Staff/child ratio, capacity, use of space and permit restrictions were monitored. Limited monitoring of other child care requirements was completed. Items that were documented during the 10-3-23 visit were monitored for compliance: Item # 102 - Five preschool children were observed during the visit. An additional violation was not documented. Item # 919 - The file that was not available was reviewed during the visit and determined to be in compliance. An additional violation was not documented. Item # 925 - Verification was observed in the files reviewed. An additional violation was not documented. Item # 1701 - No efforts to falsify information were noted during the visit. An additional violation was not documented. Item # 1704 - Verification was observed. An additional violation was not documented. Item # 1828 - Verification was observed. An additional violation was not documented. Item # 1837 - No children were observed drink juice from a bottle. An additional violation was not documented. Item # 1942 - While I was still able to detect a smell of cigarette smoke, I did not observe anyone smoking and did not observe an ashtray on the front porch. You stated that your husband no longer smokes outside of the home while children are in care. An additional violation was not documented. Item # 2030 - Verification was observed. Authorization to seek medical care was not available in the two children's files reviewed. .1721(a)(3)(I) 1893 Application did not include all required information including, but not limited to: child's full name, named to be called, child’s date of birth, any allergies, including symptoms and the type of response required, and any fears or behavior characteristics a child has. Application was not fully completed in the two children's files reviewed. 10A NCAC 09 .1721 (a)(3)(A)(B)(C)(E) 2041 Application did not include the names and the phone numbers of the child's physician and the persons to be contacted in an emergency situation. A physician was not listed on the application in the two children's files reviewed. 10A NCAC 09 .1721(a)(3)(G)(H) While reviewing the application in the children's files reviewed (CW and CW), I noted that the same birthdate and nick name of "Toot" was listed on both applications. Upon further review, I noted that hand written errors were present on both applications. I determined that a copy of the application for one child was used for the other child and only the last two letters of the first name were changed. As I could not determine who copied the application, a violation for falsifying the record was not documented. However, I brought my concerns with the document to you and instructed you to have the parent complete a new application for the younger child. Please be reminded of the importance of providing accurate information, and never falsifying documents pertaining to your license. A violation for falsification was already documented during the 9-26-23 visit. This type of violation can lead to the issuance of an administrative action, up to and including revocation of your license. ****Child care licensing requirements are established to ensure a safe and healthy child care environment. Therefore, it is important for you to be knowledgeable of all of the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with all of the applicable laws and rules at all times. The best way for you to make sure that you are meeting all requirements is to periodically review the child care law and rules.**** Please send me a written statement describing how and when the above violations were corrected. The written statement must be received no later than 10-19-23. Please note that if your letter is mailed, a hand written signature is required. As an alternative, compliance letters can now be submitted via email. I recommend emailing your letter to reduce the time needed to ensure my receipt of your information; however, if you do not have access to email, please ensure that your letter is mailed in a timely fashion and that you allow for any possible delays in the mail service. Upon my arrival, I was greeted by the owner/operator, M. Nelson. A total of eight (8) children were present during today’s visit between 0-3 years of age. Ms. Nelson stated that the grandmother of some of the children was outside, however I did not observe anyone outside upon my arrival. A short time later, Ms. Nelson received a phone call and she told the caller that “they needed to come up the kids because the state was there.” Following the phone call, someone arrived to pick up two (2) children during the visit. During the visit, the items that were documented during the 9/14/2023 visit were monitored for compliance: Item # 102 - The number of preschool children exceeded five preschool children, including the providers own preschool children. During a review of the enrollment form completed during the annual compliance visit, I determined that the same eight (8) children were present during today’s visit. An additional violation was documented. Item # 706 – No hazardous products were observed during today’s visit, therefore an additional violation was not documented. Item # 714 – The operator stated that she neglected to date the monthly outdoor play inspection prior to the annual compliance visit. The outdoor play inspection was updated and dated 9/4/2023. GS 110-102 1828 The Family Child Care Home operator did not discuss the operational policies with parents on or before the child's first day of attendance. Due to the nature of the violation(s) cited during today’s visit, a return visit will also occur to ensure that compliance has been maintained. COMPLIANCE HISTORY: Prior to today's visit, the 18 month compliance history for this program was 91%. TECHNICAL