Restrictions on the license include a first shift capacity of eight (8) children ages 0 through 12, maximum of five (5) preschool children at any time, no more than two (2) children less than one, and may care for children up to 16 years of age. Restrictions were in compliance today. The last annual compliance visit was completed on June 19, 2026. The program's compliance history was reviewed with the operator. Prior to the visit, the facility’s eighteen-month compliance history was ninety-six percent (96%). You, I. Kelly, owner/operator were present for the visit. There were eight (8) children enrolled and two (2) children present. The two children present were older than 12 and are enrolled due to special needs. New substitutes/caregivers have not been hired since the last visit. Your program was also monitored for compliance with implementing an approved curriculum as required for all four- and five-star licensed facilities where four-year-old children are enrolled; this program does not currently have 4 year old children enrolled. Children arrived to the program during the visit. Upon arrival they chose from a variety of free play materials, including music instruments. Infants are not currently enrolled. Afternoon snack consisted of peanut butter crackers, fruit cup, and milk. I reviewed the FCCH Verification of Information form, as well as children’s, staff, and program records. The required Health and Safety trainings as outlined in Child Care Rule 10A NCAC 09 .1102 have been completed as required. The following violation(s) were documented. Ms. Faulk’s car was observed parked in the driveway next to the house, so I knocked on the door to see if she was present. When no one answered, I called you and you stated you were not home, but that Ms. Faulk should be in the neighborhood somewhere and was prepared to meet the children at the bus stop. When I told you the purpose of my visit, you stated you had been dealing with some personal issues out of town recently and you asked if I could come back another day. I asked you if your program was open, and you stated it was, so I told you I could go ahead and conduct the visit with Ms. Faulk in your absence. You stated you would come home in twenty minutes or so. After the call ended, I heard voices coming from inside your home, so I knocked on the door again. At 3:10 P.M., a gentleman answered the door and invited me inside after I introduced myself as your Child Care Consultant. He stated his name was Dexter Deese and he referred to you as his wife. When I asked how I had never met him before he stated he is usually working. When I asked if anyone else was in the home, he stated your grandson Unique Kelly was visiting as he was on a school break. Both Mr. Deese and Mr. Kelly left the residence shortly after you arrived around 3:30 P.M. You stated that Mr. Deese was an “on-again, off-again” boyfriend who had been staying with you since June or July. Mail for Mr. Deese with your address on it was also observed on the table in one of the child care spaces. You stated Mr. Kelly was only here until after Christmas when he goes back to school in Fayetteville. While you and I talked, Ms. Faulk met five school age children at the bus stop and recorded their arrival time as 3:50 P.M. on the attendance record. She brought them into the main child care space and began to engage them in free choice activities. Next, you served a snack of cereal and applesauce. Ms. Faulk took the children who had not yet been picked up outside to play at 5:00 P.M. The oldest child in attendance today was sixteen years of age, however that could not be reflected in the Regulatory system. Child Care programs are expected to always achieve and maintain compliance with child care rules, and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Today you stated that you didn’t think this requirement applied to Mr. Deese as he has another residence, only stays here “off and on,” and is never around when children are present. It was confirmed today that neither Mr. Deese nor Mr. Kelly have started applications for criminal background checks. As discussed, a family child care home CANNOT have children in care if anyone staying on the premises does not have a valid qualification letter on file at the facility. Your program must close by the end of the day today, December 3, 2024. The facility will be placed on "Inactive" status until the next steps are determined; I will contact you as soon as I know what you need to do to get your facility back on “Active” status. Moving forward, I strongly urged you to have anyone sixteen years of age or older who may be staying with you, even if not permanently, complete the criminal background check process so you can remain in compliance. Instructions for how to complete this process in the new portal were emailed to you previously and again today. Technical assistance was also provided regarding how any household members should create Individual NCID’s, start the application process, and make appointments for electronic fingerprinting. Restrictions were in compliance today. The last annual compliance visit was conducted June 25, 2024. A fire inspection was conducted December 7, 2023 and your facility was approved for day time care. Prior to the visit, the facility had an eighteen-month compliance history score of 99%. You, Owner/Operator I. Kelly, were present and available for consultation today. Additional