The facility currently has a three-star license and an 18 month compliance history of 88%. The license and NC childcare law summary were prominently posted. The Secretary of State database was monitored, and JAI AMBA MAA (JAM) CORNELIUS ACADEMY, LLC. is current and active. I was greeted by A. Watley. Ms. Watley accompanied me during the walkthrough of the facility. Staff/child ratio, supervision, capacity, group size and space were observed in compliance today. The center’s Emergency Drill Log and Report was reviewed. Fire drills were documented monthly as required. Shelter in place and/or lockdown drills were documented as required. The playground safety inspections were reviewed and documented. The center last had a sanitation inspection on 4/8/25. The center received 15 demerits and received superior classification. The inspection was completed by the Mecklenburg County Health Department. The center last had a fire inspection on 9/4/2025. There were 56 children in attendance today during the walkthrough. I observed the children participating in free play, teacher directed activities, outdoor play and napping. The playgrounds were monitored during today’s visit. The facility does not provide transportation. I monitored all new staff files since my last visit. Ten percent of existing staff files were monitored. Ten percent of the enrolled children’s files were monitored at random today. There were 4 violations cited during today’s visit. Violation Number Comment Rule 843 A drug or medicine was administered after its expiration date. In spaces 3 and 4, there were expired permission to give dates for diaper creams. 10A NCAC 09 .0803(1)(d) 1045 New staff, who had contact with children, did not receive at least 16 hrs. orientation within first 6 weeks. There was no documentation on file that a staff member completed the required orientation training within 6 weeks of employment. .1101(a) 1067 Each new employee did not complete, within the first two weeks of employment, six clock hours of training in required topic areas. There was no documentation on file that a staff member completed the required orientation training within two weeks of employment. .1101(a)(b) 1874 The Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy was not reviewed with new staff prior to providing care with children and/or a signed acknowledgement with all the required information was not maintained in the staff person's file. Asia Watley, administrator, accompanied me during a walk-through of the facility. During the visit, I discussed the allegations with Ms. Watley and Colleen Shuter, regional director. Limited monitoring of child care requirements occurred during today’s visit. The following violations were observed and/or confirmed during today’s visit. Violation Number Comment Rule 531 Bottles were propped. On March 24, 2025, a staff member propped an infant's bottle on a pillow and on the staff member's leg while feeding. 10A NCAC 09 .0902(b) 904 Child was handled roughly. On March 24, 2025, a staff member handled three infant children in a rough manner by lifting an infant by the head/neck off the floor to her lap, holding a child's pacifier in their mouth while quickly moving the child's head from side to side in a rocking motion, and pulling children by one arm to move them away from her. .1803(a)(1) Violations must be corrected immediately. This center has a three star license and an 18 month compliance history score of 87%. The license and NC child care law summary were prominently posted. Upon arrival, I was greeted by A. Watley, director. Ms. Watley accompanied me during the walkthrough of the facility. There were 67 children present during the walkthrough of the facility. During the visit, I spent time observing space #8, the classroom for children 3 years of age. I observed the children napping. I observed a teacher sitting with a child and assisting with naptime. I spent time observing space #1, the classroom for infants. I observed the teacher sitting on the floor engaging with a small group of infants. The following items were monitored today: supervision, staff/child ratios, permit restrictions, license posted, approved space, storage of hazardous products, storage of medication, staff records and program records. There have been 9 new staff since my last visit. I monitored staff files. The staff and training worksheets were reviewed to confirm existing staff were still current with CPR, First Aid, ITS-SIDS training and criminal background qualifying letters. The center’s Emergency Drill Log and Report was reviewed. Fire drills were documented monthly as required. Shelter-in-place and Lock-Down drills were documented quarterly as required. The playground safety inspections were reviewed. Reports were documented monthly as required. There were 3 violations cited during today’s visit. Violation Number Comment Rule 1032 Child care providers and uncompensated providers who are not substitute providers or volunteers, including the director did not have a medical report on file prior to employment that was signed by a health care professional and/ or the medical report was older than 12 months. A housed temporary staff member did not have a current medical report on file. 10A NCAC 09 .0701(a) 1033 On or before the first day of work, all staff, including the director and individuals who volunteer more than once per week did not provide results indicating that they were free of active TB and/or TB test or screening was older than 12 months. A housed temporary staff member did not have a current TB report on file. .0701(a) 1067 Each new employee did not complete, within the first two weeks of