Outdoor equipment, swing set, in the outdoor play yard was unsafe as evidenced by the swing set had a round flat swing that did not have enough space to be used without a child swinging on it and hitting the poles on the swing set. Previous measures had been taken to keep the swing safe for children to use without smashing their fingers or hitting a pole hard. The pool noodles and previous caution measures were not on the swing leaving injury hazards for the children.

Caregiver did not provide frequent, direct contact as evidenced by during inspection, Linda McElroy brought a 6 month infant into the dining room area that has a play corner for infants and put the child down for tummy time. Meanwhile a 10 month old child along with an 18 month old child were in the big play room with other chidren and Linda could not provider constant care and supervision of the Infants/Toddler. CI Duckworth observed Linda return to the big play room but left the 6 month old infant in the dining room area in corner play area without supervision and the child was alone in the dining room.
