MCL 722.115n Application for or renewal of license to operate child care center, group child care home, or family child care home; household member or child care staff member; criminal history check; requirements; duties of department. (1) ... before a group child care home or family child care home allows an individual to be a member of the household, 18 or a child care center, group child care home, or family child care home allows an individual to become a child care staff member, the department shall do all of the following: (a) Review its database of individuals with previous disciplinary action within a child care center, group child care home, or family child care home or an adult foster care facility. (b) Conduct a search of the individual through the national sex offender registry. (c) Request a search of the individual through all state criminal registries or repositories for any states of residence in the past 5 years. (d) Request that the department of state police perform a criminal history check on the individual, child care staff member, or adult member of the household.

Ms. Brown allowed to be a member of the household without providing information to the department to have determined eligible to be a household member.

MCL 722.115p(1) Child care center, group child care home, or family child care home; potential or current child care staff member convicted of crime. (1) Except as provided in section 5n(14) and (15), a child care center, group child care home, or family child care home shall not allow an individual to be a child care staff member without requesting a criminal history check as required by section 5n.

According to interviews, Ms. Brown left to care for children on his own while she took her daughter to or picked her up from school. has not completed a comprehensive background check to be determined eligible to care for children.

Ms. Brown did not cooperate with the investigation and furnish all reasonable facilities for a thorough examination of its books, records and reports. She was repeatedly asked to provide child information cards with parent contact information, attendance records and contact information for however, she did not provide this information. Ms. Brown has not allowed me or into the child care home by refusing to schedule an on-site inspection.

MCL722.120(1)(c) Investigation, inspection, and examination of conditions, books, records, and reports... failure of licensee to cooperate with investigation, inspection, or examination. ................................. .......................................................................................... (1) The department may investigate, inspect, and examine conditions of a child care organization and may investigate and examine the books and records of the licensee. The licensee shall cooperate with the department's investigation, inspection, and examination by doing all of the following: (c) Providing accurate and truthful information to the department, and encouraging witnesses, such as staff and household members, to provide accurate and truthful information to the department.

Ms. Brown did not provide accurate and truthful information to the department throughout this investigation. During interviews, Ms. Brown has stated the man in the home on 12/14/2020 was not and later stated that there was 20 not a man in the home on that day. This contradicts interviews from witnesses and information in incident report 20-030633 that indicates male and female voices could be heard. When we asked Ms. Brown about who was she said, "I don't know." When informed that there is documentation that she stated , she said this was not true." Ms. Brown denied that she has had contact with in the last year. This contradicts information from = parents and children in care as well as police records indicating that has been in the home and Ms. Brown contacted 911 for assistance. Ms. Brown denied caring for children during the weeks of 0110312021 and 01110/2021; however, Child G's Mother stated that Child G was most recently under Ms. Brown's care on 01/0512021, 01/07/2021, and 01/11/2021. MCL 722.115m Child care center, group child care home, or family child care home; requirements for licensure. (2) ... Except as otherwise provided in this subsection and sections 5q and Si, if the department is satisfied as to the need for a child care center, group child care home, or family child care home, as to its financial stability, and that the service, facility, applicant, licensee, child care staff member, or member of the household is conducive to the welfare of the children, the department shall issue or renew the child care center, group child care home, or family child care home license. If the 21 department determines that a service, facility, applicant, licensee, child care staff member, or member of the household is not conducive to the welfare of the children, the department shall deny that application or revoke that licensee's license according to section 11.

Ms. Brown is not conducive to the welfare of children. She has continuously exposed child care children to arguing, explicit language and physical altercations between herself and " . She allowed to be a household member and as ft child care children"aone with him without his eligibility determination, knowing prior history of physical altercations and . She has not provided truthful and accurate information, ed a child care parent not to provide accurate information to both the department and and has refused access to the child care home and records. She has not complied with PA 116 or the rules promulgated under this act. Actions taken by Ms. Brown do not promote the safety and well-being of the children served.

MCL 722.120(6) Investigation, ... failure of licensee to cooperate with investigation, inspection, or examination. (6) The department may suspend, deny, revoke, or refuse to renew a license of the child care organization if the licensee does not cooperate with an investigation, inspection, or examination under this section.

Ms. Brown has not been cooperative with this investigation she has not provided complete information as requested and would not participate in an on-site inspection.
