On April 28, 2023, I made an unannounced onsite inspection to the child care center. The program director was unavailable at the time of the inspection. I spoke to the licensee designee Diana Kontoyianakis. I made Ms. Kontoyianakis aware of the allegations in the complaint. Ms. Kontoyianakis stated that both of the child care staff members involved were working in the classroom. Ms. Kontoyianakis and I went to the infant room so that I could speak to the child care staff members. Child Care Staff Member (CCSM) 1 stated she was warming up bottles to feed the children. Child A and another infant in the classroom have the same bottles. She did not pay attention and placed the wrong bottle in the warmer then handed it to CCSM 2 to feed Child A. CCSM 2 stated she did not look at the bottle, when it was handed to her, she just began to feed Child A and did not check to see who the bottle belonged to. 2 During the onsite inspection I viewed the bottles in the refrigerator. The bottles are in individual trays labeled with each child's name. Each bottle was labeled with the children's first and last names, as well as the date they were brought in. CCSM 1 stated she takes full responsibility for not paying attention to the names on the bottle and giving the wrong bottle to CCSM 2 to feed Child A.

She stated that while sitting at the front desk Child B's Mother approached her after picking up Child B from his classroom. Child B's Mother told her that she heard child care staff member tell the children, "I'm getting pissed off right now." Child B's Mother state a she was concerned, as this was not the way that "teachers" should talk to children. went to W classroom and observed Child A sitting on the couch with an ice pack on isarF,and the classroom appeared chaotic. stated, "I think I dislocated *ChildA's arm." then told Child A," I'm sorry hurt your arm.■ that she would take care of Child and asked to leave om and take a break. stated that she touched Chi s arm and asked him what happened. Child A whimpered when she touched his arm and told her that he wanted his mother and did not say anything else. A few minutes later 3 Child A's Mother entered the classroom and asked what happened.~told Child A's Mother that she was not sure what occurred with Child A. t s other told that she had just received a voicemail message from informing her that she may have hurt Child A from being too rough with gmy . _told Child A's Mother that she did not have the details and asked Chil s Mother if she would be taking him to the doctor. Child A's Mother stated, "I don't know, if he's acting funny, I will take him." _ stated that when Child A's Mother left the child care center, she called program director Jennifer Kendzel to report the incident. Ms. Kendzel told her to send _ home until an internal investigation was completed. The day of the incident was the only child care staff member present in the classroom with seven children ages 2 '/~-3. The child care center does not have cameras in the classrooms. She stated that classroom often appeared chaotic, as she expected the children to follow planned projects without providing them a lot of hands-on assistance and flexibility. However, she never observed or had concerns being physically inappropriate or mean with the children. statoefdR a the discipline utilized is redirection. Shortly after the incident occurred, she received a telephone call from Jennifer Kendzel, program director informing her that called to inform her of the incident. Later that evening wen Ms. Kendzel called to obtain details, told Ms. Kendzel she grabbed Child A's arm to prompt him to pick up a toy and heard his elbow pop. When Ms. Kendzel followed up with Child A's Mother on December 7, 2022, she told her that Child A was Ms. Kendzel completed the incident report and notified employment was terminated on December 7 2022 Ms. Konotoyiannakis stated that she never observed or had any concerns of being physically inappropriate with children. She began employment"a lchild care center July 15, 2021 and was recently placed on probation due to her classroom management style. Child A mentioned Chocolate Brooks, who is a child care staff member at the center. Child A's Mother asked Child A what he wanted to say about Ms. Brooks. Child A replied, "Ms. [Brooks] is mean to [Child B]. Ms. [Brooks] whooped [Child B]." Child A's Mother spoke to Ms. Jennifer Kendzel, program director, about what Child A stated. Ms. Kendzel reassured her that the child care staff members at the center were not spanking the children in care but told her that she would look into it. Ms. Kendzel followed up with Child A's Mother and told her that she spoke to several child care staff members, and no one witnessed Ms. Brooks spank Child B. Ms. Kendzel also told Child A's Mother that they spoke to Child A about what happened. Child A's Mother was upset that Child A was singled out to be questioned about what happened. Child A's Mother stated that prior to this, she did not have any issues with the child care center. Child A's Mother did not wish to have Child A interviewed regarding the allegation. Ms. Kendzel stated that on 05/16/2022, Child A's Mother approached her and informed her that Child A reported that Ms. Brooks spanked Child B. Ms. Kendzel asked several child care staff members that work in or in adjoining rooms to where Ms. Brooks works if they have witnessed Ms. Brooks spank a child. No one said they witnessed Ms. Brooks spank a child. Ms. Kendzel had Ms. Brooks talk to Child A about what he said. Child A smiled and said he was playing a game. Ms. Kendzel stated that shortly after Child A made the statement about Ms. Brooks spanking Child B, Child A said aloud "why are you hitting that child?" to Ms. Brooks as she was putting sunscreen on Child B. Ms. Kendzel stated that when she discussed the incident with Child A's Mother and Grandmother, Child A's Grandmother stated that Child A lies sometimes. Ms. Kendzel stated that she has had no previous concerns with Ms. Brooks and there have not been any disciplinary actions regarding her. Ms. Kendzel stated that she and Ms. Kontoyianakis did not inform Child B's Mother of the allegations. 