5 CSR 25-500.102 · 5 CSR 25-500.102 Personnel (4) (A) . states: Every three (3) years, the child care provider, group child care home provider, child care staff members, and volunteers in a group child care home or child care center licensed to provide care for infants less than one (1) year of age shall successfully complete department-approved training regarding the American Academy of Pediatrics (AAP) safe sleep recommendations contained in the American Academy of Pediatrics Policy Statement on sleep-related infant deaths. 5 CSR 25-500.122 · 5 CSR 25-500.122 Medical Examination Reports (1) (A) states: All persons working in a child care facility in any capacity during child care hours, including volunteers counted in staff/child ratios, shall be in good physical and emotional health with no physical or mental conditions which would interfere with child care responsibilities. These persons shall have a medical examination report, signed by a licensed physician or registered nurse who is under the supervision of a licensed physician, on file at the facility at the time of initial licensure or within thirty (30) days following employment.

5 CSR 25-500.082 · 5 CSR 25-500.082 Physical Requirements of Group Day Care Homes and Day Care Centers (2) (A) 5. states: The facility shall be dry, temperature controlled, well-ventilated and free of drafts. Children shall not be overheated or chilled. The temperature of the rooms shall be no less than sixty-eight degrees Fahrenheit (68 F) and no more than eighty-five degrees Fahrenheit (85 F) when measured two feet (2') from the floor.

The temperature of rooms was less than 68 degrees F measured two feet from the floor as evidenced by 4-5 years old classroom temperature showed between 61.5 and 66 degrees F in different parts of a classroom. Infants and Toddlers classroom temperature measured between 62.8 and 66.2 degrees F. Two empty classrooms downstairs showed 55.6 and 61 degree F. Two classrooms upstairs showed 66.7 and 64.2 degrees F. The temperature in hallways downstairs showed 55.6-56.1 degree F.

5 CSR 25-500.122 · 5 CSR 25-500.122 Medical Examination Reports (1) (B) . states: Medical examination reports shall include either a Tuberculosis (TB) Risk Assessment form, completed and signed by a health care professional, or a negative tuberculin skin test (TST) completed not more than twelve (12) months before beginning work in the facility. The Tuberculosis (TB) Risk Assessment form, revised March 2014, is incorporated by reference in this rule, as published by the Missouri Department of Health and Senior Services, PO Box 570, Jefferson City, MO 65102 and available by the Missouri Department of Health and Senior Services at https://health.mo.gov/living/healthcondiseases/communicable/tuberculosis/tbmanual/pdf/RiskAssessmentform.pdf. If the person has signs or symptoms of tuberculosis, or risk factors for tuberculosis, then testing for tuberculosis shall occur.

A medical examination report did not include either a Risk Assessment for Tuberculosis form or a negative tuberculin skin test (TST) for the following staff: J. Kliethermes, M. Downey.

5 CSR 25-500.082 · 5 CSR 25-500.082 Physical Requirements of Group Day Care Homes and Day Care Centers (6) (A) 4. states: The play area shall be safe for children's activities, well-maintained, free of hazards such as poisonous plants, broken glass, rocks or other debris and shall have good drainage.

The facility's outdoor space was not safe for children's activities as evidenced by in the preschool playground for children ages 4-5 year's old, there is a 1/2-1 inch gap starting to grow in the resilient surfacing padding that is present throughout the entire playground. The gap in the resilient surfacing is a tripping hazard.

5 CSR 25-500.202 · 5 CSR 25-500.202 Nutrition and Food Service (1) (A) states: The provider shall supply and serve nourishing food according to the Meal and Snack Food Chart provided in this rule.

The provider did not supply and serve food according to the Meal and Snack Food Chart as evidenced by CI Ray-Warnke and CIS Wheatley observed three children age 5 leaving the lunch table without a serving of fruit on their plate. Four children in the 5's classroom were observed throwing away their lunch at approximately 11:35am until 11:40am. CI Ray-Warnke visited all of the other classroom shortly after this observation. All other operating classroom had fruit present on children's plates at the time of service.
