Name of Operation: Brevard Elementary Developmental Day Facility ID: 88000100 Consultant: DAWN MCCRARY Operation Type: Center Case Number: 0924-376L Visit Date: 11/5/2024 Number Present: 14 Completed Date: 11/5/2024 Age: From 4 To 5 Total Minutes: 100 Time In: 01:00 PM Time Out: 02:40 PM Time In: Time Out: List to Use: Center Type Of Visit: Complaint Follow-Up Announced/Unannounced: Unannounced The purpose of today’s unannounced follow-up visit was to investigate a complaint received by The Division of Child Development and Early Education (DCDEE) on 9/25/24 and by Dawn McCrary, 9/25/24. Due to the current State of Emergency due to Tropical Storm Helene, and per agency approval, a complaint visit was conducted by phone on 10/31/24. At the time of the phone complaint on 10/31/24, all allegations were pending violations until further investigation. Permit type- Four-Star Child-Care License Special Services/Restrictions- Daytime care only; Meets reduced staff/child ratios. Developmental Day Certified; Meets enhanced space. This facility provides NC PRE K services. Upon arrival, I spoke with Kyle Worley, Preschool Coordinator. Ms. Worley was available to assist during today’s visit. There is a concern regarding discipline. I interviewed two (2) Teacher Assistants. The two (2) Teacher Assistants stated: During the week of 8/26/24-8/30/24, the first week of the 2024-2025 school year, the Lead Teacher used an escalated tone and was yelling at the children. During the time 9/3/24-9/6/24, the Lead Teacher grabbed a child by their arm, pulling it over the child’s head, to pull the child from a learning center. The Lead Teacher refused to assist children with toileting needs. On 9/9/24, the Lead Teacher yelled at a child to come sit at the table, pointed a finger in the child’s face while yelling and threatened to throw the child’s food in the trash. The Lead Teacher proceeded to make a “mock” phone call to the Assistant Principle and told the child that the Assistant Principle was going to be very angry. On 9/11/24, the Lead Teacher slapped a child on their arm to stop the child from grasping their hands in front of their face at lunch and pulled a child by the feet to remove the child from underneath a table. On 9/11/24, the Lead Teacher yelled at a child to get on their cot for rest time and threatened to call the child’s parent multiple times. The Lead Teacher picked the child up by reaching over the child’s shoulders to get under the child’s arms. During the time, 9/16/24-9/20/24: The Lead Teacher yelled at children, snatched play dough from a child after chasing the child due to the child licking the play dough; grabbed a child in between the child’s elbow and armpit to drop the child onto a bean bag chair for “time out”. The Lead Teacher required the child to stay in “time out” for a total of nine (9) minutes. Today I observed the classroom for twenty (20) minutes. I observed routine care, individual interactions, toileting, handwashing and transition to rest time following lunch. All interactions were positive, supervision was adequate. There is no video footage from the classroom as cameras are only installed in the hallways of the school. I interviewed Ms. Worley during today’s visit. Ms. Worley stated that it had been brought to her attention that the newly hired Lead Teacher was speaking to children in a loud, harsh, and threatening tone. Ms. Worley reported the concerns to the administrator and director of the program. The following actions were taken to assist and alleviate the improper behaviors and tone of the Lead Teacher in the classroom: On 9/10/24, a meeting with the Lead Teacher took place to discuss using appropriate tones and actions with the children. The Lead Teacher was asked how Administration could support. On 9/12/24, The Lead Teacher visited an NC PREK and Developmental Day classroom in the county that has a seasoned Lead Teacher for modeling purposes. On 9/17/24, a meeting took place to discuss any of the Lead Teacher’s feedback from the modeling. On 9/18/24, Kyle Worley, Preschool Coordinator, spent the day in the classroom for suggestions, ideas, strategies for behaviors and non-verbal children. On 9/19/24 and 9/20/24, the Lead Teacher spent 30 minutes each in the 4 Kindergarten classrooms for modeling purposes. On 9/23/24, the administration, preschool coordinator and early childhood director met to discuss actions needed to address the continuous inappropriate behaviors of the Lead Teacher. On 9/24/24, the administration met with the Lead Teacher. During the meeting to address the concerns of rough handling the children and using harsh tone, the Lead Teacher stated that it “was possible” that the allegations were true, although the Lead Teacher had previously stated that they did “not recall” the allegations. The Lead Teacher was removed from the classroom and placed on Administrative Leave. Based on the phone interview on 10/31/24, today’s visit, and interviews during today’s visit, the concern regarding discipline is substantiated. I used the Child Care Center Item Number Listing (DCDEE-0357) as