Upon arrival, I was greeted by one of the teachers, C. Boone. I walked unaccompanied through the center since all staff were needed in classrooms. The director, Elisha Muhammad, arrived approximately 30 minutes later and assisted me during the remainder of my visit. During today’s visit, there were 53 children and 11 staff members present. The facility currently has a Four Star License that was issued on August 21, 2020. MONITORING A partial assessment of child care requirements was conducted during today’s visit. I monitored Child Care Rules Section .0800 (Health Standards for Children) and Rule .3209 (Reduced, Enhanced Staff/Child Ratios For a Rated License For Child Care Centers), and I observed seven classrooms. ALLEGATIONS There were concerns regarding health/sanitation, specifically that children with communicable illnesses were not excluded from care. I interviewed three staff members as well as the director and asked them to describe their sick policy. I also asked specifically how they handle situations where child has a communicable illness. The teachers and director stated that parents are contacted as soon as a child is found to be ill at school, and that child goes to the administrator’s office until a parent arrives. The director shared the written sick policy with me, and she stated that she follows the exclusion guidelines which are in child care rules. For example, children with lice are not allowed to return to class until they have had at least one treatment. In addition, the center’s guidelines are more stringent than the current exclusion guidelines in “Caring for our Children” regarding covid. The center requires children to stay out of school for five days following a covid diagnosis. The director said that she generally tries to notify other families about communicable diseases like covid or Hand, Foot, and Mouth disease whenever she is made aware of an illness, and she also contacts the region’s child care health consultant for guidelines. There were also concerns that required staff/child ratios are not being met at all times. During my walk-through of the school, I monitored seven classrooms for staff/child ratios. Three classrooms were not meeting the reduced, enhanced ratios that were noted on the center’s license and posted in the classrooms. A classroom for children aged three and four years old had 11 children with one teacher; a classroom for children aged two years old had nine children with one teacher; and a classroom for children aged one year old had six children with one teacher. I interviewed six staff members. I asked about staff/child ratios and was informed that they are sometimes short-staffed and out of ratio, although they said it was not a regular occurrence. They said it usually happens when a teacher does not show up or calls out sick for the day. Today, I was told that one of the teachers in the infant classroom left suddenly shortly after reporting to work, which required some shifting of staff. I also interviewed the director, who stated that all classrooms typically are in ratio and that she has a couple of administrators she can call on to help in classrooms when needed. She said today was atypical in terms of staff shortages. The director said the ratio noncompliance today was partially caused by the infant teacher leaving, and partially because the director made a mistake with the ratio in the classroom for three and four year old children. She thought the allowed ratio was 1:10 (it should be 1:9) and she also said one extra child came to school when it was not his day to attend, bumping the number in attendance to 11 children. I asked for attendance records for children and staff from August 29-September 5. The director provided the children’s attendance records but keeps staff records through an online program. She said she would contact the vendor today to determine how to download staff attendance records, and she would email them to me. VIOLATIONS The following violation of the Child Care Requirements were observed or confirmed during today’s visit: Violation Number Comment Rule 1756 Enhanced staff/child ratios and group sizes were not met. Enhanced, reduced staff ratios required by the license were not met in spaces 2, 4, and 5. 10A NCAC 09 .2818 COMPLIANCE LETTER The above violation must be corrected immediately and verification submitted within two weeks to maintain compliance with the NC Child Care Law and Requirements. Please send me a letter that addresses each violation and explains how and when each one was corrected. I must receive your letter no later than September 30, 2025, and it should be sent to: Mandy Annunziata mandy.annunziata@dhhs.nc.gov Violations of the Child Care Requirements were documented today that will require a follow-up visit to monitor for compliance. That visit will occur any time in the next two weeks; please maintain verification of how any of the violations have been corrected to share with me on the next visit. COMPLIANCE HISTORY The center was not in compliance with all applicable licensing requirements during today’s visit and violations were documented that could impact the facility’s overall Compliance History Score. An updated Compliance History Score will be generated after today’s visit and you will be informed of the results if it dropped below the required 75%. A violation was documented for failure to maintain compliance with required staff/child ratios. Violations of this nature directly impact the safety of the children while in your care. In addition, these types of violations have the greatest negative impact on your compliance history. During the visit, we discussed that repeated violations of this nature during consecutive visits may lead