Asia Williams, Director accompanied me during a walk-through of the facility. During the visit, I discussed the allegations with Ms. Williams and an additional staff member. Limited monitoring of child care requirements occurred during today’s visit. The following violations were observed during today’s visit. Violation Number Comment Rule 303 Children were not adequately supervised at all times. On 12/16/24, a two-year-old child was left unattended standing on a stepstool at the bathroom sink. The child fell from the stool. The child sustained an injury to their foot/heel that required medical attention. .1801(a)(1-5) 853 Incident logs were not completed and maintained as required. The incident log was not updated with an incident information regarding an incident with a child that required medical attention. .0802(g)(1-6) 873 Center staff did not follow the EMC plan. On 12/16/24, a staff member in the classroom for two-year-old children suspected a child was injured after a fall and did not report the fall and/or suspected injury to the administrator. 10A NCAC 09.0802(a) 1911 An incident report was not completed and mailed to a Division representative within seven days after the incident when medical treatment was required. An incident was completed but not mailed to the Division within seven days after an incident with a child that required medical treatment. .0802(f) Violations must be corrected immediately. This documentation was reviewed with you and a copy of the visit summary documentation was given to you at the end of the visit. Upon arrival, I was greeted by the center director, Asia Williams, and we conducted a general walk through of the indoor and outdoor learning environments. I observed groups of children engaged in free play or participating in routine care activities. One group was transitioning in from the playground and I observed the teachers conducting a face-to-name match at each threshold as they entered the building. RATED LICENSE STATUS The program operates with a 2-star rated license issued on 1-10-23. They received 2 points in program standards, 1 point in staff education and one quality point through the programmatic option of having a staff benefit package and an infrastructure of parent involvement. We discussed today that your program may be eligible to participate in the subsidy program, if you increased to 3 stars. We discussed strategies to help the center increase their stars. Asia stated that she is hoping to be ready by the fall so we agreed to discuss this during your next visit; or you can call me when you are ready to proceed. You should ensure that all staff are registered in WORKS and they log in to confirm that their education status reflects all completed college coursework. It is best practice to complete this process as a part of center orientation. We also discussed the Certification from the NC Institute of Child Development Professionals. You have many staff with unrelated and/or international degrees that may benefit from their educational assessment. I sent you a link to their website, while I was in the center today. INSPECTIONS The last sanitation was completed on 7-24-23. You stated that you had contacted your Environmental Health Specialist and they stated that they would see you soon. The last fire inspection was completed 12-13-23. The last documented fire drill was conducted 6/18/24. The last documented lock down or shelter-in-place drill was conducted 6/6/24. The last documented playground inspection was conducted 6/18/24. MONITORING During this visit a full assessment of Child Care Requirements was conducted. When reviewing the staff and training worksheet I noted a few errors in the dates of the staff qualification letter. I confirmed today that all staff listed on the worksheet had valid qualification letters and the information in their files is compliant with child care requirements. Staff on-going training was assessed from 8/1/23 – 7/31/24. The following violations were observed and recorded during today’s visit: Violation Number Comment Rule 807 A safe indoor and outdoor environment was not provided for the children. A staff member's purse was hanging on a hook, in an unlocked cabinet. 10A NCAC 09 .0601(a) This violation was corrected during today’s visit, so a compliance letter is not required. COMPLIANCE HISTORY Prior to today’s visit, the compliance history score for the center was 84%. TECHNICAL ASSISTANCE One staff member’s purse was stored in an unlocked cabinet. The teacher stated that a work order has been submitted to have a lock installed on this cabinet. I reminded her that potentially hazardous materials should be stored at least 5 feet above the ground or in locked storage to ensure that children do not have contact with anything that may be harmful to them. The purse was moved to a locked area while I was present in the center. CONSULTATION It was determined that your center is exempt from having to participate testing your facility for asbestos or lead based paint. Training in all the required health and safety topics must be completed at least every 5 years. It may be time for your staff to complete this training again. Health and Safety training is available, at no charge, on the DCDEE website, in Moodle. Medication Administration is also a required health and safety training topic. This training is available through Moodle as a separate training. Staff should use their individual NCID user name and password to access this training. Your new employees have completed training in all the required health and safety topics, except medication administration. We discussed today that this course is available on Moodle, but it is listed as a separate course. Staff must register for this course in Moodle to have access. Please ensure that all staff complete this training prior to their 1st anniversary date. Recognizing and Responding to Suspicions of Child Maltreatment must also be completed at least every 5 years. The director, Asia, assisted me with today’s visit. She had to leave before the visit was finished, so I reviewed the report with the assistant director, Tricia, and she signed the report at the end of the visit. We conducted a