I monitored the indoor and outdoor environments for compliance with child care requirements. Staff/child ratios, supervision, use of space and capacity were monitored for compliance. The permit, sanitation, evacuation, safe arrival and departure procedures, no smoking signage, first aid chart, menus, activity plan, daily schedule, staff/child ratios, emergency medical care plan, emergency telephone numbers and a summary of NC Child Care Law were all posted at the time of the visit. The storage of medication and hazardous products was also monitored for compliance. A sample of children's records, new staff files and a sample of existing staff files were reviewed during the visit. The last fire drill was documented as conducted on 1 at 1-5-26 10:55 am with an evacuation time of three minutes. The last outdoor inspection was documented as conducted on 1-5-26. A shelter in place drill was documented as conducted on 1-5-26 at 10:59 am. An approved fire inspection was completed on 11-10-25. A sanitation inspection was last completed on 7-21-25 with seven demerits and a superior classification. The incorporation status of The Nest School, Inc. was verified as current and active during the visit using the Secretary of State's website. The children were observed during circle time, playing outside, and in free play. Additionally, one group was observed participating in an indoor gross motor activity. Lunch during the visit consisted of chicken nuggets, broccoli, peaches, slice whole grain bread and milk. A five star child care center with six points in education, six points in program standards and one quality point was issued to you on 10-2-21. Based on information provided and observations made during the visit you continue to meet the requirements previously met to obtain such a license. Violation Number Comment Rule 428 A current activity plan was not posted for each group of children for reference. The activity plans posted in spaces 1 and 7 were not dated and could therefore not be considered as current. GS 110-91(12); .0508(a) You attended the Director's Meeting held by DCDEE on 10-7-25 during which the new child care requirements in section .3200 pertaining to two through five stars were reviewed. You stated today that you are planning to apply for a new rated license and that your goal is to maintain a five star license. I reviewed the pathways with you and you stated that you were not certain at this time which pathway would be selected. However, you stated that it was your understanding that the corporation submitted their curriculum to DCDEE for approval and that they were researching accreditation. We briefly reviewed the requirements for Family and Community Engagement and the Continuous Quality Improvement (CQI) for the facility and each individual staff member. These forms can all be found on the DCDEE website, under QRIS Modernization on the What's New tab. I encouraged you to become familiar with these forms and to share the individual CQI form with the staff members. As we discussed, should you choose the programmatic pathway that includes the Environment Rating Scales, each classroom will need to complete a three month self study using the Infant Toddler Environment Rating Scale 3rd Edition or the Early Childhood Environment Rating Scale 3rd Edition. You can find more information about the self study process, along with the necessary forms, on the North Carolina Rated License Assessment Project website (NCRLAP.org). I recommended that you have all staff members review their information in the WORKS database to determine if the information is up to date. If not, they will need to submit new official transcripts to the Workforce Unit. Please have them contact this until directly for questions pertaining to the their WORKS account. As we discussed, the goal will be for you to apply for a new rated license between today's visit and May, 2026. All application documents, including the ERS Request form, can be found on the DCDEE website. Please feel free to contact me if you have questions about the various pathways or the application process. If needed, I can contact a technical assistance visit to assist you with the transition process. The violation documented was corrected during the visit; therefore a compliance letter was not required. Becky Jackson, Lead Child Care Consultant, accompanied me on today's visit. The allegations were as follows: There is a concern of that the emergency medical care plan was not followed. There is a concern related to incident reports. The allegations was reviewed you and you were given an opportunity to provide information and ask questions. During the visit, we reviewed the incident logs and incident reports for May, 2024 to December, 2024. We also reviewed one child's file. While reviewing the incident logs and reports, we noted the following: - Six incident reports listed on the log for a two year old female child were not available in the binder or the child's file. According to the log, these incidents occurred on 5-20-24, 9-24-24, 10-7-24, 10-9-24, 12-4-24 and 12-12-24. - Two incident reports dated 10-17-24 and 10-29-24 for this same child were available, but were not listed on the incident log. - On 9-26-24, you were notified by email from the child's parent that medical treatment was sought for this child following two open skin bites that occurred on 5-17-24 and 5-20-24. Incident reports for these two injuries were not submitted to DCDEE as required. Based on observations made and information obtained, the allegation pertaining to incident reports