I monitored the indoor and outdoor environments for compliance with child care requirements. Staff/child ratios, supervision, use of space and capacity were monitored for compliance. The permit, sanitation, evacuation, safe arrival and departure procedures, no smoking signage, first aid chart, menus, activity plan, daily schedule, staff/child ratios, emergency medical care plan, emergency telephone numbers and a summary of NC Child Care Law were all posted at the time of the visit. The storage of medication and hazardous products was also monitored for compliance. A sample of children's records, new staff files and a sample of existing staff files were reviewed during the visit. The last fire drill was documented as conducted on 11-14-25 at 10:30 am with an evacuation time of two minutes and forty three seconds. The last outdoor inspection was documented as conducted on 11-14-25 A shelter in place drill was documented as conducted on 9-15-25 at 9:50 am. An approved fire inspection was completed on 8-25-25. A sanitation inspection was last completed on 10-28-25 with three demerits and a superior classification. The incorporation status of The Nest School, Inc was verified as current and active during the visit using the Secretary of State's website. The children were observed during free play, finishing lunch and during naptime. Lunch consisted of turkey and ranch wraps, sweet peas, pears and milk. Violation Number Comment Rule 428 A current activity plan was not posted for each group of children for reference. The activity plan in space 3 was dated for 12-15-25 to 12-19-25. GS 110-91(12); .0508(a) You attended the Director's Meeting held by DCDEE on 10-7-25 during which the new child care requirements in section .3200 pertaining to two through five stars were reviewed. You stated today that you are planning to apply for a new rated license and that your goal is to maintain a five star license. I reviewed the pathways with you and you stated that you were not certain at this time which pathway would be selected. However, you stated that it was your understanding that the corporation submitted their curriculum to DCDEE for approval and that they were researching accreditation. We briefly reviewed the requirements for Family and Community Engagement and the Continuous Quality Improvement (CQI) for the facility and each individual staff member. These forms can all be found on the DCDEE website, under QRIS Modernization on the What's New tab. I encouraged you to become familiar with these forms and to share the individual CQI form with the staff members. As we discussed, should you choose the programmatic pathway that includes the Environment Rating Scales, each classroom will need to complete a three month self study using the Infant Toddler Environment Rating Scale 3rd Edition or the Early Childhood Environment Rating Scale 3rd Edition. You can find more information about the self study process, along with the necessary forms, on the North Carolina Rated License Assessment Project website (NCRLAP.org). I recommended that you have all staff members review their information in the WORKS database to determine if the information is up to date. If not, they will need to submit new official transcripts to the Workforce Unit. Please have them contact this until directly for questions pertaining to the their WORKS account. As we discussed, the goal will be for you to apply for a new rated license between today's visit and May, 2026. All application documents, including the ERS Request form, can be found on the DCDEE website. Upon my arrival I was greeted by, the assistant director, B. Scott. Ms. Scott stated that the director, Ms. S. Stewart was at a directors retreat in Chicago and would not return until next week. Limited monitoring of the child care requirements occurred during today’s visit. The license was posted. A total of 125 children were present. Children were observed during outdoor play, circle time and completing routine care tasks. ALLEGATION(S): Health and sanitation requirements are not being met. I was accompanied by Ms. Scott as I completed a general walk-through of the indoor and outdoor environments. Following the walk-through, I discussed the allegations with you, Ms. Scott, and you were given an opportunity to provide your perspective surrounding the allegations. You explained that you had just returned to work after a week-long vacation and were not aware of any concerns regarding the allegations. I then requested to interview staff members, who were selected at random, to obtain additional information. I monitored a sample of staff, children’s records and reviewed the facilities personnel/employee handbook. My findings are as follows: On or about September 10, 2025, an employee became ill during work hours. Staff members observed the employee exhibiting symptoms including vomiting, severe abdominal pain, lethargy, and paleness. Despite these signs, the employee was either not permitted or not given the opportunity to leave. The employee was observed working with children for the remainder of the day. A review of the employee handbook revealed that there is no established sick policy applicable to staff in such situations. Based on my observations and statements made