walk-through of the indoor and outdoor learning environments. It was rest time when I arrived, so most of the children were resting on their cots as I walked through the classrooms. I also observed infants engaged in free play in their classroom. RATED LICENSE STATUS The program operates with a 2-star rated license issued on 1/10/23. They received 2 points in program standards, 1 point in staff education and one quality point through the programmatic option of having a staff benefit package and an infrastructure of parent involvement. Full rated license assessments will occur based on the program’s Cohort assignment; your program is in Cohort 3, therefore your assessment period would begin on or around July 1, 2026. You should begin preparing and planning for your assessment on or after July 1, 2025 if you wish to complete the Environment Rating Scales. You should also ensure that all staff have registered and have their education assessed in WORKS. It is recommended that you complete this process as part of your onboarding process with new hires and as existing staff members complete additional coursework. During today’s visit, we discussed that the center’s indoor space calculations are based at 35 square feet per child, because there was not enough outdoor space to meet the requirement of 100 square feet per the total licensed capacity. A new rule, 10A NCAC 09 .2809 (a), states, “There shall be at least 30 square feet inside space per child per the total licensed capacity and 100 square feet outside space for each child using the outdoor learning environment at any one time.” This means that the center now has the option of reducing their indoor square footage to 30 square feet per child. When considering if this change will be beneficial to the center, we discussed the following factors. No class should exceed the number of students permitted in the space. No class should exceed the number of students permitted by the maximum group size, which is determined by the age of the children assigned to the class space. The center can not exceed the capacity listed on the license, which is currently 179, which was based on the playground capacity calculated at 75 square feet per child rule.. The center currently has a capacity of 179, which is less than would be permitted by the square footage of the center and the capacity issued by sanitation. You could increase the center’s capacity to 199 students without having an impact on administrator requirements. If the program’s capacity is 200 or more you would be required to have another administrator on site. You stated that you would like to discuss these options with your district manager, and you would follow up with me if you wish to make any changes to your license. Should you decide to proceed with these changes, you must wait until a new license is issued before implementing these changes. We also discussed that the name of the center in our Regulatory system differs from the name used in your email signature and when answering the center's phone. There is concern that the differing name may cause confusion for the public who may conduct a search or wish to file a report concerning the program. During today’s visit, we discussed the center’s official name and you asked what would be required to make the official name change. I confirmed that there have been no corporate changes, so a change in the name of your center should not impact the center’s license status. On 12/28/23, I receive a Preservice Requirements for Administrators of a Child Care Center form for Asia Williams. During today’s visit, I learned that another director, Jennifer Decker, was employed at the center from 7/31/23 to 11/24/23. I did not receive the required Preservice document for this employee. INSPECTIONS The last sanitation inspection was conducted 7/24/23. The last fire inspection was conducted 12/13/23. The last documented fire drill was conducted 12/15/23. There was no record of a shelter-in-place or lockdown drill being conducted. The last documented playground inspection was conducted 12/1/23. However, the last inspection prior to the one completed in December was completed 6/21/23 The status of the owner, Everbrook Academy, LLC., is listed as current and active on the NC Secretary of State website. Limited monitoring of child care requirements was assessed during today’s visit. I reviewed emergency medications, new staff files for all staff employed since August 2023, and reviewed staff training logs foe current CPR, First Aid and ITS SIDS certificates, as required. The program does not transport children or enroll school aged children, therefore, these requirements were not assessed. The following violations were observed and recorded during today’s visit. Violation Number Comment Rule 428 A current activity plan was not posted for each group of children for reference. The activity plan was dated for 12/11/23 in the classroom enrolling four to five year old children. GS 110-91(12); .0508(a) 841 Medications including prescription and non-prescription items were not stored in a locked cabinet or other locked container. An bottle of Benadryl was stored in an unlocked vinyl bag. 15A NCAC 18A .2820(d) 858 Plastic bags, materials that could be torn apart and toy parts small enough to be swallowed were accessible to children under three years of age. Plastic bags were stored in unlocked cabinets in three classrooms enrolling children under 3 years of age. .0604(q) 1048 All staff did not successfully complete certification in First Aid appropriate to the age of children in care. Verification of staff completion of First Aid training from an approved training organization was not in the staff file.Three staff members, employed more than 90 days, have not completed First Aid training. .1102(c) 1049 All staff did not successfully complete certification in CPR training appropriate to the age of the children in care. Verification of staff completion of the CPR course from an approved training organization was not in the staff file. Three staff members, employed more than 90 days, have not completed CPR training. .1102(d) 1811 Shelter-in-place or lockdown drills were not practiced every three months