Upon arrival I met with Karen Maynard, center director, and I explained the purpose of my visit. Allegation: There are allegations of violations of childcare requirements. I asked Ms. Maynard an incident that occurred on the playground for one and two-year old children on 4/15/26. She stated that a staff member on the opposite playground left her class of four children unsupervised to attend to her son on the one and two-year old playground. The staff member stated she saw two children hitting her son. At the time, there were seventeen one and two-year old children on the playground with four staff members. Ms. Maynard stated she reviewed the cameras on the playground and did not observe an incident. She stated there is a space against the wall that cameras do not pick up. I requested to observe video footage of the playground from 4/15/26. Ms. Maynard stated the footage is recorded over every two days. Ms. Maynard asked the staff member to complete and incident report since she stated she observed the incident. The staff member refused. Ms. Maynard completed the incident report and the staff member refused to sign it. I observed the incident report during the visit. Today I observed two classrooms of children ages one and two on the playground with four staff members. The staff were moving about the environment and observed interacting with the children while supervising the group. Conclusion: Based upon the information received today and observations, a violation of childcare requirements was substantiated. The following violation(s) were documented and technical assistance regarding maintaining compliance was offered. Violation Number Comment Rule 301 Minimum staff/child ratios and group sizes for the number and ages of children in care were not met. During outside time on 4/15/26, there were seventeen children ages one and two with four staff members. The center operates with enhanced ratios. The maximum group size for one-year old children is twelve. GS 110-91(7);.0713(a-d) 303 Children were not adequately supervised at all times. A staff member from the playground for preschool children left her playground to attend to her child who was on the playground for one and two-year old children. She left her class of four children unsupervised. .1801(a)(1-5) You were provided an opportunity to ask questions regarding interpretation and implementation of all childcare requirements. Each violation cited was discussed with Ms. Maynard. The violation(s) documented above must be corrected immediately. A signed and dated letter of compliance must be received on or before 5/12/26. The letter must include the following: *Facility Name and ID number *List of each violation number *How each violation was corrected All items must be included, or the corrective action letter will be returned for corrections. Technical Assistance: When children from different classes are grouped together on the playground, the staff/child ratio and group size for the youngest child must be maintained. Childcare rules do not differentiate group sizes based on indoor and outdoor space. Best practice in the future is to save a copy of any video footage related to an incident or occurrence. A checklist was used to note the childcare requirement monitored today, and a copy was left with you. The last annual compliance visit was conducted 3/25/25. Currently this program operates with a five (5) star license issued 4/29/25. The facility earned six points in staff education, six points in program standards, and one quality point for programmatic options met. Karen Maynard, center director, and Ashley Curry, assistant director, assisted me today. I conducted an assisted walk-through of the center. The last sanitation inspection was completed 7/3/25 with a ‘Superior’ classification and 8 demerits. The last fire inspection was conducted on 10/28/25. Children were observed playing in activity areas, playing outside, eating lunch, resting, and routine care activities. The facility uses a mini-bus (SSX 6813) for transportation. A van (BDR 1494) is used when the licensed CDL driver is not on site. Both were on site and monitored today. A full assessment of applicable childcare requirements was conducted today. The following violation(s) were documented and technical assistance regarding maintaining compliance was offered. Violation Number Comment Rule 843 A drug or medicine was administered after its expiration date. The emergency medication in room # 8 expired 10/2025. 10A NCAC 09 .0803(1)(d) 844 Prescribed medicine was not in original labeled container or accompanied by signed and dated written instructions from prescribing physician or health care professional. An emergency medication in room #8 was not in the original prescription box. One child in room #2 was missing a permission to administer medication form for an emergency medication. .0803(2)(a) 1897 The child care administrator and all staff did not complete the Recognizing and Responding to Suspicions of Child Maltreatment training within 90 days of employment. The training for J. Luther was older than twelve months on date of hire. .1102(g) You were provided an opportunity to ask questions regarding interpretation and implementation of all childcare requirements. Each violation cited was discussed with Ms. Maynard. The violation(s) documented above must be corrected immediately. A signed and dated letter of compliance must be received on or before 4/2/26. The letter must include the following: *Facility Name and ID number *List of each violation number *How each violation was corrected All items must be included, or the corrective action letter will be returned for corrections. CONSULTATION AND RESOURCES: Your next rated license assessment will be in October 2027. During your fall unannounced visit, we will review Pathway one and discuss the self-study requirements for your classrooms. We discussed the storage of emergency medications today. If a child has an action plan, check to see if an over-the-counter medication is listed. This medication will need to be stored in a small locked box and stored with the unlocked emergency medications. The parent may obtain a letter from the doctor stating the over-the-counter medication is for emergency use. If you have the letter on file in the child’s classroom, the medication can remain unlocked and stored with the other emergency medications. The location of the emergency medications should be clearly labeled in the child’s classroom. It is best practice to attach the child’s photograph to the medical action plan. Each medication must be accompanied by a medication administration log, permission to administer for each medication, and the action plan. Parent signatures are valid for six months and doctor signatures are valid for twelve months. The five-year completion date for the health and safety trainings for S. Hodges is 10/9/26, T. Weiss is 10/10/26, and M. Poe is 10/10/26. If a new staff member has health and safety training certificates that are less than twelve months old on date of hire, they do not have to retake those trainings. If they are older than twelve months, they must be retaken the first year of employment. Recognizing and Responding to Suspicions of Child Maltreatment is within 90 days of hire and ITS/SIDS if working with infants is within two months of hire. The last annual compliance visit was conducted April 16, 2024. The center is operating under a Five star license that was issued July 25, 2022. The license was earned with 6 points in program standards, 6 points in