employment, six clock hours of training in required topic areas. Colleen Shuter, administrator, accompanied me during a walk-through of the facility. During the visit, I spoke with Ms. Shuter. Limited monitoring of child care requirements occurred during today’s visit. The following violations were observed and/or confirmed during today’s visit. Violation Number Comment Rule 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. On August 20, 2024, a staff member attempted to lay three, two-year-old children down on their cots by lifting and adjusting them under their arms, multiple times despite the children not wanting to lay down. In addition, the same staff member carried two, two-year-old children by one arm for approximately two feet back to their cot. G.S. 110-91(10) All violations documented above must be corrected immediately. A written, dated, and signed letter of compliance must be submitted to me within one week, by (October 17, 2024), describing how and when the violations were corrected and how compliance will be maintained in the future. I observed the children participating in free play, outdoor play, breakfast and routines. The playground was monitored during today’s visit. Michelle Cuthbertson, Child Care Consultant, was also present during the visit. Asia Watley, administrative assistant, accompanied us during a walk-through of the facility. During the visit, I discussed the allegations with Ms. Watley, Shantae Robinson, administrator, and two additional staff members. Limited monitoring of child care requirements occurred during today’s visit. The following violations were observed and/or confirmed during today’s visit. Violation Number Comment Rule 544 Screen time was offered to children under three years of age. On April 19, 2024, one-year-old children were given screen time. .0510(f) 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. On different occasions, two staff members used a loud and aggressive tone when speaking to one and two-year-old children. In May 2024, a staff member swatted a one-year-old child with a shoe while trying to get their attention. G.S. 110-91(10) 904 Child was handled roughly. In April 2024, during naptime a staff member forcefully tried to lay a one-year-old child on a cot, approximately five times,for approximately thirty (30) seconds. .1803(a)(1) 1045 New staff, who had contact with children, did not receive at least 16 hrs. orientation within first 6 weeks. A staff member who began employment on May 9, 2024, did not have completed documentation of their orientation hours on file. .1101(a) 1067 Each new employee did not complete, within the first two weeks of employment, six clock hours of training in required topic areas. A staff member who began employment on May 9, 20244, did not have completed documentation of their training hours on file. .1101(a)(b) Violations must be corrected immediately. You achieved the following score on the assessments: ECERS-R-5.38 and ITERS-R 3.61. Ms. Asia Watley Administrative Assistant and Shantae Robinson, Assistant Director, assisted us during the visit. Michelle Cuthbertson, Child Care Consultant, accompanied me during today’s visit. Currently this center operates with a Temporary License, issued on A 16, September 21, 2024, to March 21, 2024. The restrictions include, Daytime Care Only; Children 2 ½ years of age are in rooms with direct exits; Age Range 0-12. I used the Child Care Center Item Number Listing as a basic monitoring tool to assess compliance with all applicable childcare requirements pertinent to this facility. In addition to monitoring for health and safety, I reviewed center files and required postings. During the walk-through I observed free choice play throughout both classrooms. Interactions were observed to be nurturing and developmentally appropriate. The following items were posted in the classrooms: Daily schedules, activity plans, staff/child ratio worksheets, emergency numbers, emergency procedures, arrival/departure procedures, and the summary of law. Indoor Learning Environment: Staff/child ratio was observed and in compliance. The outdoor inspections and fire drill report forms were reviewed during today’s visit. The forms were current and up to date. The last fire drill was observed documented was completed on 2/28/24. The last monthly playground inspection observed documented was completed on 3/04/24. Sanitation Inspection: The last sanitation inspection was made on 10/09/2023 by the Environmental Health Specialist. An “Approved” classification was issued with 21demerits noted on the grade card. Fire Inspection 9/27/23 and approved for daytime care only. Nutrition: Meals met nutritional value during today’s visit. The menu posted did not include granola bites and yogurt, which was observed along with the bagel and cream cheese, fruit, and milk. Weapons: Your facility is in compliance with Child Care Requirements regarding firearms. Rated License: A review of each item scoring lower than 5 on the Environment Rating Scale assessment for ITERS-R and ECERS-R was discussed with you and documented on the form attached to the visit summary. Curriculum: You stated you already use the Creative Curriculum accompanied with NC Foundations in your four-year-old classrooms. Your temporary license will expire on March 21, 2024. The ITERS-R, due to the score being lower than a 4.0 is being reassess. I discussed with the administrator assistant, if the result from the re-assessment is not completed prior to the expiration of the temporary license, the current scores of both the ECERS-R and ITERS-R will be used to determine the score. We discussed the program has currently