The Annual Compliance Monitoring Checklist for Child care Centers was used today to note requirements that were monitored. The program operates with a 5-star rated license issued May 2, 2022, earning 7 points for education standards, 6 points for program standards, and one quality point for complying with a programmatic option. License restrictions include 1st shift, meets enhanced ratios and meets enhanced space. A walk-through was conducted of the indoor and outdoor areas. Staff/child ratios, group size, capacity, use of space, and supervision were observed. I observed three groups of children playing in various activity centers, teacher lead activities, and outdoor play. Developmentally age-appropriate materials were used. Positive and nurturing communication occurred as teachers interacted with children. Space #110 was being used for a third NC Pre K classroom. Currently seventeen (17) children are enrolled in this space. Fifteen (15) children were present. This space is not approved for child care space. This is a violation of Child Care Requirements. On August 1, 2024, Ms. Kimberly Blue-Harris, Administrative Assistant Testing and Accountability, NC Pre Kindergarten & Title I/Federal Programs, contacted me via email asking about adding another NC Pre K class on site. Currently, four classroom are approved for NC Pre K use; 105, 106, 107, and 108 are the only rooms approved at this time. Space #110 will need approved Building, Fire and Sanitation inspections. A sanitation inspection was completed on April 30, 2024 with 2 demerits and a Superior rating. A fire inspection was completed on September 24, 2024. At the time of the inspection the fire safety conditions in the facility were Satisfactory. They are approved for day time care only. The Emergency Drill log was reviewed during today’s visit. Fire drills are current. A shelter-in-place/lockdown drill must be completed by November 19, 2024. Prior to today’s visit the staff and training worksheet was obtained. A review of the information was completed. All staff records were monitored during today's visit. During today’s visit, six children records were reviewed. The children’s records form was completed during the visit. Five violations of child care requirements were observed and documented during today's visit. Computer-generated report was printed at the conclusion of today's visit and a copy was left with Mrs. Edge. A copy will also be emailed to the Principal. Violation Number Comment Rule 209 Children used space that was not approved. Fifteen (15) children were in space #110. This space has not been approved for use. GS 110-91(1)&(4-5) 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. The key was left in the locking device on the locked cabinet. The key must be stored out of the locking device. .2820(b) 1035 Child care providers, including the director, uncompensated providers, substitute providers, and volunteers did not have the required Emergency Information Form on file on or before the first day of work, which included all the required information and/or the information on the form was not updated as changes occur and at least annually. The principal did not have emergency information on file. .0701(a) 1044 Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of five years for the date of issuance). One staff's qualification letter expired August 2024. G.S. 110-90.2(b) & .2703(n)&(o) 1757 A valid qualification letter was not on file and available to review at the facility. One staff did not have a valid qualification letter on file. G.S. 110-90.2(b) & (d) & .2703(e) The violations must be corrected immediately. Within two weeks (10/23/24) you must submit a signed and dated compliance letter that explains how each violation was corrected. You will also need to submit the approved building, fire and sanitation inspections for space #110. Reminder: Licensed child care centers operating within a public school (i.e., afterschool programs, Head Starts, Pre-K, etc.) should coordinate with school staff to complete the lead in water section of the program so the entire school can be tested at once. The webinar will provide information about lead and The Clean Water for Carolina Kids™ program expanded to the Clean Classrooms for Carolina Kids™ program to help address the legislatively mandated effort to address lead and asbestos hazards where North Carolina children learn and play. Training is provided to help child care facilities complete the registration process, and the enrollment surveys can be completed in approximately 15 minutes per section. The program continues to test child care centers for lead in water at every tap used for drinking or cooking every three years (15A NCAC 18A .2816) and requires family child care homes to have testing completed by January 1, 2025 (10A NCAC 09 .1725(a)). The program also reviews child care facilities’ documentation and other information to determine and coordinate any steps needed to identify and eliminate lead-based paint and asbestos hazards (10A NCAC 41C.1001-1007). The following information was obtained during today's visit via the Clean Water for US Kids website: *Lead In Water Testing- enrollment not started *Lead-Based Paint- enrollment started, no results *Asbestos- enrollment started, no results The above must be completed and results on file by January 1, 2025. She can assist you with TA, guidance on challenging behaviors as well as guidance on building positive relationships. Rated License: The Governor signed Senate Bill 425 (now Session Law 2024-34), Health and Human Services Omnibus Bill, which includes the Quality Rating Improvement System (QRIS) Modifications recommended to the Legislature by the NC Child Care Commission to update QRIS and create additional pathways for licensed child care facilities to earn star rated licenses. The Child Care Commission is currently in the process of drafting proposed child care rule language to begin the rulemaking process for implementing the new requirements. The rulemaking process will include publishing of proposed revised rules as well as a public hearing and public comment period. Hold Harmless provisions have been extended and star rated license assessments for licensed child care providers will be conducted by provider request only, until the QRIS rulemaking process has been completed. Star rated license assessments are still required for new child care programs. Starting on February 1, 2025, the ECERS-3, ITERS-3, and FCCERS-3—also known as the "3s"—will be used for DCDEE environment rating scale assessments. The DCDEE and the North Carolina Rated License Assessment Project (NCRLAP) are collaboratively working on preparations for the transition to the third editions. These third editions come with a spiral binding at the top, replacing the current revised editions. The Annual