MCL 722.115m Child care center, group child care home, or family child care home; requirements for licensure. (2) A person, partnership, firm, corporation, association, nongovernmental organization, or governmental organization shall not establish or maintain a child care center, group child care home, or family child care home unless licensed by the department. Application for a child care center, group child care home, or family child care home license shall be made on forms provided, and in the manner prescribed, by the department, including the fees required under subsection (10). Before issuing or renewing a child care center, group child care home, or family child care home license, the department shall investigate the applicant's activities and proposed standards of care and shall make an on-site visit of the proposed or established child care center, group child care home, or family child care home. Except as otherwise provided in this subsection and sections 5q and 5r, if the department is satisfied as to the need for a child care center, group child care home, or family child care home, as to its financial stability, and that the service, facility, applicant, licensee, child care staff member, or member of the household is conducive to the welfare of the children, the department shall issue or renew the child care center, group child care home, or family child care home license. If the department determines that a service, facility, applicant, licensee, child care staff member, or member of the household is not conducive to the welfare of the children, the department shall deny that application or revoke that licensee's license according to section 11.

I reviewed a written incident report submitted to the department from the center. The incident report indicated that on June 27, 2022, Child B's Mother reached out to Ms. Mazyck by email with concerns about an incident report she received that day about Child A Child B' - and on the . Child B's Mother also mentioned thatt o werf other thatRse ware of and that she was that Child A Child B. Ms. Mazyck researched the concerns and foundthat RR FaWn I22, Child A of Child B and A meeting was held with Child B's Family, Ms. Mazyck, and the regional director at the time, Former Child Care Staff Member (CCSM) 5. Child A and Child B were Child A's family received about e and was asked to talk to Child A about . Child A and Child B are now the again and no other incidents of has een reported. However, it was discovered that these were not reported to the department when they initially occurred in 2022. Ms. Mazyck is now filing the appropriate reports. I interviewed Ms. Brown, child care licensing consultant assigned to the center. She stated that the administrator at the time of these incidents in May to June 2022 was Former CCSM 5. Former CCSM 5 is no longer employed by the center. it was discovered that Former CCSM 5 did not report the incidents regarding Child A and Child B to the department. I completed an unannounced on-site inspection to the center. I observed in the preschool room. There were nine children ages 3'f years and older with two Child Care Staff Members (CCSMs). The room also contained Adult 1, who provides care 10 Child A. Adult 1 is not employed by the center as she works for an outsidi I observed Child A and Child B sitting at the table eating. The two children were not sitting next to each other. I later observed Child A and Child B engaged in freedom of choice learning and outdoor play time. They did not interact with each other. I did not observe Child A and Child B. I interviewed Child Care Staff Member (CCSM) 1. CCSM 1 stated that Child A and Child B have been in the same preschool room since September 2022. After Former CCSM 5 was no longer employed at the center, these incidents were forwarded to the department to attempts to follow the child care licensing rules regarding notifying the department of me of the incidents, both children n addition, Child ~A t Ms. Mazyck stated that although she was working at the center when the incidents occurred, she did not witness the incidents. She was not "ma aware of the incidents until Child B's Mother reached out after the third incident occurred on 6/27122 which was recorded by the CCSMs. Child B's Mother told her that there were Ms. Mazyck investigated the matter in June 2022, and found out aPe=re0ere incidents that were not recorded by the CCSMs at the time. (1) Pursuant to section 5n of the act, MCL 722.155n, before an individual has unsupervised contact with children, the department shall determine the individual's eligibility to be any of the following: (c) A child care staff member.
On March 9, 2023, I made an unannounced onsite inspection to the child care center. I discussed the allegations in the complaint with the program director and licensee designee Donetta Maczyck. Ms. Maczyck stated, "It is true {CCSM 1} had completed her fingerprints and was in the supervision only phase. {CCSM 2} knew {CCSM1} was supervision only and called and said she was sick and leaving work. I had left to run an errand and asked her to wait until I got back, however she left work before I arrived back to the center. {CCSM 1}was in the classroom alone with the children for approximately 10 minutes." Ms. Maczyck said the date of the incident is incorrect, as this occurred on January 27, 2023, not February 28, 223. On March 9, 2023, I checked the Child Care Background Check System. CCSM 1 was fingerprinted on January 19, 2023. On February 13, 2023, additional information was requested and CCSM 1 was placed in supervision only status. On June 20, 2023, I checked the Child Care Background Check System. CCSM 1 was found eligible to provide care for children on March 31, 2023.

