A checklist was not used to note the requirements monitored today. Upon arrival I was greeted by Ms. Flores. Ms. Flores was in a classroom. The Director, Ms. Smith, arrived within ten minutes of the visit. I completed a general walk-through of the center. I spoke with the owner over the phone during the visit. At the time of the visit, there were a total of twenty-two (22) children present, ranging in age from infant to five (5) years old. The children were playing with materials, interacting with the teachers, and completing routine tasks. LICENSE STATUS Currently, this Child Care Center operates with a Five (5) star license issued March 15, 2022, earning seven (7) points in education, six (6) points in program standards and one (1) quality point. MONITORING During today’s visit, a partial assessment was conducted, monitoring all space occupied by the children, including the outdoor play environment. Child/Staff Ratios and supervision were also monitored. Transportation is not provided; therefore, these requirements were not monitored. The following violation was observed and documented during today’s visit Violation Number Comment Rule 301 Minimum staff/child ratios and group sizes for the number and ages of children in care were not met. The group size ratio was not being maintained in space #4. Fourteen children ranging in age of three to five was being cared for with a maximum group size of twelve. GS 110-91(7);.0713(a-d) To comply with the NC Laws and Rules any violations cited today MUST be corrected immediately. A compliance letter must be received on or before June16, 2026, letter must address each violation, explain how it has been corrected and how the violation will maintain compliance in the future. Please make sure to include: -Facility name -Facility ID number -Each item number The letter can be emailed to Shamequa.Wilkerson-Harris@dhhs.nc.gov COMPLIANCE HISTORY Prior to today’s visit, the program’s compliance history was 94%. According to NC General Statue 110-90(4)(d) requires all child care facilities to maintain a compliance history score of at least 75% for the past eighteen months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action. TECHNICAL ASSISTANCE The following items were discussed during today’s visit to help you maintain quality within your program and to prevent further violations. STAFF/CHILD RATIO/GROUP SIZE Upon arrival the NC PreK teacher was observed in the toddler room, the toddler teacher was observed in the kitchen, and the Preschool teacher was observed in the NC PreK classroom. During my visit the teachers went to their classrooms. The Preschool transitioned to their classroom from the NC Pre-K classroom. It was a total of 14 children being cared for in the NC Pre-K classroom that can only hold twelve children. Adhering to staff/child ratios ensures that children are safe, and that staff are adequately able to supervise and interact with the children. For three- and four-year-old children, the size of the group is even more important than ratios. The recommended group size and child-staff ratio allow three- to five-year-old children to have continuing adult support and guidance while encouraging independent, self-initiated play and other activities. I would recommend that you implement the use of name to face documentation. I would also recommend that you retrain all staff regarding staff child ratio and group size. The amount of staff in attendance was sufficient to not be in staff child ratio and group size violation. A checklist was used to note the requirements monitored today. Upon arrival I was greeted by Carnilla Smith, the Director. You and the owner assisted me with the visit. I completed a general walk-through of the center. At the time of the visit, there were a total of twenty-three (23) children present, ranging in age from infant to five (5) years old. The children were playing with materials, interacting with the teachers, and completing routine tasks. LICENSE STATUS Currently, this Child Care Center operates with a Five (5) star license issued March 15, 2022, earning seven (7) points in education, six (6) points in program standards and one (1) quality point. I reviewed the NC Secretary of State’s website and observed the owner of the facility as ANB Early Care & Education, LLC listed as current/active. INSPECTIONS *The last fire drill was conducted on 5/11/26. *The last emergency drill was conducted on 5/11/26. *The last playground inspection was completed on 5/11/26. *The last sanitation was completed on 10/21/25 with a ‘Superior’ classification. *The last fire inspection was conducted on 5/22/25. MONITORING During today’s visit, a full assessment was conducted, monitoring all space occupied by the children, including the outdoor play environment. New staff CPR/FA, qualification letters and newly enrolled children files were reviewed. All spaces were monitored for supervision, staff/child ratios, materials, equipment and required postings. The program records were reviewed for current inspections. Transportation is not provided; therefore, these requirements were not monitored. This facility does have children under 12 months enrolled, therefore safe sleep requirements were monitored. During the visit I discussed with the owner a concern regarding a bus driver working in a classroom without the qualifications. I reviewed all staff files and staff training worksheets for A New Beginning and A New Beginning III during the visit. Staff and training worksheets were also requested for all drivers. The owner stated none of her centers provide transportation and all staff working in the classrooms have all qualifications to work within the classrooms. I was unable to determine any staff without proper