Jessica Huvard, director, accompanied me during a walk-through of the facility. During the visit, I spoke with Ms. Huvard and Shea Cochran, area manager. Limited monitoring of child care requirements occurred during today’s visit. The following violations were observed and/or confirmed during today’s visit. Violation Number Comment Rule 301 Minimum staff/child ratios and group sizes for the number and ages of children in care were not met. During the visit, I observed seven children present in the classroom for one-year-old children. GS 110-91(7);.0713(a-d) 318 Children between 12 and 24 months of age were grouped with children 3 years of age or older. During the visit, I observed a six-year-old child in the classroom for one-year-old children. 10A NCAC 09 .0713(a)(6) The cited violations were corrected during the visit. In addition, a written, dated, and signed letter of compliance must be submitted to me within one week, by 12/10/25, describing how compliance will be maintained in the future. A full assessment of child care requirements was conducted. Your program currently operates with a Five-star license and is approved to care for children 0-12 years of age. Today’s visit was conducted with you, Jessica Huvard, Center Director. You accompanied me throughout my walkthrough of the facility today. I monitored four classrooms in use for compliance with staff/child ratios, supervision, capacity, group size and staff interaction/discipline. Two playgrounds were also monitored today. The facility was monitored for health and safety requirements both indoors and outdoors. There are currently no infants enrolled in the program. I observed the children engaged in centers, having diapers changed, eating lunch and going down for nap. Today, I observed the staff moving about the classrooms, actively engaged in the children’s activities and providing appropriate supervision. Program requirements were monitored today. All inspections and drills were current. Children and staff records were monitored, and the information was documented on the children’s records form and staff and training worksheets. The facility was licensed on January 1, 2019. One violation was cited today and must be corrected immediately. Violation Number Comment Rule 807 A safe indoor and outdoor environment was not provided for the children. The two year old playground has an area where the ground cover has eroded away creating a tripping hazard where the ground cover meets the sidewalk. 10A NCAC 09 .0601(a) TECHNICAL ASSISTANCE: *ABCMS- As stated in G.S. 110-90.2 & .2703(r) child care operators are to notify the Division of any new child care providers working who were hired or moved into the child care facility within five business days. Ms. Ware has all of her staff linked to her facility and has been completing the process within the 5-day requirement. *Safe Sleep – At this time there are no infants enrolled at this facility. I reminded the director, Ms. Huvard, of the importance of confirming the infant teacher is trained in all the required documentation that must be maintained according to rule and that the infant teacher completely understands the Infant Safe Sleep policy that must be followed at all times. *Attendance – Currently the facility staff have three places to maintain attendance, a handwritten monthly and daily attendance form and an electronic attendance on the ipad. All areas were found to be in compliance today. It is very important for staff to maintain accurate attendance throughout the day, so they are aware of how many children are present in the event of an emergency and who they need to account for. *I discussed the importance of paying close attention to the temperature to confirm it is safe to take the children outside and for how long they should stay outside. Remember the importance of making sure there is water available for all children and staff and the staff encourage play under shaded areas during the hot summer months. I observed Weather Watch Charts posted throughout the facility today and the staff utilizing them to plan their outdoor play time for the children in their classes. *RATED LICENSE Director, Ms. Huvard, is currently working with NCRLAP. They completed Mock assessments in June 2025. They are now using the feedback to devise trainings, so they are ready for the real assessments in the next couple of months. Your program currently operates with a Five Star License issued on July 17, 2020. Today’s visit was conducted with you, Ms. Feinman, Assistant Director. During today’s visit, I monitored all indoor and outdoor space occupied by the children. You, Ms. Feinman, visited each indoor and outdoor space with me. I monitored all classrooms in use for supervision, staff/child ratios, materials, equipment and required postings. Staff files were monitored today. A selection of children’s files was monitored. Throughout today’s visit, the children present were observed engaged in indoor activities such as art, music time and centers. Staff assisted children with materials, met their developmental needs, and facilitated daily