Name of Operation: Childcare Network #249 Facility ID: 51000962 Consultant: LEIGH MCKENZIE-LEE Operation Type: Center Case Number: 0326-102L Visit Date: 3/18/2026 Number Present: 113 Completed Date: 3/18/2026 Age: From 0 To 5 Total Minutes: 130 Time In: 10:00 AM Time Out: 12:10 PM Time In: Time Out: List to Use: Center Type Of Visit: Complaint Visit Announced/Unannounced: Unannounced The purpose of today's unannounced visit was to investigate allegations of non-compliance related to safe environment, discipline, sanitation and fire drills. These allegations were received by DCDEE on 3-5-26. During the visit, the allegations were shared with you. In addition, I also spoke with several of the staff members to gather information. Based on the information provided and on observations made, the following was determined: I verified that on 3-5-26, two staff members engaged in a verbal altercation while in the hallway and door way to space 1. I spoke with both staff members during the visit. One of the staff members verified that she initiated the argument by raising her voice at the other staff member. The other staff member stated that as a member of the administrative team, she attempted to diffuse the situation as a parent and children were observing their interactions; however, verified that she too raised her voice to a level that was not appropriate. The staff member that initiated the argument was asked to leave for the remainder of the day, but returned to work the following day. During the visit, you provided me with written documentation regarding steps taken to prevent a recurrent of this situation and the consequences to the staff member that initiated the argument if this occurs again in the future. Based on the information provided, the allegations pertaining to a safe environment was confirmed and a violation was documented. During the visit, I spoke with you, the assistant administrator and several staff members regarding an allegation that a staff member pulled a child by the collar of their shirt as a form of discipline and to remove them from the classroom. I verified that a staff member used a child's shirt to escort or pull them from the classroom. However, I received conflicting information on how this was done. The staff member stated that she merely touched the arm of the child's shirt when asking him to leave the classroom with her, while another staff member reported that the staff member was observed tugging on the child's collar; however, this staff member reported that the child was not upset by the staff members actions and none of the other children in the classroom were impacted by the interaction. An additional staff member reported that the staff member pulled on the collar hard enough to force the child to walk with her and that other children in the classroom were frightened by the interaction, to the extent that some of them cried about what they witnessed. As I could not verify if the child was handled in a rough manner, a violation was not documented and the allegation pertaining to discipline was not confirmed. During the visit, I verified that two toilets in the facility were recently inoperable. One of the these toilets was in space 6, one of the classrooms for three years old children. This toilet has been replaced and is now working. You stated that during the time that the toilet was not working, the children went across the hallway to space 7. the other classroom for three year old children, to use the restroom. You and the staff members in space 6 verified that a staff member escorted the children across the hall and that staff/child ratios were maintained. The other toilet that is not operable is in space 11, one of the classrooms for four and five year old children. A work order was submitted for this toilet to be fixed or replaced on 3-4-26. There is another toilet in this classroom that is operable. Currently there are thirteen children enrolled in this classroom; thus one toilet is sufficient based on building codes that require one toilet for every fifteen children. A violation pertaining to broken toilets was not documented and the allegation pertaining to sanitation was not confirmed. During the visit, I reviewed the fire drill log and noted that the following drills were documented: - Drill conducted on 1-15-26 at 10:30 am with an evacuation time of one minute and thirty-five seconds - Drill conducted on 2-12-26 at 10:10 am with an evacuation time of one minute and forty seconds - Drill conducted on 3-5-26 at 10:40 am with an evacuation time of one minute and thirty-eight seconds Based on the information provided, fire drills were conducted monthly as required. Therefore, a violation pertaining to fire drills was not documented and the allegation was not confirmed. Violation Number Comment Rule 807 A safe indoor and outdoor environment was not provided for the children. On March 5, 2026, two staff members engaged in a verbal altercation. 