qualifications to work with children during my visit. The following violation was observed and documented during today’s visit Violation Number Comment Rule 301 Minimum staff/child ratios and group sizes for the number and ages of children in care were not met. In space #2 seven two year olds and one (1) one-year old was observed being cared for by one staff member. STAFF/CHILD RATIO Upon arrival I observed space 2 with six two-year-olds, and one child that was one year with one teacher. Lower ratios are most critical for infants and young toddlers (birth to twenty-four months) as infant development and caregiving quality improves when group size and ratios are smaller. In addition, the children’s physical safety and sanitation routines require a staff that is not fragmented by excessive demands. Child-staff ratios in child care settings should be sufficiently low to keep staff stress below levels that might result in anger with children. Caring for too many young children, in particular, increases the possibility of stress to the caregiver/teacher, and may result in loss of the caregiver/teacher’s self-control. Please be reminded that you must follow the ratio of the youngest child. The ratio with a child one year of age is 1 staff member to 6 children. CONSULTATION AND REMINDERS The following items were discussed during today’s visit to improve the quality of your program. HEALTH CONSULTANT Ellie Morrise is the new Child Care Health Consultant. If you should have any health related questions, please reach out to her at morrise@email.unc.edu and/or 919.809.9645. HEALTH AND SAFETY TRAINING Health and Safety training is now available through Moodle on the DCDEE website. This training is provided free of charge. You should use your NCID username and password to access the Moodle portal. The Health and Safety training must be renewed at least every five (5) years. If you completed the training in 2020, you should begin to retake the training now. CRIMINAL BACKGROUND As of July 11, 2022, criminal record checks are now to be renewed every five (5) years instead of three (3) years. Please make arrangements to complete your 5-year re-qualification before the expiration date. ONGOING TRAINING HOURS I observed training hours from 6/3/25 to 5/19/26. All training hours were found in compliance. Upon arrival, I was greeted by the director, Carnilla Smith, who assisted me during today’s visit. LICENSE STATUS The center currently operates with a Five Star license issued on March 15, 2022. The program received seven points for Staff Education, six points for Program Standards, and one Quality Point. It is licensed to serve 35 children on first shift. Prior to today’s visit, I reviewed the NC Secretary of State’s website and noted that the owner of this facility, ANB Early Care and Education, LLC, is listed as current/active. INSPECTIONS/DRILLS STATUS -The last sanitation inspection was completed on 2/25/25, and the center scored a superior rating with eight demerits. -The last fire inspection was completed on 5/22/25. -The last documented outdoor play area inspection was completed on 5/9/25. -The last documented fire drill was conducted on 5/9/25. -The last documented lockdown/shelter-in-place drill was conducted on 5/1/25. -The last annual compliance visit was conducted on 6/13/24. MONITORING I completed a walk-through of the center, visiting four classrooms as well as the outdoor play area. The infants were playing on the floor with the caregiver. The preschoolers were observed engaging in an art activity and transitioning to the playground. NC Pre-K were observed playing freely in centers and transitioning to the restroom. A full assessment of child care requirements was conducted. I used a checklist to monitor all applicable requirements, including but not limited to supervision, staff-child ratios, health and safety requirements, equipment and furnishings, and program records. One new staff file and three other staff files were reviewed, and four children’s files were reviewed. This program does provide transportation using small buses. One bus is not in use right now and another bus was in the shop for repairs. I reviewed the transportation requirements for the third bus and and cited violations related to bus driver qualifications. One child requires emergency medication; therefore, I reviewed the medication permission forms and storage and cited one violation. The center serves children under one year of age, thus, safe sleep requirements were monitored and found in compliance. VIOLATIONS The following violations were observed and documented during today’s visit: Violation Number Comment Rule 847 Parent's medication authorization did not include required information. The parent did not sign the medical authorization form for the emergency medication. 10A NCAC 09 .0803(4)(6-9) 858 Plastic bags, materials that could be torn apart and toy parts small enough to be swallowed were accessible to children under three years of age. Disposable gloves were stored within reach of children in the infant and toddler classrooms. .0604(q) 1044 Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of five years for the date of issuance). One of the bus drivers, J. Rowland, has a qualification letter that expired 12/16/24. G.S. 110-90.2(b) & .2703(n)&(o) 1321 Medical exam or health assessment record was not on file before or within 30 days after admission. A doctor had not completed the exam portion of the medical report form. GS110-91(1) 1757 A valid qualification letter was not on file and available to review at the facility. The center did not have a qualification letter on file for bus driver D. Quick. TECHNICAL ASSISTANCE -Safety is a top priority when providing care for young