by staff, the allegation is CONFIRMED. The last sanitation inspection was conducted on February 18, 2025. The facility received zero (0) demerits for a superior classification. Additional sanitation requirements that were monitored during today's visit included, handwashing, food storage, service and preparation, cleaning and sanitizing, lavatories, diapering and diaper changing facilities, and storage as outlined in sanitation rule 15A NCAC 18A .2820. The following violations were cited during today’s visit: Violation Number Comment Rule 1301 Center did not maintain a record of daily attendance. During today's visit, attendance was not recorded in space 4. GS 110-91(9) 9999 A violation was found for which there is no item number. On or about September 10, 2025, an employee with a communicable disease or a communicable condition was not excluded from work or subject to restrictions to prevent transmission. This is a violation of Sanitation Requirement 15A NCAC 18A .2827(e). All violations must be corrected immediately. By October 2, 2025, please submit a compliance letter stating how you have corrected the violation and how compliance will be maintained in the future. In your letter, be sure to include your facility name, ID number, and item number for each violation. Should your compliance letter not be received by the imposed date, a return visit will occur, and the violations cited again. TECHNICAL ASSISTANCE: Sanitation Rule 15A NCAC 18A .2827 states that employees with a communicable disease or a communicable condition shall be excluded from work or subject to restrictions to prevent transmission in accordance with the Rules in Section 10A NCAC 41A .0200. I explained to Ms. Scott that representatives from DCDEE were at the facility on February 4, 2025 to investigate allegations of child care requirements received by the Division on January 9, 2025. During that visit, there were allegations that staff were forced to work while ill with a communicable disease. Please be reminded that children and/or staff who are actively vomiting should generally be excluded from contact with others to prevent the spread of infection. This is especially critical for individuals in childcare settings. To reduce or prevent the spread of disease, practice good hygiene by washing hands frequently and properly, covering coughs and sneezes, and cleaning frequently touched surfaces. Stay up-to-date on recommended vaccines, practice food safety by washing produce and cooking food thoroughly, and avoid sharing personal items. When sick, stay home to avoid infecting others and seek prompt medical care, especially if you are at high risk for severe illness. Thank you for your time today. Files for the staff members hired since the 1-9-25 annual compliance visit were monitored. The storage of medication and hazardous products was also monitored during the visit. The children were observed participating in free play activities, in circle time or group activities and during naptime. Lunch during the visit consisted of cheese ravioli with turkey meatballs, green beans, peaches, roll and milk. The last fire drill was documented at conducted on 7-21-25 at 10:40 am with an evacuation time of three minutes and thirty seconds. A lockdown drill was documented as conducted on 6-18-25 at 10:30 am. An outdoor inspection was documented as completed on 7-21-25. An approved fire inspection was completed on 8-26-24. A sanitation inspection was last completed on 2-18-25 with zero demerits and a superior classification. A five star license with six points in education, six points in program and one quality point was issued on 10-2-21. Based on information provided and on observations made, you continue to meet the requirements previously met to obtain such a license. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your program. Becky Jackson, Lead Child Care Consultant, accompanied me on today's visit. The allegation was as follows: There are several concerns related to sanitation and health in the classrooms. Toys are not being cleaned and sanitized. eating Utensils given to children are broken. Childcare providers are made to work while ill with a communicable disease. There is a concern that children were not attended to in a nurturing and appropriate manner or in keeping with the children's developmental needs. The allegations were shared with you and you were given an opportunity to provide information. In addition, we spoke will all classroom staff members during the visit to obtain additional information. The following was determined based on observations made and information provided: While conducting the walkthrough of the facility, we did not observe any areas of the facility, including floors, walls or furnishings that were visibly dirty or in need of cleaning. Based on the information provided, staff are instructed to sanitize all items in the classroom at least weekly, with the exception of "mouthed" toys, which are cleaned before another child uses the toy. You stated that when children are sick with illness, such as flu, COVID, Norovirus, or RSV, cleaning is increased in frequency in an attempt to limit the spread of the germs. We observed the utensils in the kitchen before lunch was served. In a bowl set