    Name of Operation: Bailey Christian Childcare Facility ID: 64000494 Consultant: APRIL FLEMING Operation Type: Center Case Number: Visit Date: 9/9/2025 Number Present: 12 Completed Date: 9/9/2025 Age: From 2 To 5 Total Minutes: 240 Time In: 10:00 AM Time Out: 02:00 PM Time In: Time Out: List to Use: Center Type Of Visit: Annual Comp Full Announced/Unannounced: Unannounced The purpose of my unannounced annual compliance visit was to monitor for compliance with applicable child care requirements. This facility currently operates with a Notice of Compliance effective September 13, 2024. A checklist was used to note the requirements monitored during the visit. The last sanitation visit was conducted on February17, 2025 with a superior classification and eight demerits. The last satisfactory fire inspection was conducted May 27, 2025, and approved for day time care only. Upon arrival, I was greeted by Pastor Hal Jones. Teresa Price, Michelle Beamon, Administrators, and Jenna Boswell, Director, were present and available to assist. Twelve (12) children were present during the visit. Teachers interacted with children in a positive manner. This facility is corporate owned by White Oak Hill Freewill Baptist Church, Inc of Bailey NC and was verified in the NC Secretary database with a current active status. The following violations of child care requirements were documented during the visit. Violation Number Comment Rule 1032 Child care providers and uncompensated providers who are not substitute providers or volunteers, including the director did not have a medical report on file prior to employment that was signed by a health care professional and/ or the medical report was older than 12 months. Two staff members did not have a medical report on file prior to emploment. 10A NCAC 09 .0701(a) 1033 On or before the first day of work, all staff, including the director and individuals who volunteer more than once per week did not provide results indicating that they were free of active TB and/or TB test or screening was older than 12 months. On or before the first day of work, one staff member did not provide results indicating that they were free of active TB. .0701(a) The above violations must be corrected immediately. The letter must describe, in detail, specifically how each violation has been corrected and any supporting documents. You can mail or email me with verification of compliance regarding the violations that were documented. If you choose to mail, two signed and dated copies must be sent and received by September 23, 2025. Please be aware that any written information submitted by you regarding correction of the violations documented during today's visit is legal documentation. It is important that all information submitted be accurate and truthful. Please be aware that if it is determined that information submitted was inaccurate or willfully falsified, an Administrative Action, including Revocation of the facility's license could be issued. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with all the applicable laws and rules always if they have been monitored or specifically discussed with you in the past. The best way for you to make sure that you meet all requirements is to periodically review the child care law and rules. Compliance History: Prior to today's visit, this facility maintained an 18-month compliance score of 94%. CONSULTATION/TECHNICAL ASSISTANCE CHILDREN AND STAFF RECORDS: Ten percent (10%) or more of children’s records were monitored. Children records reviewed, were in compliance. Other children’s files not reviewed should be monitored to ensure compliance for the same information. All new staff and ten percent (10%) or more of existing staff files were monitored. Staff records reviewed were not in compliance. Prior to employment, two (2) staff members did not have a medical report/health assessment on file. On or before the first day of employment, one staff member did not have TB test results on file. To ensure compliance, I encourage you to continue to use the staff checklist and pay close attention to the due dates of required information. Other staff files not reviewed should be monitored to ensure compliance with the same information. CRIMINIAL BACKGROUND APPLICATIONS: A New feature links criminal background applications to facilities. All staff should ensure their criminal background is linked to the facility. A copy of the instructions to link staff was left at the completion of the visit. CLEAN WATER FOR US KIDS: In the Clean Water for Carolina Kids facility data, status for lead in water status is “analysis complete”. The lead-based paint and asbestos status is “enrollment started”. To ensure compliance, you should log onto or contact Clean Water for US Kids to know what needs to be completed to have a “section complete” status. PROVIDER DOCUMENTS/FORMS: You should visit the website often to ensure you’re using all updated forms. All requirements must be included if you choose to use your own forms electronically or hard copy. Child care rules were updated effective November 1, 2024. You can view MOODLE training for the Child Care Rule roll out. April Fleming, Child Care Consultant, accompanied me today. Upon arrival you, Hal Jones, Pastor, were not present but office staff member, Glenda Carroll, was present and contacted you upon our arrival. I asked that Ms. Carroll contact you to make you aware of our visit. You arrived shortly after our arrival and remained at the facility for the duration of the visit. Ms. Carroll also remained at the facility. You stated you were aware of why Ms. Fleming and I were present as you contacted the Division of Child Development to conduct a self-report after being made aware of a recent situation that occurred at the facility between a teacher and a child. You spoke with an Intake Consultant May 8, 2025, and provided information regarding an incident that occurred May 7, 2025. You, Ms. Carroll, and applicable staff were interviewed and given an opportunity to provide additional information. I conducted observations in all rooms used to care for enrolled children. Two groups of children were observed today. Both groups were initially observed playing in the gym that is used as auxiliary space. The children were playing with one another, using riding toys, interacting with the assigned staff, and playing with other toys that were appropriate for their ages. Two (2) staff were observed today. One teacher for each group. A total of thirteen (13) children were grouped together ranging in ages from three (3) to four (4) years. The staff present today were observed interacting with children in a nurturing and appropriate manner by talking with them in a positive tone while bent down on their level. They were providing adequate supervision by moving around the area while the children were playing and visibly watching them. The number of children present, group size, supervision, use of licensed space, space capacity, and license restrictions were monitored. Based on the type of allegation, overall enrollment was not collected, and no enrollment form was completed; however, the total number of children present was documented today. ALLEGATION: The allegation regarding nurture and appropriate care was reviewed. Based on information shared, video footage observed, and interviews with applicable staff, May 7, 2025, a staff member did not