A computerized generated report of today’s visit was completed, reviewed with you, and signed by Sarah Upton, Child Care Consultant and also signed by Michele Galloway, Administrator, during the visit. A signed copy of the visit summary was emailed to Ms. Galloway. Today, Ms. Galloway, was available and assisted me as needed. Upon arrival I introduced my presence. I observed a group with four- to five-year-old children during a group time music and movement activity, a group playing outside, a group during an art activity, and a group during a group time in which the teacher was reading a book to all children. An annual compliance monitoring checklist for child care centers was used to note the requirements monitored and is attached to the computerized generated visit summary for your records. The center’s compliance history was reviewed with the operator. The program’s compliance history was ninety-six (96) percentage prior to today’s visit. This program is operated through Cherokee Central School. Permit type –Five Star issued on July 24, 2020 Special Services/Restrictions – meets enhanced requirements and reduced ratio. NCPRE-K The last Annual Compliance visit was conducted on February 06, 2025 The last fire drill was practiced on January 08, 2026 The last shelter-in-place drill was practiced on November 18, 2025 The last playground inspection was documented on December 19, 2025 The last fire inspection was approved on July 30, 2025. The last sanitation inspection was conducted on November 05, 2025 with zero (0) demerits for a Superior classification. The Emergency Medical Care plan was posted and current. Curriculum: Creative Curriculum for Preschool Ongoing Assessments: Gold Teaching Strategies Developmental Screening: Dial-4 Lead water testing was completed on July 24, 2025 with no hazards noted. Lead paint and asbestos testing is exempt due to the age of the building. Transportation is provided through Cherokee Boys Club. Buses could not be monitored today due to them being located off-site. The NC Pre-K requirements in section .3000 of the childcare rules were monitored for compliance. The NC Pre-K Program Site Monitoring Tool has been submitted for review. Six (6) children files were monitored today. The classroom operates from 7:30 a.m. to 3:00 p.m. I used the Child Care Center Item Number Listing (DCDEE-0357) as a basic monitoring tool to assess compliance with all applicable child care requirements pertinent to this facility. For specific rule references, refer to Chapter 110 General Statues Child Care Facilities, Chapter nine (9) Child Care Rule (10A NCAC 09) and Section 2800 Sanitation of Child Care Center (15A NCAC 18A) for additional information. Updated copies of these rules can be located on our website at https://ncchildcare.ncdhhs.gov/ The following violations were documented during today’s visit. Violation Number Comment Rule 125 Daily records of arrival and departure times for children at the center were not maintained as children arrive and depart and/or were not made available for review. Children's time of departure was not being consistently recorded for all children. 10A NCAC 09 .0302(d)(4) 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. In the classroom space F108 there were several aerosol cans of Lysol being stored in a unlocked cabinet to the left as you enter the classroom. There were several aerosol cans of disinfectant spray and several cans of men's shaving cream stored in an unlocked cabinet above the sink located near the storage closet. .2820(b) Technical assistance provided: Item #125 Documenting a child's departure time in North Carolina childcare is crucial for safety, legal compliance, and accountability, ensuring children aren't left unattended, verifying parent pickup for custody issues, meeting state regulations (NC Child Care Rules), and helping with emergency planning, demonstrating who was responsible for the child at all times. Additional information for item #840- Shaving cream isn't allowed in NC childcare centers primarily because it contains potentially harmful aerosol propellants and other chemicals not tested for child use, posing risks like ingestion (leading to nausea/vomiting), eye irritation, or skin issues, with strict NC regulations requiring locked storage for aerosols and substances hazardous if ingested, making it unsuitable for unsupervised, unsupervised, child-led play. Centers prefer safer, non-toxic alternatives like soap-based foams or aquafaba for sensory play. Corrective Action Plan: All violations are required to be corrected immediately. However, if at any time you are unable to correct all violations within the specified time frame, please send a written statement regarding those violations that were corrected and include a specific plan for correction of the remaining violations. Please be aware that any written information submitted by you regarding correction of violations documented during today’s visit would be considered as legal documentation. Therefore, it is important that all information submitted be accurate and truthful. Please be aware that if it is determined that information submitted was inaccurate or willfully falsified, an Administrative Action, including Revocation of the facility’s license may be issued. The violations documented above must be corrected immediately. Be sure that you have copies of the updated scales for each classroom. If this is the pathway you choose I would suggest you reach out to North Carolina Rated