Limited monitoring was conducted today. Upon arrival, I informed the program director of the purpose of my visit. The allegation is as follows: There are allegations of violations of child care requirements. According to the reporter, a child was left unattended on the playground as the class transitioned inside the building on April 13, 2026. Findings: The program director notified me of the incident via email on April 15, 2026. I spoke to the program director and two teachers during the visit. One of the preschool classes was outside on the morning of April 13, 2025. During that time, children were being dropped off and engaged in outdoor free play. As children are dropped off, teachers record their name on a notepad. Parents sign their children in on the app used by the program. At approximately 9:25am the class began to clean up and line up to transition inside. The teachers counted the children to ensure the number matched their count on the notepad. They counted 14 children and noted 14 children on the notepad, but there were 15 children present due to a child being dropped off and not notated on the notepad. The class transitioned inside at 9:28am, and one child remained outside under the playground structure. The director entered the playground at 9:32am to open the playground gate for an event taking place that day. Visitors from partnering agencies were present for the event and noticed the child, as did the director. They told the director about the child. The director took the child by the hand and returned them to the classroom. Based on my observations and the information gathered, the allegation of violation of child care requirements was substantiated. The following violation was cited. Violation Number Comment Rule 303 Children were not adequately supervised at all times. A child was left unattended on the playground during transition back to the classroom. .1801(a)(1-5) The above violations must be corrected immediately. A Corrective Action Letter must be drafted and sent to me by May 5, 2026. Additional violation may be documented if each violation has not been properly corrected or otherwise addressed. Please be aware that any information received during this monitoring visit and any violations cited may be included in any future administrative actions. Violations of child care requirements, particularly repeated violations, could result in a civil penalty and/or administrative action that could jeopardize the status of the license for the child care facility. You were provided an opportunity to ask questions regarding interpretation and implementation of all child care requirements. Child care licensing rules and regulations are established to ensure a safe and healthy environment for children in care. Therefore, it is important for you to be knowledgeable of all of the licensing requirements that apply to your program. It is your responsibility to maintain compliance with all of the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the child care law and rules. TECHNICAL ASSISTANCE: 10A NCAC 09 .1801 SUPERVISION IN CHILD CARE CENTERS (a) Children shall be adequately supervised at all times in child care centers. Adequate supervision shall mean that: (1) staff must be positioned in the indoor and outdoor environment to maximize their ability to hear or see the children at all times and render assistance; (2) staff must interact with the children while moving about the indoor or outdoor area; (3) staff must know where each child is located and be aware of the children's activities at all times; (4) staff must provide supervision appropriate to the individual age, needs, and capabilities of each child; and (5) staff must be able to see and hear children aged birth to five years old while the children are eating. We discussed techniques that could be implemented to decrease the likelihood of a supervision incident taking place in the future. The program uses a tracking log to document transitions. They also do head counts. It is suggested that all classrooms begin to implement name to face recognition while counting and accounting for all children at transition times. At the completion of the visit, I reviewed the visit with the program director and provided an opportunity to ask questions regarding the interpretation and implementation of child care requirements. The facility currently operates with a Five Star Child Care License that was issued on August 27, 2020. The last annual compliance visit was conducted on July 21, 2025. The Program Director, Sarah Tippett, was present and assisted me during the visit. She accompanied me on a walk-through of the facility where attendance was documented and observations made. Children were observed engaging in indoor play activities and outdoor play. During today’s visit, a partial assessment of applicable Child Care Requirements was conducted. The following violations were cited. Violation Number Comment Rule 843 A drug or medicine was administered after its expiration date. The staff were provided with an opportunity to ask questions regarding interpretation and implementation of all child care requirements. We discussed the QRIS Pathway to the Stars. The program plans to use the Classroom and Instructional Quality pathway. The director is working on gathering the components and