The owner arrived after the visit began. Today was the first day of operation since the 1/24/26 ice storm. The purpose of today’s unannounced visit was to monitor applicable child care requirements for a Routine Unannounced visit. The last Annual Compliance visit was conducted on 8/7/25. This center operates with a five-star license, which was issued 8/14/25. COMPLIANCE HISTORY: The compliance history for this center for the previous eighteen-month timeframe was 96%. During today’s visit all indoor licensed space was monitored. Since the outdoor environment was covered in ice, the outdoor fenced-in space was not monitored today. OBSERVATIONS: I visited each classroom and observed the children engaged in a variety of indoor activities. The children enrolled in the NC Pre-K classroom were arriving for the day, based on an inclement weather two-hour delay. Each classroom had attendance and current activity plans posted. I observed one therapist working alone in classroom space #2 with a child, and I observed a second therapist working with a child in the reception area outside the office. The classroom for infant age children had feeding schedules posted and safe sleep monitoring charts with current information. I observed the children in classroom space #2, engaged in gross motor play in the multi-purpose space. I observed that the nutrition staff were serving mixed fruit and Ritz crackers for snack. Food allergy information was posted in the kitchen (food prep area) and in the classrooms (eating area). CHILDREN’S RECORDS: Children’s records were not reviewed today. STAFF RECORDS: I reviewed the file for the staff person who began employment on 1/21/26. I reminded the NC Pre-K director that her Criminal Record Check clearance would expire on 2/22/26. I reminded the owner that Criminal Record Check clearance would expire for three staff in early April 2026. The NC Pre-K director was aware that the CPR/First Aid training for the staff would expire on 4/16/26. I verified that the administrative staff and both caregivers in the infant classroom (classroom space #1) had IT’S SIDS training. CURRICULUM: This center implements The Creative Curriculum. TRANSPORTATION: This program does not offer transportation services. INSPECTIONS: The last documented annual fire inspection was completed on 8/13/25. The last documented sanitation inspection was conducted on 10/30/25. The last documented fire drill was conducted on 1/21/26. The last documented lockdown drill was conducted on 12/17/25. The last documented playground inspection was completed on 12/17/25. The last documented water testing for Clean Water for NC Kids was completed on 12/4/23. The center completed Clean Classrooms for Carolina Kids on 5/20/25. The following violations were cited today: Violation Number Comment Rule 1757 A valid qualification letter was not on file and available to review at the facility. During today's visit one of the therapists, who was working with a child, did not have a valid Criminal Record Check qualification letter on file. G.S. 110-90.2(b) & (d) & .2703(e) 1890 Each staff member did not have the required medical report, proof of tuberculosis test or screening and/or completed health questionnaire in a medical file, maintained separately from the staff member's individual personnel file. The new staff person, who began employment on 1/21/26, did not have a medical assessment on file. .0701(d) All violations must be corrected immediately. Please send me a signed Corrective Action letter by 2/12/26, stating how each violation has been corrected. TECHNICAL ASSISTANCE was provided today in the following areas: UPDATE ON CENTER LICENSED CAPACITY: During today’s visit I observed the direct exit that had been opened in the multi-purpose space. The owner stated that Durham Fire Inspections would be returning to approve the direct exit for the center’s clearance to use the multi-purpose space as an NC Pre-K classroom. The owner stated that he would submit the approval from Durham Fire Inspections to me. ABCMS PROVIDER PORTAL North Carolina child care administrators can now view and edit their facility staff roster in ABCMS, the DCDEE’s criminal background check system. The provider will have access to see background check status for all employees and add/delete applicants on their roster. Access to the ABCMS Provider Portal is granted by the DCDEE Criminal Record Check Unit after completing the required Moodle training and submitting the signed form available at the conclusion of the training. NC child care providers must obtain access to the ABCMS Provider Portal to meet the requirement to record new employees within five days of hire, in accordance with NC Child Care Rules. The director arrived shortly after the visit began. The purpose of today’s unannounced visit was to monitor applicable child care requirements during your Annual Compliance visit. This center operates with a five-star license, which was issued on 5/26/17. The last Annual Compliance visit was conducted on 8/22/23. COMPLIANCE HISTORY: The compliance history for this center for the previous eighteen-month timeframe was 100%.__ All indoor and outdoor licensed space was monitored today. OBSERVATIONS: I observed the children engaged in free play activities, having circle time, and drawing pictures outside with sidewalk chalk. CHILDREN’S FILES: Eight children’s files were reviewed during the visit. STAFF FILES: The staff and training worksheets were received prior to the visit. There have been one new staff hired since the 8/22/23 Annual Compliance visit. The file for the new staff person was monitored as well as thirty percent of existing staff files. The on-going training requirements were tallied for the staff files reviewed today. The director’s signature on the staff/training worksheets attests that staff files not monitored today contain all the required information. TRANSPORTATION: This center does not offer transportation services. INSPECTIONS: The last documented annual fire inspection was completed on 8/8/23. The last documented sanitation inspection was conducted on 7/14/23. The last documented fire drill was conducted on 7/2/24. The last documented shelter-in-place drill was conducted on 7/30/24. The last documented playground inspection was completed on 7/2/24. INCIDENT REPORTS: The incident log was monitored during the visit. CURRICULUM: This center implements The Creative Curriculum. The following violations were cited today: Violation Number Comment Rule 106 Operator has not scheduled and obtained a fire inspection within 12 months of the previous inspection. Operator did not submit the original approved report to DCDEE within one week of the inspection visit on a form provided by the Division. The last fire inspection was conducted on 8/8/24. The owner contacted Durham Fire Inspections during the visit to request an inspection. A fire inspector came to the center during the visit, but he was called away for an emergency before the inspection could be done. 10A NCAC 09 .0304(a) 508 Special diet or food allergy information was not posted where they can be seen in food preparation and eating areas. One little boy was allergic to nuts, and the information was not posted. .0901(g) 1329 Application for enrollment did not include all required information. One child needed emergency contact information if parents could not be reached. .0801(a)(1-7) 1890 Each staff member did not have the required medical report, proof of tuberculosis test or screening and/or completed health questionnaire in a medical file, maintained separately from the staff member's individual personnel file. TECHNICAL ASSISTANCE was provided today in the following areas: FEEDING SCHEDULES: Please be diligent in sending feeding schedules with children when they transfer to another classroom. SANITATION INSPECTION: Please contact Durham County Environmental Health, since it has been longer than one year since the previous inspection. HEALTH AND SAFETY TRAININGS: Staff must complete the required Health and Safety trainings to include Recognizing and Responding to Child Maltreatment every five years, in accordance with NC Child Care Rule 10NCAC 09 .1103 (b). STAFF MEDICAL ASSESSMENT: Staff should obtain their medical assessment prior to their first day of employment, in accordance with NC Child Care Rule 10NCAC 09 .0701 (a). Also, child care facilities are now required to test for lead and asbestos hazards in their buildings. The Clean Classrooms for Carolina Kids program is designed to identify and eliminate exposure to lead and asbestos hazards in building infrastructure, while providing child care facilities with the support needed to meet all rule requirements. The program is free, and the first step is to watch the pre-enrollment webinar, which are available at www.cleanwaterforUSkids.org/carolina.
