The Secretary of State website was checked before the visit and TENDER LOVE & CARE CHILD DEVELOPMENT CENTER, LLC was current and active. The restrictions include: First and Second Shift; Meets enhanced ratios; Meets enhanced space Upon arrival, I was greeted by A. Wilson, Owner/Director. I discussed the Annual Compliance Monitoring guidelines with Ms. Wilson. I completed the walkthrough of the center alone and Ms. Wilson assisted me. The following items were posted within the center/ classrooms: Daily schedules, activity plans, staff/child ratio worksheets, emergency numbers, emergency procedures, arrival/ departure procedures, summary of law and menus. Indoor Learning Environment: Staff/child ratio, supervision, capacity, group size and space were observed in compliance today. Children were observed during indoor free play, naptimes and transitions. There were seventeen (17) children present today. There are thirty-three (33) children enrolled in the center. Outdoor Learning Environment: The outdoor learning environment was monitored today. Inspections: The outdoor inspections and fire drills were monitored. The last fire drill was conducted on 2/18/26. The centers last shelter in place/ lockdown drill was conducted October 2026. The last monthly playground inspection was conducted on 1/13/26. The center last had a sanitation inspection on 2/11/26. The center received zero (0) demerits and received a superior classification. The inspection was completed by the Mecklenburg County Health Department. The center last had a fire inspection on . Transportation: The center does provide transportation. The vehicle used to transport children was monitored and in compliance. 2023 Ford Transit License plate:RHX-1255 expires: 6/26 Insurance expires:3/15/26 Nutrition: Meals met nutritional value during today’s visit. Files: Children records were monitored today and in compliance. Staff files were monitored today and in compliance. There were four (4) violations cited during today's visit. Violation Number Comment Rule 1128 For routine transport of children to and from the center, staff did not use the list to document attendance as children boarded and departed the vehicle. The provider did not have documentation of attendance for the children that are transported. 10A NCAC 09 .1003(l) 1321 Medical exam or health assessment record was not on file before or within 30 days after admission. One out of three childrens records monitored did not have documentation of a medical health exam within 30 days of enrollment. GS110-91(1) 1323 Each child was not immunized as per Article 6 of Chapter 130A and an immunization record was not on file before or within 30 days after admission. One new staff member with a start date of 8/5/26 had a Recognizing and Responding to Suspicions of Child Maltreatment training dated after 90 days of her start date, 1/29/26. A signed and dated letter of compliance must be emailed to me by 3/6/2026, stating how each violation was corrected and how compliance will be maintained in the future include the violation number, statement of compliance, license ID and your signature in the letter or e-mail. Name of Operation: TENDER LOVE & CARE CHILD DEVELOPMENT CENTER Facility ID: 60004033 Consultant: LASHAWNDA BERRY Operation Type: Center Case Number: 1225-190L Visit Date: 12/30/2025 Number Present: 6 Completed Date: 12/30/2025 Age: From 1 To 3 Total Minutes: 145 Time In: 12:45 PM Time Out: 03:10 PM Time In: Time Out: List to Use: Center Type Of Visit: Complaint Visit Announced/Unannounced: Unannounced The purpose of today’s unannounced visit was to investigate allegations in the following complaint report case #:1225-190L. The Allegation: There are allegations of violations of child care requirements. Upon arrival, I was greeted by A. Wilson, Director/ Owner in the parking lot, we both walked into the center together. I discussed with Ms. Wilson the reason for my visit, and she was given a chance to respond. Investigation: Today I interviewed the owner and two employees. The center has cameras but they do not record/ live only. I did a walk through of the center and Outdoor Learning Environment. Upon entering the center, as we walked into space #2, we observed six children sleeping with no caregiver in the room, one caregiver was in space #3 (the caregiver was getting something) and the other caregiver was in space #1, this is a supervision concern. During my interview with Ms. Wilson, Ms. Wilson stated that she believes this is an irate ex-employee. Ms. Wilson stated that the center does not have any staff issues that make them not meet daily ratio requirements. Ms. Wilson stated that a teacher came to her one day to ask her if she thought another teacher was asleep. Ms. Wilson stated that the teacher was not sleep but laying next to a child while rubbing their back during naptime. Ms. Wilson stated does not have any concerns, nor has she heard of any of the staff vaping inside the bathroom or on the centers premises. During today’s visit, we were able to