On March 9, 2023, I made an unannounced onsite inspection to the child care center. During the onsite inspection I visually assessed the child care centers classrooms. The "Spartans" classroom consisting of children ages 18 months-2 years old, had six child care children with two child care staff members. 1/2 This classroom was following the required 1:4 child care staff member to child ratio. 3 The "Wolverines" classroom consisting of children ages 2 years old-3 years old '/2 had eight child care children with two child care staff members. This classroom was following the required 1:8 child care staff member to child ratio. The "Eagles" classroom consisting of children 3 years old-5 years old had 11 child care children 1/2 with three child care staff members. This classroom was following the required 1:10 child care staff member to child ratio. During the onsite inspection I spoke to the program director Donetta Mazyck. Ms. Mazyck stated that they have had a lot of child care staff member turnover, but they have not been out of ratio. She believes these allegations are coming from a former employee who is angry. On June 14, 2023, I called Child A's Mother. Child A (age 2 years) attends the 1/2 child care center. Child A's Mother stated that she does have concerns that there is a lot of turnover in the child care staff members and there appears to be a lot of children and not enough child care staff members. I asked Child A's Mother if the classrooms were out of ratio. Child A's Mother was not sure what the ratios are. I reviewed the ratio requirements with Child A's Mother. Child A's Mother stated, "the classroom may not be out of ratio, because there are always at least two teachers in the classroom, but I do have concerns with supervision and the turnover of teachers (child care staff members)." On June 14, 2023, I left a voice mail message for Child B's Mother. On June 14, 2023, I spoke to Child C's Mother. Child C (age 4 years) attends the child care center. Child C's Mother stated that she has not personally ever seen the classrooms out of ratio but is not sure what it should be. She went on to say she's seen five children in a classroom with two child care staff members, in the preschool classroom there are about eight to ten children with four child care staff members and is not sure how many children are in the toddler classroom. On June 20, 2023, I made an unannounced onsite inspection to the child care center. During the onsite inspection I reviewed the attendance records and the child care staff schedule for February 28, 2023. On February 28, 2023, there were a total of twenty-seven children present in the child care center. The Eagles classroom (ages 3 '/2 5years) had 10 children with one child care staff member. This classroom - was following the required 1:10 child care staff member to child ratio. The Spartans classroom (ages 18 months-2 years) had nine children with three child care staff '/2 members. This classroom was following the required 1:4 child care staff member to child ratio. The Wolverines classroom (ages 2 years-3 years) had eight child 1/2 1/2 care children with two child care staff members. This classroom was following the required 1:8 child care staff member to child ratio. During the onsite inspection I conducted an exit conference with Ms. Maczyck. I asked Ms. Maczyck if maintaining ratio had been a problem in the center with staff 4 turnover. Ms. Mazyck stated that they have not had any issues with ratio and their enrollment is down so most of the classrooms are well under ratio.

On February 1, 2023, I made an unannounced onsite inspection to the child care center. I discussed the allegations in the complaint with the program director Donetta Mazyck. Ms. Mazyck stated that January 25, 2023, the center opened late because of the snowstorm. There were not very many children at the center that day. Ms. Mazyck did not work on January 25, 2023. We reviewed the video footage from the date of the incident. In the video Child Care Staff Member (CCSM) 1 is seen laying down on the floor with a blanket on her cell phone. During the review of the video footage CCSM 1 did not fall asleep but spent the majority of 2 the classroom time on her cell phone. CCSM 2 was seen sitting in a bean bag chair and on her cell phone while the child care children watched a program on the iPad. During the review of the footage CCSM 2 was not seen falling asleep, however she was on her cell phone and talking to CCSM 1 while the child care children were watching a show on the iPad. After reviewing the video footage Ms. Mazyck stated that CCSM 1 was recently written up for using her cell phone, as the center has a no cell phone policy for the child care staff members when they are caring for children. During the onsite inspection I interviewed CCSM 1. CCSM 1 stated that she mainly works in the early preschool room and has worked at the center since September or October of 2021. CCSM 1 stated that on January 25, 2023, she worked from 9a.m.- 4p.m., the center opened late that day because of the snow. CCSM 1 went on to state they did not have a lot of children that day, so they all stayed in the toddler room. CCSM 1 stated, "it was a very chill day the preschoolers watched something on the tablet, and I sat with them." CCSM 1 couldn't not remember what the children were watching on the tablet. I went over the allegations in the complaint with CCSM 1. CCSM 1 stated that she was not sleeping while watching the children. She had one child next to her the entire time. I acknowledged that the video showed that she was awake and had a toddler aged child sitting next to her on the floor but reminded CCSM 1 that she was on her cell phone the majority of the day, although a child was sitting next to her. CCSM 1 acknowledged the center's no cell phone cell phone policy when caring for children. During the onsite inspection on February 1, 2023, I interviewed CCSM 2. CCSM 2 stated that she works in the early preschool room. She has worked at the center since September of 2022. CCSM 2 stated she worked on January 25, 2023. She stated that during the day the child care children had breakfast, playtime, and lunch. They turned on the tablets and allowed the child care children to watch a program about snow animals and Gracie's Corner. CCSM 2 said while the children were watching the program, she was "lounging with the kids most of the day." I went over the allegations in the complaint with CCSM 2. CCSM 2 stated she did not fall asleep while providing care for the children, she acknowledged that she was on her cell phone while providing care for the children and understood that this was wrong. On February 1, 2023, I went over the findings of the investigation with the program director Donetta Mazyck. Ms. Mazyck expressed that they have policies in place, however, the child care staff members do not always follow the policies. We discussed having a rules training to go over the child care licensing rules with the child care staff members as a part of the corrective action plan. On February 2, 2023 I called and discussed the allegations in the complaint with the Licensee Designee Lee Anna Massey. Ms. Massey stated that she "could not have been clearer" with the child care staff members regarding the cell phone policy and 3 the children. She said she will be terminating the child care staff members who have already been warned and written up.