and/or drill record was incomplete. No emergency drills were documented within the last 6 months. .0604(u);.0302(d)(8) 1897 The child care administrator and all staff did not complete the Recognizing and Responding to Suspicions of Child Maltreatment training within 90 days of employment. One staff member, employed more than 90 days, had not completed this training. .1102(g) The following violations were observed and recorded during today’s visit. The above violations must be corrected immediately. By 1/18/23 please email me a signed letter of compliance. Before the letter is sent, all violations should be corrected; please contact me if additional time is needed to correct a specific violation. Include the following in your letter: facility ID number, list the item number describing how and when the violations were corrected and tell me how you plan to maintain compliance in the future with each item. If you prefer to mail your letter, you may send it to 2201 Mail Service Center Raleigh, NC 27699-2201 If the compliance action letter is not received by the due date another visit to the center may be made and additional violations may be added. COMPLIANCE HISTORY Prior to today’s visit, the program’s compliance history was 95%. TECHNICAL ASSISTANCE There were no shelter in place or lock down drills documented for the last 6 months. These drills should be conducted and documented at least quarterly. It is helpful to set reminders on your computer or calendar to ensure that these are completed as required. A bottle of Benadryl was stored in an unlocked vinyl bag, with the child’s epi-pen. Since Benadryl is not considered to be an emergency medication, it must remain in locked storage. The director removed this medication from the classroom and put it in a locked cabinet in the office area. In three classrooms that enroll children two years old or younger, there were plastic can liners and diapers with plastic wrapping that were accessible to the children. These cabinets had magnetic locks installed, however, some of the locks were broken and others were disengaged. Staff should be reminded that plastic bags must be inaccessible to children under three years of age. They should also be reminded to use locks that are provided and report locks that are broken. The activity plan posted in the classroom enrolling four and five year old children was dated 12/11/23. The current activity plan was posted during today’s visit. Three staff members, who have been employed more than 90 days, have not completed CPR and First Aid. The director stated that they have a class scheduled for 1/15/23. When the new administration was reviewing staff files, this was discovered, and they scheduled the training on the earliest available date. One staff member who was hired in August 2023 has not completed Recognizing and Responding to Suspicions of Child Maltreatment training, which should have been completed within 90 days of employment. The director stated that she requires new employees to complete this training on their first day of employment. CONSULTATION During today’s visit we discussed comments noted on an employee’s medical statement. I encourage you to discuss this with your district manager to determine the best course of action. The assistant director, Tricia, stated that she (Tricia) transferred from another location a month ago and that this employee has not been in a classroom during the last month. Until this can be corrected, this employee should not have contact with children in the center. There are new sanitation requirements effective 7/1/23. We discussed some of the changes, and I recommended that you contact your Environmental Health Specialist with your questions. Training in all the required health and safety topics must be completed at least every 5 years. It may be time for your staff to complete this training again. The activity plan posted in the classroom enrolling four and five year old children was dated 12/11/23. The current activity plan was posted during today’s visit. Three staff members, who have been employed more than 90 days, have not completed CPR and First Aid. The director stated that they have a class scheduled for 1/15/23. When the new administration was reviewing staff files, this was discovered, and they scheduled the training on the earliest available date. One staff member who was hired in August 2023 has not completed Recognizing and Responding to Suspicions of Child Maltreatment training, which should have been completed within 90 days of employment. The director stated that she requires new employees to complete this training on their first day of employment. CONSULTATION During today’s visit we discussed comments noted on an employee’s medical statement. I encourage you to discuss this with your district manager to determine the best course of action. The assistant director, Tricia, stated that she (Tricia) transferred from another location a month ago and that this employee has not been in a classroom during the last month. Until this can be corrected, this employee should not have contact with children in the center. There are new sanitation requirements effective 7/1/23. We discussed some of the changes, and I recommended that you contact your Environmental Health Specialist with your questions. Training in all the required health and safety topics must be completed at least every 5 years. It may be time for your staff to complete this training again. Health and Safety training is available, at no charge, on the DCDEE website, in Moodle. Staff should use their individual NCID user name and password to access this training. The expiration date on staff qualification letters has been extended by two years. New letters reflecting this change will not be sent. However, I will note this change as I make visits to the center. AGENCY UPDATES Please remember to check the Division of Child Development and Early Education website: ncchildcare.ncdhhs.gov frequently to stay updated on rule requirements. Please be safe and continue to follow the guidelines in the Childcare Strong NC Public Health Toolkit, which was last updated on 8/31/22. Also, remember that COVID is still a reportable disease.