take a look at the changing table pad in the infant room and it was torn. We were also able to look at the fence on the Outdoor Learning Environment. The fence had some gaps at the bottom of the fence in some areas that measured between six inches to eleven inches. The fence near the parking lot/ near the bamboo measured five feet eleven inches, which is below the six feet requirement. During the walk through of the outdoor learning environment, I observed debris on the ground. I interviewed two staff members today as well, both staff members stated that they did not have any concerns regarding the shared allegations. Findings: Regarding the allegation that: There are allegations of violations of child care requirements regarding ratio. Based on today’s visit and interviews, this allegation is deemed as unconfirmed. There are allegations of violations of child care requirements regarding supervision. Based on today’s visit and interviews, this allegation is deemed as confirmed. There are allegations of violations of child care requirements regarding center policies (smoking/tobacco). Based on today’s visit and interviews, this allegation is deemed as unconfirmed. There are allegations of violations of child care requirements regarding the fencing. Based on today’s visit and interviews, this allegation is deemed as confirmed. I contacted the center’s Environmental Health Specialist, but was unable to get in contact with them before the visit. I will follow up with them to see if there are concerns regarding these allegations that are related to the sanitation concerns. There were three (3) violations cited related to the complaint. There was one (1) violation not related to the complaint cited. Violation Number Comment Rule 303 Children were not adequately supervised at all times. Upon entering the center, as we walked directly into space #2, we observed six children sleeping with no caregiver in the room, one caregiver was in space #3 (the caregiver was getting something) and the other caregiver was in space #1. .1801(a)(1-5) 714 Openings in equipment, steps, decks, handrails, and fencing were not less than 3 1/2 inches or greater than 9 inches. The fence had some gaps at the bottom of the fence in some areas that measured between six inches to eleven inches. .0605(g) 824 Outdoor play area was not enclosed by fence with a minimum height of 4 feet. The top of the fence, less than six feet, was not free from protrusions. The fence near the parking lot/ near the bamboo measured five feet eleven inches with protrusions. GS 110-91(6); .0605((i) 856 The indoor and/or outdoor premises was not checked once a day, prior to initial use, ensuring debris, and broken equipment was removed and disposed of. I observed debris on the ground of the Outdoor Learning Environment. 10A NCAC 09 .0604(p) Technical Assistance: 1. Supervision 10A NCAC 09 .1801 SUPERVISION IN CHILD CARE CENTERS (a) Children shall be adequately supervised at all times in child care centers. Adequate supervision shall mean that: (1) staff must be positioned in the indoor and outdoor environment to maximize their ability to hear or see the children at all times and render assistance; 2. Outdoor Learning Environment: 10A NCAC 09 .0605 OUTDOOR LEARNING ENVIRONMENT IN CHILD CARE CENTERS (g) Any openings in equipment, steps, decks, handrails, and fencing shall be smaller than 3 ½ inches or greater than 9 inches to prevent entrapment. (i) The outdoor play area shall be protected by a fence. The height shall be a minimum of four feet and the top of the fence shall be free of protrusions. The requirement disallowing protrusions on the tops of fences shall not apply to fences six feet high or above. 3. Debris 10A NCAC 09 .0604 SAFETY REQUIREMENTS FOR CHILD CARE CENTERS (p) Once a day, prior to initial use, the indoor and outdoor premises shall be checked for debris, vandalism, and broken equipment. The center currently has a Five-Star rated license. The center license and Summary of the Law was prominently posted. I was greeted by A. Wilson, Director/Owner. I completed the walkthrough of the center alone and Ms. Wilson assisted me with the visit. Permit information-the program operates with a Five- Star license, issued February 22, 2022. The center has six (6) points for education, six (6) points for program standards and one (1) quality point. License restriction include: First and Second Shift; Meets enhanced ratios; Meets enhanced space The program is still located at: 2701 Ashley Road, Charlotte, NC 28208 The phone number is: (980) 298-6677. The center had thirteen (13) children present during today’s visit and twenty four (24) children enrolled. The following items were monitored: Supervision, S/C Ratio, Storage of Hazardous Substances, Storage of Medication, Adequate Approved Space, Program Records, License Posted and Permit Restrictions. The center would like to provide transportation. I monitored the vehicle that will be used for transportation and it is in compliance. The 2023 Ford Van license plate: