Name of Operation: MIDWAY HEAD START Facility ID: 82000275 Consultant: CARLA HANCHEY-EDWARDS Operation Type: Center Case Number: 0226-254L Visit Date: 3/4/2026 Number Present: 30 Completed Date: 3/4/2026 Age: From 2 To 5 Total Minutes: 110 Time In: 09:25 AM Time Out: 11:15 AM Time In: Time Out: List to Use: Center Type Of Visit: Self Report Announced/Unannounced: Unannounced The purpose of today’s visit was to obtain information related to a self-report received by the Division. During today’s visit, Ms. LaToya Simmons- Director accompanied me during a walk -through of the facility. During the visit, I discussed the information with Ms. L. Simmons- Director in charge and four additional staff members. Based on the information obtained, the following was determined. During today’s visit, I discussed the self-report with the director. The director was given the opportunity to share information, video footage, and information surrounding the allegation. I also reviewed the files of the classroom staff and the child’s file. Summary of Findings Ms. Simmons stated she was absent on 2/19/26, the day the incident occurred and was made aware on 2/20/26 by Ms. C. Williams-Education Disability Specialist that a child had been left unsupervised for seven minutes on 2/19/26. You stated you viewed the video footage of the incident that happened Thursday 2/19/26 at approximately 1:26 pm of the space designated for the 4–5-year-old children and observed a child asleep on a mat in the classroom. The two classroom staff members were observed transitioning from nap time to preparing to go to the bathroom down the hallway. You stated the center- aid returned to the classroom to retrieve her watch and noticed a child sitting on the carpet in the music center. She checked to ensure the child was ok. Ms. Simmons stated the center aid then notified the child’s teachers at which point they realized a child was missing from their group. Ms. Simmons reported the classroom staff did not follow the facility’s procedures during the transition including scanning, counting, and roll calls of the children prior to leaving the classroom. You stated Ms. C. Williams immediately contacted the child’s parents about the incident that had occurred and assured them the child was okay. The child is still enrolled at the facility as of today’s date. I also spoke with the two staff members in the classroom, both stated the children had to go to the bathroom and they were trying to hurry and did not follow their facility policies in transitioning children. The staff stated they regretted the incident and it should not have happened. I also spoke with the center aid who found the child and made sure he was reunited with his classroom teachers. Limited monitoring of the child care requirements occurred during today’s visit. A total of thirty (30) children were present ranging from 2 -5 years of age. The children were adequately being supervised in all the classrooms during today’s visit. Based on the information obtained a child left unsupervised is confirmed. The following violation was confirmed during today’s visit. Violation Number Comment Rule 303 Children were not adequately supervised at all times. A child was left unsupervised for seven minutes. .1801(a)(1-5) Ms. Simmons has implemented the following procedures: 2/20/26 Ms. Simmons stated she conducted a meeting with both staff members and reviewed the facility’s incident and the Active Supervision policies. As a result of this incident, you stated both staff members had received a corrective action. You stated to ensure on-going compliance in the future you have implemented the following: Three staff members will be in classrooms during transitioning and mealtimes. There will also be extension monitoring for the next thirty days of the classrooms by Ms. Simmons and unannounced video reviews by Telamon’s State Safety Safeguard Specialist. Reminders are posted on every classroom door and exit to scan, count, and roll during transitioning to the bathroom, outdoor playground area, or any activities outside the classroom. A mandatory staff meeting was held 2/24/26 where all policies regarding Active Supervision were reviewed with all staff members. The violation must be corrected immediately. A compliance letter is due to me within two (2) weeks of today’s visit. By March 18, 2026, please send me a letter addressing the violation, how the violation was corrected, and how compliance will be maintained in the future. In your letter, be sure to include your facility name, facility ID number and for the item number for the violation cited. You may submit the letter to me electronically at carla.hanchey-edwards@dhhs.nc.gov . If you are unable to correct the violation with the specified time frame, please submit a request for an extension. This request should include a specific plan to correct the violation and any timeframe needed. The request will need approval from management. Technical Assistance/Consultation: Please be reminded that children must be adequately supervised at all times. During today’s visit I suggested doing a name to face check on paper throughout the day to make sure all children are accounted for. During the visit I reviewed the following child care rule regarding supervision with you. 10A NCAC 09 .1801 SUPERVISION IN CHILD CARE CENTERS (a) Children shall be adequately supervised at all times in child care centers. Adequate supervision shall mean that: (1) staff must be positioned in the indoor and outdoor environment to maximize their ability to hear or see the children at all times and render assistance. (2) staff must interact with the children while moving about the indoor or outdoor area; (3) staff must know where each child is located and be aware of the children's activities at all times; Effective July 1, 2025 (4) staff must provide supervision appropriate to the individual age, needs, and capabilities of each