experience a dramatic change in staff. We discussed the education component and the fragile state the education component has caused the facility. I explained that the temporary license process again and the expectation of maintaining at least 9 points to maintain a 3 Stars for any families. The rated license packet will be processed with the points you have earned prior to March 21, 2024. We discussed that you must meet enhanced ratios along with higher ERS scores to increase your star rating. As discussed, the staff/child ratio form will need to be updated in each classroom by placing a check mark in the box for voluntary enhanced ratio requirements. The facility had the Environment Rating Scales (ERS) for ITERS-R was completed on February 8th, 2024 and ECERS-R was completed on February 12th, 2024. I reviewed the results with both administrators and discussed potential licensing violations that were observed during the assessments. They understand that should these concerns be observed during future licensing visits, violations of childcare requirements could be cited. The ERS Review Form was completed and will be attached to the Rated License Packet. I also reviewed the indicator items that scored less than 4 and gave suggestions on how the staff could improve those scores. Rated License Assessment Education Component The director qualifies at the 7-points level as an Administrator. At 50% only 3 lead teachers were used to calculate the projected education points for lead teachers. As of today, the lead teachers and the teacher points could not be determined during the visit. I stated, after I return to my office, I will complete the education points and update the administrators upon receipt. Program Component ECERS-R 5.38 ITERS-R-3.61 The current average ERS score is 4.0. The program has requested a reassessment of the ITERS-R, therefore the facility’s total points could not be determined during today’s visit. Quality Point Option The facility has not determined the quality point option as of today’s visit. I have printed and stated that this form is to be completed and sent to me by Friday, 5/8/24. Total points could not be determined during today’s visit. The following violations were cited during today's visit. Violation Number Comment Rule 526 Menus for all meals and snacks were not current or posted where easily seen by parents and cook. The menu was not current with what the children were eating for breakfast. 10A NCAC 09 .0901(b) 1045 New staff, who had contact with children, did not receive at least 16 hrs. orientation within first 6 weeks. Please note that any violations cited today or during future visits will negatively impact your compliance history. North Carolina General Statute 110-90(4)(d) requires all child care facilities to maintain a compliance history of at least seventy-five percent (75%) for the past 18 months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action against the facility's license. Rated License: I reminded you that if you receive a four or five-star license, then you will be required to have an approved curriculum for children four years of age. You currently are already using Creative Curriculum for Preschoolers in both of your preschool classrooms. As discussed, at the end of your temporary license period you must be at least a three (3) star facility in order to continue to provide care for children who receive subsidy. I greeted Ms. McAllister, the Administrator, and stated the purpose of today’s visit. Currently this center operates with a Temporary License, issued on September 21, 2023. The facility has a capacity of 177 students aged 0-12 years old. The temporary time period expires on March 21, 2024. The NC Secretary of State website was viewed before the visit and AI AMBA MAA (JAM) Cornelius Academy, LLC was current/active as of September 29, 2021. If any changes to the corporation need to be made or you decide to sell your business, then you must notify your consultant at least thirty days prior to any changes occurring. The license cannot be bought, sold, subleased, transferred to another person or location, or inherited. Indoor Learning Environment: Upon arrival, staff/child ratio was observed and was in compliance. This program operates a total of eleven (11) classrooms approved space. Currently, the facility has 31 children enrolled and 24 children were present during today's visit. Children were observed participating in free choice play throughout the learning environment. The staff was observed engaged in play within throughout the classroom environment small group activity. I reviewed all program records requirements. I discussed connecting with a QED Specialist at Child Care Resources, Inc. The Child Care Specialist can assist the classroom teachers and with room arrangements/suggestions, staff/child interactions and necessary materials needed to score well on the ECERS assessments. Outdoor Learning Environment: Was monitored and in compliance with Child Care Requirements. Records: The Staff and Training Worksheet was completed prior to today’s visit. Children: Three (3) new children ‘s records were reviewed during today’s visit. No violations were observed during this review. Program: I reviewed all the required records. The fire drill report was completed monthly, and the last documented drill was 12/20/23. The last outdoor environment inspection was completed on 1/08/2024. Inspections: Sanitation Inspection was conducted on 10/09/2023 with an Approved classification and 21 demerits. Fire Inspection was completed 9/27/23 and the facility was approved for daytime only. All required items were posted in the Lobby. Nutritional