attend to a child in a nurturing and appropriate manner. Video footage reviewed today from May 7, 2025, showed a staff member attending to a child after she took a toy away while the child was seated at the table in Room 1, the room used to care for children two and a half and older. A few other children were also observed playing with toys and interacting with the staff member at the same table. A staff member was observed interacting with one particular child and removed the toy from the child and placed the toy towards the middle of the table so the child could not reach the toy. Per information shared, the staff member thought the child had a part of the toy in their mouth, but after reviewing video footage, it was the child’s hand. The child was observed trying to reach the toy several times from the middle of the table. The staff member addressed the child by eventually sitting beside the child. At one point in the video, the staff member is observed grabbing the child’s left arm to have the child stand up and turn towards her. The interaction was not observed to be nurturing or appropriate. The child appeared to be crying during this time. As this was occurring, a staff member was observed walking to the doorway that leads into Room 1. It was reported this particular staff member asked the staff member who was present and caring for the children in Room 1 if she needed some assistance and the staff member stated she did not. After observing this, this particular staff member reviewed the video footage in the office and contacted Mr. Jones to make him aware of what happened. Mr. Jones arrived at the facility shortly after being made aware of what happened. Mr. Jones stated he reviewed the video footage and also reviewed the footage with the particular staff member. He discussed what happened with her, what he observed, and stated to us that he explained to her that this type of behavior and interaction was not appropriate and she would need to leave the facility for the remainder of the day. This particular staff member was scheduled to be off on May 8, 2025, and May 9, 2025. Mr. Jones stated he was not going to allow her to return to work until he knew it would be permitted for her to return, and he could conduct an internal investigation. After the incident occurred, you also contacted me via phone call on May 7, 2025, for advice on how to handle the situation. I explained that you needed to contact the Division of Child Development and Early Education’s office and speak to an Intake Consultant. I further explained it would be best to document what happened and maintain that documentation on file along with saving the video footage so it could be reviewed at a later date. We discussed the process of what occurs with a facility representative conducts a “self-report”. During our phone call on May 7, 2025, I asked that you notify me when you had spoken with an Intake Consultant. You emailed me on May 8, 2025, to notify me that you did speak with an Intake Consultant. You showed me a letter that you had written regarding the incident and what actions you have put into place since May 7, 2025. You also stated after speaking with the Intake Consultant May 8, 2025, you called the applicable staff member and notified her on Sunday May 11, 2025, that she could return to work May 12, 2025. This staff member returned to work May 12, 2025. You stated you had talked with her and all other staff members about what types of interactions were appropriate between the staff and children. You stated what you observed was not typical of her and that you felt like this staff member was not herself due to some personal reasons and the staff member agreed. You stated you changed the staff member’s working hours to allow her to arrive thirty minutes later than her initial work hours in the mornings. When asked, you also discussed this incident with the child’s parents to make them aware. You stated they did not have any specific questions after speaking with them. Based on the above information, the allegation was substantiated and a violation documented. TECHNICAL ASSISTANCE/COMMENTS/SUGGESTIONS: We discussed with both you, Ms. Carroll, and applicable staff to notify someone if and when they feel they need some assistance or need a break. We discussed there will be challenges when providing care to children and sometimes a break or assistance is needed, even if a staff member states he/she is okay. You stated additional staff can provide coverage so that a staff member can take a break when needed throughout the day. Staff must be able to recognize when assistance is needed, and they feel overwhelmed. If you feel a staff member needs a break or assistance, then you or someone you appoint can intervene and provide the break or assistance. We discussed conducting a staff meeting with all staff to review this information and have the staff document via a sign in/roster they attended the meeting. We discussed seeking training for your staff regarding nurturing and appropriate interactions with children. We suggested contacting the Shaquana Bynum, Healthy Social Behavior Specialist, at Down East Partnership for Children at (252)985-4300 to inquire if she can provide any specific training to the staff regarding nurturing and appropriate care/interactions. I will also inquire about any other training that may be offered and notify you of what I find. Email me the letter once you have added what you have done. You can submit the letter along with your compliance letter. The following violation was documented today: Violation Number Comment Rule 902 Each child was not attended to in a nurturing and appropriate manner, or in keeping with the child's developmental needs. Per video footage from May 7, 2025, staff member grabbed a three (3) year old by the left arm from a siting to a standing position and turned the child towards her in Room 1. G.S. 110-91(10) The violation documented above must be corrected immediately. A signed and dated letter Email or mail a letter addressing the correction of the violation and document actions taken to prevent this type of violation being documented in the future. Email or mail the letter to me on or before May 28, 2025. This two-week time frame is established to allow you time for submitting your compliance letter and is not intended to be used as a guide for correcting violations, as violations should be corrected immediately. COMPLIANCE HISTORY: I will notify you of the facility’s Compliance History score after this visit is entered into the Regulatory System. We reviewed that a facility’s compliance history score must be at least 75% or higher to maintain the notice of compliance. Childcare licensing requirements are established to ensure a safe and healthy childcare environment. Therefore, it is important for you to be knowledgeable of all the licensing requirements that apply to your type of program. It is your responsibility to maintain compliance with the applicable laws and rules; whether they have been monitored or specifically discussed with you in the past. The best way for you to ensure that you are meeting all requirements is to periodically review the childcare laws and rules on the Division of Child Development and Early Education’s website. ADMINISTRATIVE ACTION: When an allegation is confirmed, some type of administrative action may be warranted based on current procedures.