child; and (5) staff must be able to see and hear children aged birth to five years old while the children are eating. Please be reminded the confirmed allegations of non-compliance can lead to administrative action. Due to the nature of the violation cited during today’s visit a follow-up visit will occur in the near future to ensure on-going compliance with child care requirements. During the visit the children were observed playing in activity areas and outside on the playground. The theme in the lesson plans posted were on clothes, signs, and the alphabet. The lunch menu met the meal pattern requirements. I monitored the indoor and outdoor environments for compliance with child care requirements. Staff/child ratios, supervision, use of space and capacity were monitored for compliance. The permit, sanitation, evacuation, safe arrival, and departure procedures, first aid chart, menus, activity plans, daily schedules, emergency care plan, emergency telephone numbers, staff records, were all posted at the time of the visit. The storage of medication and hazardous products was also monitored for compliance. The staff and children’s records were also reviewed today. A random selection of staff files was monitored for compliance. Prior to the visit I received your staff and training worksheets. Your signature on these forms will serve as verification that the information provided is accurate. A random selection of children’s files was reviewed, and the children’s record worksheet was completed. LICENSE STATUS: This program currently operates with a five-star license issued April 4, 2019, earning seven (5) points in education component, seven (7) points in program standards, and one (1) quality point based on programmatic options of having enhanced policies approved and parent involvement. Your last fire drill was completed 10/30/25. The last monthly outdoor playground inspection was dated 11/5/25. Your last EPR drill was a lockdown completed 9/9/25. I reminded you that an EPR drill must be completed every three months. Please keep all documentation on file for review. Your last fire inspection was dated 1/27/25. Your last sanitation inspection was completed 5/5/25 with a superior rating. Your rated license application will be submitted to my supervisor once your violation has been corrected and a follow up visit has been completed. The theme in the lesson plans were shapes, pets and buildings. The lunch menu for today consisted of chicken, green beans, watermelon, and milk. Your last fire drill was completed 12/17/24 and your monthly playground inspection was dated 1/7/25. Your last EPR drill was a lockdown dated 10/14/24. During the visit you stated at the present time you were not providing any transportation for any of the childcare children enrolled. One violation was documented and corrected during the visit. Violation Number Comment Rule 1897 The child care administrator and all staff did not complete the Recognizing and Responding to Suspicions of Child Maltreatment training within 90 days of employment. One staff member with a hire date of 7/22/24 did not complete the training within 90 days of employment. The training has been completed as of 12/16/24. .1102(g) Childcare licensing requirements are established to ensure a safe and healthy childcare environment. Therefore, it is important for you to be knowledgeable of all of the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with all of the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the childcare law and rules. Technical assistance regarding the following items were reviewed with you today. During the visit I reminded you all new staff have ninety (90) days from the date of hire to complete the recognizing and responding to suspicious of child maltreatment training. Today a violation was documented and has been corrected for one staff member who completed the training after the ninety days. All flexibilities expired, except for the flexibilities related to the star rated license. I reminded you the health and safety trainings have been relocated from Pro-Solutions to Moodle on the DCDEE website and they are free of charge. I discussed various other training resources, including those online and in-person. Remember continuing professional development training provides you and your staff with the knowledge and skills needed to provide a quality child care program. Please be reminded the health and safety training courses are required to be completed every five years. CBC Provider Portal Technical Assistance & Notification to the Division of New Hires or Residents Technical Assistance Guidance As stated in G.S. 110-90.2 & .2703(r) child care operators are to notify the Division of any new child care providers working who were hired or moved into the child care facility within five business days. The process of notifying the Division has changed and is now captured in ABCMS. This change has been in effect since February 2024. Effective immediately, you will need to obtain a Business NCID and complete Provider Portal training in Moodle at https://www.dcdee.moodle.nc.gov/course/view.php?id=119. No action is needed on your part if you have completed the reference training and are currently using the ABCMS Provider Portal to update information regarding new hires or residents. Once the training has been completed and access has been given, you must verify your facility roster to ensure current staff are noted on the roster. This information should be updated in ABCMS in an ongoing basis as staff members are hired and when their employment is terminated. This satisfies the requirement to notify the Division of new child care providers working who were hired or moved into the child care facility within five business days. The compliance of this rule will be monitored during your next visit. Please note, the hard copy of the Change of Information form will no longer be needed or accepted.