aside for one classroom for lunch, we noted that five of the nine forks were chewed to the extent that cleaning of the forks would be difficult and that the tines of the fork were bent to the extent that they may cause injury to the children's lips, tongue, and/or the roof of the children's mouth. We observed additional forks in the same condition in the larger storage container located on the counter in the kitchen. In addition, based on information provided by staff members, plates, cups and utensils are at times dirty when brought to the classrooms for mealtime. It was reported that plates that have dried food on them and that cups that appear to have mold on the inside have been brought to classrooms for the children to use. We spoke with the staff members regarding concerns that they are forced to work while sick with a communicable disease. Staff reported a variety of information, including that they had no knowledge of this ever happening, that they are typically encouraged to come into work if able while sick, and those that explained that absences with a doctor's note are still considered "unexcused." Child care requirements do not stipulate when staff members must be excluded from work as they do with when children must be excluded from care. I reviewed the center's staff policies for attendance, which addresses required doctor's notes when out of work sick for three or more consecutive days, policies on paid time off and management of illness in children, which includes a list of when children must be excluded from care. While it is recommended that these same guidelines be used for staff members, child care requirements do not require that centers do so. Based on the condition of the forks observed and on information provided pertaining to the cleanliness of plates and cups, the allegation pertaining to sanitation and health was confirmed and two violations were documented. While conducting the walkthrough, we noted that the staff members were engaged with the children, involved in their play and activities, and that the children were all being treated in a developmentally appropriate manner. We did not observe any staff members yelling or bullying other staff members in front of the children and the staff members reported that they had not observed this type of behavior from staff members, particularly not in front of the children. Based on the information provided and on observations made, the allegation pertaining to nurture, care and treatment was not confirmed and a violation was not documented. Violation Number Comment Rule 807 A safe indoor and outdoor environment was not provided for the children. The tines on forks used by the children were bent, creating a hazard when used. 10A NCAC 09 .0601(a) 9999 A violation was found for which there is no item number. The tines on forks used by the children were damaged and not easily cleaned. It was reported that plates and cups were sent to the classrooms for use by the children dirty. This is a violation of a requirement 15A NCAC 18A .2809, which states: In child care centers, material, construction, and use of food service equipment and utensils shall meet the following requirements: (1) Utensils shall be made of nonabsorbent material that is free from hazards, finished to have a smooth surface, and shall be kept clean and in good repair and (2) Food-contact surfaces shall be smooth, nonabsorbent, free of sharp corners, and kept clean and in good repair. I monitored the indoor and outdoor environments for compliance with child care requirements. Staff/child ratios, supervision, use of space and capacity were monitored for compliance. The permit, sanitation, evacuation, safe arrival and departure procedures, first aid chart, menus, daily schedules, activity plans, summary of NC Child Care Law and staff/child ratios were posted at the time of the visit. The storage of medication and hazardous products was also monitored for compliance. New staff files and a percentage of existing staff files were monitored. A sample of children's records were monitored during the visit and the worksheet was completed. The last outdoor inspection was documented as conducted on 1-6-25. A fire drill was documented as conducted on 1-6-25 at 10:40 am with an evacuation time of three minutes and forty-two seconds. A shelter in place drill was documented as conducted on 1-2-25 at 9:47 am. An approved fire inspection was completed on 8-26-24. A sanitation inspection was last completed on 8-19-24 with seven demerits and a superior classification. The children were observed during free play and while eating lunch, which consisted of chicken nuggets, macaroni and cheese, broccoli and milk. The incorporation status of The Nest Schools, Inc. was verified as current and active using the Secretary of State's website. A five star license with six points in program, six points in education and one quality point was issued on 10-2-21. Based on information provided and on observations made, you continue to meet the requirements met to obtain such a license. You stated that you did not receive a copy of the administrative action by mail and that you were not notified by your mail carrier that an item was sent to the facility by certified mail. A copy of