Name of Operation: LA PETITE ACADEMY Facility ID: 9255228 Consultant: SCOTT MOORE Operation Type: Center Case Number: Visit Date: 8/27/2024 Number Present: 60 Completed Date: 8/27/2024 Age: From 0 To 5 Total Minutes: 105 Time In: 09:15 AM Time Out: 11:00 AM Time In: Time Out: List to Use: Center Type Of Visit: Annual Comp Full Announced/Unannounced: Unannounced The purpose of today's unannounced visit was to monitor compliance with applicable childcare requirements during your Annual Compliance visit. Applicable childcare requirements and the inspection was discussed with Administrator, Brianna Bailey. Currently this facility operates with a 5 star license effective February 26, 2019. Secretary of state information for the governing body was observed to be current and active. During the visit I monitored the indoor and outdoor spaces used for child care. I observed children during routine activities. I observed whole group activities and free play activities. Children were observed playing outside during outdoor play with adequate supervision. Age appropriate materials and equipment was accessible to all children. The facility was monitored for compliance using the annual compliance monitoring checklist. I also monitored, permit restrictions, posting requirements, training requirements, use of approved space, program records, and nutrition. 6 children's records were reviewed and staff records were reviewed along with the staff and training worksheet. The last fire inspection was completed 11/15/23 and the last sanitation inspection was completed 10/19/24. The last fire drill was completed on 7/9/24. The last lockdown drill was completed 6/28/24. The operation's EPR plan was last updated 1/23/24. Outdoor inspections were observed to be completed monthly. The Administrator provided me with a lead water test dated 10/12/23. Diaper creams and suntan lotions were observed to have current permissions in all rooms. Sleep checks were observed to be completed. One emergency medication was observed in the operation to meet all rules and requirements. Transportation i snot provided. I observed 1 violations during this inspection. Violation Number Comment Rule 1867 The depth of the loose surfacing was not based on critical height of the equipment. Mulch surfacing on 2 playgrounds at the ends of slides measured 1 inch or less in depth. .0605(k)(1-4) The violations documented above must be corrected immediately. A signed and dated letter of compliance must be mailed by September 10, 2024 stating that all violations have been corrected. The letter can be emailed to scott.moore@dhhs.nc.gov or mailed to: Scott Moore 5 Seawell Ct Durham, NC 27703 If you state in the compliance letter that corrections have been made when they have not, this will be considered falsification of information. If you cannot meet the requirements by September 10, 2024 you must contact me with a proposed timeline of the corrections. In some cases the timeline may be extended. You are required to always maintain compliance with all applicable child care rules and regulations. NC GS 110-90(4)(d) requires all child care facilities to maintain a compliance history score of at least 75% for the past eighteen months or during the length of time the facility has operated, whichever is less. Failure to do so may result in the issuance of a provisional license or other administrative action. Violations cited during today's visit may negatively impact your compliance score. TECHNICAL ASSISTANCE Hold harmless has been extended until the new QRIS is implemented (SB 425). Providers in Cohort 1 are not required to go any further with a rated license assessment unless they want to, and providers in Cohort 2 do not need to start their preparation year unless they want to. This is optional and up to your discretion at this time. I would advise to still work on preparing and ensuring staff education is current in WORKS. On the same website for lead water tests (cleanwaterforcarolinakids.org) you need to sign up for asbestos and lead paint testing. You will have to complete a questionnaire. At the conclusion of the questionnaire you may receive a letter of exemption. If you receive a letter please maintain it on file. If you are subject to testing they will reach out to you at a later date with further direction. We discussed processes for tracking and renewing records such as medication administration forms, staff emergency and health statements, and diaper cream permissions. It is helpful to get some of these items on a routine renewal basis such as the 1st of the year or when school starts. Briana Bailey, Director, accompanied me during a walk-through of the facility. During the visit, I discussed the allegations with Ms. Bailey, Joanne Lamb-Potts, Assistant Director, and an additional staff member. Limited monitoring of child care requirements occurred during today’s visit. Violation Number Comment Rule 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. On November 14, 2023, a staff member in the classroom for two-year-old children, threw a blanket at a child, pulled a blanket while a child was wrapped in it, pretended to throw a child's blanket in the garbage, aggressively grabbed toys out of a child's hands, and spoke to a child in an intimidating manner. On this same date, another staff member threatened to throw a two-year-old child's shoes in the garbage. G.S. 110-91(10) 904 Child was handled roughly. On November 14, 2023, a staff member repeatedly lifted multiple two-year-old children by one of their arms and dropped one of these children on a sleeping mat. .1803(a)(1) 1810 There was a substantiation of child maltreatment. GS 110-105.6(a) 9999 Water from a handwash lavatory shall not be used for consumption. On November 14, 2023, two staff members allowed a two-year-old child to drink water from a handwash lavatory for several minutes.