ASSISTANCE/CONSULTATION: In a compliance letter dated on 9/25/2023, Ms. Nelson stated that an enrolled child, A. Williams, is now enrolled on second shift. The letter goes on to state that the other two children, identified only by their first names during the annual compliance visit, are now being cared for by a family member and that she would not do a favor for anyone else and that additional children would not be present during daytime care if would exceed the number of children allowed. I determined that the same eight (8) children observed during the annual compliance visit were the same children present during today's visit. Ms. Nelson provided an explanation for the additional children present during today’s visit. She stated that the grandmother of the children had arrived to have some personal items attended to by Ms. Nelson but needed to leave briefly, leaving the two (2) additional children at the home and in the care of Ms. Nelson. I explained to Ms. Nelson that under no circumstances can she exceed the number of preschool children allowed. During the annual compliance visit, a total of six (6) preschool children were enrolled which exceeds the number of preschool children you are permitted to have. I then said that if someone arrives at her home with preschool aged children, the parent/guardian must be with those children at all times and that if the parent leaves, then the children must leave with them, UNLESS, their presence does not exceed the number of preschool children allowed. I went on to state that exceeding the number of preschool children allowed puts the children’s health and safety at risk. During today’s visit, I observed an infant under the age of 12 months drinking juice out of a bottle. I told Ms. Nelson that infants cannot be served juice from a bottle without a note from the child’s physician on file. Screen time is prohibited for children under the age of three years old. When screen time is offered, it must be done so to stimulate a developmental domain in accordance with NC Foundations for Early Learning and Development as outlined in Child Care Rule .1718(b)(1). In addition, screen time must be limited to a maximum of thirty minutes per day, and no more than two and a half hours per week, per child-see Child Care Rule .1718(b)(2). Children under the age of three must be offered an alternative activity-see Child Care Rule .1718(c). Upon my arrival to the family child care home, I observed an ashtray with several cigarette butts, on a table located on the front porch. Per Child Care Rule .1719(a)(10) children must be cared for in a smoke free and tobacco free environment. The use of smoke, or any product containing, made or derived from tobacco, including cigarettes, e-cigarettes, cigars, little cigars, smokeless tobacco, and any device used to inhale or ingest tobacco products at any time during operating hours, on the premises of the family child care home, on vehicles used to transport children, or during any off-premise activity is prohibited. In addition, the operator shall notify each parent of each child enrolled in the facility, in writing, of the smoking and tobacco restriction as stated in Child Care Rule .1719(a)(11). Eight preschool children, 0-3 years of age, were present during today's visit. GS 110-91(7)(b) 543 Screen time was not prohibited for children under the age of three. The operator did not offer alternative activities for children under the age of three years. During today's visit, various children shows played on the television located in the daycare space where children under three years of age, including an infant, were present. .1718(c) 919 Accurate records were not maintained for all staff and children. A file with required paperwork was not available for one child. G.S. 110-91(9) 925 Signed and dated statement which attests that a copy of the discipline policy was given to and discussed with a parent/guardian of each child prior to enrollment was not on file in the home. Signed and dated statements attesting to receiving a copy of the discipline policy was not file for two children. G.S.110-91(10); .1727(a)&(b) 1701 The operator made efforts to falsify information. A compliance letter dated 9/25/2023 stated that an enrolled child on the first shift was now enrolled on the second shift. The enrolled child was present during today's visit, during first shift hours. GS 110-91(14) 1704 Summary of the NC Child Care Law was not given to each child's parent, guardian, or full-time custodian before the child was enrolled in the home and/or signed statement was not on file. Signed statements from parents acknowledging receipt of the summary of the NC Child Care Law was not file for two children. GS 110-102 1828 The Family Child Care Home operator did not discuss the operational policies with parents on or before the child's first day of attendance. Two enrolled children did not have evidence that operational policies had been discussed with parents on file. 10A NCAC 09. 