I was let into the facility by administrator Ms. N. Vargas. The allegations were shared with her and enrollment coordinator Ms. J. Grady. Based on the report they stated that they believed they are aware of the incident. Ms. Vargas stated that an email was received on 1/8/26 from a parent upset that their child was taken outside that day with nothing but a t-shirt, underwear, and a jacket on. Ms. Vargas wasn't aware of the situation and shared it with the administrative staff. The owner replied back to the email stating that the child's teacher made her aware that the child had messed up their clothes and needed a change of clothes either from the center or the parent needed to be called. The owner apologized and stated that they had gotten sidetracked and did not call the parent. Ms. Vargas had an informal meeting with the teacher about the incident and explained that they are never to take a child out without clothing and to continue to call administrative staff until they receive what they need. The teacher for that classroom was interviewed today. The allegations were shared with them. The teacher stated that a child wet themselves during breakfast on 1/8/26. They went to help the child change and realized they did not have a set of changing clothes. They stated that they put it in the notes of the parent app on the IPAD that the child needed a set of changing clothes. They also called to the front office and told an administrative staff person and they said they would call the parents of the child. The teacher stated that they called a second time and the administrative staff said ok that they would call, no one came. The teacher stated that they received a call in the classroom from an administrative staff person about another subject, and stated again that the child needed a change of clothing and the staff person said ok. No one ever came and it was the class's afternoon outside time so they took them outside. During pick up, the teacher explained to the parent that they had reached out via the app on the IPAD and wasn't aware that the administrative staff hadn't contacted them. I stated to the teacher that I was aware that that Ms. Vargas had an informal meeting with them about the incident. I asked the teacher going forward how would they handle the situation if it came up again? They stated that would continue to call the administration staff to get help. Based on staff interviews, allegations of childcare requirements were confirmed during today's visit. The following violations were cited: Violation Number Comment Rule 803 There were no clean clothes available for the children to wear when children's clothes became wet or soiled. Clean clothes were not available for one (1) child whose clothes became wet. 10A NCAC 09 .0806(b) 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. A three (3) year old child was taken outside on 1/8/26 in a t-shirt, underwear, and a jacket. G.S. 110-91(10) Compliance -Violations cited today must be corrected immediately. Please send me a letter documenting how violations cited today were corrected by February 5, 2026. Failure to maintain compliance with all applicable requirements may result in an Administrative Action against your license, which could include civil penalties. Repeated violations may significantly affect your compliance history. Failure to correct the violations and/or submit the compliance letter to me by the due date listed above may result in an unannounced follow-up visit being conducted to ensure corrections were made. The following suggestions were made to the teacher that if an incident like this should occur again to call for help from the administrative staff. If they're not available, check the ratio of a near by classroom to see if they child could possible stay with them until they receive more clothing. Teachers can allow the children to walk with them to the office to alert the administrative staff on what happened, or have gross motor play in the inside until the child is given more clothing and able to go outside. Because allegations were confirmed an administrative action could be taken against this facility. Procedures put into place to prevent reoccurrence will be taken into consideration. The last Annual Compliance visit was made on 1/28/2025. The current 3 star license was issued on 9/8/2023. The April 2025 version of Child Care Center Master Item Number Listing, DCD-0357 and a checklist was used to complete monitoring today. This facility has a compliance history of 86% as of today. I was let into the facility by administrator, Ms. N. Vargas. She accompanied me on the walk through. Program records were made available to me. Ten (10) classrooms were monitored on today for: Sign in/out, allergy list, medical action plans (if applicable), menu, schedule, activity plan, and staff/child ratio chart. Storage of medication and permission to administer was monitored. Supervision, and storage of hazardous products was monitored. Children were observed having indoor/outdoor free play, teacher directed activities, and having routine needs met. There were toys available. The following was observed posted: current license, Summary of Law, Safe Arrival and Departure procedures, Menu, Emergency Care Plan, and no smoking signage. A Sanitation inspection was conducted on 7/23/2025. A Fire inspection was conducted on 6/23/2025. Monthly Fire Drills, Playground