RHX-1255 Inspection expires: 6/30/2026 Insurance expires: 3/15/2026 The center has hired two (2) new staff members since their last visit. The new staff files were monitored and in compliance. The center’s last fire drill was documented on 9/4/25. The center’s last lockdown drill was on 7/23/25. The last sanitation inspection was completed on 5/5/25 with two (2) demerits, receiving a superior rating. The center playground inspections were monitored and in compliance. There were two (2) violation cited during todays visit. The restrictions include: First and Second Shift; Meets enhanced ratios; Meets enhanced space. Upon arrival, I was greeted by A. Wilson, Owner/ Director. I discussed with Mrs. Wilson the Annual Compliance Monitoring guidelines. Mrs. Wilson assisted me with the walkthrough of the center and the visit. The NC Secretary of State website was viewed before the visit TENDER LOVE & CARE CHILD DEVELOPMENT CENTER, LLC. was current and not active. I informed Mrs. Wilson of the status of the LLC., Mrs. Wilson paid the required fees today during the visit and we are waiting for the status to update. The following items were posted within the center/ classrooms: Daily schedules, activity plans, staff/child ratio worksheets, emergency numbers, emergency procedures, arrival/ departure procedures, summary of law and menus. Indoor Learning Environment: Staff/child ratio, supervision, capacity, group size and space were observed in compliance today. Children were observed engaged in nurturing interactions with caregivers, transitions and multi-play opportunities. There were thirteen (13) children present today. There are twenty-nine (29) children enrolled in the center. Outdoor Learning Environment: The outdoor learning environment was monitored today and in compliance. Mrs. Wilson informed me that she will be having changes made to the playground. Mrs. Wilson agreed to contact me before the work is done to make sure it will be in compliance. Inspections: The outdoor inspections and fire drills were monitored. The last fire drill was conducted on 11/20/2024. The centers last shelter in place/ lockdown drill was conducted on 1/21/24. The last monthly playground inspection was conducted on 2/7/25. The center last had a sanitation inspection on 11/20/2024. The center received 8 demerits and received a superior classification. The inspection was completed by the Mecklenburg County Health Department. The center last had a fire inspection on 5/1/24. Transportation: The center does not provide transportation. Nutrition: Meals met nutritional value during today’s visit. Files: Children records and staff files were monitored today and in compliance. Staff files were monitored today and in compliance. The center currently has a Five-Star rated license, the 18-month compliance history score is 95%. The center license and Summary of the Law was prominently posted. I was greeted by T. Williams, Staff. I informed Ms. Willims the reason for my visit. Ms. Williams contacted Director, A. Wilson via telephone to inform her that I was at the center. I began the walkthrough of the center alone. Ms. Wilson, Director soon arrived and assisted me with the visit. Permit information-the program operates with a Five- Star license, issued February 22, 2022. The center has six (6) points for education, six (6) points for program standards and one (1) quality point. License restriction include: First and Second Shift; Meets enhanced ratios; Meets enhanced space. The program is still located at: 2701 Ashley Rd, Charlotte, NC 28208. The phone number is (980) 298-6677. The center had nineteen (19) children present and twenty-nine (29) children enrolled. The following items were monitored: Supervision, S/C Ratio, Storage of Hazardous Substances, Storage of Medication, Adequate Approved Space, Program Records, License Posted and Permit Restrictions. The center has hired one (1) new staff members since their last visit. The center’s last fire drill was documented on 10/9/24. The center’s last shelter in place drill was on 7/23/24. The last sanitation inspection was completed on 5/15/24 with two (2) demerits, receiving a superior rating. The center playground inspections were monitored and in compliance. There were () violations cited during todays visit. Violation Number Comment Rule 533 Human milk, formula and other bottled beverages including sippy cups, sent from child's home were not fully prepared, dated, and labeled for the appropriate child. In space #1, I observed one bottle that did not have a date. 15A NCAC 18A .2804(d) 620 All walls and ceilings including doors and windows were not kept clean, free of visible fungal growth, and in good repair. The bathroom wall is in the process of being repaired, I observed peeling paint. 15A NCAC 18A .2825(a) 812 Electrical outlets and power strips, not in use, which were located in space used by children did not have safety outlets or were not covered with safety plugs unless located behind furniture or equipment that cannot be moved by a child.