10A NCAC 09 .0601(a) During the visit, we discussed the importance of providing a safe environment for all children. When adults raise their voices in an angry or argumentative tone in front of the children, the children's sense of security and safety may be impacted. this type of behavior in front of the children is not appropriate and should be addressed with all staff members in a proactive manner. I recommended creating a policy regarding inappropriate interactions with other staff members or parents while in the presence of the children. I also suggested a training for all staff members on conflict resolution and effective communication strategies. If your District Manager is not able to assist you with locating a training on these topics, I suggested you contact the Partnership for Children of Johnston County at 919-202-0002. Based on child care rule, when an allegations of non-compliance are confirmed, DCDEE must determine if an administrative action is warranted. If an action is issued following today's complaint visit you will be notified by mail. Please refer to section .2200 of the child care rules for additional information regarding administrative actions. A follow up visit may be conducted in the near future to monitor compliance with child care requirements. These allegations were received by DCDEE on 11-7-25. Today's visit was conducted in conjunction with your annual compliance visit. A walk through and the staff/child ratio worksheet were completed as a portion of the annual visit. During the visit, the allegations were shared with you. In addition, I also spoke with several of the staff members to gather information. Based on the information provided and on observations made, the following was determined: At the time of the annual visit, supervision was adequate in each classroom and for each group of children that were observed during outdoor play. Information was provided during the visit regarding a staff member that was locked out of the building, along with a three year old child, thus leaving the remaining children in her care unattended in space 6. Based on the information provided, an additional staff member was walking past the hallway where the classrooms for two and three year old children are in care when she observed a parent standing in the hallway waving for someone's attention. The staff member asked the parent if she needed assistance to which the parent replied by pointing into space 6. The staff member looked through the window in the door into the classroom and observed the teacher, holding a child, on the outside of the building and no other staff members present in the classroom with the other children. Based on information provided, a staff member in another classroom had also observed this staff member outside and went to open a door to let her in the building. Based on information provided, the staff member that was locked out of the building is no longer employed at the facility. You stated that you had no knowledge of this situation. You verified that the staff member is no longer an employee but also stated that she left employment at the center voluntarily, working out a two week notice and that her employment was not terminated for any reason. While investigation the complaint allegations, I visited several classrooms to speak with the staff members. When I entered space five, only one staff member was present during naptime. Additional staff were present in the facility to provide assistance if needed. The staff member was observed sitting in a chair at the end of the counter near the door to the bathroom. She was sitting with her head hanging down and did not acknowledge me when I opened the door. The staff member did not appear to be aware of my entry into the classroom until I spoke to her, asking if she needed assistance. She replied that she needed assistance due to a medical condition and I located a member of the management team to assist her. Based on my observations and the information the staff member provided, the medical condition left her in a sleepy state while supervising the children. The staff member appeared to be sleeping when I entered the classroom, thus limiting her ability adequately supervise the children. I encouraged you and the other administrator to closely monitor this staff member, ensuring that she had adequate breaks to attend to her medical needs. In addition, I would also recommend placing her in a room during naptime where another staff member is present so then provider assistance to her in in the event of a medical emergency and provide adequate supervision. When I entered space nine, the staff member present with the children during naptime was observed at the door to the playground. The door was partially open and she was standing in the opening, with her back to the children. She turned around and spoke to me when I entered the classroom, explaining that she was standing in the open door to get some air as she was hot. All children in the classroom were on their mats at the time. The staff member's placement in the door way and that she turned her back to all of the children in the room limited her ability to adequately supervise the children. Based on information provided and on observations made during the visit, the allegation pertaining to supervision was confirmed and a violation was documented. Staff/child ratios were monitored for each group of children and determined to be in compliance at the time of the visit. During the visit, information was provided regarding non-compliance with staff/child ratio requirements on the afternoon of 11-6-25. Based on the information provided, the Education Coordinator moved three children, all three years of age, to space 9, one of the classrooms for four and five year old children. Ten four year old children were present in the classroom at the time, resulting in a total of thirteen children, ages three to five years of age. This exceeds the enhanced staff/child ratio requirement of one to ten