education and 1 quality point. Permit restrictions were in compliance. The last sanitation inspection was conducted November 13, 2024, the center received a Superior rating. Fire drills and playground inspections were monitored. The last fire inspection was conducted on December 20, 2024. All the new staff files and ten children’s files were monitored. Your compliance history is 90%, this may change following today’s visit. During today’s visit, a full assessment of applicable Child Care Requirements was conducted. The following violations were observed during today’s visit. Violation Number Comment Rule 1045 New staff, who had contact with children, did not receive at least 16 hrs. orientation within first 6 weeks. One new staff did not sign the orientation form. .1101(a) 1124 Emergency and identifying information, including the child's name, photograph, emergency contact information and/or a copy of the emergency medical care information form was not in the vehicle for each child being transported. There were no photos of the school age children that were being transported 10A NCAC 09 .1003(d) 1835 The medical action plan was not updated on an annual basis or when changes to the plan were made by the child's parent or health care professional.One medical action plan expired in 2022 and one medical action plan had no signatures. .0801(b) The above violations must be corrected immediately, and a letter must be sent to me no later than April 11, 2025 stating how each item was corrected and a plan to maintain compliance with the requirement. The facility currently operates with a Five Star License that was issued on July 25, 2022. The last annual compliance visit was conducted on April 16, 2024. The Director, Ruth Moreno was present and assisted me during the visit. Children were observed participating in free play outside on their designated playground, the teachers were observed moving about the playground interacting and supervising the children. The children were also observed participating in free play in their classrooms and interacting with the teachers. The last sanitation inspection was completed November 5, 2024 and earned a “Superior” classification. During today’s visit, a partial assessment of applicable child care requirements was conducted. I observed the following violations. Violation Number Comment Rule 847 Parent's medication authorization did not include required information. An authorization for Albuterol medication expired in 10, 2024. 10A NCAC 09 .0803(4)(6-9) 1834 Application did not have a medical action plan attached for any child with health care needs such as allergies, asthma, or other chronic conditions that require specialized health services. One children with a food allergy and Epi Pen did not have an action plan on file. .0801(b) The above violations must be corrected immediately, and a letter must be sent to me no later than November 26, 2024 stating how each item was corrected and a plan to maintain compliance with the requirement. Upon my arrival I was greeted by the Director, Ruth Moreno, she assisted me during today’s visit. I completed a walk-through of the classrooms, attendance was documented, and observations were made. The children were observed participating in free play indoors and outdoors on their designated playgrounds. The last annual compliance visit was conducted April 28, 2023. The center is operating under a Five Star License that was issued July 25, 2022. The last sanitation inspection was conducted November 29, 2023 the center received a Superior rating. Fire drills and playground inspections were monitored. The last fire inspection was conducted September 19, 2023. New staff and ten children’s files were monitored. During today’s visit, a full assessment of applicable Child Care Requirements was conducted. The following violations were observed during today’s visit. Violation Number Comment Rule 807 A safe indoor and outdoor environment was not provided for the children. In the classroom for four and five year olds there is a large carpet that has rolled up edges that can be a potential tripping hazard. 10A NCAC 09 .0601(a) 840 All corrosive agents, pesticides, bleaches, detergents, cleansers, polishes, any product which is under pressure in an aerosol dispenser, and any substance which may be hazardous to a child if ingested, inhaled, or handled were not stored in a locked room or cabinet. In one of thee school age spaces there was Raid bug spray and a can of air freshener that was unlocked. The was also a can of Febreeze spray in one of the vans . .2820(b) 841 Medications including prescription and non-prescription items were not stored in a locked cabinet or other locked container. Your assessment year begins July 1, 2024. The preparation year is an opportunity to focus on your Star Rated License and consider strategies to help maintain or increase your star rating. It could be helpful to consider areas where refresher information might be helpful. These ideas can then be incorporated into ongoing training and/or professional development plans as you prepare for your assessment year when the regular star rated license reassessment process is required. Some preparation year ideas to consider are: 1. Review your previous ECERS-R and ITERS-R assessments. 2. Look for assessment related resources at www.ncrlap.org 3. Seek out webinars and/or in-person trainings related to topics of interest. 4. Start a self-study process to become more familiar with the ERS or priority areas relevant to your program 5. The best way for you to make sure that you are meeting all requirements is to periodically review the child care law and rules. UPDATES The Division of Child Development has announced their plan to resume the Star Rated License process. Facilities have been divided into 3 Cohorts. Each cohort will have a preparation year and an assessment year. Your facility is in Cohort 1. Your preparation year began July 1, 2023 and will end on June 30, 2024. Your assessment year begins July 1, 2024. The preparation year is an opportunity to focus on your Star Rated License and consider strategies to help maintain or increase your star rating. It could be helpful to consider areas where refresher information might be helpful. These ideas can then be incorporated into ongoing training and/or professional development plans as you prepare for your assessment year when the regular star rated license reassessment process is required. Some preparation year ideas to consider are: 1. Review your previous ECERS-R and ITERS-R assessments. 2. Look for assessment related resources at www.ncrlap.org 3. Seek out webinars and/or in-person trainings related to topics of interest. 4. Start a self-study process to become more familiar with the ERS or priority areas relevant to your program 5. Schedule staff meetings to discuss topics related to the Environment Rating Scales 6. Support and encourage staff during a self-study process. Connect them with resources at ncrlap.org 7. Ensure all staff’s education is current in WORKS by having them log in to access their information at https://dcdee.works.nc.gov/ RESOURCES The Health and Safety Trainings are offered on the DCDEE Moodle format. On the Division’s website look under the “SERVICES” tab for “DCDEE Moodle”. These trainings are free, and participants will receive training certificates when completed. Child care programs can order free posters from the NC Child Care Health and Safety Resource Center at https://healthychildcare.unc.edu/ . Thank you for your cooperation during today’s visit.