to an administrative action against your license. A follow-up visit will be conducted in the near future to monitor compliance with child care requirements. INVESTIGATION STATUS The investigation was completed during today’s visit. Based on information provided by staff and a review of the center’s sick policy, it was unable to be determined that lapses in compliance with the Child Care Requirements have occurred; therefore, the concerns related to health/sanitation have been unsubstantiated. Based on child and teacher attendance witnessed today during monitoring, it was determined that lapses in compliance with the Child Care Requirements have occurred; therefore, the concerns related to staff/child ratios have been substantiated. Due to the confirmation of allegations that you were in violation of Child Care Requirements related to one of the concerns reported, your facility may be at risk of an administrative action. You will receive written notification from the agency once a final determination is made. TECHNICAL ASSISTANCE The following items were discussed during today’s visit. You may want to consider them in order to avoid potential violations or improve the quality of your program. -Your license requires you to follow reduced, enhanced staff/child ratios. They are as follows: 0-12 months 1:4 12-24 months 1:5 2 to 3 years 1:8 3 to 4 years 1:9 4 to 5 years 1:12 5 years and older 1:14 The ratio for the youngest child in each classroom should be followed. -I recommend re-training all the staff members on the required staff-child ratios because some teachers seemed unsure of how many children they are allowed to supervise when they are alone. Once they reach their allowed number of children, teachers should not accept any more students into their classroom, even if it requires them to tell a parent they cannot drop off a child. Let teachers know that exceeding their ratio places your center in noncompliance and at risk of an administrative action. I advise having an on-site floater teacher or administrator available to step in immediately when classroom teachers are absent. -Studies have found that children (particularly infants and toddlers) in groups that comply with the recommended ratio receive more sensitive and appropriate caregiving and score higher on developmental assessments, particularly vocabulary. Direct, warm social interaction between adults and children is more common and more likely with lower child-staff ratios. Similarly, low child-staff ratios are most critical for infants and young toddlers (birth to twenty-four months). Infant development and caregiving quality improves when group size and child-staff ratios are smaller. For three- and four-year-old children, the size of the group is even more important than ratios. The recommended group size and child-staff ratio allow three- to five-year-old children to have continuing adult support and guidance while encouraging independent, self-initiated play and other activities. In addition, the children’s physical safety and sanitation routines require a staff that is not fragmented by excessive demands. Child-staff ratios in child care settings should be sufficiently low to keep staff stress below levels that might result in anger with children. Caring for too many young children, in particular, increases the possibility of stress to the caregiver/teacher, and may result in loss of the caregiver’s/teacher’s self-control. Upon arrival, I was greeted by Davinia Robinson, an administrator-in-training, who assisted me during today’s visit. The director, Elisha Muhammad, joined us about 20 minutes later. LICENSE STATUS The center currently operates with a Four Star license issued on August 21, 2020. The program received four points for Staff Education, seven points for Program Standards, and one Quality Point. It is licensed to serve 86 children on first and second shift. Prior to today’s visit, I reviewed the NC Secretary of State’s website and noted that the owner of this facility, All My Children Family Resource Center, is listed as current/active. INSPECTIONS/DRILLS STATUS -The last sanitation inspection was completed on 4/1/25, and the center scored a superior rating with eight demerits. -The last fire inspection was completed on 8/26/24. -The last documented outdoor play area inspection was completed on 8/1/25. -The last documented fire drill was conducted on 7/30/25. -The last documented lockdown/shelter-in-place drill was conducted on 6/3/25. -The last annual compliance visit was conducted on 8/12/24. MONITORING I completed a walk-through of the center, visiting eight classrooms. The infants were interacting with caregivers, playing with toys on the floor, and transitioning to nap time. The toddlers were observed playing freely in the kitchen and block centers and chasing bubbles. Preschoolers were observed coloring and being read a book. School-age campers were talking to one another and engaging with materials. I viewed the outdoor play area through a window due to heavy rain today and noted a variety of stationary equipment and riding toys available for gross motor play. A full assessment of child care requirements was conducted. I used a checklist to monitor all applicable requirements, including but not limited to supervision, staff-child ratios, health and safety requirements, equipment and furnishings, and program records. Five staff and eight children’s files were reviewed. This program provides transportation for school-agers during summer camp when they go on field trips. The van was not parked here today and could not be inspected, although current registration and insurance were confirmed. Children’s transportation files were reviewed and one violation was cited. No children require medications; therefore, this requirement was not monitored. The center serves children under one year of age, thus, safe sleep requirements were monitored and found in compliance. VIOLATIONS The following violation was observed and documented during today’s visit: Violation Number Comment Rule 1124 Emergency and identifying information, including the child's name, photograph, emergency contact information and/or a copy of the emergency medical care information form was not in the vehicle for each child being transported. Children's transportation files were missing photographs of the children. 