Inspections, and EPR Drills were monitored. A sample of staff files including three (3) new staff files were monitored today for Criminal Qualifying Letters, Medical Statement, TB Test, Health Questionnaire/Emergency Information, Annual on-going Training Hours, and Special Trainings. A sample of children's files were monitored for Application, Emergency Care authorization, Summary of Law, Medical/Immunization, Discipline Statement, No smoking statement, Safe Sleep Policy, Infant Feeding Schedule and Shaken Baby Syndrome Policy (if applicable). This facility does not provide transportation. The following violations were cited during today's visit: Violation Number Comment Rule 841 Medications including prescription and non-prescription items were not stored in a locked cabinet or other locked container. Vaseline was observed on a counter in space ten (10). 15A NCAC 18A .2820(d) 1045 New staff, who had contact with children, did not receive at least 16 hrs. orientation within first 6 weeks. One (1) staff's orientation was documented. .1101(a) 1232 Each employee's personnel file did not contain an annual staff evaluation and a staff development plan. One (1) employee's personnel file did not contain an annual staff evaluation. 10A NCAC 09 .0514(f) 1901 All administrators and staff did not complete a professional development plan within one year of employment, that included all the required information. One (1) staff member did not complete a professional development plan within one year of employment .1104(1-5) Compliance -Violations cited today must be corrected immediately. Because allegations were self reported and confirmed during a visit on 10/15/2025, an administrative action could be taken against this facility. Procedures put into place to prevent reoccurrence will be taken into consideration. When reviewing files, documentation of orientation was observed. Hours listed for topic areas should accurately reflect the time spent on each topic area. One (1) day was listed for many topic areas but verbally you stated that orientation took place over several days, multiple hours. Please make sure documentation reflects that going forward. Brandi Vargas, administrator, accompanied me during a walk-through of the facility. During the visit, I discussed the allegations with Ms. Vargas and additional staff members. Limited monitoring of child care requirements occurred during today’s visit. The following violations were observed and/or confirmed during today’s visit. Violation Number Comment Rule 904 A child was handled in a rough way, including shaking, pushing, shoving, pinching, slapping, biting, kicking, or spanking. On December 5, 2025, a staff member had inappropriate interactions and handled a five-year-old child in a rough manner, which resulted in red marks on the child’s shoulder and collarbone area. In addition, the same staff member had inappropriate interactions and handled a four-year-old child roughly, which resulted in fingernail marks on the child’s arm. .1803(a)(1) 1810 There was a substantiation of child maltreatment. Pursuant to its investigation, the Division has confirmed sufficient information to determine child maltreatment. GS 110-105.6(a) Violations must be corrected immediately. The April 2025 version of Child Care Center Master Item Number Listing, DCD-0357 was used to complete monitoring today. I was let into the facility by administrator Ms. Vargas. She accompanied me on the walk through. Children were observed having free play indoors/outdoors, teacher directed activities, and routine needs met. Bathrooms used by children were monitored. Supervision, Staff Child Ratio, First Aid, Special Training, Storage of Hazardous Substances, Approved Space, Program Records, License Posted, and Permit Restrictions were monitored today. Nine (9) new staff file was monitored today. The following violations were cited during today's visit: Violation Number Comment Rule 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. Liquid white out was observed on a shelf, not stored in a locked cabinet in space seven (7). .2820(b) 871 Center staff did not comply with the safe sleep policy. Staff did not mark (B) for back to sleep as the initial sleep position when laying sleeping infants down. 10A NCAC 09 .0606(a) 887 Caregivers did not document compliance with visually checking on sleeping infants aged 12 months or younger and/or the documents were not maintained for a minimum of one month. Documentation of visually checking sleeping infants was not available for the weeks of November 1st-7th in space two (2) for most children . .0606(g) 1045 New staff, who had contact with children, did not receive at least 16 hrs. orientation within first 6 weeks. One (1) new staff member's orientation was not documented. .1101(a) Compliance -Violations cited today must be corrected immediately. I was let into the facility by assistant administrator Ms. A. George. I asked to speak to the administrator Ms. N. Vargas The allegations were shared with her. She stated that she was expecting to receive a visit from me regarding this allegation. She stated that she was told by the assistant director that the dad dropped off two children that day, an infant and older child. He forgot the infant's bag that contain the bottles and went and got it from the car. When he came back in, he asked the assistant director to take the bag to the older child's