Guidelines were met during today’s visit. Lunch was comprised of Cheeseburgers on Wheat Bread, green beans, oranges, and milk. Weapons: Your facility reported that they were in compliance during today’s visit with Child Care Requirements regarding firearms. One violation were cited and corrected during today's visit. Rated License: We discussed the two-component rated license process prior to today’s visit. We discussed the three components: Program, Education and Quality Point. I provided the quality point document during today’s visit for the administrator to read over. During the previous visits (pre-licensing and 1st temp visit) I have encouraged all staff at hire to complete their Works application to have their education evaluated. I will process your rated license packet with the staff’s education that has been previously evaluated. I explained and discussed enhanced ratios and enhanced space with you. I explained that if you receive a four or five-star license, then you will be required to have an approved curriculum for children four years of age. The facility has already adopted the Life Essentials for Preschool. As discussed, at the end of your temporary license period you must be at least a three (3) star facility in order to continue to provide care for children who receive subsidy. You must have earned enough points for 3-5 stars in order to continue receiving subsidy dollars. We reviewed that this may be difficult for some programs without an Environment Rating Scale. You complete the application for the Rated License Request during today’s visit for me to request the ERS Scale. The administrator and I discussed that currently she received her level three administrator course. We discussed that her two (2) of her staff have completed their AA and three (3) staff members completed their BA degrees. I stated that she will need to make sure all of have staff have sent in their official transcripts to WORKS. I stated that I am only allowed to evaluate education by using the lowest education for the entire program. I stated that all education must be submitted to WORKS for their evaluation prior to the 3rd temp visit. Health and Safety Trainings: The Child Care Development Block Grant (CCDBG), also called the Child Care Development Fund (CCDF), is a federal grant which provides funding for childcare subsidies for low income working families and improvements in childcare quality. The recent reauthorization of CCDBG, Child Care and Development Block Grant Act of 2014, brought for the first time in 18 years new state requirements. These requirements promote the health and safety of children in childcare, create continuity of access to subsidies for low-income families, better educate parents and the general public about the childcare choices available to them, and improve the overall quality of early care and education programs. States must have pre-service or orientation and on-going minimum health and safety training requirements in place for childcare providers. The trainings must cover the following content areas: * Administration of medication * Appropriate precautions in transporting children * Building and physical premises safety * Pediatric First Aid and CPR appropriate for the ages of children in care * Prevention and control of infectious diseases, including immunizations * Prevention of and response to emergencies due to food and allergic reactions * Prevention of shaken baby syndrome and abusive head trauma * Prevention of SIDS and use of safe sleeping practices * Recognizing and Responding to child abuse and neglect * Handling and storage of hazardous materials and the appropriate disposal of bio-contaminants * Emergency preparedness and response planning for emergencies To help childcare providers meet the new training requirements, the Division of Child Development and Early Education has Moodle Trainings set up and can be accessed through the Divisions website: ncchildcare.ncdhhs.gov. Technical Assistance: Make sure all bottles containing harmful substance, such as sanitizing solution and disinfectant solution should be kept at 5 feet from the floor. During today’s visit, two bottles were observed hanging below five feet in the preschool classroom. I reminded the Chef and Administrator that corrections should be made on the menu prior to parents’ arrival for the day. Currently this center operates with a Temporary License, issued on September 21, 2023. The restrictions include daytime care only and Children under 2 ½ years old in rooms with direct exits only. The fire drill report was discussed today and was observed in compliance with the latest date of 9/27/2023. The playground inspection was observed completed on 10/06/2023 during today’s visit The last fire inspection was conducted on 08/29/23 and approved for daytime care only. The last sanitation inspection was conducted on 10/09/23 with an Approved Rating and twenty-one (21) demerits. Transportation: This program does not participate in transportation. The outdoor learning environment was monitored during today’s visit and observed in compliance with child care rules/laws. I also revisited the measurements for each of the playgrounds. Records: All staff’s records were reviewed during today’s visit. Three (3) child’s record was reviewed during today’s visit. The following violations were observed. Nutrition: Today’s menu, the sliders (meat with cheese), potatoes bread/roll, oranges, and 1 % milk. Weapons: Your facility is in compliance with Child Care Requirements regarding firearms. Violations observed today were discussed with you and documented on the Visit Summary left with you at the