children. Today I observed disposable gloves within reach of children in the diaper changing area in the infant room and in an unlocked lower cabinet in the toddler room, which poses a suffocation and choking hazard for children under three years of age. I suggest conducting a walk-through of the children’s space prior to children’s arrival each morning, removing any potentials choking hazards and placing them at least five feet high. -If a child has a health care need such as an allergy, asthma, or a chronic condition which requires medication, then a medical action plan and a medication administration permission form must be on file and completed by the child’s parent and health care professional. This form should be updated every six months for as long as the child requires the medication. Today, a child’s permission to administer medication form had not been signed by the child’s parent. Please be sure the parent signs the form today. -It is important to keep children’s medical records on file to ensure children are healthy and able to participate in activities. Today, one child was missing a health assessment. The top portion of the medical report form had been filled out by the parent, but the physician had not completed the bottom portion of the form. I recommend using the children’s file checklist under “Provider Documents” on the DCDEE website and checking files regularly to help you keep track of required records. -Your bus drivers’ files were not available for review today. You stated that the files are kept at another center and they could not be accessed because the owner is out of town. As soon as the owner returns, please ask her to scan and send copies of their drivers licenses to your consultant. I was able to search the drivers’ names in our background check system and found that one did not have a qualification letter, and the other has a qualification letter that expired on 12/16/24. They have 15 days to obtain new qualifying letters; after that, they will not be able to drive or supervise children in child care until they receive new qualifying letters. TRAINING REMINDERS -Training from 6/13/24 to 6/2/25 was reviewed today and results can be found on the attached Staff/Training Worksheet. All required training hours have been completed. Please submit an updated staff/training worksheet which includes your newest staff member, A. Harrell, by 6/4/25. -CPR and First Aid must be renewed every two years. -Health and safety training must be renewed every five years. -ITS-SIDS training must be renewed every three years. RATED LICENSE STATUS The NC State Legislature has extended “hold harmless” status until new rated licensing guidelines are in place, and you may opt to keep your current license and delay your rated license assessment until the new guidelines are adopted. Please use this time to update your WORKS account with your staff members’ education information. You can visit the North Carolina Rated License Project website (https://www.ncrlap.org) for resources regarding the rated license assessment process. AGENCY UPDATES Please check the Division of Child Development and Early Education’s website frequently for any new policies or rules. Go to https://ncchildcare.ncdhhs.gov/, and click on the “What’s New” tab for all agency updates, including QRIS Modernization. I recommend exploring the new pathway options to obtain a rated license. It is important to note that the new QRIS rules are not yet effective. However, the Division is preparing for a gradual transition to the new requirements. Resources, forms, and training will be provided to support you in preparing for new options to earn your Two- through Five-Star Rated License. Upon arrival, I was greeted by the director, Carnilla Smith, who assisted me during today’s visit. LICENSE STATUS The center currently operates with a Five Star license issued on March 15, 2022. The program received seven points for Staff Education, six points for Program Standards, and one Quality Point. It is licensed to serve 35 children on first shift. Prior to today’s visit, I reviewed the NC Secretary of State’s website and noted that the owner of this facility, ANB Early Care and Education, LLC, is listed as current/active. INSPECTIONS/DRILLS STATUS -The last sanitation inspection was completed on 2/25/25, and the center scored a superior rating with eight demerits. -The last fire inspection was completed on 5/22/25. -The last documented outdoor play area inspection was completed on 5/9/25. -The last documented fire drill was conducted on 5/9/25. -The last documented lockdown/shelter-in-place drill was conducted on 5/1/25. -The last annual compliance visit was conducted on 6/13/24. MONITORING I completed a walk-through of the center, visiting four classrooms as well as the outdoor play area. The infants were playing on the floor with the caregiver. The preschoolers were observed engaging in an art activity and transitioning to the playground. NC Pre-K were observed playing freely in centers and transitioning to the restroom. A full assessment of child care requirements was conducted. I used a checklist to monitor all applicable requirements, including but not limited to supervision, staff-child ratios, health and safety requirements, equipment and furnishings, and program records. One new staff file and three other staff files were reviewed, and four children’s files were reviewed. This program does provide transportation using small buses. One bus is not in use right now and another bus was in the shop for repairs. I reviewed the transportation requirements for the third bus and and cited violations related to bus driver qualifications. One child requires emergency medication; therefore, I reviewed the medication permission forms and storage and cited one violation. The center serves children under one year of age, thus, safe sleep requirements were monitored and found in compliance. VIOLATIONS The following violations were observed and documented during today’s visit: Violation Number Comment Rule 847 Parent's medication authorization did not include required information. The parent did not sign the medical authorization form for the emergency medication. 