a basic monitoring tool to assess compliance with all applicable child care requirements pertinent to this facility. For specific rule references, refer to Chapter 110 General Statues Child Care Facilities, Chapter nine (9) Child Care Rule (10A NCAC 09) and Section 2800 Sanitation of Child Care Center (15A NCAC 18A) for additional information. Updated copies of these rules can be located on our website at https://ncchildcare.ncdhhs.gov/ The following violations were documented during today’s visit. Violation Number Comment Rule 872 Appropriate discipline practices were not followed. One (1) caregiver placed a child in time out for nine (9) minutes and slapped a child's arm to stop a behavior. .1803 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. One (1) caregiver repeatedly yelled at children in a threatening manner. The one (1) caregiver also refused to assist developmentally delayed children with toileting. G.S. 110-91(10) 904 Child was handled roughly. One (1) caregiver dragged a child by their feet from under a table and lifted a child by their arms to move the child to an alternate space. The one (1) caregiver lifted a child by the arm and dropped the child into a bean bag chair for "time out". .1803(a)(1) Technical assistance provided 872 Appropriate discipline practices were not followed. 904 Child was handled roughly. 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child’s developmental needs. G.S. 110-91(10) Children must be attended to in a nurturing and appropriate manner, in keeping with their developmental needs. Consider offering additional support during transitions when needed. Plan to reach out to Sharon Fitzgerald, Healthy Social Behavior Specialist, for additional training and guidance regarding appropriate physical interactions with children. Please see the guidance below from Caring for Our Children regarding giving directions to young children: 2.2 Supervision and Discipline “Using clear, direct, and simple commands. When clear commands are used with children, they are more likely to follow them. The caregiver/teacher should tell the child what to do rather than what NOT to do. The caregiver/teacher should limit the number of commands. The caregiver/teacher should use if/then and when/then statements with logical and natural consequences. These practices help children understand they can make choices and that choices have consequences” Discuss with all staff the importance of nurture, care and treatment of children. Each child should be attended to in a nurturing and appropriate manner, and in keeping with the child’s developmental needs. Some examples of nurturing behavior are: being fully present in your interactions with children (verbally and non-verbally), validating their feelings, providing physical affection and comfort when sought, laughing and playing games, providing safe mental, physical and social challenges that promote healthy growth and development. Staff may not threaten children with contacting their parents. This will be discussed in detail during the director’s next week. 10A NCAC 09 .1803 PROHIBITED DISCIPLINE IN CHILD CARE CENTERS (a) No child shall be subjected to any form of corporal punishment by the owner, operator, director, or staff of any child care center. For purposes of this Rule, "staff" shall mean any regular or substitute caregiver, any volunteer, and any auxiliary personnel, including cooks, secretaries, janitors, maids, or vehicle drivers. The following shall apply at all child care centers: (1) no child shall be handled roughly in any way, including shaking, pushing, shoving, pinching, slapping, biting, kicking, or spanking; (2) no child shall be placed in a locked room, closet, or box or be left alone in a room separated from staff; (3) no discipline shall be delegated to another child; (4) no food shall be withheld as punishment or given as a means of reward; (5) no child shall be disciplined for toileting accidents; (6) no child shall be disciplined for not sleeping during rest period; (7) no child shall be disciplined by assigning chores that require contact with or use of hazardous materials, such as cleaning bathrooms, floors, or emptying diaper pails; (8) physical activity, such as running laps and doing push-ups, shall not be withheld as punishment or required as punishment; (9) no child shall be yelled at, shamed, humiliated, frightened, threatened, or bullied; and (10) no child shall be restrained as a form of discipline unless the child's safety or the safety of others is at risk. For purposes of this Rule, "restraining" shall mean that a caregiver physically holds a child in a manner that restricts the child's movement, for a minimum amount of time necessary to ensure a safe environment. Notwithstanding any other provision of this Rule, no child shall be restrained through the use of heavy objects, including a caregiver's body, or any device such as straps, blankets, car seats, or cribs. (b) Discipline practices shall be age and developmentally appropriate. Achieving Compliance: A follow-up visit will be conducted to verify compliance of violations #872; # 902; #904. Due to the severity of the violations, an administrative action may be warranted. Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. The violation(s) documented must be corrected immediately. I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. Please be aware any information submitted by you is legal documentation. If it is determined the information provided in the letter is not true, this may be considered falsification of information. If sufficient information is not received by the due date, a follow-up visit will be conducted. The violations documented above must be corrected immediately. Send me a letter of compliance describing in detail specifically how each violation was corrected and how compliance will be maintained in the future. On 9/9/24, the Lead Teacher yelled at a child to come sit at the table, pointed a finger in the child’s face while yelling and threatened to throw the child’s food in the trash. The Lead Teacher proceeded to make a “mock” phone call to the Assistant Principle and told the child that the Assistant Principle was going to be very angry. On 9/11/24, the Lead Teacher slapped a child on their arm to stop the child from grasping their hands in front of their face at lunch and pulled a child by the feet to remove the child from underneath a table. On 9/11/24, the Lead Teacher yelled at a child to get on their cot for rest time and threatened to call the child’s parent multiple times. The Lead Teacher picked the child up by reaching over the child’s shoulders to get under the child’s arms. During the time, 9/16/24-9/20/24: The Lead Teacher yelled at children, snatched play dough from a child after chasing the child due to the child licking the play dough; grabbed a child in between the child’s elbow and armpit to drop the child onto a bean bag chair for “time out”. The Lead Teacher required the child to stay in “time out” for a total of nine (9) minutes. Today I observed the classroom for twenty (20) minutes. I observed routine care, individual interactions, toileting, handwashing and transition to rest time following lunch. All interactions were positive, supervision was adequate. There is no video footage from the classroom as cameras are only installed in the hallways of the school. I interviewed Ms. Worley during today’s visit. Ms. Worley stated that it had been brought to her attention that the newly hired Lead Teacher was speaking to children in a loud, harsh, and threatening tone. Ms. Worley reported the concerns to the administrator and director of the program. The following actions were taken to assist and alleviate the improper behaviors and tone of the Lead Teacher in the classroom: On 9/10/24, a meeting with the Lead Teacher took place to discuss using appropriate tones and actions with the children. The Lead Teacher was asked how Administration could support. On 9/12/24, The Lead Teacher visited an NC PREK and Developmental Day classroom in the county that has a seasoned Lead Teacher for modeling purposes. On 9/17/24, a meeting took place to discuss any of the Lead Teacher’s feedback from the modeling. On 9/18/24, Kyle Worley, Preschool Coordinator, spent the day in the classroom for suggestions, ideas, strategies for behaviors and non-verbal children. On 9/19/24 and 9/20/24, the Lead Teacher spent 30 minutes each in the 4 Kindergarten classrooms for modeling purposes. On 9/23/24, the administration, preschool coordinator and early childhood director met to discuss actions needed to address the continuous inappropriate behaviors of the Lead Teacher. On 9/24/24, the administration met with the Lead Teacher. During the meeting to address the concerns of rough handling the children and using harsh tone, the Lead Teacher stated that it “was possible” that the allegations were true, although the Lead Teacher had previously stated that they did “not recall” the allegations. The Lead Teacher was removed from the classroom and placed on Administrative Leave. Based on the phone interview on 10/31/24, today’s visit, and interviews during today’s visit, the concern regarding discipline is substantiated. I used the Child Care Center Item Number Listing (DCDEE-0357) as a basic monitoring tool to assess compliance with all applicable child care requirements pertinent to this facility. For specific rule references, refer to Chapter 110 General Statues Child Care Facilities, Chapter nine (9) Child Care Rule (10A NCAC 09) and Section 2800 Sanitation of Child Care Center (15A NCAC 18A) for additional information. One (1) caregiver repeatedly yelled at children in a threatening manner. The one (1) caregiver also refused to assist developmentally delayed children with toileting. G.S. 110-91(10) 904 Child was handled roughly. One (1) caregiver dragged a child by their feet from under a table and lifted a child by their arms to move the child to an alternate space. The one (1) caregiver lifted a child by the arm and dropped the child into a bean bag chair for "time out". .1803(a)(1) Technical assistance provided 872 Appropriate discipline practices were not followed. 