will reach out when she is ready to apply. The last Sanitation inspection was on April 14, 2025, with a “Superior” classification. The Annual Fire Inspection was completed on August 29, 2024, and the program was approved for daytime care only. The Program Director, Sarah Tippett, was present and assisted me during the visit. A walk of the facility was completed where attendance was documented and observations made. Children were observed interacting in free play activities indoors and on the outdoor learning environment. We discussed the importance of ensuring medications and forms are updated regularly so that correct information is provided. We talked about having each classroom go through their current medications/topical ointments/bug sprays/etc. and checking expiration dates on permission forms and medications themselves. REMINDERS: Going forward we will count annual training hours from Annual Compliance Visit Date to Annual Compliance Visit Date. All staff should have their hours complete prior to that date. As we discussed, the date will move around on the calendar by a couple of weeks each year, so having hours completed early is recommended. Summer Safety Tips 1.Safety Check & Maintenance Inspect equipment: Check for loose bolts, rust, splinters, or cracks on play structures, swings, and slides. Surface check: Ensure mulch, rubber mats, or sand are evenly spread and thick enough to cushion falls. Fence & gate: Inspect for damage or sharp edges and make sure gates latch securely. Pest control: Check for bees/wasp nests, ant hills, or signs of other pests. 2. Sun Protection Shade structures: Install or check canopies, sails, or umbrellas over play areas and seating. Natural shade: Trim trees for safety but keep them healthy to provide extra sun coverage. Sunscreen policy: Have a plan for applying sunscreen (with parent permission) and ensure staff follows it. 3. Hydration Station Water access: Ensure water is available with disposable cups. Encourage water breaks: Schedule regular hydration times during play. 4. Outdoor Activities & Toys Summer-appropriate toys: Add water tables, sand toys, sports equipment, or ride-ons. Rotate toys: Keep the environment fresh and engaging by rotating outdoor toys. Nature-based play: Include items like gardening tools, pots, or sensory bins with natural materials. 5. Cleanliness Sanitize outdoor toys regularly—especially anything children put in their mouths. Tidy up landscaping: Remove any debris, broken branches, or trash. 6. Safety from Heat Playtime schedule: Shift outdoor play to cooler times (morning or late afternoon). Cooling activities: Plan for cooling breaks with misting bottles, or popsicle breaks. Watch for signs of heat exhaustion in children and staff (lethargy, excessive sweating, etc.). 7. Communication Notify parents about changes in outdoor routines, sunscreen application, and clothing suggestions (hats, water shoes, etc.). The operator did not notify the Division of these pending charges, indictments, or convictions within one business day of being notified by the child care provider or household member. The administrator failed to notify the Division of a staff member’s pending charges within one business day of receiving the information. The facility currently operates with a Five Star Child Care License that was issued on August 27, 2020. The last Annual Compliance Visit was conducted on July 25, 2023. Sarah Tippett, Center Director, was present and assisted me during the visit. Children were observed participating in indoor and outdoor play Allegations: There are concerns regarding sanitation and health. Findings: -Allegation regarding sanitation and health. It was reported that children’s diapers are not being changed when needed. There are two classrooms at this center where diaper changes occur. I monitored each of these classrooms. Ms. Tippett shared with me the center’s plan for diaper changes. This includes changing diapers as needed and visually checking children at least every two hours. Although it is not required by child care rules, staff in both classrooms are also documenting diaper changes. She stated that recently a parent did complain about a child’s diaper not being changed as needed and upon investigation into the matter she found this to be the case. The teacher’s in the classroom were reprimanded for the incident. One teacher no longer works at the center. Based on information received the finding regarding this allegation is substantiated. During today’s visit, a partial assessment of applicable Child Care Requirements was conducted which included monitoring new staff files. The following violation was documented and corrected during the visit. Violation Number Comment Rule 401 Diapers were not changed whenever they were soiled or wet and/or were changed on a shift basis. 10A NCAC 09 .0806(a) You were provided an opportunity to ask questions regarding interpretation and implementation of all child care requirements. Child care licensing rules and regulations are established to ensure a safe and healthy environment for children in care. Therefore, it is important for you to be knowledgeable of all of the licensing requirements that apply to your program. It is your responsibility to maintain compliance with all of the applicable laws and rules at all times.
