The allegations are as follows: There are concerns that there are violations of child care requirements regarding nutrition, developmentally appropriate activities and program records. Capacity, supervision, use of licensed space, license restrictions, and the indoor environment were monitored. The license and emergency care plan were posted. Fire drills, medication administration, and storage of hazardous products were also monitored. Additionally, I observed the indoor and outdoor space used by the children. I observed the provider working with the two children in attendance on a number puzzle. I observed the children also having free play. Today’s menu consisted of chicken tenders, carrots, mixed fruit, crackers and milk. Based on information provided, Children are not receiving water/fluids as required during the day. Kids bring a container but sometimes it is returned with the same amount of fluid. Mrs. Spencer stated the children have individual water cups. As the children drink the water, she refills the cups which may not be empty by the end of the day. One child present was observed with a water cup and was drinking from it. Based on information received from interviewed staff and my observations, the finding regarding the allegation of inadequate nutrition regarding availability of drinking water is not substantiated. Based on information provided, Annette and the children sit and watch television all day. She does not follow a curriculum. Children are not being taught. Mrs. Spencer will sometimes have the television on in the background. However, the children are not required to watch it. If the children watch something, it is placed on the activity plan and is related to the week’s activities. Mrs. Spencer does not have a curriculum and is not required to have one. Mrs. Spencer was observed working with the children on a number puzzle. Based on information received from interviewed staff and my observations, the finding regarding the allegation of developmentally appropriate activities regarding use of screen time is not substantiated. Based on information provided, Parents are not told about injuries. Incident reports are not prepared as required. Mrs. Spencer does not recall any recent injuries. She understands she must complete an injury report and submit to me and the parent if a child is injured and receives off site medical care. Mrs. Spencer stated if a child gets injured, such as a knee scrape which does not require off site medical care, she documents it in a notebook. The notebook was observed today with past documentation of small injuries. However, Ms. Spencer did not use the DCDEE form for injuries and incidents. Based on information received from interviewed staff and my observations, the finding regarding program records regarding incident reports, this part of the complaint is substantiated. One part of the complaint, program records, was substantiated. There was one violation documented. Violation Number Comment Rule 512 Incident reports were not complete and maintained in the child's file and/or were not signed by the person completing it and by the parent. The operator did not use the correct form to document injuries or incidents. .1721(e)(3)(A-L) Child Care programs are expected to achieve and maintain compliance at all times and are required by NC GS 110-90(4) (d) to achieve and maintain an eighteen-month compliance history score of at least seventy-five percent. Any violation(s) documented may impact the compliance history score. The violation(s) documented must be corrected immediately. On or before September 17, 2025, I must receive a written, dated, and signed compliance letter that describes accurately and in detail, how and when the violations were corrected. Please be aware any information submitted by you is considered legal documentation. If it is determined the information provided in the letter is not true, this may be considered falsification of information. If sufficient information is not received by the due date, a follow-up visit will be conducted. Annette Spencer, operator, assisted me with the visit. Your program currently operates with a four-star license, issued January 19, 2023, earning 7 points in the education component, 2 points in the program standards component and 1 quality point for a total of 10 points. Restrictions are daytime and overnight, ages 0-12, capacity of 5 preschoolers and 3 school agers. No more than 2 infants under one per shift. The last annual compliance visit was conducted January 19, 2023. You visited each indoor and outdoor space with me. The one child present today was observed having free play on the floor. The following violation(s) were documented. Violation Number Comment Rule 1409 Operator did not provide a physically safe and healthy indoor and outdoor environment that meets the developmental needs of the children in care. The operator's heating system was not working. She was using two electric space heaters to keep the play area warm.
