The facility did not have a fenced outdoor play area that was on or adjoining the day care property and was accessible without hazard as evidenced by the fence had openings that were between 3.5 and 9 inches and allow entrapment - the openings measured 5 inches. Gaps were located in two areas. One area is across from the large climber and the other location is across from the shed.

A child was left without competent supervision as evidenced by children and staff were on the playground. Children and staff entered the building; however, one child was left behind on the playground for four mintues.
