Children were not restricted to approved space as evidenced by children had access to provider's bedroom and a (non related) 5 year old child was found in unlicensed space by themselves (no adult present) on the lower level where the provider had put him. CI Barton informed the provider that the child found downstairs cannot stay downstairs and needs to come up with the rest of the children in the approved space. The Provider also stated that the child had been down there before. On May 21, 2025, CI Barton and Stephanie McCray spoke on the phone. Stephanie said he would arrive each morning at 5 a.m. (she is licensed for 24-hour care) and that her sister, who is a household member but not an assistant, would care for him in her living space downstairs until Bridget, Stephanie’s assistant, arrives at 6 a.m. Stephanie arrives at 7 a.m. from her other job. CI Barton explained that none of the children should be cared for by her sister since she is not an approved assistant and that children should not be in her sister’s living space since it is not approved childcare space. Her sister does have an eligibility letter since she is a household member.

CI Barton counted 10 children then an 11th child (age 4) entered the room needing assistance with toileting. Provider stated there were no other children present in the home. CI Barton did a walk-through of the unlicensed space of the home and found a 12th child (age 5) in the basement/lower level of the home alone. The Provider said multiple times to CI Barton I'm sorry and I know I am in trouble now.
