Caregiver did not provide frequent, direct contact as evidenced by while at the front door CI Cox observed a child came to the door then ran back down the hall way to the classroom. There was no child care staff in the hallway or entry way to observe the child. While CI Cox was counting children in the back classroom a child ran out of the classroom with his lunch tray to the kitchen, CI Cox had to ask Martha Nguyen where the child was going, she had not realized the child was running out of the room. This child was gone from the room less than a minute, and with in a few seconds Martha had positioned herself in the door way giving her a view of the room and the child running to and from the kitchen.

The play area shall be located so it is convenient and the children can gain access to it without hazard. For facilities initially licensed after the effective date of these rules or for the installation of new fences in existing facilities, the fence shall be at least forty-two inches (42") high. An outdoor play area used exclusively for school-age children shall not be required to have a fence. Fences shall be constructed to prevent children from crawling or falling through or becoming entrapped.