when three year old children are present. When I asked you about this, you stated that to the best of your knowledge, you were present at the center on 11-6-25. Through the use of scanned transition worksheets for 11-6-25, you verified that three children, all three years of age, were moved to space 9 in the afternoon. However, you stated that two staff members were present in the classroom, thus meeting the ratio. While reviewing information in your timekeeping software, you determined that the second staff member you indicated was present in the classroom was not at work on 11-6-25. You reviewed information for several additional staff members, but were not able to provide me with the name of the staff member that was present in this classroom. Based on the information provided and that you were not able to verify that an additional staff member was present, the allegation pertaining to staff/child ratio was confirmed and a violation was documented. The allegations pertaining to the outdoor environment were specific to the space used by the one year old children. A group of one year old children were observed while on the playground. Some outdoor materials and equipment was observed on the playground. The children were observed to be engaged in their play, other than one female child who is new to the center and who was not having a great day. This child was crying and seem to be more engaged with the staff members than in playing with the other children and with the materials. I did not observe the children watching any type of device, be it an I-pad or telephone while on the playground. Based on these observations, the allegation pertaining to the outdoor environment for one year old children was not confirmed and a violation was not documented. While in the classrooms, I monitored the materials available to the children. I noted that there were a sufficient number of materials in the classrooms for infants, one year old children and for the four and five year old children and the school age children. However, while in the one of the classrooms for two year old children and the two classrooms for three year old children, I observed that there was not a sufficient number of materials in several of the activity areas. -Space five - one of the classrooms for two year old children - Materials were observed for a block area, book area, dramatic play and manipulatives. However, these areas only had a limited supply of materials and very few accessories to go along with the children's play. For example, only nine books, many of which were not in good condition, were observed for a class with eighteen children on roll. In addition the art shelf was turned towards the way, thus prohibiting children from accessing the materials. -Space six - one of the classrooms for three year old children - Materials were observed for a block area, book area, dramatic play, manipulatives, cozy area and art area. The areas for blocks and dramatic play only had a limited supply of materials and very few accessories to go along with the children's play. -Space seven - one of the classrooms for three year old children - Materials were observed for a block area, book area, dramatic play, manipulatives and art area. However, each of these areas only had a limited supply of materials and very few accessories to go along with the children's play. Based on these observations the allegation pertaining to materials was confirmed and a violation was documented. During the annual compliance visit I monitored fire drills for compliance. The log indicates that a fire drill was completed during every month from January to October, 2025. While talking with various staff members conflicting information was provided, with some staff reporting that fire drills occurred monthly and some reporting that fire drills were only done every three months. The allegation pertaining to fire drills could not be confirmed due to the conflicting information. Violation Number Comment Rule 303 Children were not adequately supervised at all times. The staff member in space five was observed sleeping while responsible for a group of children during naptime. The staff member in space nine was observed standing in the doorway to the playground with her back to the children during naptime. .1801(a)(1-5) 434 The materials and equipment indoors and outdoors were not sufficient to provide a variety of play experiences to promote the children's emotional and social development, health and physical development, approaches to play and learning, language and communication development, and cognitive development. There was not a sufficient number of materials available in spaces five, six and seven. 10A NCAC 09 .0509(2) 1246 All 5 of the following activity areas were not available daily to each group art/creative play, children's books, blocks/blockbuilding, manipulatives, family living/dramatic play. The shelf containing the art materials in space five was turned toward the wall, thus the materials were not available to the children. GS 110-91(12); .10A NCAC 09 .2806(b) 1756 Enhanced staff/child ratios and group sizes were not met. Thirteen children, including three year old children, were present with one staff member in space 9 on the afternoon of 11-6-25. 