5 CSR 25-500.102 · 5 CSR 25-500.102 Personnel (1) (T) states: The licensee shall have documentation on file at the facility of current certification in age-appropriate first aid and cardiopulmonary resuscitation (CPR) training for a sufficient number of child care staff to ensure that there is one (1) caregiver at the facility for every twenty (20) children in the licensed capacity. At least one (1) caregiver with current certification in age-appropriate first aid and CPR must be on site at all times when children are present. The training shall be certified by a nationally-recognized organization, such as the American Red Cross, American Heart Association, or an equivalent certification, include an in-person skills assessment, and be approved by the department.

The requirements for first aid/CPR were not met as evidenced by there was no documentation on file showing completion of age-appropriate first aid certification for the requested/licensed capacity.

5 CSR 25-500.082 · 5 CSR 25-500.082 Physical Requirements of Group Day Care Homes and Day Care Centers (2) (A) 6. states: Walls, ceilings and floors shall be finished with material which can be cleaned easily and shall be free of splinters, cracks and chipping paint. Floor covering shall be in good condition. Lead-free paint shall be used for all painted surfaces.

The walls located in the infant/toddler unit was/were not in good condition as evidenced by a half door between the two classroom spaces had duct tape covering damaged wood. Part o the duct tape was hanging free and had splintered wood hanging from it. Parts of the splintered wood was small enough to be swallowed by the infants/toddlers in that class. Three children under 1 year of age were present in the classroom. Director Souad Bathami attempted to secure the duct tape but it would not hold to the door.

5 CSR 25-500.082 · 5 CSR 25-500.082 Physical Requirements of Group Day Care Homes and Day Care Centers (4) (A) states: A safe diapering table with a waterproof washable surface shall be used for changing diapers. The diapering table shall be located within or adjacent to the group space so the caregiver using the diapering table can maintain supervision of his/her group of children at all times.

Children shall not be overheated or chilled. The temperature of the rooms shall be no less than sixty-eight degrees Fahrenheit (68 F) and no more than eighty-five degrees Fahrenheit (85 F) when measured two feet (2') from the floor.

The temperature of rooms was less than 68 degrees F measured two feet from the floor as evidenced by the heating unit upstairs was not working and the temperature read 57 degrees.

5 CSR 25-500.082 · 5 CSR 25-500.082 Physical Requirements of Group Day Care Homes and Day Care Centers (6) (A) 1. states: A fenced outdoor play area shall be available on or adjoining the day care property. The play area shall be located so it is convenient and the children can gain access to it without hazard. For facilities initially licensed after the effective date of these rules or for the installation of new fences in existing facilities, the fence shall be at least forty-two inches (42") high. An outdoor play area used exclusively for school-age children shall not be required to have a fence. Fences shall be constructed to prevent children from crawling or falling through or becoming entrapped.

The facility did not have a fenced outdoor play area that was on or adjoining the day care property and was accessible without hazard as evidenced by the fence had openings large enough for a child to crawl or fall through - the openings measured over 4 inches along the bottom of the fence on the raised prek playground where the fence is not secured and can be pushed or pulled up away from the concrete retaining wall under the fence. Bottom of fence is approximately 1' off the ground. Directly on the other side of the fencing is a drop off point with varying distances between the bottom of the fence and the ground below.

A caregiver was not knowledgeable of the needs of children as evidenced by during an inspection interview Malaika Firdous was unaware of the ages, history or developmental needs of the children in her care. When asked Malaika Firdous did not know the names or ages of all the children in her care. CI observed a redness to the child's left hand and pointed it out to Malaika. Malaika did not know how that happened and went to touch the child's hand and the child pulled it away from the caregiver.

A caregiver exhibited behavior that did not show the individual to be of good character and intent and qualified to provide care to children as evidenced by Malaika stated that it was her first day. During the encounter the director had to tell the staff member the name of the child she was holding and that the child was fearful of strangers. When the CI interviewed the director asking why the staff member did not know the names and ages of the children in her care, the director stated Malaika was new. CI observed personnel file for Malaika and the new hire orientation stated the start date as May 30th, 2023. CI asked the director if Malaika had been trained, the director responded and said they don't do that kind of training but they do the state training online. The director had provided a completed and signed new hire orientation for Malaika (signed by Director and Malaika). Later the director stated again they do not have that kind of training but assured CI that Malaika had taken safe sleep and health and safety training. Another staff member Howah Alhassan interjected saying that Malaika did receive in person facility training by her for approximately 9 days in May. Then the director agreed with Howah, that Malaika did receive training.