classroom. The assistant director wasn't aware that the dad had stated to the infant teachers that he had left the bag in the car and would bring it back in. When he brought it back in, he told the assistant director the wrong classroom and she did not check the bag nor did the teacher's in the older classroom when it was brought in there. Three (3) teachers that worked in the infant room were interviewed today. They were asked to describe what happened on that day. Teacher one (1) stated that they were present in the infant room during lunch time relieving the permanent teacher. She noticed that the child didn't have a bottle and asked the other teacher about it and was told that the dad said he would bring them back but never did. She stated that the child was offered what was served for lunch that day because they eat table food as well as receives a bottle for meals. The child didn't eat a lot of the food and was offered water with the meal. Because the child didn't eat a lot of the food offered, they were going to attempt to offer them jar food but the child fell asleep before that could happen. They also plan to attempt jar food at snack as well if the child didn't eat again, but the child was picked up before snack, Meals were not logged in the facility's APP because the IPAD's battery had died. Teacher two (2) stated that the dad came in that morning at drop off and stated that he had left the bottles in the car and would bring them back. The teacher stated that this was their first day and was being trained. At the time they were not aware of how to input information into the facility's APP and was not aware of the child's feeding plan or habits. Teacher three (3) stated that the dad came in and said he had left the bottles in the car. They waited and he never came back. The teacher stated that they made the decision to just feed the child meals offered at the facility and water once they finished the bottle that they came in with. They stated that the meals weren't put into the facility's APP because they got busy feeding other children and the IPAD's battery died. The infant's feeding plan was observed during today's visit. It was not followed by staff. Based on staff interviews, the allegations of violation of childcare requirements were confirmed during today's visit. The following violations were cited: Violation Number Comment Rule 540 An individual written feeding plan was not provided by child's parent or health care provider or was not followed and posted. (omit posting for centers located in a residence)An individual written feeding plan was not was not followed for one (1) enrolled child. 10A NCAC 09 .0902(a) Compliance -Violations cited today must be corrected immediately. Technical Assistance Please ensure that staff follows the infant feeding plans for all enrolled infants. Encourage staff to alert administration when there are known, significant, changes in a child's routine needs or if a child is dropped off and does not have what they usually have or need. Also share pertinent information amongst teachers during transition times such as lunch breaks and shift changes. This helps with continuity of care between the children and additional caregivers. 10A NCAC 09 .0902 REQUIREMENTS FOR INFANTS (a) The parent or health care provider of each child under 15 months of age shall provide the center an individual written feeding plan for the child. This plan shall be followed at the center. This plan shall include the child's name, be signed by the parent or health care provider, and be dated when received by the center. Each infant's plan shall be modified in consultation with the child's parent or health care provider to reflect changes in the child's needs as he or she develops. The feeding instructions for each infant shall include the type and amount of milk, formula and food, the frequency of feedings and be posted for reference by the caregivers. Documentation of infant's routine needs being met is not required but it is recommended to be able to share with parents especially during this time where there is constant growth and changes with the child. Also having verbal conversations with parents sharing information about the child's day during pick up is helpful. It also helps staff stay on track with what times and what a child needs throughout the day. It was stated that the IPAD died because it was used to play music all day. Music should be played with a purpose such as quiet music during rest time, and music for singing and dancing. That could help alleviate the IPAD dying when it is not being plugged up. I was let into the facility by assistant administrator Ms. A. George. I asked to speak to the administrator Ms. N. Vargas The allegations were shared with her. She stated that she was expecting to receive a visit from me regarding this allegation. She stated that she was told by the assistant director that the dad dropped off two children that day, an infant and older child. He forgot the infant's bag that contain the bottles and went and got it from the car. When he came back in, he asked the assistant director to take the bag to the older child's classroom. The assistant director wasn't aware that the dad had stated to the infant teachers that he had left the bag in the car and would bring it back in. When he brought it back in, he told the assistant director the wrong classroom and she did not