3 Ms. Kontoyianakis stated that she spoke with Child A's Grandmother about the concerns. Child A's Grandmother was concerned about Child A being spoken too without Child A's Mother's knowledge. Ms. Kontoyianakis stated that she has had other child care staff members come to her with concerns regarding other incidents in the past, so she feels confident that if someone witnessed a child care staff member treating a child inappropriately, they would notify her. I told Ms. Kendzel and Ms. Kontoyianakis that Child B's Mother should have been informed of the allegations. I also informed them that Ms. Brooks should not have been the individual to speak with Child A about what he stated since she was the individual accused of the inappropriate behavior. During the on-site inspection, I observed the classroom that Ms. Brooks works in and that Child A and Child B attend. The room has openings on either side that lead into other classrooms that would allow child care staff members in adjoining rooms to hear and observe what is occurring in that classroom. There are no video cameras in the center. I reviewed the center's discipline policy in their parent handbook. The policy indicates that redirection is primarily used for discipline. The center also uses conflict resolution to help children work through disagreements. Traditional time out is not used; however, the child care staff members may have a child take a break from an activity and participate in a new activity if they are struggling. Ms. Brooks stated that she was made aware of the allegation that she spanked Child B by Ms. Kendzel. Ms. Brooks stated that she has never spanked a child in care. Redirection is the discipline method that is used with the children in care.

On October 15, 2021, I made an unannounced onsite inspection to the child care center. I made the licensee designee, Diana Kontoyianakis aware that I was conducting a special investigation and asked to observe the infant classrooms. When I entered mobile infant classroom, I observed an infant asleep in a bouncy chair in the adjacent classroom. I started a timer from my phone to assess how long the Child A (male, age 6months) would remain in the chair before being moved to a crib. Child A remained in the chair for approximately two minutes, before being 2 moved to the crib. Child A was in the classroom with Child care staff member Kaitlyn Ropp. I interviewed child care staff member McKenna Larkins. I made Ms. Larkins aware that the allegations in the complaint indicated that she was working in the infant classroom On October 12, 2021, and at approximately 4:45p.m. two infants were asleep in swings with blankets covering their heads. I further explained that the complaint source indicated this has happened multiple times. Ms. Larkins stated that the allegations are not true, as she always works on the mobile infant side of the room and leaves to pick up school-age children in the afternoon. When she returns to the center around 4:00p.m. she signs out for the day. I asked Ms. Larkins if she had observed infants sleeping in swings at other times during the day and I interviewed child care staff member Kaitlyn Ropp. I discussed the allegations in the complaint with Ms. Ropp. Ms. Ropp stated that Child A was asleep in the swing for approximately twenty minutes, but Child B (female, 6 months old) was not asleep. I asked if she had blankets placed over the children's heads when they were in the swing. Ms. Ropp said she uses blankets for a tight swaddle, but they were not over the heads of the infants. Ms. Ropp went on to say that she will move the infants to their cribs after they fall asleep. I provided technical assistance and discussed Child A being asleep in the bouncy seat when I arrived in the classroom and reminded Ms. Ropp that if infants fall asleep in unapproved spaces, they must immediately be moved to approved sleeping equipment. I also reminded her that swaddling is only approved for infants up to eight weeks old. During the onsite inspection on I discussed the allegations with the licensee designee Diana Kontoyiannakis. Ms. Kontoyiannakis stated, "there is one infant (Child A) that tends to sleep in a swing due to his acid reflux." I asked if there was a doctor's note on file to allow alternative sleep arrangements? Ms. Kontoyiannakis stated that she believed there was one on file. I reviewed the file and there was not a note from a physician allowing an alternative sleep arrangement on file for Child A. Child A's Mother happened to be present in the center at the time of the interview. Ms. Kontoyiannakis explained the need for a physicians note, and Child A's Mother stated she would contact Child A's doctor's office and ask them to provide a note. We discussed the specific allegation that Ms. Larkins was providing care in the infant room when the children were in the swing asleep. Ms. Kontoyiannakis stated that Ms. Larkins works on the mobile infant side of the room and usually leaves around 4:00p.m. I reviewed the time card from October 12, 2021, and Ms. Larkins was signed out at 4:04p.m. On October 15, 2021, I called the complaint source to discuss the allegations in the complaint. The complaint source stated that when she went into the classroom to pick up her child Ms. McKenna (Ms. Larkins) was on the mobile infant side of the classroom and the infants were on the other side of the classroom. Two infants were asleep in swings. One had a blanket over their head and the other one just 3 had a blanket. I asked her if she was sure, it was Ms. McKenna [Larkins] and asked if she could provide a description. The complaint source stated that she could be mixing up the names.
