This facility is on a temporary license due to a change of ownership. Phil Gregory, Legal Operator, was on-site and available to answer and ask questions. Sarah Dills, Administrator, was not on-site during the visit today. Currently this center operates with a Temporary License, issued 1/1/26 and is effective through 7/1/26. The restrictions include first shift only for seventy-two (72) children, ages 3-7 years old. The Secretary of State website was checked today, and the company, Montessori School of Asheville, Inc., is listed as active-current. If any changes to the organization need to be made, then you must notify your consultant at least thirty (30) days prior to any changes occurring. The license cannot be bought, sold, subleased, transferred to another person or location, or inherited. During this first Temporary Time Period visit, classrooms were monitored as well as the playground, materials, equipment and required posted items for meeting all minimum licensing requirements. A zoning letter for 360 Weaverville Rd, Asheville was completed and dated 6/6/25. An approved building inspection was completed on 7/9/25 An approved fire inspection was completed on 6/27/25. A sanitation inspection was completed on 1/16/26 with nine (9) demerits for a Superior classification. Buncombe County Environmental Health also arrived during the visit today for a sanitation inspection. The sanitation inspection report completed for today had six (6) demerits for a Superior classification. Administrative, operational and personnel policies have been submitted for review and need revisions to meet minimum licensing requirements – this is due on or before 5/1/26. Mr. Gregory stated the Emergency Preparedness and Response (EPR) plan transfer has been completed and the facility is still current with the EPR plan last being reviewed in August 2025. The water lead testing was completed on 5/24/24 with no hazards identified. The lead based paint and asbestos survey was completed and testing is not required due to the building being built in 2006. You stated the Clean Water for Carolina Kids account has been updated to the new ownership. The last fire drill was practiced on 1/13/26. The last shelter in place drill was practiced on 2/9/26. The last playground inspection was completed on 1/13/26. The emergency medical care (EMC) plan was posted and current. The incident log is in use and maintained. The children were observed in free play, large group activities, routine care, outdoor play, and snack. The snack today in space #3 was graham crackers, cantaloupe, yogurt, carrots, and water. Three (3) children files were monitored. There are twelve (12) staff. Six (6) staff files were monitored during the visit today. The facility does not serve any children through subsidy vouchers and there are no plans at this time for Mr. Gregory to apply for a rated license. If the hallway is where parents would be reading with children, a qualified staff person must be with the parent. If there is a quiet place in the child’s classroom or outdoors where other staff and children are occupying the space, the parents can read to the child with a qualified staff member in the classroom or outdoors. We discussed that children who have a parent preference of not drinking cow's milk at the facility must have some other type of milk, such as soy milk or lactose free milk, served as a substitute. The substituted milk must meet the same nutrition requirements, such as eight (8) grams of protein. We also discussed that parents and food prep staff must have option to view the morning and afternoon snack menus in the respective classrooms and kitchen food prep area. 10A NCAC 09 .0901 GENERAL NUTRITION REQUIREMENTS (a)Meals and snacks served to children in a child care center shall comply with the Meal Patterns for Children in Child Care Programs from the United States Department of Agriculture (USDA) which are based on the recommended nutrient intake judged by the National Research Council to be adequate for maintaining good nutrition. The types of food, number and size of servings shall be appropriate for the ages and developmental levels of the children in care. The Meal Patterns for Children in Child Care Programs are incorporated by reference and include subsequent amendments. A copy of the Meal Patterns for Children in Child Care Programs is available online at https://www.fns.usda.gov/cacfp/meals-and-snacks. (b) When food is prepared by or provided by the center, menus for nutritious meals and snacks shall be planned at least one week in advance. At least one dated copy of the current week's menu shall be posted where it can be seen by parents and food preparation staff when food is prepared or provided by the center. A variety of food shall be included in meals and snacks. Any substitution shall be of comparable food value and shall be recorded on the menu prior to the meal or snack being served. (h)The food required by special diets for medical, religious, or cultural reasons, or parental preferences, may be provided by the center or may be brought to the center by the parents. If the diet is prescribed by a health care professional, a statement signed by the health care professional shall be on file at the center and written instructions shall be provided by the child's parent, health care professional, or a licensed dietitian/nutritionist. If the diet is not prescribed by a health care professional, written instructions