caregiver/substitute, C. Faulk, was also present today. Upon arrival, it did not appear that you were home as your car was not in the driveway. Ms. Faulk’s car was observed parked in the driveway next to the house, so I knocked on the door to see if she was present. When no one answered, I called you and you stated you were not home, but that Ms. Faulk should be in the neighborhood somewhere and was prepared to meet the children at the bus stop. When I told you the purpose of my visit, you stated you had been dealing with some personal issues out of town recently and you asked if I could come back another day. I asked you if your program was open, and you stated it was, so I told you I could go ahead and conduct the visit with Ms. Faulk in your absence. You stated you would come home in twenty minutes or so. After the call ended, I heard voices coming from inside your home, so I knocked on the door again. At 3:10 P.M., a gentleman answered the door and invited me inside after I introduced myself as your Child Care Consultant. He stated his name was Dexter Deese and he referred to you as his wife. When I asked how I had never met him before he stated he is usually working. When I asked if anyone else was in the home, he stated your grandson Unique Kelly was visiting as he was on a school break. Both Mr. Deese and Mr. Kelly left the residence shortly after you arrived around 3:30 P.M. You stated that Mr. Deese was an “on-again, off-again” boyfriend who had been staying with you since June or July. Mail for Mr. Deese with your address on it was also observed on the table in one of the child care spaces. You stated Mr. Kelly was only here until after Christmas when he goes back to school in Fayetteville. While you and I talked, Ms. Faulk met five school age children at the bus stop and recorded their arrival time as 3:50 P.M. on the attendance record. She brought them into the main child care space and began to engage them in free choice activities. Next, you served a snack of cereal and applesauce. Ms. Faulk took the children who had not yet been picked up outside to play at 5:00 P.M. The oldest child in attendance today was sixteen years of age, however that could not be reflected in the Regulatory system. Child Care programs are expected to always achieve and maintain compliance with child care rules, and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Moving forward, I strongly urged you to have anyone sixteen years of age or older who may be staying with you, even if not permanently, complete the criminal background check process so you can remain in compliance. Your program currently operates with a Four Star License issued January 12, 2023, earning 2 points in Program Standards, 7 points in Education and 1 Quality point. Restrictions on the permit include a first shift capacity of 8 children 0-12 years of age, maximum of 5 preschool children at any time, no more than 2 children less than 1, and may care for children up to 15 years of age. Restrictions were in compliance today. The last annual compliance visit was conducted July 5, 2023. A fire inspection was conducted December 7, 2023 and your facility was approved for day time care. Prior to the visit, the facility had an eighteen-month compliance history score of 100%. You, Owner/Operator I. Kelly, were present and available for consultation today. Additional caregiver/substitute, C. Faulk, was also present today. Upon arrival, you and Ms. Faulk were observed in the main child care space with four school age children. A fifth school age child arrived at 9:20 A.M. and you recorded his arrival time and assisted him with hand washing as required. Children were observed playing board games, doing bead art, building with large connecting blocks and playing with trucks. At 11:00 A.M., Ms. Faulk took children outside, where they played a bean bag toss game and rode bicycles and scooters. Helmets were provided as required. It was observed that you have added more age appropriate materials for the summer, including new games and blocks, to your indoor materials. It was also observed that you placed a water filter on the faucet in your kitchen as suggested by the Clean Water for Carolina Kids program. According to your menu, lunch planned for the day consisted of ham and cheese sandwiches on whole grain bread, corn, watermelon and milk. The oldest child present today was fifteen years of age, however this could not be reflected in the Regulatory system. Today I asked you if either of your grandchildren, U. Kelly or J. Kelly, had been staying with you or would be visiting this summer as previously discussed. You stated they have not been staying with you, and that no one else is staying with you or living with you at this time. I reminded you to be sure you have valid criminal records check qualification letters on file for anyone over fifteen years of age who stays with you in the future, and to notify me if anyone moves in. It was also verified today that you still have two children fifteen years of age enrolled and regularly attending your program. You stated you anticipate them remaining enrolled through at least their sixteenth birthdays, so the restriction on your license will be updated to reflect this. It was verified that you initially completed the Health and Safety trainings outlined in Child Care Rule 10A NCAC 09 .1703(b) as required in 2017, and it was verified in January 2023 that you