10A NCAC 09 .0803(4)(6-9) 858 Plastic bags, materials that could be torn apart and toy parts small enough to be swallowed were accessible to children under three years of age. Disposable gloves were stored within reach of children in the infant and toddler classrooms. .0604(q) 1044 Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of five years for the date of issuance). One of the bus drivers, J. Rowland, has a qualification letter that expired 12/16/24. G.S. 110-90.2(b) & .2703(n)&(o) 1321 Medical exam or health assessment record was not on file before or within 30 days after admission. A doctor had not completed the exam portion of the medical report form. GS110-91(1) 1757 A valid qualification letter was not on file and available to review at the facility. The center did not have a qualification letter on file for bus driver D. Quick. G.S. 110-90.2(b) & (d) & .2703(e) In order to comply with the NC Laws and Rules, any violations documented today must be corrected immediately. We need to receive your compliance letter by June 16, 2025. The letter must address each violation and explain specifically when and how it was corrected, as well as how you will prevent the same violations from happening in the future. According to NC General Statute 110-90(4)(d), all facilities must maintain a compliance history of at least 75% for the past 18 months. Failure to maintain compliance may result in an administrative action. The center was not in compliance with all applicable minimum licensing requirements during today’s visit and violations were documented that could impact the center’s overall compliance history score. An updated compliance history score will be generated after today’s visit, and you will be informed of the results during the next visit to your center. TECHNICAL ASSISTANCE -Safety is a top priority when providing care for young children. Today I observed disposable gloves within reach of children in the diaper changing area in the infant room and in an unlocked lower cabinet in the toddler room, which poses a suffocation and choking hazard for children under three years of age. I suggest conducting a walk-through of the children’s space prior to children’s arrival each morning, removing any potentials choking hazards and placing them at least five feet high. -If a child has a health care need such as an allergy, asthma, or a chronic condition which requires medication, then a medical action plan and a medication administration permission form must be on file and completed by the child’s parent and health care professional. This form should be updated every six months for as long as the child requires the medication. Today, a child’s permission to administer medication form had not been signed by the child’s parent. Please be sure the parent signs the form today. -It is important to keep children’s medical records on file to ensure children are healthy and able to participate in activities. Today, one child was missing a health assessment. The top portion of the medical report form had been filled out by the parent, but the physician had not completed the bottom portion of the form. I recommend using the children’s file checklist under “Provider Documents” on the DCDEE website and checking files regularly to help you keep track of required records. -Your bus drivers’ files were not available for review today. You stated that the files are kept at another center and they could not be accessed because the owner is out of town. As soon as the owner returns, please ask her to scan and send copies of their drivers licenses to your consultant. I was able to search the drivers’ names in our background check system and found that one did not have a qualification letter, and the other has a qualification letter that expired on 12/16/24. They have 15 days to obtain new qualifying letters; after that, they will not be able to drive or supervise children in child care until they receive new qualifying letters. Upon arrival I was greeted by Carnilla Smith, the Director. You assisted me with the visit. I completed a general walk-through of the center. At the time of the visit, there were a total of twenty-one (21) children present, ranging in age from infant to five (5) years old. The children were playing with materials, interacting with the teachers, and completing routine tasks. LICENSE STATUS Currently, this Child Care Center operates with a Five (5) star license issued March 15, 2022, earning seven (7) points in education, six (6) points in program standards and one (1) quality point. MONITORING During today’s visit, a partial assessment of Child Care Requirements was conducted for all classrooms. The monitoring included CPR/First Aid, criminal background checks and special training requirements for one newly hired staff and five newly enrolled children. The monitoring also included License and permit restrictions, staff/child ratios, supervision, storage of hazardous items, medication, materials/equipment, and all space occupied by the children. INSPECTIONS *The last fire drill was conducted on 3/10/25. *The last emergency drill was conducted 2/3/25. *The last playground inspection was completed 3/10/25. *The last sanitation was completed on 9/8/24 with a “Superior ‘’ classification. *The fire inspection