the action provided for you. At my request, you posted a copy of the action in the lobby of the building. During the visit, we reviewed the basis for the action, the Corrective Action Plan, the appeal process and how to request an informal meeting. I monitored the indoor environments for compliance with child care requirements. Staff/child ratios, supervision, capacity and use of space were monitored for compliance. The children were observed playing outside, in free play activities, practicing for preschool graduation and eating breakfast, which consisted of English muffins with cream cheese, strawberries and blueberries and milk. We reviewed each of the stipulations in the Correction Action Plan in detail, including due dates, as follows: Stipulation # 1 - This stipulation will be monitored during all visits conducted throughout the duration of the administrative action. Violations pertaining to supervision and enhanced staff/child ratio requirements were documented during the visit. As we discussed, if these types of violations are documented during future visits, DCDEE may choose to issue a more stringent action. Stipulation # 2 - Based on today's date, as this was the date of receipt, the written plan for this stipulation is due on or before June 12, 2024. Upon receipt, I will contact you to either approve the plan or to provide you with the revisions that must be made and a new due date for submission. Stipulation # 2 has not been met. Stipulation # 3 - Based on today's date, as this was the date of receipt, the written procedures for this stipulation are due on or before June 19, 2024. Nine children, one one year old child and eight children less than one year of age, were present in space 1 with one staff member. 10A NCAC 09 .2818 A violation for failure to adequately supervise the children was documented. One of the staff members in space 8 was observed standing inside the door that exits to the playground. Three children and the other staff member were also in the classroom. The nine additional children present in this classroom were already outside on the playground. The violation was documented as the staff member who was standing in the door had her back to the children and the door behind her was only slightly open. She was not able to adequately supervise the nine children who were on the playground at the time. As we discussed, when two staff members are present with a group of children and the group is transiting to outdoor play, one staff member must be outside with the children who are outside to ensure adequate supervision. A violation was also documented for failure to meet enhanced staff/child ratio requirements. In space 1, one staff member was present with nine children, one one year old child and eight children less than one year of age. The enhanced staff/child ratio requirement for children less than one year of age is one to six, thus this group far exceeded what is allowable. The staff member in the classroom stated that you stopped by the classroom just before I entered the room and that an additional staff member had not come in to assist her. As we discussed, procedures must be in place for staff members to notify a member of management before the group exceeds ratios, not after. In this situation, a second staff member should have been in the classroom before the sixth child arrived for care. When completing your procedures for stipulation # 3, please include procedures for notifying a member of management before the group exceeds enhanced staff/child ratio for the youngest child in care. I would encourage you to remind the staff today of the location in each classroom where ratios are posted and the importance of maintaining these ratios are all times. As we discussed, these types of violations directly impact the health and safety of the children while in care at the facility. Incidents and injuries are more likely to occur when children are not adequately supervised and staff/child ratios are not maintained. In addition, these types of violations have a greater negative impact on your compliance history. Your eighteen month compliance history, including the violations documented during today's visit, is 84%. To remain eligible for a star rated license, you must maintain a compliance history of 75% or higher. If your compliance history falls below 75%, a provisional license may be issued. A follow up visit may be conducted to monitor compliance with child care requirements. The violations documented were corrected during the visit. However, I observed that the majority of the children were awake and that some of the children were up, off their cots, moving about the classroom. The staff member stated that she was assisting a child that had a bathroom accident just prior to my arrival in the classroom. As we discussed during the 2-5-24 visit and again during today's visit, the allowance that one staff member be in the classroom and the second staff member to cover for staff/child ratio be within calling distance, is only permitted during naptime. This allowance is allowed while the children are napping or resting. However, once the children begin to wake up and are off their cots, moving about the classroom, it is no longer naptime, regardless of