10A NCAC 09 .1003(d) In order to comply with the NC Laws and Rules, any violations documented today must be corrected immediately. I need to receive your compliance letter by August 20, 2025. The letter must address each violation and explain specifically when and how it was corrected, as well as how you will prevent the same violations from happening in the future. In the event of an accident, it is important to always have emergency information for the children readily accessible to provide appropriate care. Today, the school-age children’s transportation files were missing photos of the children. Please be sure the van used to transport children contains files with all the required emergency information before transporting them. CONSULTATION -Be sure to schedule your yearly fire inspection prior to 8/26/25. -“Recognizing and Responding to Suspicions of Child Maltreatment” (part of the Health and Safety Training) should be completed within 90 days of hire and renewed every five years. Upon arrival, I was greeted by one of the teachers, Davinia Robinson, who walked me through the center. The director, Elisha Muhammad, was not on site today, so she talked with me on the phone via Face Time and answered questions as I toured the classrooms. The owner, Paulette Muhammad, arrived after about 45 minutes. LICENSE STATUS The center currently operates with a Four Star License issued on August 21, 2020. The program received seven points for Program Standards, four points for Staff Education, and one quality point. Prior to today’s visit, I reviewed the NC Secretary of State’s website and noted that the owner of this facility, All My Children Family Resource Center, is listed as current/active. INSPECTIONS/DRILLS STATUS -The last sanitation inspection was completed on 11/13/24. -The last fire inspection was completed on 8/26/24. -The last documented outdoor play area inspection was completed on 1/6/25. -The last documented fire drill was conducted on 12/23/24. -The last documented lockdown/shelter-in-place drill was conducted on 12/5/24. -The last annual compliance visit was conducted on 8/12/24. MONITORING I completed a walk-through of the center, visiting seven classrooms as well as the outdoor play area. Durham Public Schools were closed for a snow day today; therefore, the Early Head Start classrooms were not in session. All children present were napping. A partial assessment of child care requirements was conducted. I monitored all applicable requirements, including but not limited to supervision, staff-child ratios, health and safety requirements, equipment and furnishings, and program records. I reviewed two staff files and four newly-enrolled children’s records. VIOLATIONS The following violation was observed and documented during today’s visit: Violation Number Comment Rule 1044 Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of five years for the date of issuance). Two staff members' qualifications letters expired on 12/17/24 and have not been renewed. G.S. 110-90.2(b) & .2703(n)&(o) In order to comply with the NC Laws and Rules, any violations documented today must be corrected immediately. I need to receive your compliance letter by February 6, 2025. The letter must address each violation and explain how it has been corrected. Please send this to mandy.annunziata@dhhs.nc.gov and include the following information: -Facility name -Facility ID number -Each item number COMPLIANCE HISTORY Prior to today’s visit, the center’s compliance history score was 97%. According to NC General Statute 110-90(4)(d), all facilities must maintain a compliance history of at least 75% for the past 18 months. Failure to maintain compliance may result in an administrative action. The center was not in compliance with all applicable minimum licensing requirements during today’s visit and violations were documented that could impact the center’s overall compliance history score. An updated compliance history score will be generated after today’s visit, and you will be informed of the results during the next visit to your center. TECHNICAL ASSISTANCE -Criminal Backgrounds Checks for all staff members should be completed every five years. Two staff members’ qualifying letters have expired and must be renewed immediately. They have 15 days to obtain a new qualifying letter; after that, they will not be able to work in your center until they have received their new qualifying letter. CONSULTATION -At your request, we will meet at your center on Wednesday, January 29 at 9:30 a.m. to discuss the new QRIS pathways and increasing your center’s rated license to five stars. I look forward to assisting you with this process. -You are due to conduct a fire drill before the end of this month. -Three of your staff members are due to renew their background checks in 2025. I recommend starting the process well in advance of the deadline as most checks are taking two to three weeks to complete. -The Clean Classrooms for Carolina Kids Program provides free facility-wide testing for lead in water and inspections for asbestos and lead-based paint hazards without any out-of-pocket