Compliance Monitoring Checklist for Child care Centers was used today to note requirements that were monitored. The program operates with a 5-star rated license issued May 2, 2022, earning 7 points for education standards, 6 points for program standards, and one quality point for complying with a programmatic option. License restrictions include 1st shift, meets enhanced ratios and meets enhanced space. A walk-through was conducted of the indoor and outdoor areas. Staff/child ratios, group size, capacity, use of space, and supervision were observed. I observed three groups of children playing in various activity centers, teacher lead activities, and outdoor play. Developmentally age-appropriate materials were used. Positive and nurturing communication occurred as teachers interacted with children. Space #110 was being used for a third NC Pre K classroom. Currently seventeen (17) children are enrolled in this space. Fifteen (15) children were present. This space is not approved for child care space. This is a violation of Child Care Requirements. On August 1, 2024, Ms. Kimberly Blue-Harris, Administrative Assistant Testing and Accountability, NC Pre Kindergarten & Title I/Federal Programs, contacted me via email asking about adding another NC Pre K class on site. Currently, four classroom are approved for NC Pre K use; 105, 106, 107, and 108 are the only rooms approved at this time. Space #110 will need approved Building, Fire and Sanitation inspections. A sanitation inspection was completed on April 30, 2024 with 2 demerits and a Superior rating. A fire inspection was completed on September 24, 2024. At the time of the inspection the fire safety conditions in the facility were Satisfactory. They are approved for day time care only. The Emergency Drill log was reviewed during today’s visit. Fire drills are current. A shelter-in-place/lockdown drill must be completed by November 19, 2024. Prior to today’s visit the staff and training worksheet was obtained. A review of the information was completed. All staff records were monitored during today's visit. During today’s visit, six children records were reviewed. The children’s records form was completed during the visit. Five violations of child care requirements were observed and documented during today's visit. Computer-generated report was printed at the conclusion of today's visit and a copy was left with Mrs. Edge. A copy will also be emailed to the Principal. Violation Number Comment Rule 209 Children used space that was not approved. Fifteen (15) children were in space #110. This space has not been approved for use. GS 110-91(1)&(4-5) 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. The key was left in the locking device on the locked cabinet. The key must be stored out of the locking device. .2820(b) 1035 Child care providers, including the director, uncompensated providers, substitute providers, and volunteers did not have the required Emergency Information Form on file on or before the first day of work, which included all the required information and/or the information on the form was not updated as changes occur and at least annually. The principal did not have emergency information on file. .0701(a) 1044 Prior to the expiration date of the qualification letter, the child care provider did not complete and submit required forms to complete a criminal background check (a qualification letter is valid for a maximum of five years for the date of issuance). One staff's qualification letter expired August 2024. G.S. 110-90.2(b) & .2703(n)&(o) 1757 A valid qualification letter was not on file and available to review at the facility. One staff did not have a valid qualification letter on file. G.S. 110-90.2(b) & (d) & .2703(e) The violations must be corrected immediately. Within two weeks (10/23/24) you must submit a signed and dated compliance letter that explains how each violation was corrected. You will also need to submit the approved building, fire and sanitation inspections for space #110. Child care licensing requirements were established to ensure a safe and healthy child care environment. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with all the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the child care law and rules. I explained that you have access to the on-line version of the Child Care Rule Book, as well as a hard copy of the rules. I recommend that you visit the Division of Child Development's website (www.ncchildcare.nc.gov) on a regular basis to find out what's new in childcare. Reminder: Licensed child care centers operating within a public school (i.e., afterschool programs, Head Starts, Pre-K, etc.) should coordinate with school staff to complete the lead in water section of the program so the entire school can be tested at once. Training is provided to help child care facilities complete the registration process, and the enrollment surveys can be completed in approximately 15 minutes per section. The program continues to test child care centers for lead in water at every tap used for drinking or cooking every three years (15A NCAC 18A .2816) and requires family child care homes to have testing completed by January 1, 2025 (10A NCAC 09 .1725(a)). The program also reviews child care facilities’ documentation and other information to determine and coordinate any steps needed to identify and eliminate lead-based paint and asbestos hazards (10A NCAC 41C.1001-1007). The following information was obtained during today's visit via the Clean Water for US Kids website: *Lead In Water Testing- enrollment not started *Lead-Based Paint- enrollment started, no results *Asbestos- enrollment started, no results The above must be completed and results on file by January 1, 2025. Rated License: The Governor signed Senate Bill 425 (now Session Law 2024-34), Health and Human Services Omnibus Bill, which includes the Quality Rating Improvement System (QRIS) Modifications recommended to the Legislature by the NC Child Care Commission to update QRIS and create additional pathways for licensed child care facilities to earn star rated licenses. The Child Care Commission is currently in the process of drafting proposed child care rule language to begin the rulemaking process for implementing the new requirements. The rulemaking process will include publishing of proposed revised rules as well as a public hearing and public comment period. Hold Harmless provisions have been extended and star rated license assessments for licensed child care providers will be conducted by provider request only, until the QRIS rulemaking process has been completed. During this time, you need to make sure all staff have completed the WORKS registration and has a Status letter on file. This means submitting any certificates or an original transcript showing EDU coursework completed is in WORKS.