904 Child was handled roughly. 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child’s developmental needs. G.S. 110-91(10) Children must be attended to in a nurturing and appropriate manner, in keeping with their developmental needs. Consider offering additional support during transitions when needed. Plan to reach out to Sharon Fitzgerald, Healthy Social Behavior Specialist, for additional training and guidance regarding appropriate physical interactions with children. Please see the guidance below from Caring for Our Children regarding giving directions to young children: 2.2 Supervision and Discipline “Using clear, direct, and simple commands. When clear commands are used with children, they are more likely to follow them. The caregiver/teacher should tell the child what to do rather than what NOT to do. The caregiver/teacher should limit the number of commands. The caregiver/teacher should use if/then and when/then statements with logical and natural consequences. These practices help children understand they can make choices and that choices have consequences” Discuss with all staff the importance of nurture, care and treatment of children. Each child should be attended to in a nurturing and appropriate manner, and in keeping with the child’s developmental needs. Some examples of nurturing behavior are: being fully present in your interactions with children (verbally and non-verbally), validating their feelings, providing physical affection and comfort when sought, laughing and playing games, providing safe mental, physical and social challenges that promote healthy growth and development. Staff may not threaten children with contacting their parents. This will be discussed in detail during the director’s next week. 10A NCAC 09 .1803 PROHIBITED DISCIPLINE IN CHILD CARE CENTERS (a) No child shall be subjected to any form of corporal punishment by the owner, operator, director, or staff of any child care center. For purposes of this Rule, "staff" shall mean any regular or substitute caregiver, any volunteer, and any auxiliary personnel, including cooks, secretaries, janitors, maids, or vehicle drivers. The following shall apply at all child care centers: (1) no child shall be handled roughly in any way, including shaking, pushing, shoving, pinching, slapping, biting, kicking, or spanking; (2) no child shall be placed in a locked room, closet, or box or be left alone in a room separated from staff; (3) no discipline shall be delegated to another child; (4) no food shall be withheld as punishment or given as a means of reward; (5) no child shall be disciplined for toileting accidents; (6) no child shall be disciplined for not sleeping during rest period; (7) no child shall be disciplined by assigning chores that require contact with or use of hazardous materials, such as cleaning bathrooms, floors, or emptying diaper pails; (8) physical activity, such as running laps and doing push-ups, shall not be withheld as punishment or required as punishment; (9) no child shall be yelled at, shamed, humiliated, frightened, threatened, or bullied; and (10) no child shall be restrained as a form of discipline unless the child's safety or the safety of others is at risk. For purposes of this Rule, "restraining" shall mean that a caregiver physically holds a child in a manner that restricts the child's movement, for a minimum amount of time necessary to ensure a safe environment. Notwithstanding any other provision of this Rule, no child shall be restrained through the use of heavy objects, including a caregiver's body, or any device such as straps, blankets, car seats, or cribs. (b) Discipline practices shall be age and developmentally appropriate. Achieving Compliance: A follow-up visit will be conducted to verify compliance of violations #872; # 902; #904. An electronic signed copy of the visit summary electronically emailed to you. Today, Kelli Krueger, Lead Teacher, was available to answer questions during the visit. The indoor and outdoor areas were monitored today, including supervision, staff/child ratios, permit restrictions, discipline, nutrition and routine caregiving activities. An annual compliance monitoring checklist for child care centers was used to note the requirements monitored and is attached to the computerized generated visit summary for your records. The center’s compliance history was reviewed with the operator. The program’s compliance history was ninety-three (93) percentage as of 10/11/23. The Secretary of State website was reviewed and the Non-Profit Corporation, The Brevard Elementary Organization of Parents and Teachers, has a current-active status as of 10/11/23. This facility provides NC PREK. The last annual compliance visit was conducted on 10/19/22. The last fire drill was practiced on 9/18/23. The last lockdown drill was practiced on 9/15/23. The last playground inspection was documented on 9/6/23. The last fire inspection was approved on 10/10/23. The last sanitation inspection was conducted on 3/17/23 with six (6) demerits for a Superior classification. The Emergency Medical Care plan was