On February 2, 2023, I made an unannounced visit to the child care center and went over the allegations in the complaint with the program director Donetta Mazyck. Ms. Mazyck acknowledged that she allows CCSM 2 to bring her son to the center on half days and snow days and most of the time he sits in the office or in their lounge area. I explained to Ms. Mazyck that it is fine for CCSM 2 to bring her son to the center, however he needs to be enrolled with the appropriate documentation on file at the center. I went on to explain to Ms. Mazyck that CCSM 2's son is older than her current age range. Ms. Mazyck stated she would submit a modification for an increase in age limit and assure that the proper enrollment documents are on file.

On October 17, 2022, I received a voicemail message and incident report from Lee Anna Massey, licensee designee regarding a child being left alone in the center on October 14, 2022. The voicemail message was left on October 14, 2022, at approximately 9:00p.m. the incident report was also sent on October 14, 2022. On October 17, 2022, I called Ms. Lee Anna Massey to discuss the incident report. On October 17, 2022, I made an unannounced onsite inspection to the child care center. Upon arrival I discussed the incident with both Lee Anna Massey, licensee designee and Donetta Mazyck program director. Ms. Mazyck stated that Child A (female, age 3 years) left out of the early preschool classroom and played in an empty classroom alone for approximately 15 minutes, then left that classroom, went down the hall, into a bathroom where she was found at approximately 4:45p.m. Ms. Massey stated there were three child care staff members that day, however one was in training and not in the classroom when the child care staff members discovered Child A was missing. I viewed the video footage of the incident. The video showed Child A leaving out of the early preschool classroom at 4:06p.m. She walked past child care staff member Alisha Stumbo, who was talking to Ms. Maczyk. Child A went to the adjoining classroom, which is not currently in use. Child A was in the classroom playing alone from 4:06p.m. to 4:22p.m. Child A then walked out of the unused classroom and walked down the hall, turned down another hallway past the gym and went into the rest room located past the gym. Child A passed the front door of the center, the gym which as an outdoor exit, and entered the restroom which is right down the hall from another exit door. This center is in a multi-use building which houses two other child care centers and multiple other businesses. The video shows Ms. Alisha Stumbo in the classroom cleaning and then around 4:30p.m. she realizes Child A was missing and started looking for her. She went into the classroom next door and asked if Ms. Imani saw Child A, then everyone started searching for Child A. During the onsite inspection on October 17, 2022, I interviewed child care staff member Alisha Stumbo. Ms. Stumbo stated she started working in the center in January of 2022, she is the lead caregiver in the early preschool classroom. I informed Ms. Stumbo that I was there to discuss the unattended child incident that occurred on Friday October 14, 2022. Ms. Stumbo stated she was aware of the incident and was working in the classroom when it occurred. Ms. Stumbo stated she was washing dishes and Ms. Antoinette was with the children. Ms. Stumbo went on to say that around 4:20p.m. she realized [Child A] was missing and began to panic. Ms. Stumbo said she was not sure how many children were in the classroom but believed there were five child care children. 3 I informed Ms. Stumbo that there were originally seven child care children in her classroom, when Child A left the room there were six child care children. I asked her if she could explain how with two child care staff members in the classroom neither of them realized a child was missing. Ms. Stumbo stated she was cleaning and did not see Child A leave out of the classroom. She again she is the lead caregiver in the classroom. I reviewed the video footage with Ms. Stumbo and pointed out that she did not look at the children for an extended period and that as the lead caregiver in the classroom she should know the children and should know when one is missing. During the onsite inspection on October 17, 2022, I interviewed child care staff member Antoinette Ishinaga. Ms. Ishinhea stated that she has been working at the center since August 2022. I informed Ms. Ishinaga that I was there to discuss the child left unattended on Friday October 14, 2022. Ms. Ishinhea stated she was working in the early preschool classroom and punched out at approximately 4:30p.m., when Ms. Stumbo and Ms. Imani Keel told her
