110-91(12); .0508(a) 525 Menus for all meals and snacks were not planned at least 1 week ahead and dated. During today's visit the menu posted for the current week was for today only. 10A NCAC 09 .0901(b) 1882 Medication authorization, giving the caregiver standing authorization did not meet the specifications in rule. The permission to administer an Epi-Pen to a child in classroom space #1 with a food allergy expired in December 2025. .0803(6)(a-i); .0803(7)(a-g); .0803(8)(a-d) All violations must be corrected immediately. Please send me a signed Corrective Action letter by 2/25/26, stating how each violation has been corrected. TECHNICAL ASSISTANCE was provided today in the following areas: ABCMS PROVIDER PORTAL North Carolina child care administrators can now view and edit their facility staff roster in ABCMS, the DCDEE’s criminal background check system. The provider will have access to see background check status for all employees and add/delete applicants on their roster. Access to the ABCMS Provider Portal is granted by the DCDEE Criminal Record Check Unit after completing the required Moodle training and submitting the signed form available at the conclusion of the training. NC child care providers must obtain access to the ABCMS Provider Portal to meet the requirement to record new employees within five days of hire, in accordance with NC Child Care Rules. The Division no longer recognizes or accepts the Change of Information form. MEDICATION AUTHORIZATION: During today’s visit I reviewed NC Child Care Rule 10 NCAC 09. 0803 (7) (a-g), regarding permission to administer medication for a chronic allergy for a six-month timeframe only. I reminded the director that two additional children need updated medical permission this month, based on this child care rule. RATED LICENSE: The director attended the training on the new QRIS, star-rated license process on 9/18/25. Technical Assistance was provided by phone on 12/30/25. During the conversation, the director was interested in Pathway I and Pathway III. During today’s visit a second conversation chart was left at the center. The assistant director stated that a decision would be made by Monday, 2/17/26. The assistant director was aware that the ECERS-3 would need to be conducted in the Durham Pre-K classroom. I stated that the center needed to purchase the ECERS-3 assessment book. I stated that free webinars were offered on the ECERS-3 through the NC Rated License Assessment Project. www.ncrlap.org. I stated that the webinars could be used to meet yearly in-service training hour requirements. NATURAL LIGHT: During today’s visit I talked about the appropriateness of opening drapes and providing more natural light in the classrooms. COMPLIANCE HISTORY: The compliance history for this center for the previous eighteen-month timeframe was 90%. During today’s visit I monitored all indoor and outdoor licensed spaces. OBSERVATIONS: Upon arrival there were five preschool age children resting during naptime in classroom space #3 with one caregiver. One preschool age child was in classroom space #1, playing a game with the director. I observed that current activity plans were posted. The children were studying weather this week. CHILDREN’S RECORDS: Children’s records were not reviewed today. STAFF RECORDS: There have been no changes in staff since the 9/16/24 Annual Compliance visit. I verified that the staff had current CPR/First Aid training. INSPECTIONS: The last documented annual fire inspection was completed on 6/11/24. The last documented sanitation inspection was conducted on 2/11/25. The last documented fire drill was conducted on 2/3/25. The last documented lockdown drill was conducted on 2/13/25. The last documented playground inspection was completed on 2/3/25. The last documented water testing for Clean Water for NC Kids was completed on 9/26/24. The following violations were cited today: Violation Number Comment Rule 807 A safe indoor and outdoor environment was not provided for the children. There were exposed roots on the playground that posed a tripping hazard for young children. 10A NCAC 09 .0601(a) 1044 Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of five years for the date of issuance). Several roots were attached at both ends underground, leaving the middle section above ground, posing a tripping hazard for young children. RATED LICENSE: Please know that the “hold harmless” status for Rated License reassessment has been extended until the new QRIS guidelines are ready for implementation. CLEAN CLASSROOMS FOR CAROLINA KIS: Child care facilities are now required to test for lead and asbestos hazards in their buildings. The Clean Classrooms for Carolina Kids program is designed to identify and eliminate exposure to lead and asbestos hazards in building infrastructure, while providing child care facilities with the support needed to meet all rule requirements. The program is free, and the first step is to watch the pre-enrollment webinar, which are available at www.cleanwaterforUSkids.org/carolina. The operator stated that she would watch the video immediately to begin the clearance process. UTILIZING EMPTY CLASSROOM SPACE: Technical Assistance was provided by brainstorming on possible uses of classroom space #2. The director stated that she hopes to enroll enough children to re-open classroom space #2 this year. CPSC RECALLS The U.S. Consumer Product Safety Commission has recalled numerous items. Upon arrival we were greeted by the lead teacher, Pebbles Lucas, she accompanied me throughout the visit. We conducted a walk-through of the indoor and outdoor learning environments. I observed the children having group activity and outdoor play. LICENSE STATUS The program operates with a 5-star rated license issued on 7/10/17. They received 6 points in program standards, 6 points in staff education and one quality point through a combined turnover rate of 20% or less. INSPECTIONS The last sanitation inspection was conducted 2/15/24 with a SUPERIOR classification. The last fire inspection was conducted 4/27/23. The last documented fire drill was conducted 3/7/24. The last documented shelter-in-place or lockdown drill was conducted 3/1/24. The last documented playground inspection was conducted 3/5/24. The last documented EPR plan update was completed on . The last annual compliance visit was conducted on 9/20/23. The following violations were observed and cited during today’s visit. Violation Number Comment Rule 428 A current activity plan was not posted for each group of children for reference. The activity plan posted was dated 3/30/24. GS 110-91(12); .0508(a) 1821 The EPR Plan did not include the date of the last revision of the plan. A current EPR plan was not accessible to view. .0607(d)(8) 1882 Medication authorization, giving the caregiver standing authorization did not meet the specifications in rule. A child's authorization form for chronic medication was dated for one year instead of six months. .0803(6)(a-i); .0803(7)(a-g); .0803(8)(a-d) While the Division allows you time to explain how you have corrected violations when violations are documented, it is expected that you correct all violations immediately. When you send your compliance to me, it is to verify that you have already corrected or addressed the violations from your visit summary. If I do not receive your letter by 4/16/24, and/or if you do not address all violations, a return visit will be made to your program to monitor compliance of violations and to obtain the compliance letter. Additional violations may be documented if the situation has not been corrected or addressed. The letter must address each violation, explain how it has been corrected and how it will be maintained in the future. TECHNICAL ASSISTANCE During today’s visit we discussed that current activity plan should be posted for reference by parents and by caregivers. Best practice would be to post the plan on Friday so that it can be viewed by parents on Monday morning. A permission form to administer medication for specific chronic conditions or allergic conditions is valid for up to six months. CONSULTATION During today’s visit you asked me about an Inflatables bouncy house. Inflatables are prohibited except when used during a special event such as a celebration, festival, party, or family engagement event. If an inflatable is used during a special occasion the staff should always be able to hear and see all children. An inflatable means an air-filled structure designed to allow users to bounce, slide, or climb in. Examples include bounce houses, moon walkers, giant slides, and bouncers. RATED LICENSE Full rated license assessments will occur based on the program’s Cohort assignment; your program is in Cohort 1; therefore, your assessment period will start on July 1, 2024. You stated today that you are going to wait to send in your application. You can prepare and plan for your assessment if you wish to complete the Environment Rating Scales. The following items can be helpful when preparing for the visit: •Review previous assessments. •Look for assessment related resources – ncrlap.org. •Complete self-assessment to become familiar with ERS. •Visit www.ncrlap.org for updated trainings and videos. •You should also ensure that all staff have registered and have their education assessed in WORKS.