was confirmed and three corresponding violations were documented. We reviewed the center's Medical Action Plan, which was last updated on 7-1-24. You explained that when a child is injured while in care, the staff members in the classroom notify you or your assistant if you are not available. You stated that following this notification, you or your assistant go to the classroom to determine the level of injury and what type of care is needed. You also stated that either you or your assistant immediately notify a parent if the child sustains a serious injury, such as a head injury or a bite that breaks the skin. You went on to say that if you cannot reach the parent by phone, you contact them through messenger in your software program. You stated that when possible pictures of the injury are also sent to the parent. These two steps are outlined on the medical action plan under item 6 (Person in center responsible for determining the degree of care needed) and item 13 (Persons in center responsible for notification of parents or emergency contact of illness/accident) and both you and your assistant are listed as the staff members responsible for these items. Based on the information provided, your plan following in injury meets this action plan. However, based on additional information provided to DCDEE, while this parent was notified by phone of the 5-17-24 bite that broke the skin, the child's parent was not contacted following the 5-20-24 bite that also broke the skin. When asked, you were not able to locate verification that the previous administrator contacted the parent following the 5-20-24 incident. Therefore, the allegation pertaining to the medical action plan was confirmed and a violation was documented. On 2-7-23, a Supervision Plan for the program was submitted as required by the Corrective Action Plan (CAP) included in the written warning issued by DCDEE on 1-19-23. This plan was approved on 2-7-23. Based on information provided in the CAP, once approved, this plan was to be immediately implemented and permanently incorporated into the facility's operating procedures. According to the plan, the following steps will be taken when an incident occurs: "Staff members have (been) reminded of the policies of reporting incidence to administrators and parent. Staff members are required to fully complete a DCDEE incident form upon an accident/injury of a child. This form must be signed by the teacher and parent. Depending on the severity of the incident/accident, a parent/guardian can be notified by phone call or notified of incident during pick up. Reports must be completed on the day of the incident." Based on the findings during today's visit, this plan was not followed as required following an accident/injury. Incident reports were not available for all incidents that occurred for this two year old child, nor were the child's parents was not notified of the bite that broke the skin on 5-20-24. The written policies, procedures and plans required in a CAP must be permanently incorporated into your facility's operating procedures and failure to do so may result in the issuance of a more stringent administrative action. Violation Number Comment Rule 108 The operator made an effort to falsify information. During the 1-16-25 complaint visit, the administrator provided inaccurate information when directly asked if they were notified that medical treatment was sought for a child following injuries that occurred on 5-17-24 and 5-20-24. During the 2-4-25 visit, while reviewing an email from a child's parent, the administrator provided inaccurate information when asked if the parent notified her in the email that medical treatment was sought for their child following injuries on 5-17-24 and 5-20-24. G.S. 110-91(14) 852 Incident reports were not completed each time a child was injured, it did not include all the information required in rule, it was not signed by the parent and/or it was not maintained in the child's file. Incident reports that were listed on the log were not available for review for injuries to a two year old child on the following dates: 5-17-24, 9-24-24, 10-7-24, 10-9-24, 12-4-24, and 12-12-24. .0802 (e) 853 Incident logs were not completed and maintained as required. Incident reports were not logged for incidents that occurred on 10-17-24 and 10-29-24. .0802(g)(1-6) 873 Center staff did not follow the EMC plan. A parent was not contacted by phone on 5-20-24 following a bite to the face that broke the skin. 10A NCAC 09.0802(a) 1911 An incident report was not completed and mailed to a Division representative within seven days after the incident when medical treatment was required. Incident reports were not submitted for an injuries that resulted in medical treatment that occurred on 5-17-24 and 5-20-24. .0802(f) To ensure the safety of the children while in your care, it is critical that you immediately notify parents of more serious accidents or injuries when they occur, such as head injuries, broken bones, deep cuts, injury to or near a child's eye, bites that break the skin or exposure to a known allergen. In most cases, these types of injuries will require medical attention and in some situations, may necessitate emergency medical care. You must also ensure that incident reports are submitted to DCDEE as required, once you are notified that medical treatment was obtained following an incident that occurred at the facility, regardless of the amount of time between the injury and notification of medical treatment. The program has a plan in place that indicates who will make the