License Project (NCRLAP) and request an outreach assessment for each age group you serve. Outreach assessments are a training tool to help you and staff members understand the assessment process and to provide feedback in areas that may score low on during your official assessment(s). A list of approved curriculum and approved formative assessments can be located at www.ncchildcare.ncdhhs.gov.Information regarding this pathway can be found in CHAPTER 09 - CHILD CARE RULES 10A NCAC 09 .3205 CLASSROOM AND INSTRUCTIONAL QUALITY PATHWAY FOR CHILD CARE CENTERS. Head Start and Early Head Start facilities have a direct pathway to a Five Star Rated License. You will need to decide which pathway you choose by the time of your next licensing visit. If you think you are leaning more towards pathway option one, I highly suggest going ahead and requesting an outreach assessment. Reminder: New and terminated staff notification requirement: As stated in G.S. 110-90.2 & .2703(r) child care operators are to notify the Division of any new child care providers working who were hired or moved into the child care facility within five business days. The process of notifying the Division has changed and is now captured in ABCMS. This change has been in effect since February 2024. Effective immediately, you will need to obtain a Business NCID and complete Provider Portal training in Moodle at https://www.dcdee.moodle.nc.gov/course/view.php?id=119. No action is needed on your part if you have completed the reference training and are currently using the ABCMS Provider Portal to update information regarding new hires or residents. Once the training has been completed and access has been given, you must verify your facility roster to ensure current staff are noted on the roster. This information should be updated in ABCMS in an ongoing basis as staff members are hired and when their employment is terminated. This satisfies the requirement to notify the Division of new child care providers working who were hired or moved into the child care facility within five business days. A signed copy of the visit summary was emailed to Ms. Galloway. Today, Ms. Galloway, was available and assisted me as needed. Upon arrival I introduced my presence. I observed a group with four- to five-year-old children during a group time music and movement activity, a group playing outside, a group during an art activity, and a group during a group time in which the teacher was reading a book to all children. An annual compliance monitoring checklist for child care centers was used to note the requirements monitored and is attached to the computerized generated visit summary for your records. The center’s compliance history was reviewed with the operator. The program’s compliance history was ninety-six (96) percentage prior to today’s visit. The last sanitation inspection was conducted on November 05, 2025 with zero (0) demerits for a Superior classification. The Emergency Medical Care plan was posted and current. A signed copy of the visit summary was emailed to Ms. Galloway. Today, Ms. Galloway, was available and assisted me as needed. Upon arrival I introduced my presence. I observed a group with four- to five-year-old children during a group time music and movement activity, a group playing outside, a group during an art activity, and a group during a group time in which the teacher was reading a book to all children. An annual compliance monitoring checklist for child care centers was used to note the requirements monitored and is attached to the computerized generated visit summary for your records. The center’s compliance history was reviewed with the operator. The program’s compliance history was ninety-six (96) percentage prior to today’s visit. This program is operated through Cherokee Central School. Permit type –Five Star issued on July 24, 2020 Special Services/Restrictions – meets enhanced requirements and reduced ratio. NCPRE-K The last Annual Compliance visit was conducted on February 06, 2025 The last fire drill was practiced on January 08, 2026 The last shelter-in-place drill was practiced on November 18, 2025 The last playground inspection was documented on December 19, 2025 The last fire inspection was approved on July 30, 2025. The last sanitation inspection was conducted on November 05, 2025 with zero (0) demerits for a Superior classification. The Emergency Medical Care plan was posted and current. Curriculum: Creative Curriculum for Preschool Ongoing Assessments: Gold Teaching Strategies Developmental Screening: Dial-4 Lead water testing was completed on July 24, 2025 with no hazards noted. Additional information for item #840- Shaving cream isn't allowed in NC childcare centers primarily because it contains potentially harmful aerosol propellants and other chemicals not tested for child use, posing risks like ingestion (leading to nausea/vomiting), eye irritation, or skin issues, with strict NC regulations requiring locked storage for aerosols and substances hazardous if ingested, making it unsuitable for unsupervised, unsupervised, child-led play. Centers prefer safer, non-toxic alternatives like soap-based foams or aquafaba for sensory play. Corrective Action Plan: All violations are required to be corrected immediately. A computerized generated report of today’s visit was completed, reviewed with you, and signed by Sarah Upton, Child Care Consultant and also signed by Michele Galloway, Administrator, during the visit. A signed copy of the visit