check the bag nor did the teacher's in the older classroom when it was brought in there. Three (3) teachers that worked in the infant room were interviewed today. They were asked to describe what happened on that day. Teacher one (1) stated that they were present in the infant room during lunch time relieving the permanent teacher. She noticed that the child didn't have a bottle and asked the other teacher about it and was told that the dad said he would bring them back but never did. She stated that the child was offered what was served for lunch that day because they eat table food as well as receives a bottle for meals. The child didn't eat a lot of the food and was offered water with the meal. Because the child didn't eat a lot of the food offered, they were going to attempt to offer them jar food but the child fell asleep before that could happen. They also plan to attempt jar food at snack as well if the child didn't eat again, but the child was picked up before snack, Meals were not logged in the facility's APP because the IPAD's battery had died. Teacher two (2) stated that the dad came in that morning at drop off and stated that he had left the bottles in the car and would bring them back. The teacher stated that this was their first day and was being trained. At the time they were not aware of how to input information into the facility's APP and was not aware of the child's feeding plan or habits. Teacher three (3) stated that the dad came in and said he had left the bottles in the car. They waited and he never came back. The teacher stated that they made the decision to just feed the child meals offered at the facility and water once they finished the bottle that they came in with. They stated that the meals weren't put into the facility's APP because they got busy feeding other children and the IPAD's battery died. The infant's feeding plan was observed during today's visit. It was not followed by staff. Based on staff interviews, the allegations of violation of childcare requirements were confirmed during today's visit. The following violations were cited: Violation Number Comment Rule 540 An individual written feeding plan was not provided by child's parent or health care provider or was not followed and posted. (omit posting for centers located in a residence)An individual written feeding plan was not was not followed for one (1) enrolled child. 10A NCAC 09 .0902(a) Compliance -Violations cited today must be corrected immediately. Repeated violations may significantly affect your compliance history. Because an allegation was confirmed during today's visit, an Administrative Action could be issued to this facility. Technical Assistance Please ensure that staff follows the infant feeding plans for all enrolled infants. Encourage staff to alert administration when there are known, significant, changes in a child's routine needs or if a child is dropped off and does not have what they usually have or need. Also share pertinent information amongst teachers during transition times such as lunch breaks and shift changes. This helps with continuity of care between the children and additional caregivers. 10A NCAC 09 .0902 REQUIREMENTS FOR INFANTS (a) The parent or health care provider of each child under 15 months of age shall provide the center an individual written feeding plan for the child. This plan shall be followed at the center. This plan shall include the child's name, be signed by the parent or health care provider, and be dated when received by the center. Each infant's plan shall be modified in consultation with the child's parent or health care provider to reflect changes in the child's needs as he or she develops. The feeding instructions for each infant shall include the type and amount of milk, formula and food, the frequency of feedings and be posted for reference by the caregivers. Documentation of infant's routine needs being met is not required but it is recommended to be able to share with parents especially during this time where there is constant growth and changes with the child. Also having verbal conversations with parents sharing information about the child's day during pick up is helpful. It also helps staff stay on track with what times and what a child needs throughout the day. It was stated that the IPAD died because it was used to play music all day. Music should be played with a purpose such as quiet music during rest time, and music for singing and dancing. That could help alleviate the IPAD dying when it is not being plugged up. I explained the purpose of today's visit. Ms. Cox accompanied me on a walk through of the facility. Program records and staff records were made available to me. Supervision, Staff Child Ratio, First Aid, Special Training, Storage of Hazardous Substances and Medication, Approved Space, seven (7) new staff files, Program Records, License Posted, and Permit Restrictions were monitored today. The outdoor play area, bathrooms used by children, and thermometers in the refrigerator's were monitored today. The following violations were cited during today's visit: Violation Number Comment Rule 887 Caregivers did not document compliance with visually checking on sleeping infants aged 12 months or younger and/or the documents were not maintained for a minimum of one month. It was moved to the back of the refrigerator and read at 40 degrees at the end of my walk through.
