5 CSR 25-500.122 · 5 CSR 25-500.122 Medical Examination Reports (1) (A) states: All persons working in a child care facility in any capacity during child care hours, including volunteers counted in staff/child ratios, shall be in good physical and emotional health with no physical or mental conditions which would interfere with child care responsibilities. These persons shall have a medical examination report, signed by a licensed physician or registered nurse who is under the supervision of a licensed physician, on file at the facility at the time of initial licensure or within thirty (30) days following employment.

Medical examination report(s) was/were not on file for Lydia Voepal as evidenced by a medical examination was not on file within 30 days of an individual beginning to work with children.

The Tuberculosis (TB) Risk Assessment form, revised March 2014, is incorporated by reference in this rule, as published by the Missouri Department of Health and Senior Services, PO Box 570, Jefferson City, MO 65102 and available by the Missouri Department of Health and Senior Services at https://health.mo.gov/living/healthcondiseases/communicable/tuberculosis/tbmanual/pdf/RiskAssessmentform.pdf. If the person has signs or symptoms of tuberculosis, or risk factors for tuberculosis, then testing for tuberculosis shall occur.

A medical examination report did not include either a Risk Assessment for Tuberculosis form or a negative tuberculin skin test (TST) for the following staff: Lydia Voepal.

The School-Age Child Health Report form, revised 2021, is incorporated by reference in this rule, as published by the Missouri Department of Elementary and Secondary Education, PO Box 480, Jefferson City, MO 65102-0480 and available by the department athttps://dese.mo.gov/childhood/forms. This rule does not incorporate any subsequent amendments or additions.

The medical examination report and/or the school-age health report form(s) used was not supplied by the department or did not contain all the required information as evidenced by the well-exam report did not contain the departments required information for the medical examination form for the child.

5 CSR 25-500.082 · 5 CSR 25-500.082 Physical Requirements of Group Day Care Homes and Day Care Centers (4) (A) states: A safe diapering table with a waterproof washable surface shall be used for changing diapers. The diapering table shall be located within or adjacent to the group space so the caregiver using the diapering table can maintain supervision of his/her group of children at all times.

Diapering requirements were not met as evidenced by the diapering table was not located where caregiver could maintain supervision of his/her group of children. The diapering table was located in the bathroom facing the wall. CI Duckworth observed the diapering tables to be located in the bathroom which is centrally located and connects 2 classrooms. When staff are changing diapers, they are actually inside a bathroom which prevents vision of any children in the designated play areas.

5 CSR 25-600.020 · 5 CSR 25-600.020 General Requirements (1) states: Prior to the employment or presence of a child care staff member in a licensed, regulated, or registered child care facility not exempted by section 210.1080.13, RSMo, the child care provider shall request the results of a criminal background check for such child care staff member from the department.

5 CSR 25-500.182 · 5 CSR 25-500.182 Child Care Program (1) (C) 8. states: No discipline technique which is humiliating, threatening, or frightening to children shall be used. Children shall not be shamed, ridiculed, or spoken to harshly, abusively, or with profanity.

Caregiver used a discipline technique that was humiliating, threatening or frightening to children as evidenced by CI Duckworth observed Jamie Conrad grab a one year old child by both arms and roughly lay her back down on the cot after the child was trying to get up to observe CI Duckworth in the room. Jamie also did the same thing to another one year old child that was on the other side of her on a cot. Jamie was sitting between the two children on the floor while the children were laying on their cots for nap time. Jamie used a harsh voice when saying to the children that they were "safe" and that CI Duckworth was not going to bother them which was not soothing or comforting to the children.