conclusion of this visit. Violation Number Comment Rule 114 A summary of the NC Child Care Law was not given to a parent of every child enrolled in the center. Three (3) children's files monitored did not have a signed written statement for the summary of the NC Child Care Law for each child on file. GS 110-102 427 Children three years old or older were in care and the schedule did not include times and/or activities that were developmentally appropriate for the children in care. The activity plan posted did not have a current date. GS 110-91(12); .0508(d)(2) 511 Foods and beverages with little or no nutritional value were available often and not just for special occasions. A Red Bull can drink was observed in classroom #4, visible to children. .0901(i) 540 An individual written feeding plan was not provided by child's parent or health care provider or was not followed and posted. (omit posting for centers located in a residence). During today's visit, one (1) infant feeding plan was not completed nor posted in the space the child was being care for. 10A NCAC 09 .0902(a) 812 Electrical outlets and power strips, not in use, which were located in space used by children did not have safety outlets or were not covered with safety plugs unless located behind furniture or equipment that cannot be moved by a child. I observed one (1) outlet without a safety plug accessible to children in space #4. 10A NCAC 09 .0604(c) 842 A drug or medication was administered without written authorization and/or instructions from a child's parent or authorized health professional. An over the counter diaper cream tube, did not have sign authorization present in space #4 during today's visit. 10A NCAC 09 .0803(1)(a & b) 858 Plastic bags, materials that could be torn apart and toy parts small enough to be swallowed were accessible to children under three years of age. I observed a bag of diapers in a plastic covering accessible to children under the age of three in space #4. .0604(q) 887 Caregivers did not document compliance with visually checking on sleeping infants aged 12 months or younger and/or the documents were not maintained for a minimum of one month. In spaces #6 and #7, a sleep chart was not made available during today's visit. .0606(g) 1203 Operational policies were not discussed with parents on or before the child's first day and/or they were not notified in writing of all changes. Three (3) children's files monitored did not have a signed written statement (receipt) for the operational policy for each child on file. 10A NCAC 09 .0514(b) 1322 A written statement from each child's parent giving standing permission which may be valid for up to twelve months for participation in off premise activities that occur on a regular basis was not available. Currently this center operates with a Temporary License, issued on September 21, 2023. The restrictions include daytime care only and Children under 2 ½ years old in rooms with direct exits only. Age ranging from 0-12 years of age. The NC Secretary of State website was viewed before the visit and JAI AMBA MAA (JAM) Cornelius Academy, LLC- current/active as of September 29, 2021. If any changes to the company need to be made or you decide to sell your business, then you must notify your consultant at least thirty days prior to any changes occurring. The license cannot be bought, sold, subleased, transferred to another person or location or inherited. Indoor Learning Environment: Upon arrival, Ms. McAllister greeted us at the door. We stated the purpose of today’s visit. Twenty-four (24) children were observed present during the visit. There are thirty-eight (38) children enrolled at this program. During the morning arrival children were engaged in free choice play, large group time activities and outdoor activities. The fire drill report was discussed today and was observed in compliance with the latest date of 9/27/2023. The playground inspection was observed completed on 10/06/2023 during today’s visit The last fire inspection was conducted on 08/29/23 and approved for daytime care only. The last sanitation inspection was conducted on 10/09/23 with an Approved Rating and twenty-one (21) demerits. Transportation: This program does not participate in transportation. The outdoor learning environment was monitored during today’s visit and observed in compliance with child care rules/laws. I also revisited the measurements for each of the playgrounds. Records: All staff’s records were reviewed during today’s visit. Three (3) child’s record was reviewed during today’s visit. The following violations were observed. Nutrition: Today’s menu, the sliders (meat with cheese), potatoes bread/roll, oranges, and 1 % milk. Weapons: Your facility is in compliance with Child Care Requirements regarding firearms. Age ranging from 0-12 years of age. The NC Secretary of State website was viewed before the visit and JAI AMBA MAA (JAM) Cornelius Academy, LLC- current/active as of September 29, 2021. If any changes to the company need to be made or you decide to sell your business, then you must notify your consultant at least thirty days prior to any changes occurring. The playground inspection was observed completed on 10/06/2023 during today’s visit The last fire inspection was conducted on 08/29/23 and approved for daytime care only. The last sanitation inspection was conducted on 10/09/23 with an Approved Rating and twenty-one (21) demerits. Transportation: This program does not participate in transportation. The outdoor learning environment was monitored during today’s visit and observed in compliance with child care rules/laws. I also revisited the measurements for