determination of the level of injury and who should make this contact. This plan was also outlined in the written plan submitted to DCDEE and approved on 2-7-23 for the CAP. I encourage you to fully review all plans or procedures pertaining to injuries, incident reports, notification to parents and steps to take when medical treatment is necessary. I would also encourage you to review this information with all staff members to ensure that everyone is aware of their responsibilities following an accident or injury to a child. A violation was documented as accurate information was not provided verbally to representatives of DCDEE during today's visit and during the 1-27-25 complaint visit related to knowledge that medical treatment was sought for a child following a bite that broke the skin on 5-20-24. During the 1-25-27 visit, I asked you and the assistant administrator if you were ever made aware that medical treatment was obtained for this two year old female child following a bite or other injury that occurred while in care. You both stated that you were not made aware of medical treatment for any of the bites this child sustained. During today's visit, I again asked if you were aware of any medical treatment obtained for this child following an injury that occurred while in care. You stated that you were not. I requested that you review your email correspondence with the family to determine if the parents were notified by email following any of these injuries. You located an email from this child's parent 9-26-24 pertaining to injuries sustained. When I asked if the parent indicated in the email that medical attention was obtained for the child, you stated no. I requested that you provide me with a copy of the email, which you did. The parent stated the following in the email: "On 5/17 - (child) was bit on face at school. I was called about this at work. Ice was applied and the pediatrician was consulted." "On 5/20 - (child) was bit on the eye at school. I was never notified until picking her up. This bite required emergency room doctors, infectious disease doctors and pediatricians to manage the care. It also required antibiotic prophylaxis which resulted in additional complications for (child)." When I pointed this out to you, you stated that one of the child's parents is a doctor and that the child was taken to work with the parent. Child care requirements are clear that incident reports must be submitted to DCDEE when medical treatment of any kind is obtained following an incident that occurs while in care. The fact that the child's parent is a medical care provider and that medical care was obtained at their place of employment does not negate the need for submitting this information to DCDEE. Additionally, there is no time limit included in this requirement, thus you must submit these reports to DCDEE even if you are notified that medical care was sought days, weeks or months later. DCDEE depends on the information provided by staff members during visits to make determinations of what occurs at the facility when we are not present for a visit. Providing inaccurate or false information impacts our ability to depend on the information provided; therefore, this is taken very seriously. Falsification of information, either verbally or in writing, may result in the issuance of an administrative action, up to and including a revocation of the facility's license. Additionally, DCDEE may also issue an administrative action following a complaint visit during which allegations are confirmed. If it is determined that an administrative action is warranted, you will be notified by mail. Until a determination is made, visits will continue to monitor compliance. Child care licensing requirements are established to ensure a safe and healthy child care environment. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your program. It is your responsibility to maintain compliance with all of the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the childcare law and rules. I explained that you have access to the on-line version of the Child Care Rule Book, as well as a hard copy of the rules. I recommended that you visit the Division of Child Development's website (www.ncchildcare.nc.gov) on a regular basis to find out what's new in childcare. You could also find any needed Child Care forms by going on the web site and clicking on the "Provider" tab and then clicking on the "Provider Documents" tab. Please send me a written statement describing how and when the above violations were corrected. The written statement must be received no later than 2-18-25. Please note that if your letter is mailed, a hand written signature is required. As an alternative, compliance letters can now be submitted via email. I recommend emailing your letter to reduce the time needed to ensure my receipt of your information; however, if you do not have access to email, please ensure that your letter is mailed in a timely fashion and that you allow for any possible delays in the mail service. Paula Davis, Child Care Consultant, accompanied me on today's visit. I monitored the indoor and outdoor environments for compliance with child care requirements. Staff/child ratios, supervision, use of space and capacity were monitored for compliance. The permit, sanitation, evacuation, safe arrival and departure procedures, no smoking signage, first aid chart, menus, activity plan, daily schedule, staff/child ratios, emergency medical care plan, emergency telephone numbers and a summary of NC Child Care Law were all posted at the time of