10A NCAC 09 .2818 A violation was documented for failure to adequately supervise the children and to maintain enhanced staff/child ratios at all times. Violations of this nature are particularly serious as they directly impact the safety of the children while in your care. Based on child care rule, when an allegations of non-compliance is confirmed, DCDEE must determine if an administrative action is warranted. If an action is issued following today's complaint visit and confirmation of the staff/child ratio allegation, you will be notified by mail. Name of Operation: Childcare Network #249 Facility ID: 51000962 Consultant: LEIGH MCKENZIE-LEE Operation Type: Center Case Number: 1125-082L Visit Date: 11/18/2025 Number Present: 118 Completed Date: 11/18/2025 Age: From 0 To 5 Total Minutes: 140 Time In: 01:00 PM Time Out: 03:20 PM Time In: Time Out: List to Use: Center Type Of Visit: Complaint Visit Announced/Unannounced: Unannounced The purpose of today's unannounced visit was to investigate allegations of non-compliance related to supervision, staff/child ratio, outdoor environment, materials and program records. Please refer to section .2200 of the child care rules for additional information regarding administrative actions. A follow up visit may be conducted in the near future to monitor compliance with child care requirements. Name of Operation: Childcare Network #249 Facility ID: 51000962 Consultant: LEIGH MCKENZIE-LEE Operation Type: Center Case Number: 0925-430L Visit Date: 9/23/2025 Number Present: 85 Completed Date: 9/23/2025 Age: From 0 To 5 Total Minutes: 55 Time In: 02:35 PM Time Out: 03:30 PM Time In: Time Out: List to Use: Center Type Of Visit: Complaint Visit Announced/Unannounced: Unannounced The purpose of today's unannounced visit was to investigate allegations of non-compliance related to the temperature of the indoor environment, particularly in classrooms where children twelve months of age and under were in care. These allegations were received by DCDEE on 9-23-25. Today's visit also serves as an administrative action follow up visit. A written warning was issued by the Division of Child Development and Early Education on 9-17-25. You verified receipt of the administrative action on 9-22-25. The administrative action was observed in your office, not posted as require. When I arrived, I shared the allegations with you. You verified that the electricity to the facility was impacted by an issue in the power company's equipment and that this problem began late in the day on 9-22-25. Individuals with Duke Energy and Pike Electric were observed working outside at the facility. You stated that the electricity was working fine in some areas of the building and not in other areas. For example, the lights in the adult restrooms in the hallway were not working, but other lights appeared to be fine. You stated that several of the HVAC units were also impacted, resulting in some of the units working and others not. You stated that the parents were notified of the issue at pick up on 9-22-25 and that those with children twelve months of age and under were informed that their children may have to leave early if the temperature in those classrooms was at or near 75 degrees F the following day. You stated that of the twenty infants enrolled in spaces 1 and 2, only ten attended and that all were combined in space 1. You stated that you contacted the parents of these children by 12:30 pm and informed them that their children must be picked up as the temperature in their classroom was nearing 75 degrees F. You stated that no other children were sent home as their classrooms were below 85 degrees as allowable in spaces for children one year of age and older. During the visit, I visited all classrooms where children were present and monitored the temperature. Thermometers were present in the classrooms for infants and the HVAC thermostats were used in the other classrooms. Temperatures of the classrooms, number of children present and ages of the children in care were as follows; Space 1 - 80 degrees F - three children present, twelve months of age and under Space 2 - 84 degrees F - space not in use Space 3 - 81 degrees F - nine children present, all one year of age Space 4 - 78 degrees F - three children present, all one year of age Space 5 - 79 degrees F - space not in use Space 6 - 81 degrees F - fifteen children present, two and three years of age Space 7 - 76 degrees F - fourteen children present, all two years of age Space 8 - 76 degrees F - sixteen children present, all two years of age Space 9 - 79 degrees F - twelve children present, three and four years of age Space 10 - 82 degrees F - thirteen children present, four and five years of age Space 11 - 77 degrees F - space not in use Space 12 - 78 degrees F - space not in use Space 13 - 77 degrees F - children not present at time of visit Environmental health requirements stipulate that classrooms must be between 65 and 85 degrees F. All classrooms met this requirement. However, child care requirements stipulate that children twelve months of age and under must be in rooms that are 75 degrees F or less. The allegation pertaining to the temperature in the classroom for infants was confirmed and a violation was documented. I reviewed the stipulations in the Correction Action Plan with you as follows: Stipulation # 1 - Three violations were documented during the visit. Stipulation # 1 will be monitored during all visits conducted throughout the duration of the administrative action. Stipulation # 2 - Your written procedures pertaining to enhanced staff/child ratio and a staffing plan are due to me by 10-6-25. Upon review of your procedures, I will contact you by email if