was conducted on 6/5/24. The following violation was observed and documented during today’s visit. Violation Number Comment Rule 807 A safe indoor and outdoor environment was not provided for the children. CONSULTATION AND REMINDERS The following items were discussed during today’s visit to improve the quality of your program. HEALTH AND SAFETY TRAINING Health and Safety trainings are now available through Moodle on the DCDEE website. These trainings are provided free of charge. You should use your NCID username and password to access the Moodle portal. The Health and Safety trainings must be renewed at least every five (5) years. If you completed the trainings in 2020, you should begin to retake the training now. CRIMINAL BACKGROUND As of July 11, 2022, criminal record checks are now to be renewed every five (5) years instead of three (3) years. Please make arrangements to complete your 5-year re-qualification before the expiration date. A report was received by the agency on 11/13/2024. During the visit, I discussed the allegation with the Director, Shay Smith. The owner Darnella Warthen arrived within twenty (20) minutes of the visit. MONITORING I completed a walk-through of the facility. Limited monitoring of child care requirements occurred during today’s visit. I monitored (supervision, child/staff ratios, adequate/approved space, license and permit restrictions). During my initial walk through there were seventeen (17) children present ranging in age from infant to four(4) years old. I completed a second walk through before ending the visit and I observed thirty-two (32) children ranging in age from infant to five (5) years old. I observed the children engaged in free play, interacting with the teachers, and completing routine tasks. ALLEGATION #1 There are concerns regarding supervision. ALLEGATION #2 There are concerns of incident reports not being written for a child who was injured in care. ALLEGATION #3 There are concerns regarding a safe environment. OBSERVATIONS/DISCUSSIONS ALLEGATION #1 During today’s visit I observed adequate supervision in the classroom for infants. The children were observed interacting with the teacher. The Director stated that she has not had any issues concerning supervision. The director stated the teacher did not observe any scratch marks on a child while in care and no incident occurred with any child on 11/7/2024. RESOLUTION Based on my observations and discussion with the Director I was unable to determine if lapses of supervision occurred. Therefore, the allegation is UNSUBSTANTIATED. ALLEGATION #2 This allegation will remain open for further investigation. ALLEGATION #3 During today’s visit each classroom was observed to not have any equipment, toys, and/or items that will cause an unsafe environment. The children were observed in each classroom using materials appropriately. Based on my observations I was unable to determine if an unsafe environment occurred. Therefore, the allegation is UNSUBSTANTIATED. The following violations were observed and documented during today’s visit. Violation Number Comment Rule 201 A room was occupied by more children than the space allowed at 25-sq. ft. of floor space per child. Twelve children were observed being cared for in space #3. Nine children are allowed to be in care in space #3. GS 110-91(6); .1401(f) 301 Minimum staff/child ratios and group sizes for the number and ages of children in care were not met. Staff/Child ratios were not maintained in space #2. Seven children ranging in age of one to two years old and one staff member was observed upon my arrival. Twelve children ranging in age of three and five years old were observed in space #3 with one teacher during today's visit. GS 110-91(7);.0713(a-d) 853 Incident logs were not completed and maintained as required. The incident log was observed not to be maintained. The last documentation in the incident log was documented on 7/30/24. .0802(g)(1-6) To comply with the NC Laws and Rules any violations cited today MUST be corrected immediately. You may want to consider them in order to avoid violations in the future: INCIDENT REPORT LOG During today’s visit it was observed that the incident log has not been maintained. The last documentation in the incident log was dated 7/30/24. The Director stated she was unaware that she needed to document in the incident log. I informed the Director to record the incidents in the log. I gave the director a copy of the incident log for her review and to start documenting the incident reports in the log. I would suggest logging incident reports weekly to make sure that they are completed. STAFF/CHILD RATIO AND CAPACITY Upon arrival space #2 with toddlers and twos was not in staff/child ratio. I observed one staff member with seven (7) children that were one- and two-year-olds. While observing space #3 I observed four additional children arrive. This caused the teacher in space #3 to be out of ratio and room capacity. There were twelve (12) children three to five years of age with one teacher. The capacity to care for children in space #3 was 9 children. The Director stated that she had a call out this morning and the infant teacher was doing the van run. The director stated that she had to care for the infant classroom, and the NC-PreK teacher had to combine the NC PreK class with the preschool class. I discussed with the director and the owner the importance of always being in staff/child ratio. I suggested to them to notify their staff when they have reached their max ratio to ask parents to wait until the next staff person arrives or limit the number of children based on staffing. I also discussed with the Director and owner space #3 can only care for nine (9) children at any time.