each of the playgrounds. Demisha McAllister, Administrator, assisted us with the visit today. Traci Meyer Carpetner, Child Care Consultant, accompanied me on today’s visit. Currently this center operates with a Temporary License, issued on September 21, 2023. The restrictions include daytime care only and Children under 2 ½ years old in rooms with direct exits only. Age ranging from 0-12 years of age. The NC Secretary of State website was viewed before the visit and JAI AMBA MAA (JAM) Cornelius Academy, LLC- current/active as of September 29, 2021. If any changes to the company need to be made or you decide to sell your business, then you must notify your consultant at least thirty days prior to any changes occurring. The license cannot be bought, sold, subleased, transferred to another person or location or inherited. Indoor Learning Environment: Upon arrival, Ms. McAllister greeted us at the door. We stated the purpose of today’s visit. Twenty-four (24) children were observed present during the visit. There are thirty-eight (38) children enrolled at this program. During the morning arrival children were engaged in free choice play, large group time activities and outdoor activities. The fire drill report was discussed today and was observed in compliance with the latest date of 9/27/2023. The playground inspection was observed completed on 10/06/2023 during today’s visit The last fire inspection was conducted on 08/29/23 and approved for daytime care only. The last sanitation inspection was conducted on 10/09/23 with an Approved Rating and twenty-one (21) demerits. Transportation: This program does not participate in transportation. The outdoor learning environment was monitored during today’s visit and observed in compliance with child care rules/laws. I also revisited the measurements for each of the playgrounds. Records: All staff’s records were reviewed during today’s visit. Three (3) child’s record was reviewed during today’s visit. The following violations were observed. Nutrition: Today’s menu, the sliders (meat with cheese), potatoes bread/roll, oranges, and 1 % milk. Weapons: Your facility is in compliance with Child Care Requirements regarding firearms. Violations observed today were discussed with you and documented on the Visit Summary left with you at the conclusion of this visit. Violation Number Comment Rule 114 A summary of the NC Child Care Law was not given to a parent of every child enrolled in the center. Three (3) children's files monitored did not have a signed written statement for the summary of the NC Child Care Law for each child on file. GS 110-102 427 Children three years old or older were in care and the schedule did not include times and/or activities that were developmentally appropriate for the children in care. The activity plan posted did not have a current date. GS 110-91(12); .0508(d)(2) 511 Foods and beverages with little or no nutritional value were available often and not just for special occasions. A Red Bull can drink was observed in classroom #4, visible to children. .0901(i) 540 An individual written feeding plan was not provided by child's parent or health care provider or was not followed and posted. (omit posting for centers located in a residence). During today's visit, one (1) infant feeding plan was not completed nor posted in the space the child was being care for. 10A NCAC 09 .0902(a) 812 Electrical outlets and power strips, not in use, which were located in space used by children did not have safety outlets or were not covered with safety plugs unless located behind furniture or equipment that cannot be moved by a child. I observed one (1) outlet without a safety plug accessible to children in space #4. 10A NCAC 09 .0604(c) 842 A drug or medication was administered without written authorization and/or instructions from a child's parent or authorized health professional. An over the counter diaper cream tube, did not have sign authorization present in space #4 during today's visit. 10A NCAC 09 .0803(1)(a & b) 858 Plastic bags, materials that could be torn apart and toy parts small enough to be swallowed were accessible to children under three years of age. I observed a bag of diapers in a plastic covering accessible to children under the age of three in space #4. .0604(q) 887 Caregivers did not document compliance with visually checking on sleeping infants aged 12 months or younger and/or the documents were not maintained for a minimum of one month. In spaces #6 and #7, a sleep chart was not made available during today's visit. .0606(g) 1203 Operational policies were not discussed with parents on or before the child's first day and/or they were not notified in writing of all changes. Three (3) children's files monitored did not have a signed written statement (receipt) for the operational policy for each child on file. 10A NCAC 09 .0514(b) 1322 A written statement from each child's parent giving standing permission which may be valid for up to twelve months for participation in off premise activities that occur on a regular basis was not available. Three (3) children's files monitored did not have a signed written statement for off-premise activities for each child on file. .1005(b)(4) 1851 The operator did not notify the parent of each child enrolled in writing of the smoking and tobacco restriction. Three (3) children's files monitored did not have a signed written documentation from parent, receipt of the smoking and tobacco restriction for each child on file. .0604(j) 1908 A child's file did not have a statement with parent signature acknowledging receipt and explanation of the Prevention of Shaken Baby Syndrome and Abusive