activities. Today, I also reviewed all required inspections including fire drills, emergency drills, sanitation, fire, and outdoor inspections. All inspections were found to be in compliance today. The facility’s EPR plan was updated on June 20, 2024 and ready to go files and supplies were accessible. A checklist was used to note the requirements that were monitored today. The completed checklist was given to the Ms. Feinman at the conclusion of the visit. Two violations of childcare requirements were observed, documented and technical assistance regarding maintaining compliance was offered during today’s visit. Violation Number Comment Rule 1316 Emergency medical care information did not contain information needed for safe medical treatment. One (1) child was identified as having a medical condition that required emergency medication but the medication was not on cite and available in the event it was needed and no medical action plan was completed and submitted by the child's parent. .0802 (c)(4) 1320 Children's records that include an application for enrollment, medical and immunization records, and permission to seek emergency medical care was not on file for each child. One (1) child was missing the required medical form completed by a physician and one (1) child was missing the required medical information completed by the child's parent. GS 110-91(1);.0302(d)(2); .0304(g) COMPLIANCE HISTORY According to NC General Statute all Child Care programs must maintain a compliance history of at least seventy-five percent (75%) for the past 18 months or during the length of time the facility has operated, whichever is less. Any violations documented during visits to your program may have an impact on the total compliance history score and cause your score to drop below the mandated level. **Prior to today’s visit, the compliance history score for the center was 89%. TECHNICAL ASSISTANCE: It is extremely important to provide a safe environment at all times which includes reviewing all medical reports required to be submitted by each child’s parent and the child’s physician and maintaining required documents for those children with identified medical conditions. During today’s visit one (1) child was missing the required medical history completed by the child’s parent, one (1) child was missing the required physical report completed by the child’s physician, and two (2) children who have identified medical conditions did not have the required medical action plans on file and in place if needed in the event of an emergency. CONSULTATION: PLAYGROUND SAFETY While monitoring the playgrounds today, I discussed the importance of checking the temperature of the playground equipment and ground cover to confirm it is not too hot to the touch BEFORE the children are allowed outside. I left two hand outs with Ms. Feinman regarding playground safety as it pertains to the temperature of outdoor play equipment. The facility has a heat gun and we talked about the importance of using that during the hot summer days we are currently experiencing. RATED LICENSE The Growing Years Learning Center – Cary is in COHORT 2. Your Prep year is from July 1, 2024 - June 30, 2025 and your Reassessment Year is from July 1, 2025 – June 30, 2026. During the facility Routine Unannounced visit conducted on 2/16/2024, I had a lengthy discussion with the facility assistant director, Ms. Feinman on 2/16/2024, regarding the rated license process and the variety of pathways that could be followed. Today I recommended the facility assistant director, Ms. Feinman, begin by confirming all of the staff have an up-to-date WORKS account and determine where the staff education is. UPDATES/RESOURCES: Today I discussed information regarding Clean Classrooms for Carolina Kids program to identify and eliminate exposure to lead and asbestos hazards in child care. Assistant Director, Ms. Feinman, provided documentation showing the facility has completed lead water testing and no areas of non-compliance were identified. The building this facility is housed in was built after 1978 therefore does not need to be inspected for lead paint and/or asbestos. EMERGENCY MEDICATION: Today we discussed the importance of making sure all staff know who the children are that require emergency medication in the event the emergency medication is needed to be administered. I recommend the administrators contact their health care consultant for periodic trainings on the emergency medications housed in their building. CLASSROOM ATTENDANCE: Throughout my walk-through of the facility today I found attendance being completed. While monitoring this requirement, I reminded the staff the importance of maintaining updated attendance throughout the entire day. We never know when an emergency situation could arise, therefore updating attendance throughout the day is extremely important. Be sure to visit DCDEE’s website and access the What’s New section for the newest child care rules that were effective January 1, 2024. You may visit MOODLE and complete training for the new child care requirements effective January 1, 2024.