summary was emailed to Ms. Galloway. Today, Ms. Galloway, was available and assisted me as needed. Upon arrival I introduced my presence. I observed a group with four- to five-year-old children during a group time music and movement activity, a group playing outside, a group during an art activity, and a group during a group time in which the teacher was reading a book to all children. An annual compliance monitoring checklist for child care centers was used to note the requirements monitored and is attached to the computerized generated visit summary for your records. The center’s compliance history was reviewed with the operator. The program’s compliance history was ninety-six (96) percentage prior to today’s visit. This program is operated through Cherokee Central School. Permit type –Five Star issued on July 24, 2020 Special Services/Restrictions – meets enhanced requirements and reduced ratio. NCPRE-K The last Annual Compliance visit was conducted on February 06, 2025 The last fire drill was practiced on January 08, 2026 The last shelter-in-place drill was practiced on November 18, 2025 The last playground inspection was documented on December 19, 2025 The last fire inspection was approved on July 30, 2025. The last sanitation inspection was conducted on November 05, 2025 with zero (0) demerits for a Superior classification. The Emergency Medical Care plan was posted and current. Curriculum: Creative Curriculum for Preschool Ongoing Assessments: Gold Teaching Strategies Developmental Screening: Dial-4 Lead water testing was completed on July 24, 2025 with no hazards noted. Lead paint and asbestos testing is exempt due to the age of the building. Transportation is provided through Cherokee Boys Club. Buses could not be monitored today due to them being located off-site. The NC Pre-K requirements in section .3000 of the childcare rules were monitored for compliance. The NC Pre-K Program Site Monitoring Tool has been submitted for review. Six (6) children files were monitored today. The classroom operates from 7:30 a.m. to 3:00 p.m. I used the Child Care Center Item Number Listing (DCDEE-0357) as a basic monitoring tool to assess compliance with all applicable child care requirements pertinent to this facility. In the classroom space F108 there were several aerosol cans of Lysol being stored in a unlocked cabinet to the left as you enter the classroom. There were several aerosol cans of disinfectant spray and several cans of men's shaving cream stored in an unlocked cabinet above the sink located near the storage closet. .2820(b) Technical assistance provided: Item #125 Documenting a child's departure time in North Carolina childcare is crucial for safety, legal compliance, and accountability, ensuring children aren't left unattended, verifying parent pickup for custody issues, meeting state regulations (NC Child Care Rules), and helping with emergency planning, demonstrating who was responsible for the child at all times. Additional information for item #840- Shaving cream isn't allowed in NC childcare centers primarily because it contains potentially harmful aerosol propellants and other chemicals not tested for child use, posing risks like ingestion (leading to nausea/vomiting), eye irritation, or skin issues, with strict NC regulations requiring locked storage for aerosols and substances hazardous if ingested, making it unsuitable for unsupervised, unsupervised, child-led play. Centers prefer safer, non-toxic alternatives like soap-based foams or aquafaba for sensory play. Corrective Action Plan: All violations are required to be corrected immediately. A computerized generated report of today’s visit was completed, reviewed with you, and signed by me, Sarah Upton, Child Care Consultant and also signed by Michele Galloway, Administrator, during the visit. An electronic signed copy of the visit summary was left on-site with you. The center’s compliance history was reviewed with the operator. The program’s compliance history was one hundred percent (100%) as of 04/04/2025. The facility operates with a five-star license issued on 07/18/2024. The Special Services/Restrictions includes NCPRE-K site, meets enhanced space and meets reduced ratios. The concern (0325-460L) was received by the Division of Child Development and Early Education on March 31, 2025 and sent to me on April 02, 2025. Upon my arrival I explained to Ms. Galloway the reason for my visit. I discussed with her the following allegations, and she was allowed to ask questions. Ms. Galloway self-reported the incident, and assisted me with the information needed today. Allegation states: There are allegations of violations of child care requirements. On 3/21/25 children in classroom S 102 took a walk around the courtyard to give the children a brain break and pick some flowers. As they were returning into the building at 11:15am three (3) children were out of sight as teachers entered the building. Based on the information provided one (1) teacher entered the building ahead of the class while the other teacher held the door for children to enter. The three (3) students did not enter the building with their class and were left outside in the courtyard area for about two to three minutes. The students were not left alone without adult supervision as there were other teachers from the public school in the area and could see the children. The three (3) students were safely escorted to their classroom by a kindergarten teacher. Since the incident you reported that