shall be provided by the child's parent and shall be on file at the center. New and terminated staff notification requirement: As stated in G.S. 110-90.2 & .2703(r) child care operators are to notify the Division of any new child care providers working who were hired or moved into the child care facility within five business days. The process of notifying the Division has changed and is now captured in ABCMS. This change has been in effect since February 2024. Effective immediately, you will need to obtain a Business NCID and complete Provider Portal training in Moodle at https://www.dcdee.moodle.nc.gov/course/view.php?id=119. Once the training has been completed and access has been given, you must verify your facility roster to ensure current staff are noted on the roster. This information should be updated in ABCMS in an ongoing basis as staff members are hired and when their employment is terminated. This satisfies the requirement to notify the Division of new child care providers working who were hired or moved into the child care facility within five business days. Consultation: We discussed that any parent volunteers that read with children cannot be left alone or be counted in staff/child ratio. If the hallway is where parents would be reading with children, a qualified staff person must be with the parent. If there is a quiet place in the child’s classroom or outdoors where other staff and children are occupying the space, the parents can read to the child with a qualified staff member in the classroom or outdoors. We discussed that children who have a parent preference of not drinking cow's milk at the facility must have some other type of milk, such as soy milk or lactose free milk, served as a substitute. The substituted milk must meet the same nutrition requirements, such as eight (8) grams of protein. We also discussed that parents and food prep staff must have option to view the morning and afternoon snack menus in the respective classrooms and kitchen food prep area. 10A NCAC 09 .0901 GENERAL NUTRITION REQUIREMENTS (a)Meals and snacks served to children in a child care center shall comply with the Meal Patterns for Children in Child Care Programs from the United States Department of Agriculture (USDA) which are based on the recommended nutrient intake judged by the National Research Council to be adequate for maintaining good nutrition. The types of food, number and size of servings shall be appropriate for the ages and developmental levels of the children in care. The Meal Patterns for Children in Child Care Programs are incorporated by reference and include subsequent amendments. A copy of the Meal Patterns for Children in Child Care Programs is available online at https://www.fns.usda.gov/cacfp/meals-and-snacks. (b) When food is prepared by or provided by the center, menus for nutritious meals and snacks shall be planned at least one week in advance. At least one dated copy of the current week's menu shall be posted where it can be seen by parents and food preparation staff when food is prepared or provided by the center. A variety of food shall be included in meals and snacks. Any substitution shall be of comparable food value and shall be recorded on the menu prior to the meal or snack being served. (h)The food required by special diets for medical, religious, or cultural reasons, or parental preferences, may be provided by the center or may be brought to the center by the parents. If the diet is prescribed by a health care professional, a statement signed by the health care professional shall be on file at the center and written instructions shall be provided by the child's parent, health care professional, or a licensed dietitian/nutritionist. If the diet is not prescribed by a health care professional, written instructions shall be provided by the child's parent and shall be on file at the center. New and terminated staff notification requirement: As stated in G.S. 110-90.2 & .2703(r) child care operators are to notify the Division of any new child care providers working who were hired or moved into the child care facility within five business days. The process of notifying the Division has changed and is now captured in ABCMS. This change has been in effect since February 2024. Effective immediately, you will need to obtain a Business NCID and complete Provider Portal training in Moodle at https://www.dcdee.moodle.nc.gov/course/view.php?id=119. Once the training has been completed and access has been given, you must verify your facility roster to ensure current staff are noted on the roster. This information should be updated in ABCMS in an ongoing basis as staff members are hired and when their employment is terminated. This satisfies the requirement to notify the Division of new child care providers working who were hired or moved into the child care facility within five business days. The compliance of this rule will be monitored during your next visit. Please note, the hard copy of the Change of Information form will no longer be needed or accepted. There was a general comment (below) on today's sanitation report regarding having chickens on-site: Facility received approval from health department to have chickens on site as long as the chickens are contained and the facility maintains vet records. Facility plans to keep chickens contained at grassy area where children are not allowed to spend time unless they have a permission slip completed by a parent.