Head Trauma policy and/or the acknowledgement did not have all the required information. Three (3) children's files monitored did not have a signed acknowledging receipt of prevention of shaken baby syndrome and abusive head trauma policy for each child on file. .0608(b)(1-6) The next two Temporary Time Period visits will be unannounced. During those visits a full assessment of the center's ability to maintain compliance with all applicable Child Care Requirements will be conducted. Please note that any violations cited today or during future visits will negatively impact your compliance history. North Carolina General Statute 110-90(4)(d) requires all child care facilities to maintain a compliance history of at least seventy-five percent (75%) for the past 18 months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action against the facility's license. Rated License: We discussed the two-component rated license process. You stated that you want to apply for the rated license and have the Environment Rating Scale assessment completed. I explained and discussed enhanced ratios and enhanced space with you. I explained that if you receive a four or five-star license, then you will be required to have an approved curriculum for children at four years of age. We discussed you are using Life Essentials, Kiddie Academy adoptions for Preschoolers. As discussed, at the end of your temporary license period you must be at least a three (3) star facility to continue to provide care for children who receive subsidy. Environment Rating Scale: Since you want to have the Environment Rating Scale completed, I recommended that you visit www.ncrlap.org for supplemental materials for preparing for the Environment Rating Scale Assessments. WORKS: Emergency Preparedness and Response: The rules are designed to assist licensed child care programs to be adequately prepared to respond to the needs of children and others in the event of disasters and emergencies. As these rules will have an impact on your facility, please review the information below carefully and let me know if you have any questions. * Detailed information about the new emergency preparedness and response rules can be found at: http://ncchildcare.nc.gov/providers/pv_emergency.asp . * One person from your facility must take the Emergency Preparedness and Response in Child Care training. A copy of the Emergency Preparedness and Response Training documentation must be on file for review. * Once the training is completed, the trained staff must complete an EPR Plan on a template at the following website https://rmp.nc.gov/portal/portal.aspx within four (4) months. If you do not have a computer, you may access one at a public library. To get on the template you will need an email address and an NCID. Detailed instructions for getting an NCID and for accessing the template are on the Division’s website on the Emergency Preparedness tab. * After you complete the Emergency Preparedness and Response in Child Care training, you must conduct either a shelter-in-place or a lockdown drill every three months. A new form has been created to document these additional drills as well as the fire drills. It is under the Provider Documents tab titled, “Emergency Drill Log.” Health and Safety Trainings: The facility’s staff members are currently and continuing receiving trainings on all the health and safety trainings. Please continue to take the required training in the following content areas: The trainings must cover the following content areas: * Administration of medication * Appropriate precautions in transporting children * Building and physical premises safety * Pediatric First Aid and CPR appropriate for the ages of children in care (Required) * Prevention and control of infectious diseases, including immunizations * Prevention of and response to emergencies due to food and allergic reactions * Prevention of shaken baby syndrome and abusive head trauma * Prevention of SIDS and use of safe sleeping practices * Recognizing and Responding to child abuse and neglect (Required Training) * Handling and storage of hazardous materials and the appropriate disposal of bio-contaminants * Emergency preparedness and response planning for emergencies The following violations were cited during today’s visit. Technical Assistance: 1. All activity plan should be dated either monthly or weekly and accessible to the families. 2. Plastic should not be accessible to children under the age of 36 months. 3. Please make sure you check the electrical outlets around the building, especially in your classroom spaces. 4. Sleep charts are required for each space that children take a nap. 5. Feeding schedules should be completed and posted for easy reference by staff working in the infant classrooms. 6. A staff member’s Red Bull was observed in classroom space #4. Staff shall role model appropriate eating behaviors by consuming only food or beverages that meet the nutritional requirements specified in Paragraph (a) of this Rule in the presence of children in care. 7. Please make sure that you review all children’s records thoroughly to make sure you reduce the amount of missing paperwork for each child’s record. Please use the children’s records checklist to make sure all records are on file. Please make sure you are paying attention to the required signature for documents. 8. Please make sure you are paying attention to dates on application and the date children are enrolled, making sure you are complying with child care requirement of medical report and immunization records are on file after 30 days of enrollment. You are currently minimum ratio requirements at this time.