had repeated all topics within five years as required. Ms. Faulk also completed all required topics within her first year of employment. As discussed, she must also repeat all topics by 2027. Transportation requirements for the Hyundai Elantra used by C. Faulk to occasionally transport children from the bus stop during the school year were monitored and in compliance today. You stated you do not plan on providing transportation during the summer. Child Care programs are expected to always achieve and maintain compliance with child care rules, and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. The following violations were observed today and corrected during the visit: Violation Number Comment Rule 908 Health questionnaire was not completed annually. Annual health questionnaires were not on file for the operator or additional caregiver. .1703(a)(1) 915 The written schedule did not show blocks of time assigned to types of activities and/or include periods of time for both active play and quiet play or rest. A written schedule was not observed today. GS 110-91(12); 10 A NCAC 09 .1718(6)(a-c) As all violations were corrected during the visit, a compliance letter is not due at this time. Technical Assistance Regarding Violations Cited Today it was observed that you had older versions of health questionnaires on file for yourself and C. Faulk, so I printed new forms for you, which you both completed during the visit. Please ensure you update this form annually moving forward. You also stated your written schedule must have gotten lost or fallen down off the wall and you couldn’t find it. I shared a copy of the program records checklist for Family Child Care Homes with you to assist with your recordkeeping. We reviewed which items need to be posted and which ones need annual updates or renewals. Please use this to keep track of required postings and deadlines moving forward. You may also use the checklists for operators and additional caregivers, which are found on the DCDEE website under Provider Documents and Forms as well. Technical Assistance Technical assistance was provided today regarding requirements for daily schedules and activity plans. As discussed, you may combine these into one document or keep them separate if you wish. Since you are operating a full day during the summer months, you must ensure you offer at least four different activity options on your activity plan. Today I suggested you pick from the list of categories on the sample school age activity plan you use and assign four different activity options daily, then you may plan activities accordingly. Remember to continue using the NC Foundations for Early Learning and Development as you plan activities. Today you asked about parents who may bring sunscreen or bug spray, so I provided technical assistance regarding permission forms. Remember to ensure you have written permission to administer topical ointments for any sunscreen or bug spray, and be sure to lock up anything provided in an aerosol can. We also discussed your request to take children on walking field trips to the new park in your neighborhood. As discussed, you may use a blanket permission form (good for the whole summer) for off-premise activities as long as you select a regular day and time and make parents aware of the schedule of activities. I printed a copy of this permission form for you today. Technical assistance was also provided today regarding meeting new requirements for lead in paint and asbestos testing. The steps for enrollment were discussed as follows: 1. Sign Up – Pre-enrollment webinars are available at cleanwaterforUSkids.org/carolina or paste https://bit.ly/3CK-webinar into your web browser to see available dates and times for the next month. 2. Enroll – At www.cleanwaterforUSkids.org/carolina using the PIN and complete the enrollment surveys for three program sections: 1) lead in water, 2) lead-based paint, and 3) asbestos. 3. Evaluate Hazards - The program will ship your facility a water sample kit and may coordinate an on-site visit by a professional to assess for lead-based paint and asbestos hazards, if needed. 4. Receive Results – Receive your results, recommendations, and water mitigation support, if needed. 5. Request Reimbursement - If you choose to conduct lead-based paint or asbestos mitigation, you can request reimbursement from NC DHHS. Rated License Information As discussed during previous visits, your facility was assigned to “Cohort 2” in the cohort model of resuming rated license reassessments. Your planning year begins July 1, 2024, and your reassessment must be conducted by June 30, 2026. Today you stated you plan to complete the three-month Family Child Care Environment Rating Scale-Revised (FCCERS-R) self-study to maintain at least two points in Program Standards. I reminded you that if you are considering having the FCCERS-R completed in an effort to earn more points in Program Standards, you will have the option of requesting a “practice” assessment during your planning year. I encouraged you to visit www.ncrlap.org/resources to help you prepare if you wish to request the FCCERS-R. It was verified today that you are currently maintaining compliance with Education standards and your Quality point as nothing has changed since your last reassessment. Reminders You must schedule and obtain an approved fire inspection by December 7, 2024. Remember to send a copy upon completion.