posted and current. The approved curriculum for four-year-old children is COR and Teaching Strategies Gold. The staff and training worksheet was received prior to today’s visit and monitored for child care requirements. Upon arrival, I made my presence known to Kelli Krueger, Lead Teacher. The children in space #1 were observed participating in a large group activity to choose which learning centers they wanted to choose. The children transitioned to free choice play in the classroom. They participated in dramatic play, manipulatives, blocks, and art. The children in space #3 were observed having free choice play on the playground. They were observed riding trikes, using chalk on the chalk board, running and socializing. Supervision was adequate. All staff/child interactions were positive and nurturing. Three (3) children’s files, were monitored for child care requirements. Two (2) newly hired staff and one (1) existing staff file was monitored for child care requirements. The staff and training worksheet was received prior to today’s visit and monitored for child care requirements. The program does not provide transportation. The developmental day requirements in section .2900 of the childcare rules were monitored for compliance. Children who receive developmental day services are currently cared for in space #1. Staff-child ratios and maximum group sizes required in Child Care Rule 10A NCAC 09 .2902(f) were verified in compliance. Lead teachers assigned to each of these spaces have NC Birth-through-Kindergarten licenses and both administrators have a Level III NCECAC with over five years experience. The program operates nine hours per day, Monday through Friday, ten months per year. Children’s individual plans for care and developmentally appropriate activity plans are followed, and opportunities for inclusion with children who are typically developing are offered. I confirmed this facility provides the following five family involvement activities: (1) quarterly parent education sessions, (2) parent/teacher conferences twice a year; (3) daily notes of progress provided to parents; (4) opportunities for parent volunteers to assist with special classroom activities, field trips and other learning experiences for children; (5) and provides parents with referral information about other community programs and resources serving young children. The NC Pre-K requirements in section .3000 of the childcare rules were monitored for compliance. The NC Pre-K Program Site Monitoring Tool was reviewed today. The center’s compliance history was reviewed with the operator. The program’s compliance history was ninety-three (93) percentage as of 10/11/23. The Secretary of State website was reviewed and the Non-Profit Corporation, The Brevard Elementary Organization of Parents and Teachers, has a current-active status as of 10/11/23. Permit type- Four Star Child Care License Special Services/Restrictions- Daytime care only; Meets reduced staff/child ratios. Developmental Day Certified; Meets enhanced space. This facility provides NC PREK. The last annual compliance visit was conducted on 10/19/22. The last fire drill was practiced on 9/18/23. The last lockdown drill was practiced on 9/15/23. The last playground inspection was documented on 9/6/23. The last fire inspection was approved on 10/10/23. The last sanitation inspection was conducted on 3/17/23 with six (6) demerits for a Superior classification. The Emergency Medical Care plan was posted and current. The approved curriculum for four-year-old children is COR and Teaching Strategies Gold. The staff and training worksheet was received prior to today’s visit and monitored for child care requirements. Upon arrival, I made my presence known to Kelli Krueger, Lead Teacher. The children in space #1 were observed participating in a large group activity to choose which learning centers they wanted to choose. The children transitioned to free choice play in the classroom. They participated in dramatic play, manipulatives, blocks, and art. The children in space #3 were observed having free choice play on the playground. They were observed riding trikes, using chalk on the chalk board, running and socializing. Supervision was adequate. All staff/child interactions were positive and nurturing. Three (3) children’s files, were monitored for child care requirements. Two (2) newly hired staff and one (1) existing staff file was monitored for child care requirements. The staff and training worksheet was received prior to today’s visit and monitored for child care requirements. The program does not provide transportation. The developmental day requirements in section .2900 of the childcare rules were monitored for compliance. Children who receive developmental day services are currently cared for in space #1. Staff-child ratios and maximum group sizes required in Child Care Rule 10A NCAC 09 .2902(f) were verified in compliance. Lead teachers assigned to each of these spaces have NC Birth-through-Kindergarten licenses and both administrators have a Level III NCECAC with over five years experience.
