The facility did not have a fenced outdoor play area that was on or adjoining the day care property and was accessible without hazard as evidenced by the fence had openings that were between 3.5 and 9 inches and allow entrapment - the openings measured , along the Back Side of the fence at the bottom of the fence to have a gap of 9 inches in one spot and two additional sports measured 10 inches. Along the Right Hand side of the fence at the bottom as you exit out into the playground by the two playhouses, 2 spaces were observed to have a gap of 1 foot and 1 space was observed to have a gap of 8 inches.