the visit. The storage of medication and hazardous products was also monitored for compliance. A sample of children's records, new staff files and a sample of existing staff files were reviewed during the visit. The last fire drill was documented as conducted on 1-8-25 at 10:11 am with an evacuation time of six minutes. The last outdoor inspection was documented as conducted on 1-8-25. A lockdown drill was documented as conducted on 1-8-25 at 9:15 am. An approved fire inspection was completed on 11-12-24. A sanitation inspection was last completed on 9-4-24 with zero demerits and a superior classification. The incorporation status of The Nest School, Inc. was verified as current and active during the visit using the Secretary of State's website. The children were observed during story time, playing outside, participating in music and movement activities and in free play. Additionally, one group was observed participating in an indoor gross motor activity. Lunch during the visit consisted of chicken and rice, carrots, applesauce and milk. A five star child care center with six points in education, six points in program standards and one quality point was issued to you on 10-2-21. Based on information provided and observations made during the visit you continue to meet the requirements previously met to obtain such a license. Violation Number Comment Rule 1321 Medical exam or health assessment record was not on file before or within 30 days after admission. A completed health assessment was not available in one of the children's files reviewed. GS110-91(1) While reviewing the fire drill log, I noted that several of the drills took in excess of two minutes to complete, with some of them taking as long as six to nine minutes. Your most current drill reflected an evacuation time of six minutes. You stated that this time includes the time to evacuate the facility, check each classroom to ensure no one is left in the building and return all children and staff to their classrooms. We discussed that the time listed on the log should only include the time it takes to evacuate the building. At the time of your next drill, please only record the time to evacuate. As we discussed, to ensure the safety of all staff members and children, a time of two minutes or less should be the goal for each drill. I recommended that you repeat the drill if it takes longer then two minutes in an effort to reduce the time. As we discussed during the visit, children's medicals must be fully completed. If the parent provides you with a print out from the child's doctor, please review it the information ensure that it contains all the same information that appears on the medical provided by DCDEE. Child care licensing requirements are established to ensure a safe and healthy child care environment. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your program. It is your responsibility to maintain compliance with all of the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the childcare law and rules. I explained that you have access to the on-line version of the Child Care Rule Book, as well as a hard copy of the rules. I recommended that you visit the Division of Child Development's website (www.ncchildcare.nc.gov) on a regular basis to find out what's new in childcare. You could also find any needed Child Care forms by going on the web site and clicking on the "Provider" tab and then clicking on the "Provider Documents" tab. Please send me a written statement describing how and when the above violation was corrected. The written statement must be received no later than 1-30-25. The incorporation status of The Nest School, Inc. was verified as current and active during the visit using the Secretary of State's website. The children were observed during story time, playing outside and eating lunch, which consisted of pepperoni pizza, green beans, oranges and milk. A five star child care center with six points in education, six points in program standards and one quality point was issued to you on 10-2-21. Based on information provided and observations made during the visit you continue to meet the requirements previously met to obtain such a license. Violation Number Comment Rule 812 Electrical outlets and power strips, not in use, which were located in space used by children did not have safety outlets or were not covered with safety plugs unless located behind furniture or equipment that cannot be moved by a child. One outlet in a power strip in space 3 was not covered or in use. 10A NCAC 09 .0604(c) You currently have one staff member on maternity leave, scheduled to return in May. This staff member typically works in the classrooms for infants. Her ITS-SIDS certificate will expire while she is on leave. You asked today if there was a grace period given for staff who are on leave. I explained that while it would not be a violation if she does not complete the training prior to the expiration date, she must complete the training prior to working in either of the classrooms for infants. I encouraged you to register this staff member for a training as soon as possible once she returns to work and explained that she cannot work in the classrooms for infants until she provides you with verification of completion of the training. A violation will be documented if a visit is conducted and this staff member is providing care in either of these classrooms without completing a new training. The violation that was documented was corrected during the visit; therefore, a compliance letter was not required as a follow up to the visit.