1715(b) 1837 An infant was served juice in a bottle without a prescription or written statement on file from a health care professional or licensed dietitian/nutritionist. An enrolled infant was served juice from a bottle. A statement from a health care professional was not file. .1706(q) 1942 Children were not cared for in a smoke free and tobacco free environment. An ashtray containing several cigarette butts was observed on the front porch of the home. .1719(a)(10) 2030 Operator did not provide a written statement to parents regarding the smoking and tobacco restriction. Two children's files did not contain a written statement to parents regarding the smoking and tobacco restriction. .1719(a)(11) 2041 Application did not include the names and the phone numbers of the child's physician and the persons to be contacted in an emergency situation. Two enrolled children did not have the names and phone numbers of the child's physician on file. 10A NCAC 09 .1721(a)(3)(G)(H) Violations of this nature directly impact the safety of the children while in care and must be corrected immediately. A compliance letter must be submitted within two (2) weeks of today’s visit. In the letter, you must address each violation, how the violations were corrected and how compliance will be maintained in the future. Please be sure to include your facility ID number and each item number. The letter must be submitted to me no later than October 10, 2023. You may submit the letter to me at Teraesa.Leak@dhhs.nc.gov. Due to the nature of the violation(s) cited during today’s visit, a return visit will also occur to ensure that compliance has been maintained. COMPLIANCE HISTORY: Prior to today's visit, the 18 month compliance history for this program was 91%. TECHNICAL ASSISTANCE/CONSULTATION: In a compliance letter dated on 9/25/2023, Ms. Nelson stated that an enrolled child, A. Williams, is now enrolled on second shift. The letter goes on to state that the other two children, identified only by their first names during the annual compliance visit, are now being cared for by a family member and that she would not do a favor for anyone else and that additional children would not be present during daytime care if would exceed the number of children allowed. I determined that the same eight (8) children observed during the annual compliance visit were the same children present during today's visit. Ms. Nelson provided an explanation for the additional children present during today’s visit. She stated that the grandmother of the children had arrived to have some personal items attended to by Ms. Nelson but needed to leave briefly, leaving the two (2) additional children at the home and in the care of Ms. Nelson. I explained to Ms. Nelson that under no circumstances can she exceed the number of preschool children allowed. During the annual compliance visit, a total of six (6) preschool children were enrolled which exceeds the number of preschool children you are permitted to have. I then said that if someone arrives at her home with preschool aged children, the parent/guardian must be with those children at all times and that if the parent leaves, then the children must leave with them, UNLESS, their presence does not exceed the number of preschool children allowed. I went on to state that exceeding the number of preschool children allowed puts the children’s health and safety at risk. During today’s visit, I observed an infant under the age of 12 months drinking juice out of a bottle. I told Ms. Nelson that infants cannot be served juice from a bottle without a note from the child’s physician on file. Screen time is prohibited for children under the age of three years old. When screen time is offered, it must be done so to stimulate a developmental domain in accordance with NC Foundations for Early Learning and Development as outlined in Child Care Rule .1718(b)(1). In addition, screen time must be limited to a maximum of thirty minutes per day, and no more than two and a half hours per week, per child-see Child Care Rule .1718(b)(2). Children under the age of three must be offered an alternative activity-see Child Care Rule .1718(c). Upon my arrival to the family child care home, I observed an ashtray with several cigarette butts, on a table located on the front porch. Per Child Care Rule .1719(a)(10) children must be cared for in a smoke free and tobacco free environment. The use of smoke, or any product containing, made or derived from tobacco, including cigarettes, e-cigarettes, cigars, little cigars, smokeless tobacco, and any device used to inhale or ingest tobacco products at any time during operating hours, on the premises of the family child care home, on vehicles used to transport children, or during any off-premise activity is prohibited. In addition, the operator shall notify each parent of each child enrolled in the facility, in writing, of the smoking and tobacco restriction as stated in Child Care Rule .1719(a)(11). Violations regarding children's records are pertaining to the enrolled children, C. Webb and C. Webb. Child care licensing requirements are established to ensure a safe and healthy child care environment. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your program. A violation was documented for exceeding the allowable number of preschool children in care. You stated that two of the children in care are related to your husband. However, you were not sure about the children's names or ages and did not have any paperwork available for either of the children. In addition, there was another child in care that you stated is enrolled in the family child care home, but you did not have the required paperwork for. Having children in care with out the required paperwork is a safety concern as you do not know about allergies, medical conditions, and emergency contact information. In the future, children should not be in care in your home without the required paperwork. While in your home, I observed a one year old child sitting in a highchair. The child was not eating during the visit. Just prior to the conclusion of the visit, I observed the child attempting to crawl out of the highchair and commented that he must be ready to get out of the chair. You stated that he was not strapped in tight enough, placed him back in the highchair and tightened the straps before connecting them. It is not developmentally appropriate to confine a one year old child to a high chair when not eating. Children must be allow time for free play and to participate in activities.
