The facility is currently operating with a Five Star License issued on January 5, 2023 and had an eighteen (18) month compliance history score of 100% prior to today’s visit. The last rated license assessment was completed September 20, 2022. The April 2025 Center Item Number Listing and March 2023 Annual Compliance Checklist were used to monitor today. The license and NC Summary of the Law were prominently posted. Upon arrival I was greeted by Ms. Betty Clay, Owner/Director and I explained the purpose of my visit. Preschool aged children were observed participating in independent center play. Teachers were engaged with children. One (1) infant was observed present today. He was observed sitting in a bouncy seat and his teacher was sitting next to him, talking, and playing with him. Safe sleep checks were observed documented as required. Ms. Clay stated she provided infant formula and prepared bottles as needed. The safe sleep policy and feeding schedules were posted. Lunch was provided during the visit and reflected what was listed on the menu. Lunch met requirements. Ms. Clay stood next to children as they ate at the table and talked as they ate. Adequate supervision and a nurturing environment was provided. Materials were observed plentiful and in good repair. Age appropriate materials were available for each child. All required information was observed posted and current. Ms. Clay stated the facility used Funshine Express curriculum. Current lesson plans were observed posted. One (1) child’s medical report indicated a food allergy that required an Epi pen. The medical action plan was not completed and attached to the application and the Epi pen was not onsite. Ms. Clay spoke to the parent during the visit and requested the Epi pen be brought to the facility. A copy of the medical action plan and medication permission form was emailed to Ms. Clay for the parent to complete. Transportation requirements were monitored. Staff files were reviewed and met requirements. Ms. Clay and Ms. Battle need to complete their ongoing training hours by 9/10/25. A sampling of children’s files was monitored. The last sanitation inspection was conducted on 5/12/25 and received a Superior rating. The last fire inspection was conducted on 7/18/24 and the facility was approved for daytime care only. The inspector visited the facility on 9/1/25 and there were items that needed to be corrected prior to issuing the DCDEE fire inspection report. The corrections were completed and the alarm system report was emailed to the inspector on 8/12/25. Ms. Clay contacted the inspector today and requested the DCDEE form. The DCDEE form should be forwarded to me within 7 calendar days of receipt. The EPR plan was updated 8/6/25. Ms. Clay had trouble getting the plan published. For technical support please contact (919) 814-6365 or dcdee.inservice.training@dhhs.nc.gov. The ABCMS roster was not completed. I observed the ABCMS portal training certificate for Ms. Clay. She should enter the roster into the portal. The roster will be monitored again at the routine unannounced visit. Violation Number Comment Rule 106 Operator has not scheduled and obtained a fire inspection within 12 months of the previous inspection. Operator did not submit the original approved report to DCDEE within one week of the inspection visit on a form provided by the Division. The last fire inspection was completed 9/1/25. The approved DCDEE report was not completed. 10A NCAC 09 .0304(a) 807 A safe indoor and outdoor environment was not provided for the children. One (1) child, RI, with a diagnosed food allergy did not have emergency medication onsite. 10A NCAC 09 .0601(a) 1834 Application did not have a medical action plan attached for any child with health care needs such as allergies, asthma, or other chronic conditions that require specialized health services. The medical report for RI stated a food allergy. A medical action plan was not completed. .0801(b) Corrective Action: Violations must be corrected immediately. The child care provider is expected to maintain all applicable child care requirements at all times. The provider will send me a compliance letter that includes the violation item number and an explanation of how each of today’s violations were corrected. Corrections must be received by me on or before Wednesday, August 27, 2025 to the email address listed below. Failure to correct the violations and send the written statement by the due date listed above may result in an unannounced follow-up visit being conducted or an administrative action may be recommended. Based on Child Care Rule 10A NCAC 09 Section .2200, the Division of Child Development may take administrative action against the license and/or impose civil penalties based on the failure of the operator to correct any documented violations within the established time period. Technical Assistance/General Discussions: - I recommend reviewing the child application and medical report when children enroll to make sure all required medications are onsite. - Medical action plans should be completed by the parent or physician and attached to the child’s application. The medical action plan is valid for 12 months. I recommend putting a copy of the medical action plan with the medication in the classroom in addition to attaching it to the application. - Prescription medication authorization is valid 6 months. - Emergency medications should be stored above 5 feet and should not be locked. Prescription medications should be stored in the original container with the Rx attached. - Over the counter antihistamines are not emergency medications and should be stored behind lock and key. - Grapes and hotdogs should be cut into small pieces for all children. – QRIS update: Get ready for the 3s Starting on February 1, 2025, the ECERS-3, ITERS-3, and FCCERS-3—also known as the "3s"—will be used for DCDEE environment rating scale assessments. The DCDEE and the North Carolina Rated License Assessment Project (NCRLAP) are collaboratively working on preparations for the transition to the third edition. Information regarding the transition can be found by visiting https://ncrlap.org/Resources/pages/get-ready-for-3s. These third editions come with a spiral binding at the top, replacing the current revised editions. Visit the NCRLAP’s website, https://ncrlap.org/. for more information about updated resources, credit hour trainings, and outreach assessment opportunities to help you become familiar with these tools. In August, we’ll provide a rule roll out module in the DCDEE e-learning Moodle platform. We’ll also host informational webinars: Webinars – Choosing a Pathway to the Stars • August 18 at 1:00pm (child care centers and centers located in a residence) • August 18 at 6:30pm (family child care homes) • August 20 at 1:00pm (family child care homes) • August 20 at 6:30pm (child care centers and centers located in a residence) In September, child care consultants will host in-person facility operator/administrator meetings within the counties they serve to provide additional guidance on the changes, the transition plan and timeline. Beginning In October, child care consultants will begin discussing the new rules in Section .3200; Standards for Two through Five Star Rated Licenses during licensing visits. Consultants will review the pathway options, identify facility needs, answer questions, and work with the facility operator to establish an individualized timeline for transition to a new rated license within 12 months based on the pathway chosen.