the time of day or the time that naptime is scheduled to end. The staff members in the classroom where this allowance is used to cover staff/child ratio during naptime must be informed that once children begin to wake up, they should request that their second person come to the classroom to ensure staff/child ratios are maintained. During today's visit, the children were observed during free play, in circle time and eating lunch, which consisted of chicken quesadillas, black beans, mandarin oranges and milk. The last fire drill was documented as conducted on 3-9-24 at 10:00 am with an evacuation time of four minutes and two seconds. A shelter in place drill was documented as conducted on 1-12-24 at 10:00 am. An outdoor inspection was documented as conducted on 3-27-24. An approved fire inspection was completed on 8-25-23. A sanitation inspection was last completed on 3-8-24 with seven demerits and a superior classification. Violation Number Comment Rule 209 Children used space that was not approved. The group of children from space 6 used the long hallway outside of their classroom for gross motor activities and the short hallway outside of their classroom for story time. These hallways are not approved for the use of the children for routine care. GS 110-91(1)&(4-5) 871 Center staff did not comply with the safe sleep policy. A child less than twelve months of age was observed sleeping in a bouncy seat. 10A NCAC 09 .0606(a) 1245 For each child, there was not at least 30 sq. ft. inside space per the total licensed capacity and 100 sq. ft. outside space for each child using the outdoor learning environment at any one time. The long hallway outside of space 6, which will accommodate 16 children at 30 square foot per child, was used for gross motor play by a group of twenty children. The short hallway outside of space 6, which will accommodate 4 children at 30 square foot per child, was used for story time by a group of twenty children. 10A NCAC 09 .2809(a) A photographer was present on the day of the visit to take pictures of the children and was set up in space 6. Twenty children, ages three and four, are enrolled for care in this space. At the time of the visit, all twenty children were present from this space with two staff members. Since their classroom was being used by the photographer, the children and the staff members utilized other classrooms in the building while the children and the staff in those rooms were outside. This was done until it was time for this group to go outside. When their outdoor time was up and the rain had increased, this group of children and the staff members used the back hallway for additional gross motor play. The hallway was measured and will accommodate 16 children at 30 square foot per child. After this gross motor time, the group of children and the staff members moved to a smaller hallway outside of space 6 for story time. You stated that the children and staff were in this hallway for approximately thirty minutes. This hallway was also measured and will accommodate 4 children at 30 square foot per child. I reviewed the building inspection report and the hallways were not approved for use by the children. During the visit, the photographer was observed leaving and the children were observed back in space 6 for lunch. As we discussed during the visit, the use of space 6 by the photographer requires that the children in this space and the staff use other spaces in the facility. Once all other groups of children were back in their classroom, there was not an approved space for these children to use. In addition, the spaces that were used were not large enough for the number of children present. Therefore, violations pertaining to the use of unapproved space and a space that did not meet the space requirements for the number of children present were documented. During the visit, we discussed that when all classrooms are in use and you plan for picture day, you will need to utilize another space in the facility rather than moving a group of children out of their space. This will ensure that children are in approved space and that the space is large enough to accommodate the number of children present. As an alternative, you may choose to use the lobby area of the facility for the photographer. While monitoring space 2, I observed an infant sleeping in a bouncy seat. One of the staff members stated that he was very congested. As you and I discussed, there is not an allowance in the Safe Sleep requirements for children to sleep in swings, bouncy seats, etc. Please ensure that all staff who work in the classrooms for children less than twelve months of age are aware that once a child falls asleep, they most be moved and placed on their back in a crib. A violation was documented during the visit as the staff members in this room did not move the child once he fell asleep. A follow up visit may be conducted in the future to monitor compliance with child care requirements. Child care licensing requirements are established to ensure a safe and healthy child care environment. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your program. A five star license with six points in program, six points in education and one quality point was issued on 10-2-21.