revisions are needed and provide you with a new due date. If no revisions are necessary, you will be notified that this stipulation has been met by email. Stipulation # 2 has not been met. Stipulation # 3 - Once you are notified that stipulation # 2 has been met, you will have one week to conduct a staff meeting to review the procedures for stipulations 2. All staff must be present at this meeting. Following the meeting, please email me and include the date of the meeting and a list of all staff in attendance. Stipulation # 3 has not been met. Violation Number Comment Rule 886 The temperature in a room where infants aged 12 months or younger where sleeping exceeded 75 degrees. The temperature in the classroom for infants (space 1) was 80 degrees F. .0606(a)(5) 892 The center's safe sleep policy was not posted in a prominent place in the infant room where parents and caregivers were able to view daily. The center's Safe Sleep Policy was not posted in space 1, one of the classrooms for infants. .0606(b) 1948 Following the issuance of any administrative action the operator did not post the administrative action, cover letter, and/or corrective action plan, if applicable, in a location visible to parents and visitors near the entrance of the child care facility during the pendency of an appeal and/or throughout the effective time period of the administrative action. (Applicable to administrative actions after 2/1/19) The written warning issued by DCDEE on 9-17-25 was not posted. 10A NCAC 09 .2201(i)(1-4) Prior to the conclusion of the visit, an individual with Duke Energy came into the facility to talk with you about the issues. He assured both you and I that the issue would be resolved before the facility opened on 9-24-25. I requested that you contact me by email if the issues were not resolved to discuss you plan for providing care. I suggested that you move children into classrooms out of the direct sunlight and when possible, relocate children to spaces with a lower temperature, as long as the materials and furnishings were developmentally appropriate. I also suggested that you keep all children inside and not allow outdoor play due to the temperatures outside and the limited cool air indoors. Lastly, I reminded you that drinking water must be available to all children. Based on child care rule, when an allegations of non-compliance is confirmed, DCDEE must determine if an administrative action is warranted. If an action is issued following today's complaint visit and confirmation of the staff/child ratio allegation, you will be notified by mail. Please refer to section .2200 of the child care rules for additional information regarding administrative actions. Child care licensing requirements are established to ensure a safe and healthy child care environment. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your program. It is your responsibility to maintain compliance with all of the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the childcare law and rules. During the visit staff/child ratio, capacity, use of space and permit restrictions were monitored. Limited monitoring of other child care requirements was completed. The preschool children were observed participating in free play activities and playing outside. The school age children were observed watching a presentation by Dan the Animal Man, who brought in an alligator, snake, owl and tortoise. The menu indicated that the following would be served for lunch: chicken nuggets, baked beans, peaches, whole grain rolls and milk. The item that was documented during the 8-7-25 visit were monitored for compliance: Item # 1756 - Staff/child ratios were monitored throughout the facility and determined to be in compliance. An additional violation was not documented. Violation Number Comment Rule 428 A current activity plan was not posted for each group of children for reference. Plastic grocery store type bags were observed on the floor in an unlocked closet in space 8; thirteen children, all two years of age, were present in this classroom. .0604(q) 895 Infants under the age of 12 months were not placed on their backs for sleeping unless the center had obtained the appropriate written waiver. Based on information provided by the staff member in space 2, a five month old child was routinely placed on his side for sleeping. .0606(a)(1)(A-B) 1792 Staff did not model appropriate eating behaviors by consuming food or beverages that meet the nutritional requirements specified in the Meal Patterns for Children in Child Care Programs in the presence of children in care. An opened Celcius Energy drink was observed in a top cabinet in space 4. A Duncan Donuts iced coffee was observed in a top cabinet in space 5. A partially consumed Mountain Dew was observed in a top cabinet in space 7. .0901(i) While in space 2, I observed a young infant sleeping on his stomach. When I asked if he was able to roll completely over, one of the staff members in the classroom stated that he could not. When asked about how he was typically laid in the crib, she stated that she places him on his side and he rolls over to his stomach. Regardless of their ability to roll over, all children twelve months of age and under must be placed on their back when laid in their crib. If the child has the ability to roll completely over, they can adopt their own sleeping position. A violation was documented for not placing the child in his crib on his back as required. These allegations were