On 09/14/2022, 1 received an incident report submitted by the center that indicated that Child A's parents observed Child Care Staff Member 1 (CCSM 1) hit and pull Child A during outdoor play. The report also indicated that Child A's parents requested Child A's belongings and removed him from the program. On 09/15/2022, 1 conducted an on-site inspection. I was unable to speak to program director Kristen Seabert in private because she was needed to maintain appropriate child care staff member to child ratios. Ms. Seabert stated she had no knowledge of the incident involving CCSM 1. She was only told that CCSM 1 could not be there. CCSM 1 was not present. Ms. Seabert provided me with Child A's child information card. On 09/15/2022, 1 spoke with licensee designee Julie Guenther by telephone. She stated that CCSM 1 has been removed from the classroom pending the outcome of my investigation. She did not advise CCSM 1 of the allegation made against her, nor did she speak to Ms. Seabert about the allegations. She refrained from gathering additional information so as not to impede on my investigation. She stated that she has not had any concerns regarding CCSM 1. Building Witness I has previously reported concerns regarding center staff to her, but never about CCSM 1. Ms. Guenther described Witness 1 as &the eyes and ears" of the building. She stated that the center started its school year on 09/12/2022. To her knowledge, this was Child A's first experience in a child care or preschool setting. On 09/15/2022, 1 interviewed program director Kristen Seabert by telephone. She identified herself as the lead caregiver in Child A's classroom. She expressed complete shock when I informed her of the allegation against CCSM 1. Her immediate response was, "No way!" She stated that she has known CCSM 1 for 18 years and she is behind her 120%. She reported having multiple families request their children be placed in her and CCSM 1's classroom. She had not observed any marks on Child A. She described Child A's first two days of school as emotionally difficult for him. Child A's home language is Spanish. Neither she nor CCSM 1 speaks Spanish. Kristen Seabert wondered if the language barrier contributed to Child A's difficulties during the first two days of school. Additionally, Child A was not She recalled that Child A sat on her and CCSM 1's laps for comfort multiple times in the 2.5 days he attended. She described Child A as "inconsolable" during rest time. Child A was more upset than usual on his second day following lunch. Ms. Seabert had CCSM 2 come speak to Child A in Spanish to help settle him down. Child A told CCSM 2 that he was hungry and that he missed his mother. She (Ms. Seabert) instructed CCSM 2 to reassure Child A that he would receive a snack after rest time and that his mother would pick him up just as she did the day before. CCSM 2 told her that Child A did not speak very good Spanish. Ms. Seabert stated that she was encouraged on Child A's third day because he did not cry at drop off and he engaged in play with other children on the playground. The first two days of school, Child A wandered around the playground by himself, periodically standing near her or CCSM 1. On his third day, Child A approached her and CCSM 1 on the playground. CCSM 1 guided him over to the sandbox where he played with another child for a "really long time." Kristen Seabert stated that Child A did not display any distress or even cry while on the playground on 09/14/2022. She could not recall CCSM 1 doing anything towards Child A or any other child that could have been misinterpreted as inappropriate. On 09/15/2022, I interviewed CCSM 1 by telephone. She identified herself as the associate staff member in Kristen Seabert's classroom. I informed her of the allegation against her. She calmly denied the allegation. She stated that she has never, ever hit a child in her care. She described Child A as having a "rough time" at drop off on his first day (09/12/2

Based on interviews and video review, program director Kristen Seabert failed to provide appropriate care and supervision of all children in her care, including Child B and Child C, at all times. On 09/14/2022, Ms. Seibert grabbed Child B and Child C by the arm in an unkind manner. On 09/19/2022, Ms. Seabert ignored Child B's signs of needing to use the restroom.