you have reviewed the following child care requirement 10A NCAC 09 .1801 SUPERVISION IN CHILD CARE CENTERS with all staff and they have signed an acknowledgement form that they have reviewed the requirements. You also reported that all staff reviewed the safe school policy from Cherokee Central Schools and signed an acknowledgement form. Today I reviewed what was reviewed and signed by all staff. You also reported that teachers have implemented a count as children transition from one area to another and that they also do a count within the classroom every 30 minutes. It was also reported today that there is now one (1) teacher in the front of the line and one (1) in the back. During my visit today I observed classroom S102 transitioning from outside to their classroom and the teacher was observed touching each child as she counting the children in line. Based on the information received today the allegation was substantiated regarding supervision and the following violation was written. Violation Number Comment Rule 303 Children were not adequately supervised at all times. Supervision is basic to the safety and the prevention of injury and maintaining quality child care. Parents have a contract with the facility and its staff to supervise their children. The importance of supervision is not only to protect children from physical injury, but from harm that can occur from teasing/bullying/inappropriate topics discussed or inappropriate behavior. It is the responsibility of staff to regularly count children (name to face recognition) on a routine basis, at every transition, and whenever they leave one area and arrive at another. Corrective Action Plan: All violations are required to be corrected immediately. However, if at any time you are unable to correct all violations within the specified time frame, please send a written statement regarding those violations that were corrected and include a specific plan for correction of the remaining violations. An electronic signed copy of the visit summary was electronically emailed to Ms. Galloway, Administrator. Today, Ms. Galloway, was available and assisted me as needed. Upon arrival I introduced my presence. I observed the group with three- to five-year-old children and one group with children four-to-five-year-old children playing outside. I observed a group of children ages four-through-five years engaged in free play activities. One group with four-to-five-year-old children was observed during an art activity. An annual compliance monitoring checklist for child care centers was used to note the requirements monitored and is attached to the computerized generated visit summary for your records. The center’s compliance history was reviewed with the operator. The program’s compliance history was ninety-five (95) percentage prior to today’s visit. This program is operated through Cherokee Central School. Permit type –Five Star issued on July 24, 2020 Special Services/Restrictions – meets enhanced requirements and reduced ratio. NCPRE-K The last Annual Compliance visit was conducted on March 03, 2023 The last fire drill was practiced on January 29, 2024 The last shelter-in-place drill was practiced on January 22, 2024 The last playground inspection was documented on January 31, 2024 The last fire inspection was approved on August 01, 2023 The last sanitation inspection was conducted on November 30, 2023 with zero (0) demerits for a Superior classification. The Emergency Medical Care plan was posted and current. Curriculum: Creative Curriculum for Preschool Ongoing Assessments: Gold Teaching Strategies Developmental Screening: Dial-4 I used the Child Care Center Item Number Listing (DCDEE-0357) as a basic monitoring tool to assess compliance with all applicable child care requirements pertinent to this facility. For specific rule references, refer to Chapter 110 General Statues Child Care Facilities, Chapter nine (9) Child Care Rule (10A NCAC 09) and Section 2800 Sanitation of Child Care Center (15A NCAC 18A) for additional information. Violation Number Comment Rule 1321 Medical exam or health assessment record was not on file before or within 30 days after admission. After review of six (6) children's files it was noted that five (5) children did not have a completed medical exam or health assessment on file. The children had a medical exam on file completed by the physician however, the top part of the form that documents the child's medical history was not completed. GS110-91(1) Technical Assistance: Item 1321 all children must have a completed medical exam or health assessment on file that includes the child’s medical history. According to § 110-91. Mandatory standards for a license. The Commission shall adopt rules for child care facilities to establish minimum requirements for child and staff health assessments and medical care procedures. These rules shall be developed in consultation with the Department. Each child shall have a health assessment before being admitted or within 30 days following admission to a child care facility. The assessment shall be done NC General Statutes - Chapter 110 Article 7 11 by: (i) a licensed physician, (ii) the physician's authorized agent who is currently approved by the North Carolina Medical Board, or comparable certifying board in any state contiguous to North Carolina, (iii) a certified nurse practitioner, or (iv) a public health nurse meeting the Departments Standards for Early Periodic Screening, Diagnosis, and Treatment Program.