costs. Visit www.cleanwaterforuskids.org/carolina to enroll. -You can access and update your EPR plan by using your NCID to log into the North Carolina Risk Management Portal at https://rmp.nc.gov/portal/portal.aspx. Please review and update your EPR plan yearly. TRAINING REMINDERS -Health and safety training must be renewed every five years and can be accessed through Moodle. This includes “Recognizing and Responding to Suspicions of Child Maltreatment,” which can be found on the Prevent Child Abuse NC website: https://preventchildabusenc.org/online-trainings/ New teachers must complete this training within one year of hire. RATED LICENSE STATUS The NC State Legislature has extended “hold harmless” status until new rated licensing guidelines are in place, and you may opt to keep your current license and delay your rated license assessment until the new guidelines are adopted. The director, Elisha Muhammad, assisted me during today’s visit. Upon arrival, you greeted me and welcomed us into your program. Four (4) classrooms were opened today. I conducted a general walk-through of the indoor and outdoor learning environment. The children were observed participating in free play in their outdoor learning environment, eating lunch and having some rest time. RATED LICENSE STATUS The program holds a 4-star-rated license issued on 7/2/19. The program is in the “held harmless” status and points from the previous assessment are carried forward. The program received 7 points in Program Standards, 4 points in Staff Education, and 1 Quality point through the programmatic option of having an infrastructure of parent involvement. INSPECTIONS The last fire drill was conducted on 7/31/23. The last shelter in place or lockdown was conducted on 7/13/23. The last playground inspection was conducted on 8/1/23. The last sanitation inspection was conducted on 8/8/23. The fire inspection was conducted on 6/13/22. The status of the center’s owner, All My Children Family Resource Center, is listed as current and active on the NC Secretary of State website. During this visit, a full assessment of Child Care Requirements was conducted. I did not assess transportation requirements because the program does not transport children. The following violations were observed and recorded during today’s visit. Violation Number Comment Rule 106 Operator has not scheduled and obtained a fire inspection within 12 months of the previous inspection. Operator did not submit the original approved report to DCDEE within one week of the inspection visit on a form provided by the Division. A current fire inspection was not available during today's visit. The last fire inspection was completed on 6/13/22. 10A NCAC 09 .0304(a) 824 Outdoor play area was not enclosed by fence with a minimum height of 4 feet. The top of the fence, less than six feet, was not free from protrusions. The fence gate chain fabric leading from the older children playground to the younger playground was not free from protrusions during today's visit. GS 110-91(6); .0605((i) 887 Caregivers did not document compliance with visually checking on sleeping infants aged 12 months or younger and/or the documents were not maintained for a minimum of one month. Three children sleep charts were not documented correctly during their rest time. .0606(g) 1314 Emergency information did not name childs health care professional. One child currently enrolled did not have a health care professional listed on the application for review during today's visit. .0802(c)(2) 1316 Emergency medical care information did not contain information needed for safe medical treatment. Two children did not have a hospital preference listed on their application for review during today's visit. .0802 (c)(4) In order to comply with the NC Laws & Rules, any violations cited today must be corrected immediately. I would suggest when children enroll in the program double check to make sure they have completed all required areas on the application before filing them. *F. Cunningham did not have a medical care professional listed I would suggest doing a sleep chart check daily or on a weekly basis. If the educators are turning the sleep charts in once a week, you can check them and provide feedback if needed. I would suggest calling the fire inspector two -three months before your inspection is due to schedule them to come out before the current inspection expires. ANNUAL IN-SERVICE TRAINING The in-service hours were monitored for the annual year August 16, 2022- August 14, 2023. CONSULTATION Some providers are experiencing delays in scheduling their fingerprinting appointments. Criminal record checks can be completed up to six months prior to the expiration date. We are encouraging all staff to begin their renewal process early to avoid lapses in their qualification. HEALTH AND SAFETY TRAININGS Health and Safety trainings are now available through Moodle on the DCDEE website. These trainings dare provided free of charge. You should use your NCID username and password to access the Moodle portal. As per Child Care Rule .1103(b) the Health and Safety trainings must be renewed at least every 5 years. Some of your staff completed the trainings in 2017, they should begin to retake the training. AGENCY UPDATES Please remember to check the Division of Child Development and Early Education website: nchildcare.ncdhhs.gov frequently to stay updated on rule requirements. The North Carolina General Statute 110-90.2(b) requires that all childcare providers must have a criminal background check prior to employment and every three years thereafter. As of July 11th, instead of renewing your criminal background check every three years, you will renew them every five (5) years.