received by DCDEE on 8-6-25. Staff/child ratios, supervision, use of space, and capacity were monitored for compliance in spaces 6 and 7 where three year old children were present. Fifteen children, all three years of age, were present in space 6 with two staff members. Fourteen children, thirteen three year old children and one two year old child, were present in space 7. No other classrooms were monitored during the visit. The nature of the complaint was reviewed with you. In addition, I also spoke with the staff members that were present in spaces 6 and 7. One of the staff members that routinely works in space 7 was not present at the time of the visit. Based on observations and on the information provided, the following was determined: When I arrived for the visit, I requested to visit the two classrooms for three year old children. Two staff members were present in both classrooms. I obtained enrollment information, as well as information about the number of children that were present at the time. Based on the information provided, I determined that just prior to my arrival in space 7, only one staff member was present with ten children. Because one of these children was a two year old child, the maximum number of children allowed with one staff member was nine. The allegation pertaining to staff/child ratio was confirmed and a violation was documented. After I monitored these two classrooms, I spoke with one staff member from space 7 regarding discipline in the classroom. When asked, she stated that she had not observed any staff members in space 7 or any other classrooms inappropriately discipline a child or children. I specifically asked about yelling and screaming at children, shaking and/or hitting children, and allowing one child to discipline another through hitting. The staff member stated that she had not observed any of these behaviors. You stated that you had not received any complaints from parents or staff members regarding any of these behaviors. You also stated that you had not observed any staff members inappropriately disciplining a child in the facility. While in the classrooms for three year old children, I did not observed an instances of inappropriate discipline. Based on the information provided and on observations made, the allegation pertaining to discipline was not confirmed and a violation was not documented. Violation Number Comment Rule 1756 Enhanced staff/child ratios and group sizes were not met. Ten children, including nine three year old children and one two year old child, were present with one staff member in space 7. 10A NCAC 09 .2818 A violation was documented for failure to maintain enhanced staff/child ratios at all times. Violations of this nature are particularly serious as they directly impact the safety of the children while in your care. While speaking with the staff members in space 7, I observed a form used to document the number of children present in the classroom throughout the day. You later stated that the staff members in all classrooms are expected to complete this form every thirty minutes. Based on the form completed for space 7 , sixteen children were present at 7:00 am. Based on the arrival times provided by the staff, only one staff member was present in this classroom until 7:15 am. This staff member stated that the information was recorded at 7:15 am rather then at 7:00 am. The staff member that arrived at 7:15 am stated that only nine or ten children were present when she arrived in space 7. The information provided verbally conflicted with the written documentation. As I discussed with you, representatives of DCDEE use various forms of documentation to determine compliance with child care requirements as we cannot be present in your facility at all times. Based on the information recorded on this form, there were sixteen children present with one staff member at 7:00 am, which does not meet enhanced staff/child ratio requirements for three year old children. However, according to the verbal information provided by the staff members, only nine or ten children were present in space 7 when the second staff member arrived at 7:15 am. This conflicting information raises concerns regarding the accuracy of the information recorded on the forms and the information provided verbally by the staff members. I suggested that reducing the forms that the staff members must complete from two (head count sheet completed every thirty minutes and the arrival/departure times form) to just one that captures all information may be a better option. As we discussed, the documents used to verify the children present at any given time throughout the day would be vital in the event of an emergency that requires an evacuation of the facility. If these forms are not accurate, children can be overlooked during an evacuation. If the staff have recorded that more children are present at a given time than are actually in the classroom, emergency personnel may be searching the facility for children who were not even present. It is critical that documentation be accurate and that accurate information be provided to representatives of DCDEE and other agencies at all times. A follow up visit may be conducted in the near future to monitor compliance with child care requirements. Child care licensing requirements are established to ensure a safe and healthy child care environment. It is your responsibility to maintain compliance with all of the applicable laws and rules at all times.
